we got charged £20 for unpaid direct debit, £10 for telephone calls we never got, £10 for letters bein sent out, capitalisation charges of £206 each month and add hoc fee of £10 and then another add hoc fee of £20...... How the hell can tehy get away with this lot of rubbish?

i know you have sent off your sar, but if you have your agreement to hand, can you post it minus personel details, google photo bucket.

if not, it will be in your sar.

 

also, the list of charges, minus personel details also.

 

the telephone harrasment letter, give seven days for that to kick in.

as they keep calling you just repeat, every thing in writing as to your instructions.

hiya again, here is the documents you requested and also 3 other letters we got sayin the interest rate was changin then it wasnt etc....Our payments are meant to be £319 but they takin the £327 which is wrong. Can we do anythin about them takin the higher payment wen our payments are meant to be £319? It seems they dont pay attention to the letters they are sending us and think we dont notice they are taking the wrong amount. :evil:

Its so infuriatin that the amount we now owe is more than we originally borrowed even tho we have made 3yrs of monthly payments of £303.21 then we have made payments before that as well, how can they get away with this daylight robbery? :mad:

we also have head office sayin we are £715 approx in arrears yet the new manager at local office says we are £1800 in arrears...How can they both get different figures and the payments we never paid a couple of times, we had agreement to add them to end of term of policy so how come they sayin we in arrears wen they always on fone same day if direct debit aint paid?:mad:

Im sure there is definatley somethin wrong with this whole situation

This looks exactly like mine!!

 

The "capitalisation" is the killer here!. Two thirds of your payment is going to interest and just under one third of payment is going to the capital of the loan. There is just something not right with this whole picture! Its crazy. They are charging you for everything, Im surprised they havnt included the snacks at the christmas function!

 

I dont get these guys. Ive subbed and keeping a close eye on developments.

yeah but some of these charges for calls are for calls we never recieved and letters as well....The statement and letters just tell different stories..... Its all makin me wanna tear my hair out :evil:

do me a favour and check the dates of these charges

welcome have stiff targets to meet,

they as the norm do this at the end of each month, keeps targets and commission up.

 

have you done an sar

the reason i ask is in that you will have computer screen shots of the charges, dates, and welcomes comments.

 

i had them up in court on my claim, i demanded a full explanation of these charges and proof.

more a pitty that at trial i was only in court for 30 min

judge had allready made his mind up and awarded judgement to me, so the charges issue never came up.

 

what you have to remember is these charges are racked up with out the customer knowing, then added to the loan and then screwed at the apr rate.

 

now every time a charge is levid, welcome must tell you and give an anual statement

we sent away for subject access request last week but at the moment, all we have is wat we sent you.

We never really had any bother with welcome apart from odd call wen direct debit was late but now there is new manager in local office and he already upset me last week by harrassin my hubby at work and wen I phoned him back and told him to stop it then went in with cash payment and had another argument with him about his rights, which he says they can visit us anytime coz its in the agreement we signed along with a load of other gobblydook, I told him we are now withdrawin our consent for any visits or calls and want future correspondence in writing or Im gonna seek legal advice about harrassment etc that this new manager has taken dislike to me for standin up to him and now we havin these problems.... In one statement of charges, we are charged 3 times for calls or letters, yet on another statement, its a different story so how can they get away with this..... Its like the local office doesnt know wat head office is doin etc and its gettin confusin :evil:

Can they get away with all these charges coz it seems we owe them more than we even borrowed despite payin for 3yrs since singnin that document.

We have never had any payment protection papers thru since signing that either....should we not have recieved some for of paperwork to confirm we have payment protection?

Is our agreement legal coz its all mumbo jumbo to me now coz im gettin too stressed to concentrate :evil:

dont get stressed out over these muppets.

i was once in your position until i found cag.

now its me doing the advising

 

as this will be an old welcome agreement, i can say with out a doubt it will be flawed, yet to meet one prior to 2005 that is not

 

when you get your agreement, we will go over it and advise,

 

give it another month and you will be free of welcome

a copy of our agreement is in the above link my husband put up today along with letters we recieved and a statement....Did you have look at them? That is all we have at the moment and we dont know how long we will have to wait for subject access request.....Welcome aint very co-operative so we think they will make us wait and suffer....Thanx so much for all help and advice from everyone so far..... and as for your prediction of bein free of welcome in a month, I really cant see that happening cause they intend screwin us out of every penny and to make matters worse...we are already in a trust deed situation which we signed last december and welcome were notified and were happy to stay 2nd security on our property...Dont know if this makes a difference but thot it only fair to mention it :mad:

just had a look at the agreement

 

it appears they have not included the acceptance fee in the total ammount of credit

 

it gets better

 

they have included the ppi

i believe this again is a no no

i now you cant put acceptance fee in but unsure on an added extra ppi as this is front loaded

 

do you know what the 150 charge is for

 

ill get some one to confirm the ppi bit

 

ime sure its not allowed but need to confirm

Im not sure wat you mean by game over and wont relax by thinkin it means I can take them to court and win coz all this is makin me a nervous wreck.... I dont know wat the £150 is for but Im assumin it could be the fee for the guy who arrange the loan from welcome...kind of like an agents fee I think but not sure...we were stupid enough to go to them in first place due to financial difficulties and they fooled us with their eagerness to help us...Boy did they fool us good and proper :evil:

If you are right regardin the ppi bein added, wat is our next step?... How can we get rid of these robbers for good?

I hate havin to harrass you dear but I aint so good at stuff like this and you have been invaluable so far and its very much appreciated..... Im possibly startin to relax a little coz my nails aint been bitten today....thanx so much but we need to know the next step and wat we should do, if anything, before the subject access request comes. Should we stop the payments to welcome right away coz it would seem we would be thtowin money away by payin them if the agreement is flawed....Please advise us wat to do now :eek:

now I know Im harrassin you dear but how can it be over?...Do we simply stop payin and let them harrass us or do we tell them the agreement is unenforcable coz its not legal?.... I just dont know how to proceed..... I need this sorted coz it wont go away and they will continue to harrass us.

I need to get this sorted coz they may try get our house sold coz they are 2nd charge on our property...How do we get that removed...they wont remove it willingly and thats were we are worried...

Please try help us relax on this score as well.... I would like to relax and enjoy x-mas with my kids but this is hangin over our heads and scarin us and we worried if we stop payin...they will force house sale and we will lose everythin

my hubby thinks we should still keep payin until this is resolved but I think its a waste of money we could spend on our kids over x-mas..... Our priority is to safeguard our house so does my hubby have a point? Why should we keep givin them money wen they been fiddlin us for years.... Im really angry now and it would give me great pleasure to stop payin welcome :mad:

I would think you do still owe them something, even if the PPI is taken out of the equation. I have to agree with your hubby - it just ain't worth the risk, and I think you will fare better in claiming back naughty charges if you have played it straight.

are you speakin from experience?.... Have you had probz with welcome as well?.... We just dont know which way to rutn for the best but we do know they have conned us and robbed us over past 10yrs

I cant believe that we have to keep payin them after all we have gone thru now.... They been addin charges for years probably and thats wat we payin now as well as interest on the charges....This is so infuriatin and it seems I wont be relaxin over x-mas after all :mad:

Not with Welcome but I have come close to having my home repossessed and it is not good for the stress levels. I got my charges back from the company after we had refinanced the loan with another lender.

what you have to do is take a balanced view on all the comments

what i can tell you is i have used the wilson case in court myself and walked away from welcome with out owing a penny.

what you have to remember is that even though you will no longer have to pay welcome, the debt still exsists.

they will default you and the default will be on your credit file for six years.

every body has an obligation to pay there debts but with welcome, i make an exception.

 

if you decide to proceede, the charge on your house will be gone, welcome will have no claim on you.

 

to put your mind at rest, i would do the following,

 

make an appointment with a solicitor

take all the info with you for his recomendation

the first half hour for a consultation is free.

 

you can contact a specialist solicitor who will not charge you if you want, they are very good and i recomend them

Telephone their head office!

Remember this is a secured loan so I would recommend maintaining payment!

Ask what charges have been raised on the account and if they are unreasonable give them the opportunity to return them!

Give them your concerns about their treatment of you quoting the Financial Service Authority's treating customers fairly principles (look on their website).

Finally, dont let it get you down, they will not want to lose your account so I imagine that if the problem is no greater than you suggest, they will be only to willing to assist! But don't be tempted to borrow out of trouble!!!!!!

Thanx so much to all who made comments and suggestions and gave advice. I know Im bein a pest but this company has made me and my husband so mad recently. We were good payers altho we had few payments added to end of the term due to financial situation at certain times.

We dont care about defaults coz we already in a trust deed and have no intention if gettin into this mess again, we just wanted them to be fair but a new customer manager in local office is makin our life hell by addin charges for letter and calls we dont get.... How can that be fair?

If we simply stop payin, wat will happen next?... Can they force the sale of our hosue before we can prove their charges are unfair and agreement is wrong etc..... This is wats worryin us the most.
