I am in debt to the Halifax to a sum of £2818.14, however, during my time as a student, most of this was unauthorised overdraft charges and charges for returned direct debits etc, I am a little flumaxed over how to go about counter claiming this money back - do i pay them first, then claim? Help please!:confused:

Welcome.

 

No, claim them first and use them to pay off the debt.

 

Before you start please have a thorough read of the FAQs (there's a Step by Step guide here too). You may want to print these out to refer to later

 

Then look at other threads in your bank's forum, so as you know what you can expect to happen

 

You need to spend 2 or 3 days gradually getting your head round everything.

 

There's a lot to take in, but it's time well spent and will ensure that you succeed in your claim without problems

 

This is a self-help forum and you must be prepared to put in time and effort. It is your claim and you cannot expect others to do all the work for you.

 

When you feel confident that you understand the process and the various stages involved, start a new thread in your bank's forum and post your progress and any questions there

I had a debt with halifax and was starting a debt management plan to pay them back. This was whilst i was claiming the bank charges, and now i have taken them off because the charges cleared the debt,

if you're not on a debt management plan with them or are not paying anything back offer what you can afford and when your charges come through , dont pay them anymore

 

not sure of your situation at the moment, but whilst you offer to pay it back

it keeps em off you for a while

Halifax preliminary letter sent 17/05/06 charges £2661.00

Bog Standard blah blah blah letter received 22nd May 2006.

received lengthy letter dated 24th May 2006 offering £605 pah!

letter before action sent registered 5th June 2006

letter received in response to lba offering £1801.00 errrrr no ta

court action filed 23rd June 2006

deemed served to bank on25th June 2006

notice of acknowledgement of service has been filed

they intend to defend

7th july received letter PAYING IN FULL!!!

 

10th July cash deposit £112.58

10th July cash deposit £2869.00

:D :D :D :D

 

HALIFAX SETTLED IN FULL

Also, once you start a payment plan, as long as you maintain regular payments they will leave you alone. They will keep asking you to increase payments but tell them you are not in a position to. Only offer to pay what you can realistically afford. You don't want the cycle to start all over again!
