after downloading and printing out my statements last night i worked out that from 06/04 i have been charged £1169 in charges.

i phoned my bank today and spoke to an opeartive who helpfully informed me that i have been fined for going over drawn. he also agreed with me that due to the electronic way the account is run it only costs around 50 pence to inform me that i have either gone overdrawn or i have had a payment failed. he then said that yes the remainder of the £25 or what ever is punative but wouldnt be drawn on the fact that this is illegal.

if i wished to persue a claim over the phone i would need to contact the customer complaints on 0800881155 during office hours mon-fri 0900-1700 hrs.

he couldnt give me email contacts for my branch manager as he claims the hsbc dont contact customers via email. i shall be sending of a letter from the library first thing in morning direct to my branch manager asking for a refund in full or i shall start proceedings after 14 days to claim back in full pluss the 8% intrest.

 

will keep you all informed on the outcome

received a standard reply to the letter i sent last monday to my local branch manager.

needless to say they are looking into my complaint and will get back to me after investigating.

i will send them a letter thanking them for a reply and informing them that they are still working to my time line and if i dont get a refund then i will start court proceedings.

time to sit back and wait again. but then it should be all worth it in the end

well time up on first leter and no proper response

LETTER BEFORE ACTION

 

Dear Sir/Madam,

 

ACCOUNT NUMBER: xxxxxx

 

 

I am following up a letter posted on 13/03/2006. In the letter I outlined a request for all charges on the account to be refunded within 14 days, and that County Court proceedings would be started should the matter not be resolved.

 

 

I have calculated these charges to total the sum of £1169 (one thousand one hundred and sixty nine pounds).

 

 

Whilst your charges may be in line with those of other high-street banks, it does not excuse the fact that they are punitive in nature and so forth are unlawful at Common Law, Statute and recent Consumer regulations.

The charges have pushed my account substantially beyond its overdraft limit resulting in more charges being incurred.

 

 

I now make a final request before action, for a refund of charges on the account to the sum of £1169.00 (one thousand one hundred and sixty nine pounds) within 14 days of receipt of this letter by way of personal cheque or direct credit to the account. Should you refuse to refund the charges within fourteen days I will start proceedings for recovery in the County Courts where you be eligible for an extra 8% APR as allowed by the County Courts Act (1984) which I have calculated to be an additional £68.61 (sixty eight pounds and sixty one pence) in addition to my court costs.

 

 

Please note that only full satisfaction of my request will avoid court proceedings, any partial refund will be refused by myself as I believe I am entitled to this money.

There will be no further communication from me and I shall issue a claim at the expiry of this deadline.
