Hi to everyone

 

I'm so glad to see I'm not alone with student loan issues.

I graduated some 13 years ago as an "oldie" (I can't go with that mature student malarky because I'm as juvenile in my old age as I was in my 20's). As my annual income never reached the payback threshold while I deffered repayment all was fine. Until I forgot the apply for the deferrment one year. The debt was passed to some debt collection agency but has now ended up with Clarity who I'm repaying at an affordable amount.

However on the last statement from SLC (or Honours Student Loans) I noticed two repayments in one month, totalling £176.25 were missing.

Emails have passed between us - their finance department claim I haven't paid it - my bank statement shows otherwise ( I paid by online banking transfer) - I've sent a copy of the bank statement but heard nothing back from them. I now need to go back over 5 years of statements to see if any other payments have vanished into the black hole.

They are a disgrace. This has been ongoing since September last year. Yesterday I gave them 24 hours to give me an explanation or I'll be reporting this to the police as a theft. I must admit I hadn't even considered the penalty charges they'd added over the years. Oh bring it on!

It would be a good idea to report this in the student's forum as you may get some more advice/support there.

All help is merely my opinion only - please seek legal advice if you need to as I am only qualified in SEN law.

I suggest

 

1) You ask for their official complaint form ( they must give you a copy under the consumer credit act)

 

Then go through their complaint procedure, prob waste of time, but when you have had their final response you can make a complaint to the Financial Ombudsman Service.

 

Oh yeah, did you know you can get any "admin" charges removed that they have slapped on your debt? :D

Also, hit them with a S.A.R - (Subject Access Request) and a request for a copy of of your credit agreement enclose a £1 postal order and head your request with:

 

S.77 Consumer Credit Act request.

 

This will shut them up for a bit while they go find it. (they probably wont be able to find it)

 

They have 12 days to supply you with a copy, after which time they cant hassle you.

noomille060 ...its not known at this stage whether they will be able to comply with the request or not....please dont advocate the unlikelyhoods beforehand.

Nothing personal but CAG is here to help those who need it because of circumstances they did not anticipate and want help with.

No one can pre-suppose the results of a CCA request especially if theres a hint of avoidance.

If we want to be taken seriously by those who are legislating things then we need to show them that we are looking for a level playing field thats fair and just to consumers. Nuff said.
