Hi I posted a few days ago about Ruthbridge contacting me about a debt that I thought was statute barred. I now don't think it is but on Wednesday last week I sent a cca request recorded delivery. I have just this morning received a reply from them. They have not even acknowledged my request and the letter simply says, without prejudice, you are hereby given notice that we have advised our client to commence bankruptcy proceedings!! However they have offered me a 'final opportunity' to pay a lump sum as full and finalsettlement. Trouble is I don't have a penny I can offer them so as generous as the offer is, its pretty pointless!

I take it the fact that they haven't produced a cca is a pretty sure sign there isn't one, and can they actually make me bankrupt? Not that I'm bothered, I never want credit again and I have no property or assets anyway!

I wouldn't worry... it's an empty threat... write a reply stating that as the account is in dispute they are prevented from continuing recovery action. Mention your previous correspondence in requesting a copy of your CCA and then wait again for a while... if they write back again post in this thread and something with more weight can be sent back. I've had more bankruptcy/legal threat letters than my son has had hot dinners!

Errr wait until the 12+2 working days are up before sending the "Account in dispute letter"

Thank you. So I'll wait for the 12+2 is up then send the dispute letter. Does anyone know where I can get a template for this? Does it sound like they don't have a cca and are just trying it on?

 

Are you sure this isn't statute barred... Ruthbridge only ever seem to get involved in a debt if it is Statute Barred or 2 weeks away from that at most...

 

Ruthbridge have been quiet on these boards for a while, made me think they'd stop bothering trying to collect...Obviously not though - That being said, I doubt a Leopard has changed its spots..

Well the original debt would be statute barred in April 2010 but I 'think' that I was paying a bit towards it through DLC until August 2006, so I assumed that it would not be after that. I say think because I have records on my bank statements of paying DLC and I can only assume that it was this debt, but I'm not positive.

Isn't Ruthbridge the last resort for Cabot? From what I can gather, they farm out the dodgy collections to that lot because they can distance themselves from their unlawful collections methods? They tried to get me to pay up on a Barclaycard that I stopped paying in 1997. I didn't know about this place then, I just told them I would see them in court. 2 years ago. Seemed to work for me.

If you look up old threads on this board which relate to Ruthbridge- I bet 99% (or more) of the debts are Statute Barred..Ruthbridge specialise in this (trying to collect on Ststute Barred debts) and are a DCA in their own right. Normal DCA's pay between 5 and 12p in the £ for debts, one suspects Ruthnridge pay considerably less than that for theirs.

 

I'd be VERY surprised if Ruthbridge have a debt on their books that doesn't go SB until next year.
