Hi,I hope someone can advise me.

My complaint for bank charges against yorkshire bank is with the FOS.and like everyone else my case is on hold.

After reading these forums about hardship cases I wrote to the bank, stating that we are on benefits and struggling to pay our mortgage and household bills,included proof that we have nearly been evicted twice and proof of the arrears with the other bills, and also an income and expenditure sheet.YB sent a reply back after 2 weeks offering to give us £315. of the £1,900 claim,and said that wouldn,t affect me claiming the rest back if the OFT win.I am pleased that they have offered this ,but this amount doesn,t even cover the arrears with the gas and electric .

I think the bank should have refunded at least half of what they owe ,should I write to them again ,asking for more or should I just go straight to the FOS with this.thanks for all the help so far .regards angnnig

I'm inclined to suggest that you write back to YB, with a copy to FOS for information (make sure you let the bank know this in your letter. If you don't get a satisfactory response, then go to FOS. I would also ask them to stop adding charges to your account so that you can try and get back on your feet. It's worth a shot.

Hi all, I have sent a letter to the F.O.S,explaining that yorkshire bank have refunded £315 of the £1900 in charges and as I am on benefits and going through financial hardship and that i really needed all of the charges back, so i asked YB to refund me the rest of the charges back and they had refused me.The FOS then sent me a letter saying that they would look into the matter.Today i recieved another letter from the FOS saying that Yorkshire bank is not obliged to refund the charges that i have complained about,and that Y.B has explained that it has partially refunded £315 in charges ,"which i already new cause i told the fos this".and that YB have requested to me that i contact the my branch,so it can consider the matter further."the bank never said they would consider the matter further to me "and because I haven,t responded to this the bank have been unable to carry out an assesment of my current financial circumstances with a view to applying anymore of the following remedies. 1) the cancellation of direct debits and standing orders.2)a full or partial refund of charges. 3)writing of some or all of the debt .4)an agreement about future payments."I didn,t recieve a letter stating any of this from YB ",so because i havent made an appointment to see an advisor at the bank .the FOS are not willing to help me.

The letter i recieved from YB was a really snoty one saying that they WILL NOT be making any further offers to me untill the outcome of the ongoing high court case is known ,but i could still see an advisor at the bank to discus exactly what help they could provide to alleviate the financial hardship i am experiencing.They told the FOS different.so i thought well how can they help apart from offering me a loan to get me in more debt.if they would pay me what they owe me in charges that would be a better solution .Seems like the FOS dont want to help,i might have to take this to court.any advice greatly appriciated thankyou.kind regards angnnig

I think it's possible that although they just offered for you to see an advisor to help with alleviating the financial hardship, the advisor might have gone on to suggest the things YB have told the FOS.

 

I suppose you could take them up on that, but I think I'd suggest you just get yourself a new bank account, get everything transferred to it, and let YB add on charges to their hearts content. Thanks for your advice Caro,I think I might make an appointment to see an advisor at YB and if they dont offer to refund me the rest of the money i will just let them know that i will take them to court.and i think i,l send a letter to the FOS telling them that YB didn,t tell me that they would consider the matter further , they gave me a straight anwer of no more charges will be refunded nor did they mention any of the above remedies, as i would have seen an advisor if they had have done.

hopefully the FOS will see through YB and consider my case.

i will definatly get another bank account and cancel the dds with YB.

I have also contacted the FOS regarding Yorkshire Bank - I have my parachute account ready - I will take them to court if necessary - what has made me the most annoyed is that voluntarily we reduced our overdraft by £100 month to show willing and this is how they repay you - it is disgusting. Keep going!!!

Yorkshire Bank sound really nasty! I would definitely look at taking them to court. I would also report them to the FSA who set out the terms of the hardship waiver in July.

 

I have had a small victory with a hardship case with the Natwest and am looking for a further one with HBOS. I never approached the FOS, just went straight to threaten court action, so I can't help with that- sorry.

 

Keep fighting, get your money out of their account and addon any other charges to your claim. Good luck!

Believe me they are,If the FOS refuse to help again ,i will definatly take them to court.Well done with your victory with nastywest :D.wish i,d just gone straight to court, everything takes so long with the FOS and your still not garaunteed help after all the waiting.if i report them to the FSA ,do you think they would help and are there any template letters for this?Thanks for your advice.kind regards ang

I,ve finally had a response from the FOS ,thier basically telling me that Yorkshire bank are not obliged to pay me any of the charges i say that they owe me and that i should get help from the debt helplines for my financial hardship and should wait until the ongoing testcase.So it looks like im going to have to go to court with this.Has anybody any advice about this as im dreading the whole idea of court.thanks for any replies.kind regards angnnig

I'd send YB a letter stating that due to your hardship not being taken into consideration, you are giving them 14 days before you lodge a court claim. Remember the claim will be stayed and you will have to apply to the court to have the stay lifted due to hardship.

 

My case is being "assessed" by the Halifax as we speak. I'll let you know when I hear anything. Good luck!

Maybe a good idea to address the waiver at the allocation stage,so as to oppose any stay citing the waiver criteria.

Will give you some help with that later.

My claim is also with the FOS at the moment - I requested my account be closed and to pay overdraft off in instalments - have heard nothing at all.

 

How can a charge of £25.00 per day be justified??
