I have a CCJ that is 2 years old to the grand sum of £100. At the time I had separated from my (now ex)wife and had been forwarded no court paperwork. When I did eventually receive the paperwork I payed straight away, but not within the 1 month deadline. This leaves me pretty much unable to get a mortgage in the next 4 years, all because of a paltry £100, which I would have paid straight away. Do I have a case for getting this set aside?

Not receiving the paperork therefore been unable to make a defence is a valid reason to have it set aside.

 

Also the fact that you could of paid it off immediately had you received the original papers will help.
