Hi Guys I can see lots has already been posted on the subject of' Log Book Loans' mine is a slightly different one as I have owned the car for a year and they [edit] it from outside of the house last week with no prior notification. They are now going by the name of Hermes Property/CC Collections as well as Nine Regions Ltd trading as Log Book Loans. I have a copy of the bill of sale signed by the previous owner dated 16/12/2010, logged at the high court with a stamp 22/12/2010. I have not seen a credit agreement. I have contacted HPI and they have confirmed a claim was put on the vehicle by this mob 16/12/2010. The police have been next to useless and not interested calling this a cival matter, at what poit does it become a legal issue of theft? including the personal contents in the car and the fact that I am paying the road tax and insurance but do not know where the car is being stored. The collections company Grosvenor credit management and investigators do not want to know and have now passed back to CC Collections and funny enough their phone line is now dead. I have emailed the OFT today and Consumer Direct with all the info and a copy of the Bill of sale. I have found citizen advice not so helpful and although the rep who they transfered me to at Consumer Direct was trying to be helpful came back with no information to help me get the car back other than speak to the garage as it is their responsibility. The garage do not give two hoots as they have their cash from me for the car. Basically both myself and the garage bough the car in good faith 'innocent purchasers' after using a car check mycarcheck.com which was not and is still not showing any outstanding finace owing.(I do not have a copy of the original check but did one a few days ago) Please help me I am going crazy with frustration CC Collections are telling me to wait 14 days for them to get back to me aaaahhhhhhh
  2. :!:Hi everyone, new to this CAG -- Just received letter from PMF stating my car is subject to hire purchase agreement. Checked last night with HPI and no such contract noted (couldn't do the check when I bought the car two years ago from private owner). They have sent a "keeper questionnaire" which appears to be a fishing expedition as it does not include any information they must already hold. Could there be a current agreement that is registered and cannot be found by the HPI search? Am I within my rights (what rights?) to ask PMF to disclose the information they have about such a debt? Should I worry about the car disappearing from my premises? Any further information / suggestions would be appreciated.
  3. hello! bailiff have seized my car for unpaid parking tickets which were in dispute as i had sent a witness form by recorded delivery and i did not recieve a reply. i then called newham council to question why i hadnt recieved a reply and they told me to call the court, which i did, though its all automated. anyway, two months later, bailiff have taken my car with no prior contact!! AT ALL. no letters, no visits, NOTHING!! i thought my car had been stolen and called the police wh then told me that the bailiff had filed to them that they had taken the vehicle!! why couldnt they tell me!! they are now demanding £1500 for me to get my car back. i am a single mother with a small baby and its money that i simply just dont have AT ALL!! i know that the bailiff handeled this job incorrectly thus them taking my car was illegally done and i will file a formal complaint but i need help as i dont know what my next action is, would i have to pay for the car and then complain or can i somehow get any further action frozen? please help, i am a mess about this!! I sm not the first person they have done this to, please help me fight this. I have filled out a TE7 and TE9 in order to freeze any further action and have sent off a subject access request but how does this stop them from selling my car after the decisions have been made. i will launch a formal complaint. what are the processes of getting my car back without having to pay there illegal fines. what are the odds that i will get my car back and how long do you think it will take?? should i rent a car and then claim back expenses?   4. posting on behalf of family member who has court case (allocation??) tomorrow WEDNESDAY Looking for real quick pointers and advice on what they should say or do at the hearing ... no real idea what an allocation hearing is ? They say all figures are different that they received compared to the package sent to the courts Details .... They are in a dispute with RCI Financial services (Nissan, Renault) Purchased a car in April 2010 for £13,500, paid instalments until needed to change payment date from 2nd to 28th this was agreed however RCI stated that we had missed one payment and owed £300, In September they took the first payment from the new agreed payment date of 28th in October they decided not to continue the contract In October they issued a default notice and termination notice and in November they proceeded to use a company called Anglia to snatch back the car. (Not sure if Default Notice was ever received by them but in SARs documents that they requested) The car was snatched back from private property proceeding to break into the car, this was against the 1974 consumer credit act ? In March 2011 they sold the car in auction and stated they received £8,500 from the auction they then issued court CCJ action to recover “repudiated” damages for £16,500 minus the £8,500, We ended up with no car and a damage claims for default of £8,000, they claim repudiated for all Facts 1) RCI are extremely difficult company incompetent in managing HP contracts, very aggressive and not able to negotiate with. 2) RCI use the repudiated contract clause to extract damages 3) RCI are not interested in any form of negotiation 4) RCI employ Anglia recovery who use lies and misinformation to recover vehicles 5) RCI are now pursuing court action and use Solex solicitors who again do not want negotiation they want f=damages and costs Avoid this company do not use for the purchase of Renault or Nissan vehicles Any help much mich appreciated Merc
  5. Hi everyone. Last week my partners car was repod from the hotel car park which he owns. Lombard finance had not issued a default notice or a termination notice. When the repo company came first thing in the morning, my partner was away and i was still in my pjs. They demanded that i see them and showed me a repo notice. I told them that he was not here but I would call him. At 9am, I had to take our son to school. They moved out of the driveway and off the property. By the time I got home, the car was gone and the neighbours told me that the police had attended while the comany removed the car. We have called Lombard to let them know that they contravened sections 87 and 92 - not issuing a default notice and removing the car from private land, both of which they have contested. They have passed it on to their legal dept. We have also contacted the police chief constable to ask for the officers' names and a report. They have not responded yet and we plan to write a letter giving them 28 days before we contact the ipcc. If anyone could offer me any advice on how to proceed at all, I would be so grateful. I especially need help re: writing the letter before action. Thanks in advance Kx
