Removing A Virgin Meida Default on My Credit Record

Ok heres the story. I cancelled my services with virgim media because I had a bad service from them I was supposed to be getting 20mb broadband when I was getting less than 1mb. I then moved house 3 weeks later. Last week I got a letter forwared from my old address saying I had defaulted on my prevoius bill. They then handed my account over to Wescot Credit Services Ltd. I made a payment last week of the full balance when I recieved the letter from virgin. I called virgin today to ask them do they have my payment and they said they had. I then enquired as to why I didnt get a bill they said they did send a bill it was sent to my ebilling account twice. Funny that when I had canceled my broadband service and did not have broadband anymore how was I supposed to get my bill?

 

Virgin now said they will mark my default as been satisfied but for me its not good enough I want it removed from my credit record. Does anyone have any advise as to how to get this removed?

you should have agreed with them about the default before making payment. I did that with company, advised them that i would not be making payment until i got a letter agreeing to remove the default upon payment. They kept to there word. Problem is there have what they want so dout very much they are goign to want to help..

Have a read through the defaults and CRA threads in the debt forums.

An irrelevant point to the default part, but relevant to the slow speeds you got.

 

1. How long were you with VM signed up for 20mb [are you sure not 10mb?] "service", and getting less than 1mb?

2. How much were you paying per month?

 

I have successfully sued broadband companies for providing me with a speed well below what was promised. Whilst they say "up to", if it is very easy to find services of "up to" 1mbps and even "up to" 2mbps [these claims were about "up to" 8mbps services], it is reasonable to assume that I would receive above those services. I am therefore entitled to the difference in price between the service most relevant to what I received and the service I paid for.

 

What I would do is send them a letter - if you draft one, I'll try and proof it for you - threatening legal action if;

a) They don't remove the default from your credit record, as it was their mistake that resulted in it being there.

b) Pay you compensation that reflects the lack of service you received.

 

Then see what happens. I personally would issue no problem. Others may decide to take it to their ADR scheme.
