Dont think its royal mail.. isnt it ukmail post? so it'll be some kind of special scanning they do.

OMG.........

Just had a nasty letter from mbna staying that

potential commencement of legal proceedings.

 

Basically if I dont pay within 7 days then I will get a county court judgement

or

my employer will have an attachment to earnings. ... that will go down as good as a bucket of cold sick and prob loose my job!

 

a bailiff

 

or best still a charge being put on our house

 

 

ARE THESE ALL EMPTY THREATS UNLESS THEY CAN PRODUCE A COPY OF THE ORIGINAL IN COURT?

I think the courts might take a dim view of MBNA assuming they will win their case. Until a judge finds in their favour it is all wind and p*ss. (But then what else would you expect from MBNA?)

Just rang UKMAIL EXPRESS PARCELS AND MAIL THE PEOPLE WHO SEND MBNA'S SNOTTY LETTERS WHICH HAVE NO POSTAL MARK ON THEM AND SOME ORANGE/YELLOW LINES THAT LOOK LIKE A BARCODE ... BUT ISNT.

 

THEIR NUMBER IS 08451 552552 THEY CAN IDENTIFY WHEN THIS WAS POSTED I THINK BY THE LITTLE S WITH THE CODE ON THE TOP RIGHT OF THE ENVELOPE, THINK THEY MUST ALL BE DIFFERENT???

 

ANYHOWZ THEY ARE NOT OPEN UNTIL MONDAY NOW SO THIS MAY IDENTIFY DEFAULT NOTICES WHEN THEY ACTUALLY DID POST THEM OUT

Hi Muffintop

 

At the moment and in the time scale and manner they have stated these are empty threats in my experience of MBNA you start getting these type of letters before they pass to the DCA's.

 

I wouldnt stress too much there is nothing much they can do without first proving the debt in court.

Yeah cheaper than royal mail hence why most of the credit card firms use them:)

 

I see you've already been told but defo not a proper default notice.

Very interesting info from PT on another thread - hope he won't mind me pasting it here, just in case anyone missed it:-)

 

let me expand slightly

 

The law as we all know requires a "A term stating the rate of any interest on the credit to be provided under the agreement"

 

So on the MBNA agreement it says £1000, £3000 & £5000 yes?

 

DOG. whats the thread and post number pse I need to track back on this. I thought however my MBNA microfiche thingy did say 500.00 credit limit.

So does that mean that when when i took out card though my credit limit was £1,500 at time the fact that by the end it was raised to just over £10,000 that the fact is if i can not find at interest rate for £10,000 listed there in the original ts and cs that MBNA have shot themselves in the foot?

Was just going to post to say got a default notice yesteday dated march 16th.

 

IMPORTANT DEFAULT NOTIFICATION

You are in breach of the agreed terms and conditions and a decision has been made to place a restriction on your account. This means that you card(s) and credit card cheques cannot be used. If you have regular transactions such as Internet payments, you should use an alternative method of payment.

 

As your account is xxxx in arrears, failure to bring your account up to date will also result in the evendual termination of the agreement and the registration of a default at the cra. A default will register on your credit file for the next six years and any potential employer, car dealership or creditor who utilise the services of a credit bureau will be able to see the details of this information.

 

ITS NOT TOO LATE TO PREVENT THE TERMINATION OF YOUR AGREEMENT.

 

CALL now to make a debit card payment.

 

is this a default notice???????? nothin on my file from mbna yet, kept the envelope but there is not date or postage date on it, only some sort of bar code thing this doesnt say when it was sent and it wasnt sent recorded del to me either so how can i prove if this is valid or not?

I think it is your original credit limit that counts - and £1,500 isn't on the table, so you are in luck:)

hiya guys,,,hope you are all well

 

ive not been on for much time over the weekend and still trying to get my thoughts right on this so if my own limits were 1500 for each of my mbna cards, they are now stuffed as the limits didnt include this on where the table of the aprs were,,,have i now got that right?

I have a real problem and need some quick advise..I have almost messed my credit file up with bcard and mbna who have not as yet put default on it but have put late markers on... due to them not adhering to the account being in dispute.. i need my credit rating so I have paid mercers today a payment of 90 for the month towards my arrears of around 800.00. they say this will stop negative entries on my file and I can still continue with my legal action ...HAVE I DONE THE WRONG THING? dont know what else to do as know I will need to have access to credit.:p really scared now and beg to wish I hadnt got into it

hey am so sorry to hear what you are now facing,,, know you have put your last post on this mbna so you have paid mercers whom are now chasing the mbna debt?

 

im not sure what the legal stance is in what you have done by making that payment

 

im sure others more experienced will come along

 

im here to give you moral support by the bucketloads,,,chin up and maybe now you will need to look at other option s too with what happens with your house and getting it sold?

thankyou, i rang a solicitor dealing with ccas and they say that it shouldnt jeorparidse the case.. but i found i got more press if i didnt pay than if i did....

i dont know what to do, mbna want 500 to clear arrears then 34.9% interest rate. i dont think they have proper agreement and would fight in court but this stuffs up my credit rating in the meantime. however realisticlly i wont sell this house for maybe 1 year
