Congratulations on getting your costs, another blow to the DCA's.....the DCA that was all hot air and no trousers chasing me (1st Crapit) also kept it until the last possible moment.

 

I like the irony of sending baillifs to collect costs from a DCA but hey it was a win-win situation, you either get costs or you get the costs via the baillif!:D

Advice given is my opinion only, I am not a legal or financial expert (far from it).

Hi,

 

I realise that it's months since this thread started but I found this letter on my Photobucket and thought it might give a positive message to those on the forum who are worried when they receive an SD:

They CAN BE BEATEN!!!

Ive got one of them but with a nice healthy awarded costs on it.

 

As said they can be beaten and if you get a good judge you will get costs.

 

I got just under £400 costs.

I am convinced if I would have asked for £1000 I would have got it.

 

Tips:

Go smart

Call the Judge Sir

Go prepared with all case law

Explain the family pressure it has put you under.

It would seem that all judges are different but good planning, organised paperwork and politeness are essential.

Hi

I received a letter from Red stating that I owed £1847.00 0n a capital one credit card, and that if I dont pay within 7 days they would issue Court proceedings, I called them About this and they immediatly offered a £250 discount if I settled immediatly, this prompted me to see how far I could push them so I offered £600.00( I told them I would have to beg steal and borow to obtain this) First of all he said the offer was to low but eventually they accepted the offer and confirmed that they would mark my CRA as satisfied. After reading this thread about Red I am wondering whether I should have paid it at all, as they appear to be chancers trying to get as much as posible for poor quality debts. Although my debt was only from 18 months ago .
