      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i have just had a phone call from my branch of the woolwich,he is saying that he does not believe i will have any success due to this happening in a scottish court and not an english one.... he is sending this to the head office of the woolwich....i should have done this is the 1st place..will keep you all updated...paul :(

just arrived today from barclays my 1st letter.....usual rubbish...i'm sorry that you are not happy blah blah...comments are recieving attention and will get back to you in 14 days....

do i make a phone call to them as per a supplied phone no.and have a chat as the 14 days is up on monday 27/03/2006...cheers all..

i sent of 2 letters to the Woolwich...One to my branch and one to the head office...recd a reply from Woolwich head office saying give them 28 days...and my branch sent the copy to Barclays complaints Dept also giving me 28 days......who should i deal with...i have also spoke to them saying the 14 days are up and they say they can only deal with it in 28 days and i have to do what i have to do...i see what you mean when you say money is not very importamt to them....paul

hi all i have just recieved a letter from barclays complaint dept regarding my woolwich account....i am asking for £1049.00 and they are offering me as a goodwill gesture £500.00.......i will of course accept this but will continue with a battle for the other amount.....will keep you all updated..paul

after having recieved a letter offering me £500.00 as a goodwill gesture.i have sent by return a letter accepting there offer but saying that i am continuing to get the remaining £549.00 and giving them 7 days to respond.....will keep you updated..paul

hi all,had a standard this is a full and final settlement letter and saying take us to court...from barclays.....

my question is when i file a court claim online do i say the organisation is barclays bank or the woolwich ( which is who i am with )...paul

 

I know its a bit late but the claim should be made against Woolwich.

 

If the defence is entered by Barclays just send a letter to the court requesting Barclays be joined in the action as second defendants.

PUTTING IT IN WRITING & KEEPING COPIES IS A MUST FOR SUCCESS

hi all..you are an impatient lot lol.....had a phone call today from a barclays solicitor saying that he was not aware that they had defaulted as all my correspondents had been sent to the woolwich head office....( as usual a woolwich c..k up )....they have said they are willing to pay all of the money back to me as long as i promise ( promise eh shaking in his boots ..lol )...that i stop the issue of a warrant...i have said ok but only when the cash has arrived in my account and he has said they will send some sort of paperwork ( not sure what this is ) and then they will refund the cash into my account, as soon as i sent the paperwork back....the solicitor i must say was a very nice man and he is fully aware about all the other claims with themselves and other banks that are going through....i also asked him if the woolwich were going to close my account with which he replied " have i been contacted by the woolwich about closing the account " i replied " no "..then as far as he is concerned this will not happen....but will keep you updated...cheers and this site is the best well done to the bosses dave and bankfodder ( and the mods ) with whom this site will never have existed...as soon as cash arrives a donation will be on it's way..keep up the good work..........paul
