  1. Hi all, Right! - this could be a difficult one. My wife has a Lloyds bank Trustcard credit card which goes all the way back to 1988 and has PPI on it throughout the 30 years it's been in existence. Now, the CC is still active although the balance is now zero as i managed to finally get it all paid off around June 2013. The card was originally issued as a Cheque Guarantee card for her current account. This was issued when she opened the current account. What wasn't initially obvious was the fact that it was also a credit card with a separate credit card account. I have a quite a few questions - so be gentle with me 1. My wife never applied for a CC only a Current account with TSB and had no idea that the subsequent CC account carried Payment Insurance - is that grounds for a PPI miss-sell? 2. We have scoured the house for monthly statements and have pretty much every one from 2000 to 2013, most of 97-98, some of 96 and some very sparse copies from 91 and 92. We have nothing prior to 91 - except believe it or not the actual original plastic card with issued in 88 on it. So as you can see we have alot of missing years in between. What can we do (if anything) to try and fill in the missing years? Is it even possible or permissible to extrapolate the data. 3. I sent an SAR and received back alot of paperwork but nothing back further than 2000. So that was no real help - is there anything else i can request? 4. If it is a case worth pursuing and bearing in mind that it runs across some 330 months up until 2013 when it was paid off - is there any spreadsheet i can use to try and assertain just how much we might (if successful) get back? 5. Do i make calculations up until the balance was brought to zero or until now? 6. What's the best approach for this - FOS, letters to bank, Resolver?? I've had success with resolver on bank loans with PPI but they were simple things in comparison. I'm a bit clueless as to the best approach on this one as CC PPI seems to be so much more complicated. If anyone could guide me along this path I would be very grateful. Answers on a postcard Thanks in advance Kholo
  2. I work for a company that employs more than 1000 Trade plate drivers; we travel all over the UK delivering and collecting vehicles for many different customers. Many of the places we go to are quite remote, airfields and large compounds etc, there is not usually public transport to many of these places. The only way we can complete our work is to work with other drivers, sometimes this is arranged by the company and sometimes we arrange this between ourselves. When there is public transport it can often take a long time to travel between jobs, and quite expensive. Therefore, working with other drivers is normal. I received the notice from Metropolitan police was about seven weeks after the incident asking me to identify the driver of the car at the incident time. On average we will complete about three jobs a day, on that basis I would have driven about one hundred vehicles in average of three to four cars a day. How many drivers I would have worked with is not possible to work out. Under those circumstances I do not know anyone who could remember the details of a specific car or who they were working with at a specific time of the day seven weeks previously. The company do not keep records of who works with who at any time, the only thing they are interested in is that all of the assigned work is completed on time. I have asked many drivers if they can remember working with me on that day, none can. I have looked at any written notes I keep; this has not helped. I have checked my mobile phone to see who I spoke to around that day, nothing I have done has enabled me to identify who would have been driving at the time of the alleged incident. Also the photographs sent to me earlier by the Police wasn’t clear enough to identify who was driving the vehicle at incident time. I understand that the Police will ask for any information that will lead to the identity of whoever was driving, and in most cases it can be provided. I have however read what the law says in this situation. It clearly says that a driver/keeper cannot be guilty of failing to identify who was driving if they did not know with reasonable diligence. It seems common sense to me that the law was written that way because of exactly this kind of situation. The law also says I am not required to keep records. I accept that this is a very unsatisfactory situation, I remain willing to do anything I can to identify the driver concerned but I cannot see what else I can do. Metropolitan Police write to me again saying that I have a legal responsibility to identify the , further action in this matter has been suspended for 14 days. I do not know what I have to do with this, Thanks

  4. In 1988 while I was in the army I took out a £2000 loan from the RBS in Stirling branch As I recall I was forced to take out insurance with his loan. In 1990 I had to leave the army to look after my mother who was seriously ill at the time. I tried to claim the insurance from the loan which was rejected as I left the army voluntarily. My mother is moving house so I've been clearing out the attic and I've discovered the old credit agreement from this loan. Do I still have a case to claim the compulsory insurance or am I time barred?
  5. Posting on behalf of my parents. Have used these forums before, very useful they are too This may be in the wrong forum. Basically to cut a long story short, a council owned vehicle was turning round in the cul-de-sac they live when it struck the bottom of the drive and left some damage to some paving slabs. The driver was going to drive off if my father hadn't had seen him do it. Having contacted the council they sent us a Compensation Form, and now have sent a letter that makes reference to the Road Traffic Act 1988 Section 154 ("Duty to give information as to insurance or security where claim made"), which, in the grand scale of things and from other research, appears to apply mostly to accidents with another car. The letter is giving insurance details and excess amounts and asking for my parents details. The problem is, the accident was caused by their vehicle on my parents drive. It is not in my mind related to car insurance as the car would have been either in the garage or up the drive at the time well away from the public road. Could the insurance possibly be related to house or buildings insurance? Any advise would be much appreciated.
