A quick question if anyone is able to help. A condition of our settlement with Natwest was that we drop all of our counterclaims against them, now seen as though we had not yet put in a counterclaim against Natwest for the PPI as we had just said we were considering it, does that mean that we can still chase natwest for the PPI without it effecting our settlement arrangement????

As the PPI was never a counterclaim against LTSB then I see no reason why you cant raise the issue with them separately. However, I will flag your query with the site team.

As the PPI was never a counterclaim against LTSB then I see no reason why you cant raise the issue with them separately. However, I will flag your query with the site team.

 

This sort of clause would probably never stand up in Court anyway. If anything, the Judge (a new one) would likely say that any current counterclaims are included in the agreement, but it would be rediculous to say that any future claim - known or unknown right now - would be included. Don't make sense to me.
