Hi all,

 

I recently sent Freddies a CCA for a kays account of which I have just recieved. It seems enforceable although wanted opinions from others regarding when Kays started using enforceable CCAs. I ask because although I feel the agreement is enforceable the DCA are acting somewhat cagey leading me to think that the CCA might be unenforceable.

 

Also, my account was opened on 02/01/2007 but I did not sign an agreement until the 27/01/2007. Is this allowed?

This is standard with mail order companies.

The process is similar to this:-

 

you place a order/request a catalogue, they credit check and open account - in your case 02/01/07.

 

They then send an agreement out and you sign and return - in your case 27/01/07.

I think the cancellation notice period starts from the date you sign the agreement
