      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi al, did you get a letter when they sold your account or is it just on file? i was never informed of it it just happened. also is your cca valid for the account now and do the accounts numbers match etc? im not getting far with mine except for a default even though its in dispute,(have got my own thread) seeing your further along than me thought you might know more. good look, im looking at you for inspiration.

Sorry for the delay in replying to your post i've been having a few problems with my computer so i've been able to get on for abit :(.

 

I can't remember if i got the letter about selling my account originally but i found the other copy in my S.A.R whilst looking through it.

But I think that yours and my circumstances behind selling accounts are different. Mine got sold for non payment for several months through being out of work with ill health whilst i think yours was more changing company ( I think Solution Finance is now part of Littlewoods) and that's why you recieved the card and everything.

 

When CapQuest replied to my S.A.R they told me that SF didn't have a copy of my agreement so effectively i don't have an account but i want to get rid of the default and claim back the charges and there is alot.

 

Like i mentioned above that are circumstances behind selling of our accounts are different. I never recieved a new card like you did because of my non payment so my account was suspended maybe it might of been different if i had kept up with repayments.

 

I'll have a look at your thread over the next day or so and see if I can add anything and i'll try to help as much as i can but i'm relatively new to this myself - i'm still learning.

thanks al, ive had a default served on me as well, even though they'er in default because they've ignored my cca request, i sent it on th 17th nov and have heard nothing except to get a letter from mercer saying they were adding a default. have you had the debt set to nil? just trying to get an idea of what their like.thanks again

Hi, yep my balance is nil now because they haven't got my agreement so they can't chase me for it.

 

Have they replied to your CCA request now if they haven't and it's past the 12+2 days you need to complain to Office of Fair Trading and they will deal with it for you and also mentioned that they have since put a default on the account because of it and see what they say. I would also send an Account in Dispute letter that is in te template library to make them aware that you have complained for not complying to the CCA and take it from there.

Also all the details you've put on this thread i would put it on your thread aswell so caggers can get a better idea on the situation aswell.

i havent heard a thing from them and they got my cca request on the 18th nov, the lady i spoke said they havet applied the default yet so not sure how that works, i will now post the letter i have for them, ive had it ready for about a week but ive held off posting as i wasnt sure if it was the right thing to do, im also resending the letter for no phone contact. i will also contact oft, thanks for this al, i will update my thread as well, sorry for stealing yours, at least i know what to do now.

Received a letter today from Capquest regarding the letter before action letter i sent. it says.

 

I can confirm that Solution Finance have not responded to CapQuest regarding your recent correspondence and I have forwarded a further copy of your most recent letter dated 10th December 2008 for their review.

 

You have requested monies refunded on your account. I can confirm no payments have been made to CapQuest and your account was closed on CapQuest's system on 10th December 2008. Please forward any further communication directly to Solutions Finance with regards to the afforementioned matter.

 

As advised in my letter dated 24th October 2008 I can confirm that the credit reference agencies were instructed to remove any defaults placed on your account by CapQuest. Please contact me directly if you require any further assistance in this matter.

 

Once again please accept my apologise for any inconvenience this matter may have caused and should you wish to discuss this matter further please contact me.

I sent the LBA on the 4th December so they have closed my account after they recieved it. Also they say that they can't get a hold of Solution Finances contact details and haven't supplied it in the letter so i have no way of contacting them.

Don't you have any old letters or statements from Solution with contact details on them?

 

Does this mean they have passed the account back to Solution?

 

Have the defaults been removed?

When i first started to claim my charges back i sent my original request to Solution Finance at there customer services department address but no one ever replied i sent about 3/4 seperate letters.

 

I tried ringing there customer services number and it says it's Littlewoods.

 

CapQuest said they passed it back to Solution but don't have there address or contact number, she has "tried" to get someone from Solution to confirm it by email but no one has replied.

 

CapQuest say they have removed the defaults but i'm still awaiting my credit files from all 3 agencies.

 

I don't know what else to do they owe me nearly £1000

Thanks for the addresses i'll check them out.

 

I know the first one in Lincoln isn't the right one as there an independant company and Solution Finance weren't.

 

There original address was based in Nottingham or Northampton i always get them mixed up.

 

But i'll check them anyway

You would think they would be allowed to trade as Solution Finance if they were not related to Solution Finance Limited, wouldn't you? It must completely p*** off Solution Finance Limited to be tarred with the same brush. (they mame it clear in the first line of their site that they are not related to any finance providers [of the same name].

 

There is a finance provider of that name in Australia - Solution Finance - Personal Finance, Loans, Home Loans, Low Doc Loans, Mortgage Brokers

 

and in France, there appear to be two - rachat credit en France, rachat credit personnel, rachat credits et simulation rachat credit and http://www.solutionfinance.fr/

 

- Czech republic - Solution Finance | Corporate Finance | Mergers & Acquisitions | Advisory (mergers, acquisitions - not really the same level)

 

None of this really helps. It would seem that 'your' Solution Finance is just a trading name for somone else. I'll keep looking

Moving on to Solution Financial Services (supposedly in London) - no phone number in phone book or yellow pages, no website. There are companies with this name in Mumbai, Carlsbad, CA, Burlington, MA.

 

There is also Solutions Financial Services (UK) Ltd in Hull ( Tel: 01964 527827)

 

 

I think you really need to try and find some old correspondence

THe address given in post #64 is the address for Barclaycard (see Barclays Premier Credit Card Summary - Barclays Premier - bottom of page)

 

So it would seem that Solution has been bought out by BC. I suggest you send your claim to BC but head it "Solution Finance Accout No XXXXXX" and refrer to Solution Finance Account in the letter. See what happens.

Solutions Finance no longer trades under that name. The Company has been Dissolved. It was a Partnership between Barclaycard and Littlewoods.

 

It is now Barclaycard that deals with all the accounts including Littlewoods. All VISAS begining 4929 regardless of the company/lender stated on the card will in fact be a Barclaycard.

I've just had a look at my account number and it starts with 4265, Does that mean Barclaycard don't deal with it? do you know who does?

Barclaycard may still deal with your credit card. A company called Monument Credit Card Services used that number 4265. They were another trading name of Barclaycard.

 

The Address they used Last Year was

However, you should write to Barclaycard at their Head Office in London.

Do you know who issued your card or where you applied for the card through. Check the back of your card. The card issuer may not be the same as the lender you go the card from but the lender is the company lending the money on credit to you.
