      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can I just say I was all prepared to regularly come back and offer help and I do occassionally lurk. I settled out of court *JJ v Barclays - Settled* and when I asked for my litigation to be updated all of my progress was removed from the litigation section completely, so I felt a little dismissed otherwise there would have been two people you would have seen! By the way I didn't agree to the confidentiality.

 

Apologies if I misread, but that was what it appears that you were saying. Also you haven't posted on anyone elses threads since asking a question ages ago.

Don't forget to contribute to the CAG. Without them we would probably still be drafting our prelim letters.

OH Cap One - £436/ So far received £40. MCOL submitted 17/7/06. Caved 4/8/06 for full amount!!!

OH Monument - £140, claim filed 8th May. Requested judgement by default, settled in full 4th July via out of court settlement (see thread). Total £192ish received.

Me Barclays - £630. Received letter 13th May offering £300 full and final (they can bog off). Claim filed 16th May. Acknowledgement of Service filed 22nd May to defend all of the claim. Allocation Questionnaire completed and Stay been ordered by Judge on 18/7/06!!!

After the 3rd page, this thread was getting out of hand.- that's when I got bored.

 

Dark Night, you got your money. If you do not wish to make a donation - then don't- No one is forcing you. You do not need to justify your reasons for making a lower donation so that you can sleep at night.

 

If you feel you never got enough help or couldn't be bothered uisng the search options etc then reflect that in your donation - there is no mandatory fee upon winning your case.

 

I do however note how you have so much time to keep replying to the threads. Hmmm.

 

Stop trying to inquire into things that are none of your business. You made some recommendations about the site, had a moan - leave it at that.

Hmm,

I'm guessing he might actually be a bank employee out to get you guys in trouble. He has also succeeded in winding some of the mods up which really shouldn't happen.

He's asked a lot of personal things about the site and posted things he shouldn't under confidentiality. Stand back and look at some of the things he's asked about. He's almost doing to you what we ask the banks.

Hello all,

Can I just say that I'm really pleased for you Dark Knight, congrats on taking the initiative & getting your money back. But its making me real sad to see you guys arguing. This site is amazing, & its real strength is in the camaderie we all feel when we come here; suddenly we're not fighting alone any more. Isn't it playing into the banks' hands if we all start to argue? I know that you have many valid points, but nothing is perfect, just the best we can make it, this site included, & the people who run it take a lot of time & trouble to help people who wouldn't otherwise have a clue how to go about claiming their charges back (myself included).

The donation thing is purely on a voluntary basis; give whatever you can afford, or don't if you can't afford, but giving your time & energy to help others can also be counted as a valid contribution if you can't afford to donate much I reckon.

Lets all pull together, not against each other, & save our energy for fighting the real enemy.

I wouldnt say it was a case of argueing...........more a case of a lot of people expressing their views.

 

The underlying point is,as you suggest,that all our efforts should be towards recovering the charges from the banks.

Most people ARE working together on this,and doubtless will continue to do so.

Hi everyone!

 

Sorry I've not got back to your replies sooner but my dad has had a very big stroke and is in hospital at the moment receiving care so I've not had the time to come on and talk to you all as I have wished to do.

 

Hopefully I will be back on soon, but I'm not going to descend back into the arguments on this thread- so I hope this is the end of it to be honest, so please everyone - no more digs at me from this post onwards- thankyou.

Just thought that Dark_Night might wish to review his position on the chances of reclaiming charges beyond 6 years.

 

As I recall, you said that 'might' wasn't good enough. Seems like it was good enough for Stu.

 

If anyone else is considering claiming beyond the standard 6 years, you might wish to have a look too.

Isn't it time that this thread was closed. In fact when someone wins, their thread should be left open for a few weeks to allow the congratulations to come through and then closed. All of the comments are still there to help anyone else. Also the member is still available through the forum.

I have to use a new ID due to the nature of the terms of my settlement, including the confidentiality clause agreement.

 

 

Unless they have actually paid you or provided some other valuable benefit, in respect of your confidentiality agreement then it is void.

Intelligent Finance; Prelim letter emailed 16/08/06, claiming £318. Email recieved from "Anne-Marie" 17/8/06 saying my email has been passed to Customer Relations dept. Fob-off letter received 23/8/06, letter sent in return same day - Delivered 24/8/6 Recieved letter offer 25% settelement - refused - LBA sent. MCOL on 10th revcieved notification that they intend to defend on 13th. 06/9/2006 WON!!!!!!
