Personally, I would pick my battles.

 

I signed for mine in the end, despite starting out with the standard caution in my mind and my name printed on my request (instead of signed).

 

They already have a copy of your signature anyway - it is what they compared your driving license with. If they wanted a specimen to lift, they could have used that all along.

 

As above - my vote is to drop the claim and sign for it - either at your branch or you could ask them to post it.

On Friday i had a visit from a Sc0tcall debt collector regarding a HSBC credit card debt,

he showed me his PDA detailing the debt amount.

I politely informed him it was in dispute,

he said ok i'll make a note of that and off he went.

 

In 2009 i requested the CCA from L0well debt collectors, they never producted one.

I recently took HSBC to court to obtain my SAR which i have received, no CCA is enclosed.

 

Credit card was taken out in the late 1990's, last payment for the debt was in 2008,

the account has been in dispute since 2009 and it will become statute barred next year.

 

Are Sc0tcall likely to come to my house again?

I'm thinking of ignoring any further letters chasing for payment as i have done for the last 5yrs.

 

However if they are likely to come to my house again should i send a harrassment letter detailing to communicate with me in writing only

and inform them the account is in dispute?

they should not have just turned up on your doorstep. You must report this to the OFT.

Originally HSBC, then passed onto L0wells and now with Sc0tcall

 

I might have received letters from Sc0tcall informing me they 'may' visit my home and requesting full payment, as soon as i see the 'may' letter i simple ignore them and put them in the files

just a quick question (im in the same boat as you) - so when does the timer for statute barred actually starts from ? I always thought it's from the default date. mine was defaulted in Sep '09.

Last payment/acknowledgment it seems, 6 years England and 5 years for Scotland. default may happen after 3 - 6 months, default drops off CRAs after the limitation period which can be after last payment etc.

sb is 6yrs from last payment or written ack by you.

 

the complete account will vanish from cra files on the defaults 6th birthday , paid or not.

Is there a maximum time they have from the last payment received until the date they mark as default on your account?

 

For example if the last payment was made in January and they didnt put a default on your file until Nov the same year (11 months later) is there anyway to get the default date changed to an earlier date - say 3 months after last payment?
