  1. Good morning all. I'm hoping somebody can give me a little advice on a problem I have at work at the moment? Basically, I have just been suspended from work for something that supposedly happened one evening earlier this week. I have been accused of bullying by a female member of staff. She claims that I had a disagreement with her during the day (which I accept) and that just before leaving for home that evening I approached her desk, "red faced and in a rage" and proceeded to launch a torrent of verbal abuse at her whilst leaning over her desk in an aggressive manner with my fists on her table. This upset her and made her feel threatened, she burst into tears after I had left and has lodged a formal complaint about my behaviour. I was off work the following day (normal weekly day off) but received a text message from my sales manage saying that I needed to make sure I was in early the following day to attend an 8.30 meeting. I was eventually called to the meeting at 12.30 which was held with my general manager, not my sales manager. He immediately warned me that an official complaint had been received and that this could be going "legal". I immediately asked if I could have somebody present to witness what was being said, but this was refused on the basis that this was just going to be a discussion between him and I to let me read the letter of complaint and for him to hear my side of events and to answer other allegations that had been made against me. This discussion was recorded (with my consent) by the way. It was immediately apparent (once I started reading the letter) that this was being blown out of all proportion. I had not approached my work colleague in a rage, and had not leant over her table aggressively. I had gone to talk to her calmly before I went home as I didn't want there to be an atmosphere at work due to the disagreement that had occurred earlier in the day. I had stood by her desk in a non threatening manner, had tried to resolve the issue as best I could but she became aggressive herself, swearing at me. Now this whole incident was recorded on CCTV camera, and when I asked my general manager if he had viewed the footage he said he had. When I then asked if it had shown I was acting in an aggressive manner he immediately replied "to me it looked as if you could have been discussing football or something" which indicated to me that it didn't, although he wouldn't admit as much. Aside from the allegations of what happened earlier this week, my work colleague is stating that there has been a history of my repeatedly belittling her and "bullying" her, which I refute. I have text messages on my phone from her, some as recently as 6 or 7 days ago where she has replied or sent me texts with kisses on the end of them. I find it hard to believe that somebody who feels she has been bullied or belittled would send text messages of this kind. As I say, I have been suspended for 10 days (paid) whilst further investigation are carried out. Thoughts? Sorry for the long rambling post, but I am really worried about this as it could cost me my job.
  2. Hi guys, Been pretty upset today as found out i'm suspended from work for 'misconduct'. I'll explain..I'm a youth mentor for a university and work mainly with FE Students. Basically i started the job in September 2012 and had all the relevant training provided by the university. As a youth mentor I have to teach students about various educational topics every month such as sti's etc and monitor/supervise students in the student common room..as part of the university's interest in students they ask students to fill in feedback forms at the end of each educational topic teaching session. In December 2012 there was some comments left in scribbly writing which made racist remarks to myself as a tutor stuff like 'why don't we have a english tutor etc'. I didn't actually see these comments but my manager did. My manager rung me at the time and asked me to call him. I called him and he told me that he had seen the comments and that i should ignore them as the majority of students are white and its ignorance, but he didn't want me to feel the matter was being ignored so he would have a meeting with all students and get the police to come in to talk about racism. He did all of this and no one admitted they wrote the comments. He then asked me if i wanted to file a police report or what. I told him that I didn't as I wasn't bothered about it and they're only college kids mainly 16 so i put it down to ignorance. In March 2013 this year we've had two new staff members as two left who work as youth mentors next to me. Basically since then staff members have been getting odd texts which appear to be from another staff member but aren't saying they've been sacked etc. I was also victim to this and almost fell for it, luckily our work noticed and text us all so I realised. My work never found out who was doing it but had a meeting advising everyone to be careful and as a result they moved all staff files from a public area to a secure area. Today I got called into a meeting all of a sudden at work with the head of youth mentoring and head of staff. They asked me to recall the racism incident in December and pulled out the feedback forms which has racist comments on them. They then pulled out feedback forms I had signed as part of my contract and another's mentors feedback form which had been modified and extra words added on it. They told me that all 3 pieces of documents looked like they were my writing (scribbly) and could I explain this. i told them that I was extremely offended that they would imply I had been modifying documents and more importantly the pens we all use to write with are the same and shared between students and ourselves because we have limited supplies and I had not been writing or modifying anything and had no reason too. Furthermore the way of the writing ie: the way the a's and g's were wrote on the racism form seemed totally different to mine. They noted this and I told them just because someone has scribbly writing and mine is also does not mean that this is the same person. They then said to me on that basis I wrote '&' on a sheet and the last mentor's work that had been modified also had an '&' on. So they put to me that no racism ever happened, I was lieing and secretly unhappy with my job and decided to falisify feedback documents, feedback sheets and was so dumb I used the same pen, same writing style and letters and words. They then ever said that next year my re-application for this job should be suggested that 'it won't go to the same person'. To be honest I was pretty upset as I haven't done the above things and they told me that they have sought advice from their 'HR lawyer in the university' and that she hasn't actually seen the documents but her advice is to suspend me. I will be paid for days i worked that's it. I feel this is really unfair espically when the feedback forms are left in a open environment on a desk where students can get them or staff and i did put this to them. However i feel i've been unfairly treated here espically suggesting and implying that I won't get the job next year if I re-apply. The thing that annonyed me about that is that they had someone last year who re-worked here so necessarily that wasn't a fair statement. I just wondered what can I do? what are my rights? have they acted fairly? Could i ask that if they want to speak to me further that I have a lawyer there? If anyone could let me know that would be fantastic as at the end of the whole meeting I was pretty upset as i really enjoy teaching these children and giving something back..
  3. Hi, I am asking for some advice on behalf of my sister (she is not good at this sort of thing and is now too embarrassed to follow up). About 3 years ago she was suspended from work WITHOUT pay pending an investigation by the police. a few months after she was informed that no action was being taken as there was no evidence to back up an allegation made against her. The matter was closed in the police side as far as I know. Anyway, my sister waited for her work to contact her with reference going back to carry on work. NOTHING. she spoke to members of staff she was good friends with and no-one knew anything but there was a lot going on with other members of staff now and other allegations where being thrown around by the managers (false ones too from what the general opinions where). Now almost three years down the line my sister is STILL waiting for her 'employer' to contact her and clear up the situation. I had finally got her to stop just chatting with staff and contact the employer. Following the 3rd letter off her and several telephone calls to the office without response I called the office twice to be told the boss was in a meeting but would be given a message to call me. No call to me over the next couple of days so I called him on his mobile. He was a bit niffed I think (understandably I guess) but he would not tell me anything at all about my sisters employment situation or status. He assured me he had written to my sister in response to her letter and that she should follow this letter up as soon as possible. NO LETTER. Today the letter arrived - this is the one he had sent out weeks ago in response to my sisters letters - saying she should contact him at the office to confirm her postal address so that he could send her more mail regarding the situation. He also commented on the telephone call from 'a man claiming to be her brother' he had received - odd how I spoke to him long after he had sent this letter!!! Anyway, she is now meant to ring him to confirm the postal address so he can contact her and progress the situation. Seems to me like a runaround is developing here. My sister is moving to Germany THIS WEEK to live with me and is not returning. We need the P45 etc... to allow a smooth transaction onto the German employment system. The employer has been informed verbally and by letter of the move to Germany but there has been no cooperation so far. Where does my sister stand? For 3 yrs she has been cashing in her saving to live off !!! Is this right or is there something fishy going on here ? I tried Citizens advice, job center, benefits office and tax office but it was like talking to a faulty bath sponge. The information soaked in but nothing came out. Please help as we are meant to be driving home to Germany this Friday. Thanks, Iain. By the way - I forgot to mention she has worked for this employer for 19 fault free years to the date of suspension!!! She has only missed a shift four or five times for any reason in this whole period. She is mid 40's now. She is an old people care assistant and worked nights full time. I want to go to tribunal over this. Can my sister give written consent to the employer that I can speak on her behalf to him about it? Thanks again for ANY help as soon as possible.
  4. Hi - I need advice regarding any rights I may have; following DWP decision to cease my Income Support Payments? Received DWP letter this morning, advising me that as from 08/05/2013 they cannot pay me - for failing to return A2, sent to me on 26/04/2013. I contacted them immediately, explaining that I had in fact completed and returned the A2 form to them on Monday 6 May 2013. On checking, they advised me that it had not been received by them and were going to issue a duplicate A2 to me via post. I queried the fact that they had mad a decision to stop my Income Support Payments, with effect from 08/05/13 (2 weeks ago); as I am paid fortnightly; I had been due a payment tomorrow which I had been relying on and asked how the hardship this will cause me can be dealt with? The lady said she would get a BA to contact me from the section, which would be between 1pm today, up to 1pm tomorrow? I expect call will be tomorrow, but wanted to ensure I ask the forum how I might go about getting my payments back on track, pending their receipt of a dupliate A2 form from me? It just seems ridiculous to take such action, retrospectively - causing extreme hardship unnecessarily. Why can they not threaten to stop such benefits, if information not received by X-date, allowing you a bit of time to liaise with them and ensure info reaches them within set timescale. As I am paid fortnightly; it is really messing up all my accounts/outgoing payments, council tax, shopping etc. I am also considering they will likely mess up my housing benefit payments now also!!! Its ridiculous!!! All this mayhem and hardship this drastic action will now cause for me and my family, when a simple reminder would have got things sorted out without so much chaos. Any advice anybody can offer me, so I can probe the DM calling me tomorrow with a view to getting my payments reinstated until they receive the duplicate sending of A2 - recorded delivery? Please Please any advice - would be very much appreciated. The next fortnight going to be a nightmare without IS payments in progress and esp no advance warning, to prepare me?   5. Was in Court earlier this month, facing a second eviction date. N244 submitted, and the eviction was suspended. I've managed to get the lender to extend the term of the mortgage. It's reduced the CMI by £150 so that is going at the arrears as well now. The arrears were rather small compared to some at £2100, they are now £1800. By Christmas I should have them cleared. Can I then get the suspended order discharged? I don't like the way they can just get an eviction date whenever they feel like it. What if I'm on holiday? Ill? And don't have time to react to it. Also, is it possible to claim back some of the fees on the mortgage? I have read some confliction advice regarding this.
  6. My HB was suspended on 15th April due to a change of circumstance of partner moving in and making a joint claim for ESA. A decision cannot be made on my ESA until I have attended an ATOS medical assessment on 31st May I have not received any HB since 25th March and my landlord is now chasing me for eight weeks rent which is understandable. I have been to Shelter about this and my landlord has given me more time to pay luckily. I have also wrote to my local council asking them to pay my benefit based on the only income I have which is Child Benefit and Child Tax Credits. Today I checked my benefits online which I can do with my local council and my account is saying that the next payment is due on 17th June which will be 12 weeks benefit. Can HB only be suspended for 12 weeks and then a payment is released? Shelter has even telephoned my council to make a payment and they still haven't I have also read on here that if I email the CEO of my council, the problem will be resolved much quicker. Any help would be much appreciated.
  7. hi i am new to the CAG, but would like some advice please. we currently have a suspended mortage eviction order. we have had this for 3 years. our arrears are £3300. we have to pay back our monthly mortgage payment of £495 plus £75 towards the arears. we are not behind with our payments until this month. we have only been able to pay £300 this month so we still owe £273. we have not been issued with a default notice yet but we will be. my question is will the default be for the total arears or for the £273, which i can pay this thursday. our building society is Chelsea and they will not enter into any negotiations. i know this through previous experience. i am worried sick about this as we have kids and i do not want to lose my home. any advice asap would be greatly appreciated.
  8. Hello, I am hoping that someone can advise me on what to expect at the hearing that I am to attend. We have arrears of £2600 on our (only) mortgage, which is with GE Money. These have built up over the last few years due to a decrease in availability of work. (Self employed in construction industry). I have always had a payment arrangement for the arrears. However, because our income is based upon finishing a job or a builder paying us, our pay dates are never consistent. If the mortgage payment is due on the 28th and we get paid on the 30th (And pay the mortgage) the payment arrangement is then considered broken. Even though our statement shows that a payment has been made each calender month or appox every 6 weeks. The payment plans have always been for an additional £170 per month, which I argued was too much for us. The main amount of arrears related to non payment of the mortgage over 3 months in winter when there was no work due to a cancelled job plus emergency repairs to our roof that was badly leaking due to old age. GE Money are saying that we have broken 27 payment arrangements with them! They still have had a regular payment. They were going for possession but again have agreed to a payment plan of normal payment £648.00 plus £50.00 for arrears, an amount that we can manage just from my wage. So now they are going for suspended possession. Apart from a letter from the court and solicitors confirming the date. (Postponed once already as the solicitors had not had time to do the paperwork). I have had no other paperwork. Should I have received paperwork outlining the solicitors/GE money's argument? What do I need to prepare? Can I stop this? I sought advice from a solicitors but am not entitled to legal aid. Can someone help me please?
  9. Can somebody please point me in the right direction? We have two accounts with HSBC which we got into arrears with, when the business went into administration in June 2009. Various letters and correspondence transpired until we ended up in the following situation. 28.09.11 HM Courts & Tribunals Service, ****** County Court Order for possession (Mortgaged Premise) (suspended) On the 26.09.11 at ***** County Court This order has been made on discretionary grounds and the court orders that 1) The defendant give the claimant possession of ***** on or before 24.10.11 2) This order is not to be enforced so long as the defendant pays the claimant the unpaid installments under the mortgage of ****, by the payments set out below in addition to the current installments under the mortgage. 3) Payment required £534.00 per month, the first installment to be paid on or before 01.10.11 07.10.11 Letter from Shoosmiths acting on behalf of HSBC, at the hearing on 26.09.11 the Judge granted an order for possession suspended on payments of your monthly installment plus £534.00 per month towards the arrears. According to Mortgage A, HomeOwner Loan the balance outstanding @ 31.01.13 is £36,959.51, based on your original offer document the remaining term of your loan is 7 years and 3 months. Which would mean 87 payments of £424.83; I am currently paying £685.01 per month (Mortgage plus arrears) According to Mortgage B, HomeOwner Loan the balance outstanding @ 19.03.13 is £4,166.45, based on your original offer document the remaining term of your loan is 7 months. Which would mean 7 payments of £595.20, I am currently paying £700.47 per month (Mortgage plus arrears), I am not too bothered about this one, as that would see me paying that off a month earlier. Because I am ahead of the repayments based on the terms for each loan, does that mean I am no longer in arrears, I must admit I am not sure what the arrears figure finally was, but based on what I have said would have hoped so, would it be best to write to HSBC and ask them for clarification. We have paid the Mortgages plus arrears without fail since October 2011, I just need to know what I can do now to remove the threat of the suspended possession order and get back to what I should be paying, based on the remaining terms of the loans, do I go back to the solicitors Shoosmiths, HSBC, The Court or all of them. If there are any questions then please ask, I have tried to keep it brief, but with as much information as possible, thanks for reading.
  10. Hi Im in need of some serious help, I have a Mortgage in arrears with kensington mortgages to the tune of 17000 and got taken to court by them in april 2012. I was given a suspended court order and told to pay my contractual payments of £890 plus an extra £500 to cover the arrears. since then I have been having serious problems with keeping employed and since then have defaulted on the suspended order payments to the tune of £5500 I have had to take in lodgers to help me pay the bills in the house, I have contacted kensington and kept them aware of my circumstances with employment and have been doing my best to stick to at least the contractual payments since then, in November 2012 my mother passed away in an accident abroad and I had to go away abroad to sort things out with the rest of my family and I returned back to the UK on 3rd december, whilst being away I missed one payment on the agreed payment of the arears so since then I have been trying to get kensington to help me get back on track by re setting back up the agreement to whta it was originally £800 plus £500, this they have turned down once just a few weeks ago, I appealed to them again asking that they look into it again as I had lost a lodger so my circumstances had changed and I had taken in another lodger to help me with the mortgage I sent them proof of this along witha covering letter detailing my circumstances and this morning I recieved a letter from kensington saying they have turned down my proposal to pay an extra £500 again. Speaking with someone in litigation she has told me that unless kensington recieve the £5500 in arrears since the suspended order from last april they will push for an eviction warrant, this means that even if I was to give them the £5500 pounds they could still turn down my proposal and push for eviction? someone please help is there anything I can do, or am i doomed to lose my home?
  11. Hi, would just like to say i would be greatful for everyones views, opinions and advice. This is quite a long story and has even left me confused at the best of times so please ask if you have any questions. My job role is hotel receptionist. I have been accused of checking in guests into our hotel and not taking payment for the room. I was told these guests have now walked out and that I would have to pay £100+ for the room. In an informal meeting with my manager I told her I didn’t check the guests in but I cut the key accidentally and that I put the key in a pre arrival folder because I thought it belonged to a group arriving later that day because of how the booking was made. I explained that the way the booking was made it looked identical to the other group bookings. My manager told me she didn’t believe me, I was upset by this. It turned into an argument and she said I was contradicting her. Then said I would have to pay £100+ or face a disciplinary. I thought this wasn’t fair as I didn’t check them in. So I stormed out saying I quit and then drove of around the corner and sat for a bit. She left a voicemail on my phone. I rang her back where we had another argument down the phone about it. She said I couldn’t have thought it was a group and the booking was made correctly. She gave me half an hour to cool down before coming back. I came back, started work as normal as we were busy. I then went to her office and said I’m sorry for walking out, she said its fine and then I carried on my shift as normal. The next day I received an email that had been chained to the whole reception team saying that I had checked in a room with no payment and that people did not spot it sooner. Now I and a few other colleagues would have to pay £100+. I thought this email was unfair as I said didn’t check in the guest with no payment I just cut the key. I felt the email singled me out a number of times and knew colleagues would now be asking what happened. After the argument we had the day before I didn’t want to go into to work but I knew it was a busy day and it was also the last shift I was working before 2 weeks annual leave. So I went to work, explained myself to a few people that I didn’t check in the guests as sent in the email. So this is where things get bad for me. Towards the end of my shift we had people who had used our car park because of a local event come to pay. They paid by credit card. I decided to post this money to the room instead of car parking. I honestly thought nothing of it as all the money was going to the company. I thought now there would be a smaller amount for everyone to pay or we could rebate the rest now. I received a voice mail on my phone the next morning, I rang back and my manager asked what had happened with the money. I said I posted the car park money there. She said she wants me to come in the next morning to have a meeting with her and hr. This got me scared as I have never been asked to have a meeting with hr before. So the next day I came in, I was told they wanted to find out has happened. The person from hr would take notes while my manager asks the questions. I was asked to give my version of events for what happened during our informal meeting and why I posted the car park money to the room. I explained my side then my manager showed me 2 cctv images saying that they were the guest in the room that walked out and it showed me checking them in. She then also said that the key had been used minutes after I checked them in so I couldn’t have thought the room was for a group. I apologized if this was the case but I honestly could not recall checking in a room with no payment. With this being said the meeting was over, I was asked to sign the notes hr took, was told a further investigation would continue and to enjoy my holiday. After leaving the meeting I could have swore that I had seen the guest in the picture the last night I was working which would have been 2 days after they apparently walked out. I then tried to remember checking the guests in cctv image in, and I remembered them asking to be put on a specific floor. So I thought that could definitely not be them. I was told further investigation would be carried out and thought not much more about it on my annual leave. I was due to start work soon so I phoned a colleague to find out my hours on the rota. I was told there were no hours for me the next week. This got me scared. So I sent an email to my manager before giving her a call. She said she had me down starting next Monday and that there was a error on the rota. She said I should have been sent a letter by hr. No. She told me to give hr a call the next day as I first had to have a meeting before I start back. The next day I get an email from hr saying that they sent the letter to wrong address and they would re send it. They also attached the letter to the email. To my shock it said I have been suspended for financial irregularities while an investigation takes place and a hearing will take place the following Monday. They said I have checked in a guest without payment and then used peoples credit cards to get rid of the outstanding balance. They sent me a copy of cctv images, time I cut the key, time key was used and our grievance and disciplinary procedures. What I’d like everyone’s opinion on are a few things. On my letter and on our disciplinary policy it says that suspension is not an act of discipline. I think getting suspended while on annual leave is a form of discipline. What do you think? Also in the disciplinary procedure it says the investigation will be carried out in a fair and consistent way at all times. I don’t think it is fair that all the evidence against me has been collected and handed by my manager and I believe not once looked at independently. For a start, I’ve been given a sheet that states the time I cut the key was lets say… 15.59. The two camera images used for evidence shows me at 15.44 and 15:48. So looking at the earliest image shows a 15min time gap. I know it would not take me 15 mins to check in a guest let alone check in a guest and not take payment. Also in the last image it actually even looks like I’m handing them the key to their room at 15:48. So this has definitely not been looked at correctly. Also during the investigation meeting I was told that the key I had cut was used straight after checking in the people on cctv by my manager. In the letter they said they are sending me a door lock report of when the card key was used, instead I’ve just got another sheet printed in a different way showing what time I cut the key, 15:59. Surely nobody properly investigating could believe that I can cut a key one second and within a millisecond they can go to the lift walk along the corridor and use the key to enter the room. This has led me to believe for the first time that nobody was in the room, as even from the start I was shown no proof I just accepted what my manager said. Also I don’t believe the cctv images has been shown to anybody else who could have been a witness. There are two other colleagues on the cctv who might have been able to recognize them. Do you think this has been carried out fairly or do you think my manager is just annoyed that we had an argument and I refused to pay any money. Thank you.
  12. Hello. I work for a retailers online delivery service. We have a shop within the warehouse which we use to sell products which we can no longer send to customers to staff at a reduced rate. The system we use is that we reduce an item by 50% and if it does not sell we then reduce it to 75% off. So I was recently working on the shop. And I put an item through the till for myself (Company policy states that I should not have done that.) Where the story takes an ugly turn though is that the item had been on sale at 50% and had not sold. Instead of putting a new pricing label on with 75% I instead reduced it manually at the till. I was put on suspension while the matter is investigated. However I was able to show that I was not the first person to buy the item at that price, and the investigating manager in fact confirmed this. However I am still on suspension and they have not been able to give me any clue why it's taking so long. The worry I have is that management may try and argue that I should not have reduced the item by the amount I did to begin with. And although I was simply following what my manager had asked me to do (reduce everything to 75%) as this is a brand new section at less than 2 weeks old. And we don't really have any of these procedures written down, It would really come down to my word against theirs. When I last spoke to the investigating manager they told me it would be at least another week until I heard anything, this will bring the investigation up to 2 weeks. I've already admitted that I served myself and shouldn't have. But have also shown that I wasn't doing anything to exploit the business. I'm hoping that people on this site may be able to offer some guidance and advice. I don't feel that the mistake I made would warrant dismissal, but can't help that feel that the only reason the investigation would take so long is that they're trying to build a case for it. I really love my job and have done a lot for the place. But I find myself considering handing in my notice to avoid having an accusation of theft on my record. If anyone would like some more details please ask. Thanks very much.
  13. Hi, I apologize in advance but this is going to get long winded... I have just returned from an eviction hearing and I could really do with some advice on how to handle some of this. It was a rushed application because I was away from home for three weeks and the warrant was waiting on the door when I got back for the 1st of March. I submitted an N244 yesterday and had a hearing today and the judge suspended it for the time being as there are quite a few things about to happen and hopefully the loan will be paid off sooner rather than later. I was instructed to make a payment by tomorrow towards some of the arrears and I will do that. Ok here is where I need help. I think I submitted completely the wrong defense but the judge ignored it and pulled up a few things. I was told that the mortgage was a second mortgage, and was bound by the Consumer Credit act (?) and the terms were completely different to the first morgage which is governed by MCOB They are claiming that I have to pay the £2500 arrears on the loan AND the £9500 worth of charges that have been added to the account. The judge stated to the solicitor that the charges were excessive and should be looked at by the company. He also said that it should be addressed by the court and that he was suspending the eviction if I can pay back the £2500 owed by the 15th of April. I have all ready paid off £500 towards this figure. Now my question. I really didn't understand what the difference between the two types of mortgage are, I thought that they were governed by the same body. But I have been assureed that its completely different as the mortgage is governed by CCa (?) think this is right. If the mortgage is goverened by a different body does this mean that the charges are unfair and I should try to clam them back and how do I do that... and can somebody please explain the difference between the two kinds of mortgage. thanks in advance Lynne
  14. In 1993, our lender was granted a possession order which was suspended as we came to an arrangement with them. Recently, our lender became very aggressive and applied to the court for permission to enforce the order which they were granted by a judge who refused to hear our arguments for it not to be granted.   15. My daughter has been accused of stealing the days takings are the club she works in. They say she was fiddling with her sleeve on the CCTV and they cant see her actually put the money in the safe, but saw her go to it. She has a meeting on Weds and they say she has to give them a satisfactory explanation of what happened to the money!!! They have also told her who she bring and thats another young girl and cant take the older guy and they have told her not to discuss it with him. Her grandad is a retired union rep, is he allowed to go with her and also what should she be asking and doing, nothing like this has ever happened to any of us before so no idea what to do
  16. I've been working for my company for almost 4 months and my probationary period is for 6 months. I know I have been doing a good job as the Marketing Manager as I've managed to increase the Facebook likes from 4000 to 9000 in the time I've been there, by merging the Facebook profile with the page which ultimately attracted more visitors. Our annual show managed to sell more tickets than it has in past years with less performances. I've managed to build two partnerships with other local companies where we will be advertising them and they will advertise us free of charge. I've also paid out of my own money for hotels and taxis if I have worked late and I've paid for things such as nibbles for one of our press nights and the contents of 7 goody-bags that we gave to prize winners of a recent competition we ran. I work late when required and turn up early too. We also had a fatality recently and I was the one who dealt with the press. The company were very appreciative of my help. I was called in to the office yesterday after a complaint had been made following a post I put on my Twitter. My Marketing Officer and I were messing around in the office and took a photo of a teddy bear staring at a topless models on the computer. The complaint was sent to head office by a lady who had been shown it by her daughter. The thing is, I didn't know that there was a upside down business card on the table with the company logo clear as anything when taking the photo. I realised minutes after posting the photo online and removed it straight-away. This was over a month ago and someone has now reported it to my manager. I have reasons to believe that whoever it was that sent the letter was actually someone who I know. For a start, in the letter they mentioned that I worked in Marketing, and who would honestly go out of their way to destroy someone's career that they don't even know? The email they sent to Head Office was quite long and it just seems as though it may of been someone being vindictive who I actually know. They included the photo that I had posted. I was suspended on Thursday and will be having a formal meeting on Monday with my manager to discuss. It's possible I might loose my job. I should of known better before posting the photo and it was just unfortunate that someone found it in the short time it was visible to the public domain. Do you think I will loose my job? How can I fight to keep it? My manager seemed sorry that he had to suspend me as he knows I am a hard worker and he knows I've been doing a good job. The company are furious that I had used company property to get the model's photo up on Google, and that their logo was shown in the image. Also as a manager I should be setting an example to my Marketing Officer. I really don't want to loose my job as I know I've been working so hard. The other day I worked 15 hours and I come in on weekends when required. What can I do?
  17. sorry in advance as this may be a little bit long winded. my face no longer fits with tptb where i have been employed for over 2 years and so they want me out,there has been many employees before me that have been made to hand their notice in instead of being sacked.today i had a disciplinary hearing where my answers were not even listened to and instead of getting a final written warning i got suspended untill wednesday. at my first disciplinary metting for not following company procedure for paperwork i was given a written warning,this was sometime in november,however at the hearing i brought up a lot things this compnay partakes in which is illegal,eg,not paying overtime when you have been issued with more than the 8 hours i'm contracted for,making us answer work phones out of hours with no compensation,taking money for damages without my consent leaving my weeks pay below the national minimum wage. this was conveniently left out of the official notes when these were handed to me with the written warning so i declined to sign the notes or warning untill the notes were ammended to include everything that was said as i know that once i sign, it means it was a true and accurate record of what was said at the hearing.hr got back to me and we went through everything,i got some things added on but basically came to a stalemate and i have not received any ammended notes or a written warning to sign since. where do i stand with this?is it on record?is it still gonna count toward a final written? fast forward 2 months and i have another hearing for not following procedure,i made a genuine mistake this time and apologised,but this was not a good enough answer,i have to pay for my mistake out of my wages and i won't be able to recoup the money,so now my employer has caused me a loss.i tried to put my point accross but this wasn't good enough so ha asked me to leave the room. i see he tries to ring someone then my manager goes into the room and comes back out then he asks me to come back in then tells me i'm suspended untill wednesday,on my letter for this disciplinary it says that i may get up to final written warning not suspension so i assume that they hope i hand my notice in to make things easier for themselves which is going to be far from the case if i get sacked. also before christmas,apparently i walked mud onto someones carpets which wasn't the case,and i was to be charged for someone to go out to clean the carpets,but i had to go back there and took pictures of the carpets which weren't dirty at all and these are dated before the company has sent someone out to clean the carpets.i have also suffered racist comments by emails which i have kept e.g sheep shagger and just about any other sheep joke out there and have the docket to prove they took money out of my wages without my consent which took me to below minimum wage,so if i do get sacked i will be going straight to the cab. thanks for reading,any help will be much appreciated.

My HB has been suspeneded i rang them up to find out why and they told me its because they want an address from my ex partner, how the hell am i ment to get his address when we don't even speak to each other anymore and if we did he would not tell me anyway!!! is there anything i can do?? i am getting income support every two weeks and i am already behind on my rent, i have had enough of all this what do they expect me to do!!!   19. Hi, i was appealling against a final written warning and the allegatiions on that were astounding.story below.. My x boss instigated alot of psycological bullying towards me, detremental remarks about my gender,( im a female supervisor in a male dominating enviroment,) and that caused me a great deal of stress and mental depression, not to mention the bullying i was receiving from some of my work colleaques too...i was up at an investigation meeting with him, which made me feel really uncomfortable as i did not like bieng alone with him at any time..it was an awful situation to be in..i was so stressed out that my mind just was not 100%. i signed his allegations against me, not really knowing what i was doing..until i received them through the post..i broke down into several bits, how dare he write that about me, he instigated the lot..i appealled against his allegations, then went to an appeal meeting with my statement against him. i was told there that they just wanted to put all this behind me, put it to bed, but could they have a medical report to understand my mental state between certain dates..i obliged. it took along time to come through, to which i am still waiting on the outcome to that too... anyway, i was back at my job because i appealled. we got a new stand in manager end of october last year, he was ok, until he got talking to the works bully..then everything went down hill for me after that...i now find myself suspended on full pay, and have been since november 26th 2012...how long does a suspension take?

Hi all I just need a bit of advice. 2 years ago I got behind with our car loan repayments, we went through a bad patch husband was nearly killed in a car accident & our son has a very serious heart condition. However upon attending court the the judge suspended the repossession on the basis we paid xxx amount each month until the balance was cleared. Now our problem, our son recently had to go into hospital for a surgical procedure on his heart, this resulted in me taking a considerable amount of time off from work. Because of the lost income we have got behind by 2 months on our arrangement. My question is does the lender have to return to the court again to enforce the possession order, or can they just come and collect the vehicle? As my understanding is they have to return to court to enforce and a court bailiff carries out the repossession, which gives me time to suspend the possession again, is this correct? To be fair we have in two years reduced the balance by more than half from £9000 to under £4000, so our intentions are to clear the balance. All we are asking for is the two missed months just be added onto the end, is that an unreasonable request? And how would that argument prop up in court as last time the judge did not want to repossess as the vehicle is registered disabled.

Hi can anybody help with some advice, we have a suspended possession order on our mortgage & we are currently paying £300 a month on top of our mortgage but we are struggling to meet this amount, we were wondering if we could apply to the court to have this amount reduced as spoke to our mortgage company & they're just threatening to take possession of the property, which obviously we would like to avoid. any advice would be greatly appreciated as its making us both ill with stress. thanks
  22. Hello, I booked 2 return tickets on JetLink Express 2 weeks ago with Lastminute.com. A few days ago they suspended operations and cancelled all flights. LastMinute rang me and said that they have to cancel the flight and APPLY for a refund however there is no guarantee that they will get my money back. The advised that I contact my travel insurance I paid with my Amex, am I right to think that I am covered for this flight cancellation? Please advise Akhil

I cant find this anywhere sorry... in Feb of 2011 we recieved a suspended repossion order.. the repayment was difficult to keep up with... we have since been back to court 2x with new judgements... my question is.. we have kept up with the latest and the Mortgage is through Santander and now we are getting letters from their solicitors HL Interactive referring to original order. We understood that because we went back to court the most recent judgement is what we have been following and according to that we are up to date.. can anyone advise please???? ThNK YOU
  24. Please can you help. I noticed 4 weeks ago that my housing benefit, which I have been receiving for 6 months, had not been paid. I called the council who told me on the telephone that the day before my call they had suspended my housing benefit. I asked them why and they would not tell me but told me a letter had gone out to me, this failed to arrive and had to ask for a copy of this letter at the council offices, some 12 days later, and noted that it had not been dated. After numerous telephone calls asking for why it's been suspended, and being told that they can not tell me, they now today have said that I am to be invited to a IUC with their fraud team, again when I asked why and why is housing benefit suspended, and asked on what grounds, they have refused. They simply say I have to wait for a letter, which based on their last sending won't arrive to me. I have asked if I can go to the council office for a copy of this letter, they have said no, to wait on post. As you can appreciate I am most concerned at now I am 6 weeks in arrears with my private landlord rent, am not getting any answers and after being told to ask for their reasons to suspend and their reasons for interview, I am being blocked and told they can't tell me that but will at interview. I am in receipt of JSA for same period and DWP tell me they have no issue to my benefit, no flags have been raised to their fraud team, via atlas and they also have asked the council for answers, but have been told that it's a council matter not DWP. What can i do as I need some help as I am completely in the dark?? And I'm doing the panic thing, which effects my health, that does not need much help there as for some time JCP have said I should go onto ESA but i want to go to work, so have remained on JSA.
