      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good man besty,another one after the ulster bank.Dont expect them to be quick i sent my letter on 15th of june got a reply from their office in dublin to say it was passed on to them and they would be escalating the matter but i have heard nothing,that was on 23rd june and they have now hit the 40 day mark and still nothing.

I reckon they have escalated it to the depths of their vault hoping it will go away but it wont.

Just be paitent will keep you informed of how im going.8-)

was going to post letter today as i didnt get round to it on thurs

asked the girl would they accept a postal order for the £10.00 she said that it was going to be £8 per sheet

then said to make an appointment first before going down that route

so i am going to see the manager on wed

i will bring letter and £10.00 with me and get a reciept for both

maybe they have been told to keep it at branch level

Just reading through the posts, I got a reply last week from the Ulster bank with all my statements for the last 6 years, but the cheque I sent to them to cover the Data Protection costs was sent back to me about a week after they got my letter requesting the statements, they said that they didn't need it.

The exact line in the letter is

 

".. I have enclosed your cheque for £10 that you issued with your last letter, as we do not require it at this moment in time."

 

As I say I have been sent my statements, and I did get a letter from their Dublin office saying they had been told of the situation and would get things moving

 

Not sure why the cheque was returned, but that letter came from the local branch, might be the fact that I sent them a Nationwide cheque??? :D

 

Just sending them my letter asking them to refund before action, to a nice sum of £1119.

 

Lets see how long it takes them.

still says £8 a sheet because on microfich

lol

gave him letter so 40 days start from today 2-8-06

wouldnt take £10 cash as he has to ask head office first

asked me name of web site

which i gave him happily

i think i was wrong that they have put it to local level

the manager didnt think that i could claim any fees back as i didnt have the money in bank to cover dd or checks

will update as i recieve letters

Hi all

 

I am going after the Ulster bank too, for the last 5 years , have all statements except 2, should I go ahead with 1st Prem. letter, or apply for 2 missing statements.

Would applying to bank for 2 statements get them without sending DPA SARletter??

the 40 days does not start until they have recieved the cheque for £10.

maybe the people at branch level don't know this, altough i would be surprised. seems to me like a stalling tactic. if they do not comply fully with your SAR ask them for a detailed reason in writing.

send another copy of the letter to the head office and include the cheque.

Have u heard anything from the ulster bank. I went into my online account and copied the statements showing the charges i had received this year as well as the refunds i received. Even though was i refunded a few hundred pounds I am still out of pocket £1200 and thats just this year alone. So basically i didnt send the data protection act letter, just a basic one of my own. That was on 23 June and i havent heard anything so i sent another letter on 24 July and still nothing. Do u think i would be better to send the data protection letter or just wait??

this site has constructed a format which is recognised by the banks as being one which is successful, probably due to the support that is offered from everyone.

if you follow this format and take your letters from the templates library with minimal changes, the bank will soon become aware that you have a support network behind you.

on the other hand, if you are sending letters of your own consruction, they will know that you are an individual on your own and they will know that the chances of ****ing you off are a lot higher.

elizabeth gilmore doesnt exist,the data protection department doesnt exist,

i got the exact same standard replys.

you try ringing the dublin number and asking for the above...no one has heard of either!!!

what i did was made a complaint to dublin that i wanted passed onto my local branch, i then called local numpty manager and explained what i was doing.

he fairly perked up when i mention head office in dublin.

anyway i explained that i was reporting them to the information commisioners office(http://www.ico.gov.uk)

lo and behold a courier sent the documents within 3 days.

went through it all and started a claim for £1600.

that was 2 weeks ago.

today £250 has magically appeared in my account.

keep hassling them and gl:)

Besty, I sent my DPA request to Ulster Bank on 9th June, got the letter from Elizabeth Gilmore dated 27th June saying it had been escalated etc, finally got the statements (poor photocopies!) yesterday on 25th August.

 

Elizabeth Gilmore appears to exist, by the way, as I spoke to her twice last week chasing up the statements.

 

Apparently the statements were originally posted to me on 8th August, (ie they waited the full 40 days from their first letter to me before posting - they should have sent them within 40 days of reciving my request.) I didn't receive these (if they were posted!). Duplicates, as I said, were received yesterday.

 

Am claiming just over £2000 in charges from Ulster. Sending my 1st letter claiming a refund on Monday. Will start my own thread over the weekend to mark progress.

The number I used was on the original letter I received from Dublin -

+353 (0)1 6084000.

 

It's a switchboard, I just asked for Elizabeth Gilmore and was put straight through. She was quite friendly - she asked if I was calling from the Bank Action Group (!!), I said no I'm an account holder. She promised to call me back, which she did an hour or so later.
