  1. *WON* Pleased to say we have won this case.HC didn't turn up at the court.They had written to the judge asking him to make judgement without them being there.For a start the judge wasn't happy as the letter they had sent to the court was under the seven days notice.We had never received this notification at all,so he wasn't happy about that.I explained that HC have repeately not provided us with any documents in their standard disclosure which we had requested. The Judge therefore ordered that they must provide the documents within 7 days,or the case would be struck out.No documents turned up,I wrote to the court explaining that we haven't received them.The order came from the court saying that the case has been struck out.Great news they can't come after us again...Thanks for help,advice from everybody involved.
  2. Had written to the court to state that HC have not supplied the documents requested. Two weeks later still nothing.Within a week we are back in court again without the documents requested. One of the cases should have been struck out because the fee wasn't paid on time.The Judges directions were if the hearing fee was not paid by a certain date the case would be automatically struck out. I have written to the court to ask for the case to be struck out because of that reason.I will make a point of it in court.HC as usual get away with this. So we go to court without any of the documents supplied HC have stated in there standard disclosure. No doubt they will turn up the day before the court case. Any advice appreciated.

  5. Quick question. If a bailiff has put a levy on your car,(council tax owing).This wasn't signed just shoved through letter box. I have to pay £700 by Friday. If i moved the car so he couldn't find it,what happens?? Any reply would be appreciated.

  7. Judge has now decided that both cases shouldn't be fast track, but small claims.So obviously the court made a cock up.
  8. Thanks for your thoughts citizen B. Do I just send HC a standard letter requesting the documents they hold.Or do I need a legal jargon letter. I was just going to send a letter listing what I require,is that enough. Also this new DN they have,they haven't served that on me neither. Thinking about it I suppose with it going through the courts they don't have to?
  9. Hi everybody. Have rang the court this morning to ask for clarification as to why the case has gone fast track. The court doesn't understand why the case has gone fast track and are going to ask the judge the same question. They will write back to give the reasons. In the meantime I will continue with the directions for fast track.
  10. Have done my disclosure list.Quite short really. Paperwork sent by HC, letters of request and there response's. Amended defence. Thats it. Its possible the judge is trying to possibly see if HC wants to continue,they have sent their disclosure list in good time,unusual for them. As previously said court fees payable by claimant when we get nearer the time are £500 +. I'm going to write to HC for the documents they hold,mainly this new DN which is dated the begining of this year. Any thoughts about this DN. Previously they hadn't served one or produced it in court. What are the consquence's of this?

  12. I have just noticed on HC's Idex diclosure list they have a different claim No at the top. Can I use this !! They have the correct name on it though?
  13. Why would a Judge want to go Fast Track for a small amount of £700 ? Anybody out there know. When I send my disclosure list in, could I write to the court/judge and ask why this is going fast track. Would this be regarded as inpolite to the judge.
  14. Another question On a standard Disclosure Form N265.As regards my documentation for inspection do I list my amended defence. I was just going to list what they had sent me which is very little.ie poor unreadable cca,copy statements. Can't find on site other threads regarding this?
