  1. I today received a SD from BW legal in regards to a HBOS Credit Card which I defaulted on 2009. The letter it self was delivered via normal mail They are asking for 9.4 K even though the amount outstanding on the card was 8k (so I guess they have added fees and late payment charges along with interest) I have read through the article about SD via post and was wondering what my next steps should be I assume 1 should be to to fill the form asking the court to set-aside the SD and after that what else should I do ?

  4. Hi, what did you agree with the solicitor over the phone? That I would pay money towards my arrears (but wasn't able to after couple of months) but that they would still go with the court order but as long as I paid they would not do anything did they tell you there was no need to attend the hearing? No they didn't Have you received the order from the court following the hearing, what did it say about payment of the arrrears? It only said the order for reposseion was granted You can apply to the court to get a hearing to stop the eviction and allow you to pay the money you have offered. We can help you with that. Okay what should I do next and what should I fill out
  5. I need advise what my options are. below is my situation · Took a secured loan of 25k back in 2006 · Property worth 400k · Suspended Possession 2009 Aug (didn’t attendcourt hearing. Agreement with solicitor over the phone) · Arrears of 9K · Today offer to pay 3k next pay date and another3 k next pay date they refused. They want me to pay the entire arrears off infull I don’t have those funds Today I receive a letter from GE Money solicitor saying they will apply for an eviction date I am just wondering what my options are. Sorry for being very brief happy to supply more info. I am pretty confident I can pay off my arrears but need sometime is it to late now?

Hi I got this letter from Wescot Following your recent request for a copy of the signed agreement, we can confirm that this account falls under the following legislation, Consumer Credit (Exempt Agreements Order 1989, Article 3(1)(a) and is therefore enforceable. However, an itemised breakdown of the outstanding balance has been requested from our client. I am bit confused they deman in disputer is over PAYTV service in particualr over the 12 months contract. As this was done all over the phone I can't remeber being told that I was entering one and hence I am refusing to pay. What can Wescot do to enforce this as it my understanding that this was not a Credit Agreement. Should I ask them to prove this as per the civil evidence rule

My question This was all done over the phone and i dont think i agreed for a 12 months contract so i dont know what they can produce ? What should I do next as I dont belive I entered in to a long term agreemnt that they are trying to hold me against ?

  9. I am being chased by Wescot in regards to an outstanding amount on my PayTV subscription which I subsequently cancelled couple of months later. I don’t remember the 12 month minimum contract I never signed an sort of agreement it was all done over the phone . I am now being chase for the outstanding months Would such an agreement be enforceable ? I never signed for anything ? Any advice and what I should do. Wescot on there collect letter mentioned that I had an outstanding amount on a credit agreement would this be considered such an agreement even though I didn't sign it ?
