  1. browne all bank staff can be prosecuted for leaking "insider" information even posting something simple can be seen as gross misconduct if caught.

  3. for op, (didn't read everyone posts, so apologies if this has been stated before) dwp add a reference or description if you like , example DWP AB123456C JSA, this allows you to see that it was a payment from DWP for job seekers payment to you. The bank can not amend this information. DWP have been requested in the past to stop this but how else could you tell the different from your payment and your mates payment if they were both paid into the same account other than the national insurance number.
  4. at the end of that day why not try? worst case they will write saying you have been unsuccessful, but i would urge you to disclose this on your application and quickly set up a payment agreement with the creditor so that when they do the search they can see that you are in in the middle of repaying it. Also when at your interview take proof of the agreement with you. Your friend might not have disclosed his debit and right away the bank wont like that. And he may have been refused on other grounds for example they just didn;t like him or he could not give accurate information on the where abouts for the last 6 years.

When you called them the first time, they should have noted the system stating that your were exercising your rights to cancel so as far as i can see regardless the delay of the return of the handset you can proof it has never been used and that you called advising you were terminating the contract. As for the failure to call you back is simply appalling customer services. There isn;t much you can do direct with them to be honest. You might want to take it up with ofcom (Problems with your mobile phone | Ofcom) Make sure the account is marked as in dispute and cancel your direct debit or they will just keep taking the payments. Do your best to locate the handset as if its sitting in a royal mail depo then you must get it back and keep proof of when you originally sent it. Three should then accept that it was posted back as agreed and as the handset was never used why should you have to pay for services you did not use / have access to.
  6. sounds like they never got the phone back? did you post it recorded? try going to your bank and filling out a direct debit indemnity claim form, then cancel the direct debit. them try and locate the where abouts on the handset and advise the network to close the account and mark it as in dispute, this will stop them recording negative information to the credit reference agencies. its going to take a while but at the end of the day even if the address was miss spelt they should hae recived it.
  7. must be a new thing then because tmobile used to move the number but did not use a pac code for internal customers, needles to say in this case that seems to be the most logical problem.
  8. once you took the account out that would have given them permission. have you got this agreement in writing, if so forward copies to the three credit reference agency and they will amend the data for you. if not try and get o2 to send you a letter confirming the agreement.
  9. ok fair comments, and to a point i agree but what i do not understand is that if you acknowledge you owe the funds and have until now been unable / unwilling to pay then why do you think that your details can not be passed on for collection. Your beef here is with the collections agency and tmobile will to the most part not get the balance now payable. If they are lucky the would get the full amount inishal defaulted. Can i suggest you try to negotiate a settlement with the collections agency direct or ever get them to pass the balance back to tmoble them come to a settlement with them?
  10. ladybunny as long as you inform the network within 24 hours normally they wave any calls. however the rest of what you said is correct, op is responsible. OP if you were the network and i called you and said sorry but my sim was stolen three months back so i am not paying you how would you take it. After all i'd then be leaving you out of pocket for my ignorance. if you had insurance try getting them to pay but i have a feeling they will same much the same as the network. sorry but i think you up the (badword) creek without a paddle.
  11. i am with 3 and have google maps on my phone, i get no warning about the charge as its a self run program. However you can go into setting and remove its Internet access, of course when i did that i would not load. If all the maps where stored on the phone you must have one hell of a memory card...
  12. you can set the time and change anything you like. once your finished go the setting and hit factory reset them post back, they wont even know.
  13. funny but i have had this prob (bills not phone) i was told it was 12month half price of text talk 700 £35 meaning a pay 17.50, they did this for 6 months then credited my account with the rest and them took 35 a month i called them and they said that after 6months the system rests the monthly payments and dose not allow them to reapply it so they credit the account instead. must say it sounded daft but they were able to explain it..
  14. i used to work for tmobile and there have been cases like this before, edit as that's what you have committed by self certified yourself using the systems. All pay monthly phones are based on contracts and if you bent the system to suite and did't pay up them this will have been spotted when it went into the red, believe it or not but when accounts go into the red many are manually processed to recover the debit first and if your little breach was spotted that will be why they have hit you with the full contact term (that should have applied) as they will know if you let slip what you have done you could be facing legal charges in a court of law... pay up and let it be a lesson to you..
  15. i see whats went wrong, a pac code closes the old account only when 3 are contacted by (for example) o2 to move the number. as in this case no one has request the number then the old contract is still live. If you have given up moving the number you will be required to give them 30days notice. If i were you i would go back to who ever advised you to get a pac, explain whats went on and ask them if they can fix it. Also id give three 30days notice on the old contract a pay up, then try a get the funds back later or you'll end out with a black mark on you credit file. Ps i used to work for tmobile so i know what i am taking about, and three are correct you can not use a pac to move the number from one contract to another unless they are held with different networks, however they can move it if they understood what you were asking.
  16. you should have agreed with them about the default before making payment. I did that with company, advised them that i would not be making payment until i got a letter agreeing to remove the default upon payment. They kept to there word. Problem is there have what they want so dout very much they are goign to want to help..
  17. easy, pay arrow they will have bought the debt. get them to send you a letter to confirm then every time you get a letter from other agency's, forward them a copy. I had a similar problem when i lost my job in 2003. Took orange until the start of this year to allow me to pay. They had written it off in 2004 but sold it on in 2007 to arrow.
  18. got a quick q, about this lot.. i was called up out the blue and offered a car on HP, i have two defaults from 2003 for a mobile phone contract and a bank loan. They are both cleared and i have no problems getting things like bank accounts and mobile phones, but get turned down for credit cards and hp agreements. so when they called, out of interest i attended there show show room. they were nice and very professional, until they went through the figure and i say no way.. they them turned a little rude and said (this is a direct quote: we'll you wont get much better giving your financial circumstances, if i was you a would take whats on offer as if you say no today we may not be able to offer you it again in the further) what a check, a mistake 5 years ago and i am still being called down for it! anyway i left and a week or so later checked my file (i have a subscription with experian) and they had added three searches. i emailed experian and they replied saying they were for different products, two for hp and one for a loan and agreed to remove on hp search but i would need to prove that i didn;t agree to the loan. i call welcome and they said that they did a loan as part of the hp?? confused, me too
  19. i have just had to call my bank and up my overdraft to pay them, they doped my owed balance to 750 for full and final payment. so at least they are off my back but i pitty anyone who have not got the same options. they are really nasty and will make you feel small and ashamed for owing the money.. really makes me sick..
  20. i got one the other day saying orange sold the debt on, its for 1056, its 5 years old and i have proof they wrote it off for house keeping.. this company will not make payment arrangements with me and i am at the end of my tether.. they are rude and keep saying the will come a collect things from my house. i keep telling them i live in Scotland but they don;t seem to care.
  21. well i can see that this thread has now ultimately come to an end, i would like to thank those who read my points of view and gave me theirs, for that i am grateful and i have learned a great deal. contrary to what a few of you think, i did not set out to offend or intimated anyone and i wouldn't like to think that my thread may deter others from registering and seeking help.   22. bookworm, i agree 100% with what you are saying, and no i would not say selling drugs and so on is ok as long as it puts food on the table.. this is a completely different ball park but i get the point you are making. can i be completely honest here, money brings power and with power you can pritty much do whatever you like, do you realy think that the banks will loss this test case? and if they do, do you think they will let it be? i would say that the best we will get is a small reduntion in charges, still well over what you would class as a fair admin chrage and not a penelty. my point is that "if possible" prevention is better than cure. oh and joncris, why is my question irrelavent? there is always two sides to a coin you know... if you do not want to part take in an adult debate them please reframe from viewing my thread. thanks
  23. Look i am not trying to be a brown nose, i am just saying that 8/10 people who complain about charges make no effort whats so ever to adjust their finances to avoid them. And as i have said before if someone is looking for information i will do my best to help them.
  24. i am sorry to here you have unfortunate circumstances, i can see it from both angels here. What the banks etc should have done was freeze charges waiting for the outcome of the PPI, in this case i am agreeing with you. That banks and so on robbed you blind. My main argument is with those who willingly go into the red and moan about it later. Impulse buys and so on.
