      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all, I worked for a high street bank in the banking centre, I was trained within the charges area, never ever give back charges, this was profit share for the staff, and the less charges we give back the bigger xmas party we would have, to be honest profit share was rubbish, and was all a big ploy, we were errored for charges we give back to honest people who really were struggling, its hard when its your job on the line, no matter how much you want to help people, i myself have been in the same boat and know what its like.

 

THIS IS DISGUSTING THEY WERE PROMISING STAFF MONEY OUT OF OTHER PEOPLE MISFORTUNE.

I think the OP had a boss that talked out of their posterior. I recognise an element to it and I recognise the tone of the OP's boss(not a very good boss and certainly not one who knows what they are talking about either).

If i can help people with charges i will, all i told was the truth, and i have many other colleagues who would back me up.

apologies, I used to work for a bank and we were never trained in this method. If they had, I would have probably posted up as you have. Out of interest, which bank was it?

hiya again, was so annoyed someone had put i was hit and run, i have a full time job and five kids, and not much time for internet lol, i used t work for abbey, we were all trained in the banking centre in the same way, profit share, and all customers were labelled 1 2 3 this all leaked out on watch dog a number of years ago, if you were customer 3 you got nothing back, customer one maybe??? within a banking centre, it was part of are stats, refund charges, and we were errored on how many we give back, the more we kept for the bank the more profit share we got, i myself have been in touch with bank regarding charges as became sick, and could not keep my head above water, and did mention this to them within my claim, they soon paid up.

 

I would just like everyone to get back what they deserve, and to stop this charge robbery

not sure they always called it profit share, and made out that all charges money was snacked between staff??? the more we kept the more bonus staff got? we had charges sheets to write on and had to log everyone given back with valid reason/ no valid reason then there was trouble lol

 

and at the end of the year we would get more money for xmas party out of charge money

i was trained in 1998 i think would be nice to know though how many banks were training in this way wouldnt it.

 

have been in touch with admin today, am so passionate about charges just frustrates me so much how they get away with it.

hiya been in touch with admin today, and yes, i even contacted papers around 12 months ago, but bottled out when they contacted me back, x just got scared, but if the flood gates opened for honest people then hey wouldnt it be worth it

I know what you mean re being scared by talking to the press. They can talk to you annonymously if necessary or if you feel that you do not want your name in the papers.

 

As an aside, I started within the bank around 1998, was never trained that way albeit different bank.

hiya dont keep disappearing sorry if it appears like that, need to speak to admin regarding this, plus have been doing some homework and trying to contact ex colleagues maybe who have notes or paperwork, trying to get an army lol

 

please please dont think i am hiding but work long hours also and with 5 kids find it hard to get on internet, plus have to fight teenagers for my turn.
