  1. Posting this in attempt to try to help my friend who was quite irresponsible with her credit cards. I think they are all with different banks and she says no way for these to be combined into one or for her to get a loan (bad credit rating) to pay them off. £1000 overdraft on each card so £3000 in total plus monthly interest rates piling up on top of each sum plus I think there are some late payment fees too or something. She only can make small payments (meeting the monthly minimum) but it is going on for her for almost 3 years now and because of the interest rates piling up on top of the rest each month, she can't see the light at the end of the tunnel and I am worried for her because of this. Her health is affected as well as her general mood. I am noticing psychological effects too, she is becoming short tempered with her nearest and dearest (including me as best friend) which is really not like her. She's got no money for buying presents for family or anyone else, no holidays, nor for new items of clothing or to afford more than 2 drinks somewhere out once or max twice a month and that's pretty much the only time she spends out of her home and workplace, apart from when buying groceries. She's basically got no life because no money and the paying off seems to be taking painfully long. I know she has some sort of depression symptoms too. The situation is very stressful for her and she cries often, she doesn't tell me but I know this. Are there any options/solutions to make paying off these overdrafts more manageable? Even if she could put paying off 1 of the cards on hold would be helpful...? Any hacks/tricks are welcome! She's got a job working with kids on a self employed basis and paying her NI and taxes but she's not being left with much at all after paying rent, bills (houseshare with others) and travel expenses. Does a bit of paid extra work in childcare but it's only enough to barely keep her head above the water. In some weeks when the extra childcare not needed, she's got no money for food.
  2. Whilst clearing out and shredding some old files a few days ago I came across an old loan agreement with First National Bank which had PPI added. There is also a letter in the file in answer to a letter I sent to them asking them to cancel the PPI in which they say they cannot cancel it. My question is, am I too late to claim this back? the agreement is date either 1999 or 2000 it is difficult to tell. I have all the papers, account number etc.
  3. Hi All, My head is all of the place at the moment due to letters from HMRC's Tax Credit Office. I will give you some background info. I have been claiming WTC, CTC and Housing Benefit since 2012 due to low income. I had been working just a few hours here and there. TBH, I deliberately kept the hours down as the total benefits outweighed any potential income. The " Benefit Trap" so to speak. Last year, I decided to go down the Self - Assessment route and contacted HMRC and was issued with an UTR. I have kept my official earnings at around 10K,so not to earn too much. In June this year, I received a letter stating that according to the WTC people my working hours were ' zero' and had been since May 2014.This is when I became "Self - employed". I requested a Mandatory Reconsideration. I received a reply about 7 weeks later saying I was not entitled to WTC because they have no record of my hours worked since becoming self- employed. They have requested further info 1. Copies of advertisements placed ( I have never placed any!) 2. A breakdown of the hours you worked in a week. ( I have a breakdown of the amount worked,but not the hours. Should I break this down to say an average of 27 hours a week over a month? ) 3.Invoices for any work you have done. ( haven't got any,but could work on that.) To add further woe, I was given until 14 August to provide this, but I only opened the letter last Friday as I had been out of the country for 5 weeks.... As I am sure some of you know for the Mandatory Reconsideration the HMRC give two options? 1. Choose this option if you DON'T want to proceed and withdraw the request and repay any over payments ... or 2. Choose this option ... and supply the requested information. I am tempted to go with option 1 as it seems like a lot of hassle,but have not decided yet. I want to call them tomorrow,but am seeking some advice here first. However, I think my biggest worry is potentially losing my HB. I live in London with my wife and child and this would be life changing. If I did choose Option 1 and ended my request for a Mandatory Reconsideration, would this affect my HB?? I know I am supposed to inform my local housing authority of any changed,but haven't. I seemed to have spun a right web for myself,however, writing this feels like the first step. Hopefully, some of you can advise? Thank you, Bothered One
  4. Apparently, according to a friend, you can get divorced for £60. This is apparently what her parents did. My husband and I want a divorce, there is no dispute, we don't want to fight about it, we've been separated for a while and have both met someone else. What is the cheapest and easiest way of getting a divorce? I have a form printed off the internet "Application for a decree nisi/conditional order or (judicial) separation devree/order) - it's just one page and theres the option for "undefended case" which is what seems to be the right option for us. Any advice gratefully received.
  5. I have been offered a full-time freelance role with a creative company in a field I want to work in. But as I'll need to make major sacrifices for it I want to be careful. So would anyone mind clarifying what effect these clauses could have in future, and whether or not they are standard/acceptable? Thanks so much in advance if you can advise (Omissions have been made to keep this brief) [The Contractor] waives their Moral Rights ... in respect of any acts of [the business] or any acts of third parties done with [the business]'s authority in relation to any copyright works produced wholly or partly by them in performance of their duties. Any inventions, writings, designs [etc] made by [the Contractor] individually or jointly, during their engagement by [the business] (or within two years before that time) that can be used in any business of [the business] must be disclosed immediately. [The business] retains full rights to use any such material in any of [the business]'s services. [The business] shall have the right to make the Contractor's services available to third parties and the Contractor will co-operate fully with, and follow all lawful directions and instructions of such third parties. - [The business] shall be entitled to use and authorise others to use the name, likeness, photograph and biographical material of the Contractor in connection with the advertising or exploitation of any project to which the services relate in any format and in any and all media. - The provisions of this clause shall survive the termination of this Agreement for any reason.

A friend transferred some money out of his bank account to an etrade account as he thinks he will lose his job in a couple of months, and wanted less than £6,000 in the account, but worries that housing benefit and DWP will do data matching or go into his accounts and see the transaction and then look into the etrade account (which isn't trading at the moment). Will they notice the money being sent out, do they monitor transactions three months before and do data matching? Does the DWP employ credit reference agencies who pick up on these transactions and etrade accounts? He's thinking of closing this bank account and opening another one in another bank. To stop this transaction being fund for £6,000 out of account. Obviously, he will get contribution based benefits after working for four years.
  7. So basically I live in a shared house. We received a letter to say that the landlord wanted to complete an inspection (we had one of these around a month ago - where they were incredibly rude, shouting at bin bags etc.). I politely rang up the letting agency to inform them that this day was not suitable for us (we were in the middle of packing to move out). They said they would inform the landlord and arrange for another day. Anyway yesterday they came in anyway. Only my flatmate was in bed as we were all out. They let themselves in, walked around and woke up my flatmate and started shouting at him for small bits of mess. I rang up the letting agency and they said they had tried to contact us, but could not get hold of us to tell us that they were coming anyway as 'they were only checking meters'. I said I had made it very clear I didn't want them coming round (I like to be in the house when they visit - I personally don't like landlord being around my things without me being there). I am extremely annoyed by this, the letting agency are nothing but trouble - have not helped us in any way this year and been an absolute nuisance. What would you advise to do? Am i within my right to cancel the rest of the tenancy and move to my new house (im currently in a cross over period). This would save me rent. Thanks for any help.
  8. I moved to France in 2004 and have recently been reading about PPI claims. All loans were paid off before I moved. I have found paperwork with account numbers on from Blackhorse and Masterloan, is it worth finding out if PPI was added or is it too late?
  9. Hi all. Need some advice, please DH had an Egg credit card and we defaulted during a rather dark period of our lives. The account was passed on to Bryan Carter who took him to court in Jan 2011. We didn't contest it or turn up to the court date (which wasn't in our local court, but some 200 miles away) and a Charging Order was placed on our property. We're currently trying to sort our financial affairs out as we want to move next year. The "amount owing under judgement or order given on 18 June 2010 by the court, together with any interest becoming due and £268 the costs of the application" Surely, as the amount is under £5k, interest would not be payable? Is this just standard wording, or have the court given them carte blanche to charge us for that too? We have been paying £30 a month to Bryan Carter since 2011 but have never received any statements of account and we now want rid of this, so that we can start to repair our credit rating and get the charging order removed. Is it possible to attempt to fight this retrospectively? We have never asked for CCA's to prove liability or that the agreement was worded correctly; or for any statements of account on the original debt (and we know how bad these companies are for just plucking figures out of thin air! We're sure that the original debt was not this much) Is this worth doing now, or a bit pointless as it has already been through court? Alternatively, how open do you think they would be to accepting a full and final settlement for less than the amount outstanding? Many thanks for any help you can provide.

My mother in law received a letter for her car not being paid for at a car park looked after by park with ease. 2 cars went and both cars were paid for. by the time parking was done and we both left one of the cars had overstayed by 1 and a half minutes longer than an hour. Received an invoice on her car dated 28 days later it actually arrived 29/30 days later. I appealed saying This ticket was not issued within 14 days. The date of the offence was 15th July 2014. the date of issue was 12th August 2014. The prescribed fee was paid and the claim against you is utterly refuted as being without foundation or just cause. We paid for an hours parking from when we parked up, left the car and checked the fees for the car park. the fine is for overstaying the hour by less than one minute thirty seconds. PWE replied " Thank you for your email We have no requirement to issued parking charge notices within 14 days. There are no payments for your registration or anything similar, therefore you failed to pay for the parking that was due at the time of parking or up to 48 hours following your departure and so the parking charge notice has been issued correctly. You can pay your parking charge notice online at or by sending a cheque or postal order to Park with Ease Ltd, Unit F2, The Court, Kestrel Road, Trafford Park, Manchester, M17 1SF If you believe this decision is incorrect, you are entitled to appeal to the Independent Appeals Service (IAS). In order to appeal the IAS will need your parking charge number, your vehicle registration and the date the charge was originally issued. Appeals must be submitted to the IAS within 21 days of the date of this letter. For further information please visit www I then appealed using the above information to the IAS but must have input the date wrong about when i received the letter as the claim was dismissed and the IAS said "The Appellant challenges on the ground that the notice requirements under PoFA have not been complied with and they paid. The Operator is not seeking keeper liability under PoFA and therefore the notice requirements are not relevant, although the Appellant is incorrect about the notice period in any event and claims that they received a letter on a day that has not arrived yet. There is no evidence from the Appellant that they paid. They have a witness but have provided no evidence from that witness. The Operator has provided clear evidence that they have not paid. Even giving the Appellant the benefit of the doubt on this the Appellant accepts not paying for the time that they actually parked for." please tell me i do not have to pay the 25 or maybe even 50 pounds they are trying to charge me as that is ridiculous it was parked at.. ..for example 1:05pm and recorded leaving at 2:06 and 28seconds
  11. I am due in Court later this week for a repossession Hearing, I have filed a defence and so now it is going to take a day for the hearing to take place. I currently have laryngitis and literally just have a `squeak` as a voice, am I able to geta Doctors note to not attend Court and if I don`t attend, after having given a Doctors note, what will happen please? I am defending myself so would need to do a great deal of talking, which of course is going to be near impossible, please help because added to my illness, this is making me really stressed Thank you.

  14. I recently have SORN my old car. I didn't have a V5C form so I used a V890 form, which only asks you for the car REG and address. Sent off in the post and couple of days later it's sorn. Does this mean I could sorn any car as long as I know the address? Couldn't this be used by ticked off neighbors that don't like you parking in the bay outside their house, in hopes that they recieve fines down the line by AMPRs?
  15. Hi, I am currently taking someone to court over an ebay dispute. The date is this Thursday the 8th. I am however too ill to attend and have been told by my doctor that I need complete bed rest for the next 7 days (serious pregnancy complications) and the court is a good 2 hour drive away. Is it too late to get the hearing adjourned? The doctor said he would be able to supply a letter if needs be. Thanks
  16. I am self employed and my earnings vary a lot often for a short period oftime. My housing benefit claim was already close once because my earnings weretoo high. However the problem is that my earnings vary a lot often for asmall period of time and it is inconvenient for me to make a new claim forhousing benefit each time my earnings vary. I would like to know how to explainmy situation to the housing benefit department to avoid that my claim is closedeach time my earnings vary temporarily I would like to know if there is a specific law for self employer or if I have to file a specific form
  17. I couldn't help but over-hear two men in their mid-twenties while sitting at a bar. One of the guys says to his friend, "Man you look tired." His buddy says, "Dude I'm exhausted. My girlfriend and I have sex all the time. I just don't know what to do." A fellow about (72), sitting a couple of stools down had also overheard the conversation.   18. Wondering if anybody can help. I have received a "parking charge notice to keeper" through my door today, the letter states that i have to pay £50 or £25 in 14 days for not paying at the brockholes valley Preston. The letter stated the visit was on the 5th October which is more than a month ago, surely they have to send letters out in certain timframes? Does anybody know anything about this? Thanks

  20. Hi All, Posting on behalf of a colleague. Col, as we'll call him, was removed from a club for being over-intoxicated. Unable to contact the friends with whom he had gone, in a city away from home, he entered a casino, clearly worse for wear, and proceeded to use his debit card to gamble away £400. He has no recollection of most of these events, only becoming clear after checking his statement. He intends to ask his bank to make a chargeback to reclaim the funds (each transaction over £100) - however, I am concerned that by doing so this might be considered fraud (if the bank even reimburses). I'm tempted to advise that he chalks it up to experience, but he argues that he was clearly too drunk to consent to gamble, and the casino have taken advantage. Thoughts?

  22. Hi all I received a few letters from Lowell Finance (I think it was). this was for a debt for just over 2000 pounds. IT NEVER SAID WHAT FOR and for the life of me I cant think, as I'm sure I'm paying for everything I know of. because of this I ignored the letters as I didn't want to acknowledge some debt in case its something that may already be over 6 years old. I've now since received 2 letters from HM Courts and Tribunals Service, both containing Attachment of Earning Application, I ignored the first but the second came with a WARNING handwritten note saying I must complete the form and return it to the county court as failure may result in a CUSTODIAL SENTENCE. am I too late to do anything and should I just comply and start paying this debt, or can I still do something about it. - I honestly do not know what its for or how old the debt is

We had a mortgage with Kensington until we remortgaged in around 2004, before sending off a SAR could someone confirm the 12 year rule, i.e. Can we only claim the charges in the last 12 years? or Do we have up to 12 years to claim the charges for x amount of years before the account was closed in or around 2004? Can anyone enlighten me or point me in the right direction?

Hello I joined two companies over ten years ago fashionworld and brilliantgift shop from which i bought items, and over the last ten years sure i have paid for the items fifty times over by now, have got into such a mess with them, I would only have to miss a payment then there would be further late fees added on, and not to mention the admin fees, I dont get much money as im on sick benefits and suffered from mental illness all this time, for the last ten years they have been taking so much of my money, a friend mentioned to me that I could reclaim the late fees they had been charging and I am completely new to this have no idea how to go about it, I wondered if anybody could be any information on how to start going about claiming back? This month I owe them about hundred and fifty pounds to them, because i missed some payments, I cant go on like this I cant afford these charges anymore seems to be getting worse, now Im worried because I just decided i cant bear parting with that much money and have spent the money on something else and this means next time the charges will be even more still got to my wits end with this now, I am always worrying how the hell im going to pay, is there anybody could advice me what to do ? thank you
  25. Hi, I work 2 days a week (weekends) for a small boutique and have been there for 7 years. I have been offered a new job and have accepted this. My contract states that I have to work 8 weeks notice but I need to leave after just 5 weeks. I know I will be in breach of contract, but small shops, employing part time wont wait 2 months, which to be fair does seem excessive. Can someone please tell my what could happen to me if I leave after 5 weeks instead of 8. My boss is pushing for 8 weeks notice and is not answering her phone so I have put this to her in writing.
