      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Let me know when the courts send you the letter stating that HSBC intend to defend! They've got until the 20th to respond to mine then i win by default. I know it's all the same in the end but i'd rather not win by default!!

Sorry, im being thick...it's because they've responded to your claim obviously!!! They've not responded to mine yet, out of interest, who's name did either of you put as the defendant or did you just put HSBC?

Evening All!

Slightly worried now as i put David Lewis name as the contact for the bank. I read it to mean they needed an individuals name, and as head of customer relations i thought he seemed appropriate! Do you think this will make a difference? I'm wondering why they've responded (to Andy) and not to me? We seem to be on the same time scale pretty much...he also had an offer and i didn't!!!!!!!!I think it's favouritism :p

i am in the same boat ....... just a waiting game. my guess would be in the next 2 to 3 weeks, but they could leave it till the last min and then file a defence and get another 14 days that way ... so worst case senario would be 6 weeks.

 

but i don't think it will be anything like that long

MCOL issued 31st aug

offer recieved and rejected 5 sept

second offer recieved 3rd oct

If you ring this number, 0845 6028006, it takes you through to the service quality team who've actually proved quite helpful for me, i rang them today to make sure they'd recieved the MCOL forms, and she sadi they hadn't, but checked with the legal dept and said they'd been transferred over to them, even though it didn't show on the notes on my account. About an hour the MCOL site changed from 'issued' to 'acknowledged'.

will try that and see if they are open tomorrow. Only just got your message as i've been to golf (it beats being in work).

I did however have a letter today off Mr Bowden saying that they tried to contact me yesterday but I was unavailable and would I ring them on the number above. the number put you through to the bog standard 'enter your sort code' meesage and when I spoke to a lacky the customer centre was closed.

That number takes you straight through to Mr. Bowden himself, i spoke to him a while ago and whilst he seemed very helpful, he did absolutely nothing, you'll probably have more luck if he's specifically asked you to call!

I had a letter today from the bank (rather than DG) asking me to send a breakdown which i have, twice, so i called DG who said the letter had probably crossed in the post with MCOL and so to send the breakdown straigh to them. Hope they get a move on.It's such a pain having to wait, worth it in the end though.:)

You're right, it is a pain waiting and a few of my friends and family who have been pretty sceptical are starting to think it's all fallen flat. We'll see whose laughing soon.

I tried the number you gave me but the centre is closed today, I thought they may have been open half day but obviously not. I'll try again on monday.

And you! I had a letter from the courts this morning saying that HSBC intend to defend...Ahhhgg...really wanted them to settle without all this. From what i've read this seems to be pretty standard, but other people seem to have had offers at the same time as the courts say their going to defend. I'll give it another few days and then i'll panic:roll:

I think they may have to defend as they are denying liability by doing so. If they don't defend it means they automatically have a judgement against them which would by default mean they were wrong.

I think it's just playing around because we know they settle eventually anyway. Most peple who have defences raised get settled pretty quickly I believe so good luck

I'm in the same boat as you. I got conformation from the court that they intend to defend the claim in the post this morning.

 

Quite worrying, i think. I know it seems pretty standard, but still, the thought of possibly taking the bank to court certainly puts the fear in to me

Sounds like a good idea to me. First man person to get their payout buys the round. You’d better have a huge payout though ‘cos I’m not cheap!

 

 

 

To be honest I think everyone feels a bit nervous when dealing with the banks, we've always been led to believe that they are these hugely powerful corporations and to a certain extent, they are. There's not much you can do without their help in a financial sense. But we can all take confidence from the others on this forum who have been through the same process we are going through and have come out unscathed (in most cases).

I've got the attitude that even if the court threw it out i've only lost £120 quid, which is only a good night out really and as for the charges, they are gone anyway, getting them back is a bonus.
