I have recently had my credit report through and after looking on it there are two defaults showing that have been settled and marked on report as settled.

There is also a default showing from last year with vodaphone that i have paid up through a dca.

I was wondering if anyone had a letter that i can send to dca to get the default removed and can you get settled defaults removed???

Even though they may have been settled they will still remain on your record for 6 yrs

how do i go about getting the default changed to settled then for vodaphone??

do i have to write to the dca or vodaphone??

Contact the credit reference agency and tell them you dispute the entry as its been paid.

 

They will then open an investigation and liase with whoever put the entry there.

 

Nothing to stop you sending a request to voda and the dca to ask why it has not been marked as settled.

As stated on previous posts, mobile phone contracts are not regulated under the CCA, so therefor do not have to provide you with Default Notices or anything of the like...

 

Although, Vodafone *may* be an exception as they used to state that they are complying with CCA rules and regulations... But if they wanted to now, they could say exactly what Orange did to me..

 

If theyre not nice to you, then there is a letter you can send, s.10 of the DPA covers this! :D

I thought the issue was the entries on the credit file?

If the information held on you is not correct then you can challenge it and ask that it be put right.

 

As stated here there are sections under the dpa that you can have a look at.

Got a letter today following a CCA request for Scotcall...........sent my 1.00 and letter back saying they had now sent the debt back to the owners (royal bank Scot) and that I should direct all my enquiries to them.

 

Funny I have already done this and am still waiting !!..........

I did challenge Vodafone default on my credit file with Vodafone and then submitted a query to CRA saying it was in dispute they contacted Vodafone who said they were right and I was wrong so CRAs left it on my file:mad:

Lloyds TSB - N1 claim issued 18/07/06 - £3440 Offered unconditional settlement 23/08/06

Vodafone-Information Commisioner assessment -default removal -25/07/06

How are Voda in the right if mobile companies are not covered under the CCA?

If they've cancelled the contract, my argument is that your prior permission (in the contract) to spply payment data to the CRAs is likewise cancelled.

 

There are some sample letters that I've used in the thread.

I'm often a sarcastic SOB and speak my mind (and I don't do PC at all), but I have a laugh as I go. I won't be intimidated, and I don't take prisoners... so live with it, or go get yourself a humour implant :p

surly - does this include the storing of your data? ie what if a default is on your file that was settled. should this removed as soon as the contract ends beacuse the companies update the default at intervals to keep it there?
