I am being chased by Wescot in regards to an outstanding amount on my PayTV subscription which I subsequently cancelled couple of months later. I don’t remember the 12 month minimum contract I never signed an sort of agreement it was all done over the phone . I am now being chase for the outstanding months

Would such an agreement be enforceable ? I never signed for anything ?

Any advice and what I should do. Wescot on there collect letter mentioned that I had an outstanding amount on a credit agreement would this be considered such an agreement even though I didn't sign it ?

Dear Sir/Madam

 

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

 

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

 

I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

 

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

 

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

 

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

I dont think Pay TV,Sky ect are covered by CCA.

payment would be service charge ie you have set amount of time in which to pay

I might be wrong If I am then someone will be along to give you advice

This is what they have come back with

 

 

Following your recent request for a copy of the signed agreement, we can confirm that this account falls under the following legislation, Consumer Credit (Exempt Agreements Order 1989, Article 3(1)(a) and is therefore enforceable.

 

However, an itemised breakdown of the outstanding balance has been requested from our client.

 

 

My question

 

This was all done over the phone and i dont think i agreed for a 12 months contract so i dont know what they can produce ? What should I do next as I dont belive I entered in to a long term agreemnt that they are trying to hold me against ?
