Those nice people at Yorkshire Band have threatened me if I go ahead with the claim against them. They said in a very long letter "Please note that should you proceed to raise court action against the bank in respect of this matter, the Bank reserves the right to lodge a counterclaim against you for damages suffered as a result of the breach by you of you contract with the bank."

Is this just a standard threat to try and frighten me off, or do they mean it. I am only claiming for £150, and I don't think it will be worth the hassle if the bank decide to get nasty about it. Anyone else had such threats.

There are several of us who have been threatened with counterclaim, just another scare tactic as if they were successful with persuing a counterclaim they would still have to reveal to a Court how they calculate their charges - something which we all know that they are loathed to do.

 

Off the top of my head, I know that definately me (well My Mum) and Caro have had counterclaim threats and there are a couple more besides. If you search this thread using the search mechanism for 'counterclaim' you will find others as well.

 

Best of luck, it may only be £150 but its YOUR £150!

They've threatened me too.

 

Ignore it. They're bluffing. There's no way they could take you to court to reclaim money that a court has ordered them to pay to you. It's nonsense.

Have also recieved threat of counter-claim.Quite clever of them but as yet still waiting for the first bank to appear in court and even defend never mind reappear to counterclaim!!

 

I declined a half offer from YB making it quite clear that I was aware of 'their intention to counter claim'

I actually received a counterclaim with my defence, but am not remotely worried because:

 

1. They will not go to court.

2. It was so pathetic it was laughable.

 

They are very good at trying to scare people, but when it comes down to it they don't have a leg to stand on so ignore the threats.

YB are one of the most obstinate, charmless and intimidatory banks over the reclaiming charges issue. If anyone reads thread titles like this and feels that they don't want to carry on the claim - DO NOT GIVE UP!

 

Every £1 I get back from this unpleasant (and i'm being nice) company will be worth £10 from any other bank, and i'm sure most of the other YB claimants feel the same!
