Yes you are correct. Apparently DG solicitors only sent the Tomlin doc to the court 24 hours before the payment due date so they chucked it out and wrote to DG to tell them! Their solicitor agent appologised to us and said they had never had a case like it before.

 

We have been advised that we may have grounds for complaint big time!

 

Having a think about that one.

 

Off to the local for a bit of fizz or something!

X 20 - Hi have also been helped by this site many times and realy grateful. Still fighting and need further help. We signed a Tomlin Order to stay repossession proceedings. We had hoped to sell our house in time to pay back the amount due. That was due on the 16th June. I know the lender will now apply to repossess and enforce the warrant. Does he have to apply afresh or can he just apply to issue a warrant without further notice to us. The Tomlin Order was ordered by a Judge, we were not legaly represented.
