Hi Guys I have been looking over my statements (business bank) from Barclays.

The total charges are 4k. My account was defaulted and sold on to a dca who listed it with all 3 credit agencies,the default is for 1057.00.

My main account was actually only 3.71 in arrears when they closed it.The remaining balance was the arrears from a business loan which was being paid off through the main account so the default is all tied in with both accounts but listed as one.

I have now drafted my letter before action but am concerned about getting the default removed since the default figure does not relate to penalty charges at all,but as I say purely the balance of the business loan (was originally 3k and being paid off at 109.00 per month)

I have written to the bank and the dca requesting copies of agreements/deed of assignments and default notices and am awaiting a reply.

I have been thinking as to whether I could propose a deal with Barclays and am seeking advice and clarification here as to whether this might be a reasonable one to resolve all matters.

Barclays have taken 4k from me in penalty charges.

I was defaulted for the unpaid arrears on the loan for which I have not made any further payments on.

Could I offer to accept the 4k they took in penalty charges whilst agreeing that they can deduct the 1057.00 owed against the loan account subject to them agreeing to remove the default entry ?

 

Or should I wait until the court stage and offer them this proposal ?

Or is the whole idea a bad one and will need to be addressed seperately.....I am just concerned that this other amount will come into the frame although Barclays have sold it on.

Think I will not bother as dont want to give an admission to the debt and by doing this would be acknowledging just that

If Barclays sold the debt on, it's no longer theirs to bring up.
