My daughter I been charge late payment and return charges, She paid for all the goods recieved and refused to pay charges, without any communication from Freemans she has recieved a county court summons. I suggested that we defend on the principle that they are unfair as is with the banks and credit cards. Does anyone think that this would be successfull?

Welcome to the site I will move your thread to the correct place.

Claiming these unlawful penalty charges back is very similar to bank charges reclaims.

Its a case of tweaking letters.You will be asked on the summons to respond and also if you wish to counterclaim ? Here will be your chance to redress the balance.
