I recently discovered Natwest had issued a default against me.

Due to a recent period of unemployment i recently contacted them to arrange reduced payments to avoid any defaults or action being taken against me. They accepted the offer but unknown to me issued a default against my credit file. On discovery of the default I immediately repaid the debt and started the process of trying to get the default removed.

Due to a crossed payment when I settled its left the account actually £50 in credit.

Having read these forums I went down the route of requesting a copy of the "signed true and certified copy of the original default notice".

I received a very snotty reply informing me that -

 

"Your request for documents contains some misconceptions about your entitlement to information in a specified form and our obligations to supply that information.

 

As you are aware this account was fully repaid and therefore, there is no active agreement between NatWest and you with regards to the above account.

 

The consumer credit act is for active agreements and therefore we are under no obligation to provide you with the requested documents as your obligations to us under the agreement has ended."

 

First off - is this true that because the account is settled they are under no obligation??

Also since the account is in credit surely the agreement still stands as the account is still in dispute and not fully settled.

this is a complete load of bull. write back and demand it or you will make a complaint to OFT and FOS

Hello Stealthtrooper

 

Defaults are notoriously difficult to have removed in isolation. Mr Marmite has asked you if there are any charges on the account and I would repeat this Q to you, the reason being that asking for return of penalty charges and removal of a default together seems to work, I did it myself with both NatWest and Barclays and achieved both pretty quickly after threatening court action.

well if you went the S.A.R route you SHOULD get a copy of any agreements that have been signed by you.
