Sold my 4x4 (see kwik fit don't do 4x4's to see the saga) on ebay on Sunday to a Bulgarian guy who lives in London.

 

Only problem is he speaks very very little english and thought he was getting a fully functional R reg Vauxhall Frontera Sport with less than 100K on the clock with MOT and tax for £510. He called after the auction had finished and arranged to come round the following day. When it dawned on him it was not really drivable in the interests of safety because of the brakes he stopped answering his telephone and has not replied to any emails.

 

I could open a dispute etc but I cannot do that for 7 days and then ebay seem to look at it taking a further 45 days in which I am left in some sort of limbo land. By this time the MOT and tax will have run out and I will be left with a car that is a spares or repairs only and will probably be lucky to get £100 for.

 

The only outcome from the dispute even if it goes my way will be that in 52 days time I will get my Listing and Selling fees returned.

 

Ebay do make a thing of saying that when a buyer makes a bid it is a legally binding agreement to buy the item. I would like to know if this is so legally binding can I take the buyer to court.

It's much quicker than 56 days - after 7 enter the dispute process and you can close it almost immediately for non payment. Irrespective of his grasp of English, the NPB flag and your adverse feedback (should you decide to leave it) will get things moving again.

It is a contract, but for individuals selling on ebay the only caveat is that the goods must be as described.

 

If your listing clearly states the car is not roadworthy then it is the buyer's problem if he expected it to be then found out it isn't.

you can open a non paying buyer dispute on the 8th day after auction.

it can then be closed 7 days later and you can offer 2nd chance offer.

 

you could still offer 2nd chance offer when you open dispute as you know the highest bidder isnlt going to pay. Hopefully you did put cash on collection.

 

Although it says legally binding when you but something ...it isn't in uk law
