  4. Hi, my shift pattern includes shifts which require me to work periods greater than 6 hours. There are no in built breaks within these shifts. I have approached my employer about this issue and their response was that they have a workforce agreement in place and therefore they can exempt section 12 of the WTR under section 23 of the WTR. My guess is that they can also exempt section 12 under section 21 as the job is a special case as described in section 21. What I think they have missed is the effect of section 24 WTR on both sections 21 and 23 and their duties in regard to that; Compensatory rest 24. Where the application of any provision of these Regulations is excluded by regulation 21 or 22, or is modified or excluded by means of a collective agreement or a workforce agreement under regulation 23(a), and a worker is accordingly required by his employer to work during a period which would otherwise be a rest period or rest break— (a) his employer shall wherever possible allow him to take an equivalent period of compensatory rest, and (b) in exceptional cases in which it is not possible, for objective reasons, to grant such a period of rest, his employer shall afford him such protection as may be appropriate in order to safeguard the worker’s health and safety. I may be wrong in this but my opinion is that there should be an in built break on the shifts where I am required to work longer than 6 hours. I don't think that the act allows employers to remove the breaks completely just whether they can be taken at that particular time or not. Regardless of this section 24 overrides sections 21 and 23 and compensatory rest breaks must be provided ? It is a dangerous job 24/7 so breaks are paramount. What is your opinion ?   5. Hi I'm representing a group of employees at my retail workplace some of which are part time and some are full time. The shifts we do vary between 4 and 12 hours a day. It is an individual business not part of a chain or anything. There is no union or HR department there are just the managers who own the business and about 20 staff who work for them. The problem is that we are not allowed to take any rest breaks even in 12 hour shifts. We have previously been allowed a few minutes to eat a meal at some point during the shift but we have to stay at our workplace and if the phone rings we have to leave our meal to answer it or if a customer needs serving we have to serve them. Often our food is left to go cold before we can get back to finish it. The new problem is that we have seen an email between the managers complaining about staff eating during their shift and it shouldnt be allowed as it looks bad to the customers (the email wasn't meant to be seen by us but one of the managers left it on screen on a computer in a public office. They dont know we have read it and ok maybe we shouldn't have if it wasn't addressed to us but we have and its about us anyway). So one of us contacted acas and all they said was there is nothing they can do as there is no way to enforce it. Then we contacted HSE who were very understanding and they passed it on to our local council. Although we have since contacted the council who have said they have been in to speak to one of the managers and they are not going to take any action because they pay us for the whole shift (like if we work from 7am to 7pm straight we get paid for 12 hours. they would only take action if they stopped our pay for a rest break but didn't allow us to take it). We don't think this is fair but we really don't know what to do about it so we are hoping someone on here can advise us on what to do. Other people have said just leave and work somewhere else but it's not as simple for that for some of us who can't find a different job. Thankyou

  7. This is so very wrong - back in 2001 the Labour Government encouraged the purchase of Diesel vehicles, reducing diesel and pumping money into the industry.   9. Just a quick question here. My office closed on XMas eve, and we go back on the 4th like most people. However, due to the work I do, and a very demanding client, I am having to cancel plans and work from home in order to work on a system. I am alone in doing this, while the rest of the office enjoys a nice break. Am I entitled to these days back since I am working them? Or am I just being picky? Thanks
  10. Hi there! My partner has just received a CCJ through the post from an old Halifax account, (about 4 years old). He was always into his overdraft and was always charged penalty charges, so it was impossible for him to ever clear this overdraft. A few years back Halifax changed their terms and conditions and he was £5 over his overdraft. This resulted in him being charged an excessive amount so he closed the account. However, they refused to close it and continued adding penalty charges, but he disputed paying the penalty charges so since then, it has been passed around many different credit agencies. I have successfully had a stat demand set aside and want to help him to try and defend this, as it now also has lots of interest on it. Please can anybody point me to a similar thread or tell me the best thing to do? Should I get him to send a SAR to halifax and 1st credit??? Many thanks!

Hi guys on the 22nd/10/2014 i sustained an injury at work hurting my shoulder and knee, i have carried on working due to the fact i have no holidays to take to get to my gp,, i completed an accident form then 1 week later emailed my manager to see if he had seen it, at which he replied no, ( no further discussion has been made ) until today i worked all day through my breaks to then travel the 45 miles back home and make my late appointment with my gp. He wants me to go back next week drain the blood from my knee administer a cortisone injection in it and also put cortisone in my shoulder. if it does not cure my shoulder then an ultrasound and possible keyhole to fix the problem. He advised rest but i told him its xmas i cant miss the pay and work has told me i will already be on a disciplinary as it is because i have had 5 days off in 12 months, The doctor said well its my own choice that's his advice, i then went and told my manager what was happening for him to then say i cant attend work, as the doctor had advised i rest, no sick note issued mind. i told him well no one has give a stuff since the 22nd Oct so i can keep working now, but he is now adamant i cant work and i should travel the 45 miles to work tomorrow and call him once there for a meeting, even though it will then take him 2 hrs to travel up to the depot. i told him i have made changes to my vehicle now so it makes it easier on me while i mend but alas he is making me stop work,. So my question after all that is, if i feel ok to carry on and the doctor has not signed me as unfit for work can i still work.... Besides no body cared about it for the last 5 weeks or so.

Some time ago I had a account with Barclay card defaulted on it they never really harassed me about it in fact I went months no letters from them I did ask for a true copy credit agreement got sent a blank made up one and argued with them for a bit and they just stopped replying even the CAB couldn't get a reply from them when they requested the agreement. last year I got a notice of assignment the debt was passed on the Lowell, Barclays marked the defaulted account as satisfied on my credit record and Lowell took over marking my credit file defaulted they do every month to this day I requested the true credit agreement from Lowells from then on. June last year Lowell closed my file telling my they couldn't find the credit agreement as it had been so long. Today I gets a letter from Barclay card with yet another blank made up credit agreement demanding payment What the F LOL

Hi guys, I don't know whether I'm having a off day but I'm trying to understand this rules on the government website without success http://www.direct.gov.uk/en/Employment/Employees/WorkingHoursAndTimeOff/DG_10029451 Basically I'm a shift worker, I work 10am till 10pm Mon to Thurs. I work in random places up to 2 hours drive from home. During these working times I'm entitled to 1 hour lunch. Also I do not get paid from 10am till 11am and from 9pm till 10pm, the company expect me to give them a free travel/grace time. My question is, how many hours rest am I entitled to before I start work again? And am I entitled to 90 hours off because I work a shift hours stated above? Am i entitled to 11hours rest or does it come under compensatory rest of 90 hours at the end of the week? I just can't make head nor tail of the gov link above. Appreciate your help. Thanks
