      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What they don't tell you is that if you don't have house contents insurance you have to take their damage liability insurance out as well. On the example here that will add a further £250 to the total bill.

 

Actually, their damage liability insurance is 99.9% compulsary. Even customers with their own home contents policy find they have to have to have it. This is because you must be able to show a policy that will specifically pay out to Brighthouse and not you in the case of a claim. The goods you are buying are subject to a hire purchase agreement (i.e. the goods belong to Brighthouse until the final payment) so, technically, they are not yours to insure.

 

Basically, Brighthouse are charging YOU to insure THEIR goods.

 

Furthermore, damage liability cover will not provide a replacement product. It will only - at best - release you from your agreement, which you can do anyway after having paid half the instalments on a hire purchase agreement and returning the goods.

 

Also, in the case of accidental damage or theft, the store manager will have the final decision whether or not the damage liability cover policy should apply - regerdless of a police crime number or any investigation.

 

I also love their "optional" £10 delivery charge, as stated on their website. Yes, it's optional alright, but if you don't pay it you wont get the goods. Delivery is the final bit of their identity check.

Basically, Brighthouse are charging YOU to insure THEIR goods.

 

Like my mortgage company insisting that they are noted on my house insurance policy as having a financial interest in the property, and if I don't will impose their own block policy at vast cost? That game's been going on long before Brighthouse came along!

Not quite the same, Buzby. Let's compare it to car hire purchase.

 

Yes, there's a HPI register, but your car insurance is completely independant of the hire purchase company. If your vehicle is written off, payment doesn't automatically go to them leaving you with nothing, does it?

Hi Lefty, that's not a great example!

 

Forget HPI for the moment, the DVLA hold full details of beneficial interest parties (it's a 'hidden field' on the V5C). Any time there is a material change, the DVLA contact the finance house to let them know of the change, and this brings together the finance house and the insurer, long before you get your cheque in settlement.

 

Change anything else voluntarily... Reg No, RK, your address, the beneficial owner is told all about it! NALOPKT!

The Advertising Standards Authority have written to me advising that they have referred my complaint to OFCOM. (To whom I had already complained!) ;)

 

I received this email from OFCOM:

With regards to the timescale investigating complaints, while we aim to respond to the majority of complaints within 15 working days, more complex cases may take up to 60 working days to respond to. In any case, while we always try to meet these targets, we have to ensure we reach a satisfactory conclusion before closing an investigation.

 

We’re sorry for the delay responding to you, but confirm your complaint is still in progress and you will receive a written response outlining our findings in due course.

Looks like they are seeing it as a "more complex" case! Either way, I'm pretty sure that all concerned - Trisha, Brighthouse, Five, TopHouse Productions - are well aware by now of the potential bad publicity heading there way! ;)

It's one of the easiest things in the world today to get yourself into real problems with debt.

Credit cards, buy now pay later schemes, loans, mortgages - you name it, we're almost all of us borrowing money in one form or another. Fine if you can pay it all back when you need to , terrifying if you suddenly can't and your debts are taking over your life. The first step back to solvency is to acknowledge the problem (so many hide away from it hoping it will go away - it won't I'm afraid) and then ask for help.

  • I know it sounds obvious but go for it anyway - don't carry cash or credit cards when you go out unless there is something specific you need to buy. It works for the Queen!
  • Watch out for 'temptation by catalogue'. I know from talking to my show guests how many of them get into trouble by ordering more than they can afford. Be careful when you order.

Dont ask for any help off BrightHouse because you won't get it.

As for 'watch out for 'temptation by catalogue' then maybe Trisha should add to her website- watch out for temptation by BrightHouse.

Very sad news here. I'm sure everyone will join me in wishing Trisha a speedy recovery...

Having lost a very close friend myself to breast cancer, I know first hand of the heartbreak this awful disease causes...

Five's Trisha has breast cancer

 

 

TV talk show presenter Trisha Goddard is being treated for breast cancer, it has been announced.

A lump was discovered during a routine mammogram three weeks ago, requiring her to be absent from her Five TV show Trisha for two weeks.

"She may possibly need, or choose to have, chemotherapy," said Goddard's husband Peter Gianfrancesco.

Goddard's business partner, Malcolm Allsop, said she would "come through this as she has with other setbacks". He said that Goddard planned to return to the studio at the end of the month.

It's also very sad news for BrightHouse, because channel five will almost certainly have to cut back on the number of Trisha shows they make over the next year - meaning BrightHouse WON'T get the same level of TV exposure channel five had agreed to...

But, BrightHouse are a compassionate lot - they're a "community retailer" don't forget! I'm sure they won't be applying any penalty charges on channel five for breach of contract... 8-) 8-) 8-)

i agree that it is not nice to here about the breast cancer.

 

Have u also heard bout the other news?

 

Brighthouse has had mre of the sub prime ppl joint there scheme since they have been with trisha needless to say my sister in law does not believe the horror stories about bright house claiming they are all made up. Yes you have guessed it she has fallen for there tv sponsership.

 

Glad that she knows about this site as she will need it when they are causing her problems.

I feel sorry for the people directly affected by this news.

 

The job market is going to be very tough for an awful lot of people for a long time.

 

Now more than ever we need to keep the momentum going against BH, as they are one of only a handful of companies poised to take advantage of the situation.

 

They will soon latch onto another way of promoting themselves, much like a virus, or another phrase I like, S**t to a blanket!!

poor bright house advertising.

 

Was looking at one of there rip of catalogues the other day if u was to take out the credit on a bed it was going to cost over £1k the same beds cash price was nearly £400 but the same bed is in argos for nearly £200.
