Ive recieved a letter this morning From Welcome, we apparently owe them £10000. Yet we did a voulntary termination of the contract with them well over 12 months ago. We have not recieved any thing from them in all this time until today.

 

They are claiming that the car was repossessed from us. This in a load of bull.

 

We had so much trouble with the car when we had it, head gasket (what ever it is) went in the first week. Every thing that could go wrong did. We didnt want the car anymore, it was nothing but trouble. We wanted them to have it back.

 

We refused to pay it because we were sold it under false pretence (told it had a BMW engine). One of the finance men told us he'd lower our payments, after weeks and weeks of complaining and several letters to them 9which they conveniently didnt recieve, even tho my husband handed one to a memeber of their staff) we jumped at it.

But he didnt tell us that the term would be increased, meaning the total we'd pay back was more.

 

The man my husband has spoken to has said that he can arrange it so that the original loan we had, less what we have paid back and less what they got for the car when it went to auction, we can pay that back in monthly installments!

 

I have said that it isnt going to happen because thats just as good as saying 'ok then, we'll accept it was repossessed!'

 

Can anybody suggest what we should do?

Do some reading on this site - possibly even this forum topic, you will see the general advice around requesting your CCA - doing a SAR, etc, etc.

 

You have to start with that at least - without a valid CCA they cannot enforce the loan without permission from a judge (something like that) - so asking you for 10k is kinda scary, but it's just a letter at the moment - so start asking them for paperwork.

  • NatWest - Settled in full 8 weeks after LBA (without interest)
  • Capital One - LBA 27th July - Offered & paid £28 - Rejected - settled
  • Monument - LBA 18th July - Offer 19th July - Refused - settled

  • WFS - 8 Point Complaint - awaiting response - Failed CCA Request - awaiting response - Awaiting S.A.R - (Subject Access Request) info

***WFS Written Off £8k 01/08/07***

 

Monument sent my info even tho i forgot to send payment!!! Thanx Monumnet
