Hi all i have not had any generated letters for a while this has come through the post today here goes:roll:

IT REALLY IS THAT SIMPLE, JUST FOLLOW THESE EASY STEPS:roll:

call is onxxxx and tell us if you,re paying in full or need to spread the payments

Make the payment in full or set up a monthly direct debit for the instalments

 

Once the payments have been made the remaining balance will be cleared and the debt will no longer Exist:roll:

 

But we do need to speak you you in the next 10days to take advantage of this offer- even if you can,t pay immediately. Don,t worry we won,t ask you to pay any more, but we nee to update our system to stop any further action, like letters fone calls or possible litigation.

The '' other'' agency is probably their prefered one and so they up date others at longer periods.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

They must think we are stupid..

 

They would already have had your credit file. Aside from the fact they are looking at it every month and probably even updating the records.

 

Their options. Ok - so you probably werent aware of what they COULD do. However, they have not made you aware of what they MUST do before any of these options are open to them.

 

Presumably you have requested a CCA from them ? Have they complied

 

Were you ever provided with a Default Notice, a Termination Notice, a Notice of Assignment ?

 

They will need to follow preaction protocols - if they dont and simply issue a stat demand or Claim then of course let us know and we will be ready for them :)

search by lowell financial ltd this time i now they all the same

application type collections is this something new:-o its usually showing unrecorded

and then a call from Hamptons this evening i said in writing only

The CRAs seem to be quietly changing the style and wording of the entries, maybe means that they have their grubby paws on an account.

another generated letter arived today dated the 4th jan here goes

 

Dear mrs xxxx

We are now preparing to insruct a solicitor

We have tried to resolve this matter with you without sucess. We have now reveiwed the information contained in your credit file and based on the way you are conducting your orther finances, we beleive that you may be in a potition to start repaying this account

As you have failed to repay this debt or provide a genuine reason why it should not or canot be paid, we are now peparing to instruct Drydensfairfax solicitors a law firm that specialises in recovering unpaid debts to manage your case

14days to pay us or agree a repayment plan

--------------------------------------------------

to avoid your account being passed for legal action you must repay the debt in full or call us to agree an affordable repayment plan with in 14days of the date of this letter you may pefer to do this by visiting www.lowell.co.uk

What will legal action mean?

A claim for the outstanding balance will be issued against you by the court and if you still do not pay, an application will be made to obtain a county court judgement ccj for payment by you of the debt and additional legal costs. if a ccj remains unpaid for longer then 30days this would be reported on your credit file for up to 6years and may prevent you from obtaining furture credit such as loan, mortgage, mobile phone contract, or even renting a home, if you still do

not pay the ccj can be enforced by submitting an application for

 

 

Acharging order secureing the debt against your home if you own your own property and/or

An Attachment of Earnings an order from the court instructing your employer to deduct money from your earnings or

A warrent of Executions meaning a court baliff would visit your property and could remove goods to the value of the outstanding debt to repay what you owe

With this gem, Mr Bartle is breaking both the Solicitors Regulation Authority’s own code by deliberately misrepresenting the true legal situation. Also breaking OFT debt collection guidelines.

 

He deliberately implies that the only way to prevent a CCJ is that you pay. This is not true. You are at liberty to defend any action. He also fails to mention the likelihood of a hearing!

 

The claim will technically be ‘issued’ by the court, but will be originated by him – again, implying the court is against you.

 

Mr Bartle is a very naughty man. You should complain about this misleading letter to the OFT and the SRA. Give the naughty man something to think about.
