  1. Hi all, I've just recently bought a used Focus RS 09 plate for £19,500 from a ford dealership around 4 weeks ago. I requested that an MOT be performed before I picked up the car, which it was, no issues were found. After a week and a half of driving it I get a vibration coming through the pedals, after taking it back to the dealership and them having a look at it, they confirm that it has a bent driveshaft and a buckled alloy wheel. Now, surely this should have been detected in the MOT test previously? Do I have any grounds here to claim a refund on the car? I'm really not happy it was sold to me in this state, that and the fact it's been two weeks and the parts have still not arrived. Just to add, the dealership have said they will cover all costs for the parts and fitting etc as it is still under warranty, but this whole fiasco has made me lose all confidence in the dealership and it makes me worry what else they may have missed on the car. Cheers Dave
  2. Hello, I just need some insight into the email below txtloan have sent me. I mean I am not new to this and believe I should pay what I owe and that is that but sometimes other people can say things which open other doors. I took a loan from txtloan in march/april for £300 and set up a repayment plan when I couldn't pay in april for £20 per month for 6 months which ended on 30th november 2012. So my original loan was £300 (£351 w/interest), I have paid £120 which should leave £231 but the DCA is claiming my balance to be £540. And how can they still charge me interest even when on a repayment plan? The DCA txt loan has sent my balance to is Mackenzie Hall, who we all know are such awesome guys. ____________________________________________________ Thank you for your e-mail. Please note that we offer short-term 15 day loans only and currently your loan is on day 288 on our credit cycle. The process works as follows: Day 1 - you receive a loan of £300. A repayment reminder is sent before the loan term elapses. Day 16 - We collect the original amount you borrowed, £300 plus interest of £51 - £351 in total. However, if the funds are not available on Day 16, additional charges are added. Day 17 - a 1st reminder is sent and a £25 administration fee is added and interest accrues at the rate of £3.40 per day until your loan is repaid in full. The loan totals £379.40. Day 27 - a 2nd reminder is sent and a £25 administration fee is added and interest continues to accrue at the rate of £3.40 per day until your loan is repaid in full. The loan totals £438.40. Day 61 - the loan totals £554.00 and is passed to our Collection Partner. This incurs an additional £138.50 administration fee. The loan totals £692.50. We try to collect your outstanding debt on a regular basis. You may have to pay additional charges to the debt collection agency. Failure to repay a loan may damage your credit record and could result in legal action. We had a repayment plan arranged for you. We confirmed that for the first 6 months we accept reduced payments of £20.00 towards your outstanding balance of £554.00 and unless we hear from you the full remaining balance is expected on 31/12/12. Regrettably, no payment or correspondence was received until now, therefore, the loan followed original credit cycle as per the agreement which you have signed and was forwarded to our Debt Collection Partner on 14/01/13.
  3. Hi all This is my first post on here so I hope I have posted in the correct place. I purchased a website through a company called DPBUK Limited two days ago through a dropshipping website, I did research them first, the reviews weren't great, but I decided to go ahead thinking its a simple task what can go wrong. I have experience in creating online stores using Opencart and have a relitively good understanding of web design but I wanted the xml feed of products which I could only get by purchasing one of their websites. All was well initially, the site came up and I spent all night last night getting it sorted; the look of the website itself wasn't was I was used to, it looked like something from 2000, anyway, I accepted that this is what I had paid for, after all it had the product feed that I wanted so I was happy... Next there was a problem with the FTP access to upload files using FTP clients such as FileZilla, I contacted their support and this is when it all went pear shaped... I was told that the FTP access has been permanently disabled for all users, due to a breach of security via FTP in Russia... They did give me an option of booking a 2-hour slot within working hours where they would allow me access to upload files and folders to my website, I have never had this happen with any other web host before and I have used a few! I was advised that I could use the file manager in Cpanel which I knew anyway but you can only upload a file at a time which will take hours. I needed time to think about whether I needed to book a slot so I decided to have a look at my website and relax for a while... So I went to my website and it was gone - I received a 403 forbidden error, not looking good I contacted support to which I receive a reply implying I had deleted the files myself, I had spent hours getting it how I wanted it so why would I do that... There was alot of 'well you must have done this or that', as there was no FTP access, I would have had to log into the cPanel, go to file manager and click every single box on the server and click delete for the whole website to disappear. They have said as I caused it, which I clearly didn't as it was working fine just 10 mins before I contacted them regarding FTP access, they would re-install my website from scratch if I agree as a one-off. I no longer want to continue with this company and wish to cancel the order, so under the circumstances would I be legally entitled to cancel the contract for a full refund. I initially paid £79.99 for the website, £85 for 1 year hosting and £35 for a complete marketing guide, which I am happy to keep as that was my mistake! I would be looking for the years hosting and cost of the website to be refunded. Where would I stand under the Distance Selling Regulations 2000, could I reject the order? I am really unhappy as FTP access comes as standard with any web host and the option to add more FTP users is there in Cpanel but has been disabled so you can't log in, had I have been aware of this issue initially I would have reconsidered my options! And of course there is the issue I have with being made out to be lying, I am 100% certain I did not delete those pesky files! Couldn't I go in with the burden of proof as within 6 months but this clearly isnt a manufacturing defect? I have tried to explain the situation in the most unbiased way as the lady I contacted apart from assuming I had done something wrong was helpful. One last thing, I paid using PayPal. Any advice would be greatly appreciated!! Rory

  5. Not sure where i should b posting this but bear with me .. myself and my son have exactly the same names (yes vanity got the better of me) he is running up various debts using our name. I recently noticed a black mark on my credit file re Vodafone account (i've never had one) i remember at the time my son saying he was not going to pay this account since he lost his phone so him being the (life owes me everything type of person) stops paying it.. today in the post i noticed a letter for a wonga demand this also is my sons , so are debts with o2 , and god knows, what others he's never told the truth in his life. i'd kick him out but dont think it will stop the letters tumbling onto my doormat , so i'm wondering what i can do to distance myself with my sons debts. One thing i have learnt is never ever be vain enough to give your son your exact name.. regards Ian.....snr... lol.
  6. Hi, I am new to this site and I wanted some advice on how to go about an issue. I have just looked at some few threads and seen some similar situations. My wife and I leave in our flat and occasionally/rarely previous occupants letters do come to our address. I did speak to our Landlady regards to what to do with the letters of previous tenants and we were advised to bin them as they were probably junk letters. Recently we decided to open one of the letters as we wanted to be sure our address was not used by some other person as a couple of letters had come in for a particular name(If it was a previous tenant/occupant,I am not sure). The letter stated it was a distress warrant to visit and collect a sum of £395 from our address. We dont know how that may have come about as we do not have any knowldge of who the person is. I have read different threads/suggestions to show a form of ID with a council tax or utility bill when they arrive at our flat but some others have advised not to do so as my information may be taking and then the warrant may be sent in my name(is that possible?) or they may not listen to me but still want to collect the money or goods. What are our options? How would you suggest I go about this issue? I await your suggestions. Thanks
  7. Hi ,I am hoping someone has the answer for me to this. Me and hubby are currently going through the Income support/ESA transfer, and hubby has recieved a letter today for a medical next monday, and I am wanting to know if he does fail the medical can I claim jobseekers for myself, hubby and 2 kids?, as my hubby is too ill to work. I know he can appeal but we dont want all the worries of doing so, so if he does fail and I can claim jobseekers then I am more than happy with that
  8. Forgive me if i have posted this in the wrong thread - new to all this my problem is that my mum died in March 2013 and my dad and I went down to the local branch and informed this to them My mum had a loan and credit card debt - which she paid of every month with no problems - but when she died we told them there was no estate to cover this then on the 10th April we received a letter to state that because my dad had informed them of no estate - they were not going to pursue the debt - good news huh ?? Well fast forward to now - the bank has now changed their minds and now pursuing the loan because the say it was in joint names - but they knew that when they sent the letter on 10th April since last Tuesday we have been getting automated calls saying pay the debt and and we have had two letters saying the same Can they do this to us ?? Thanks in an advance
  9. went for a repossession hearing this morning - property is under offer and due to exchange within the month so I was quite relaxed in that the mortgage company solicitor suggested they go for a 56 day order. I spoke to the 11 year old solicitor sent to represent the solicitor and we agreed to agree on this. On going into court the judge was brilliant.... "I dont understand why you are bringing this action when the house is due to exchange in the next few weeks? Why would you want to saddle these people with a possession order that will make it difficult to get another mortgage...this is nonsense and I am adjourning for a month pending the exchange of this property.....good day!" Top man!! I did smile as the child spluttered and burbled about just in case it doesnt exchange and the judge said in the most condescending way possible...."well we'll come back and you can try again!"
  10. Went for atos medical on 5th April ( absolute farce!!).got a letter today 17th may telling me I failed.what I don't understand is the date the letter was sent is the 13th may.but the decision says from 25/04/13 I am not entitled to ESA yet I received a payment on the 25th April & 9th may.will I have to pay this back.thanks.

  12. We've been with Virgin (home phone) for many years (since they were NTL) - never had an issue with paying on time - always paid by Direct Debit. We had a voicemail message asking us to call 150 last week, but to be honest I thought it might be a sales call, so didn't phone back. On Tuesday my son said he hadn't been able to call me on my mobile phone. I tried and it was giving a discontinued tone, so I called to report it as a fault. I was told I would need to be put through to another department, who told me that mobile phone and international calls had been barred from my phone on 12th April due to the fact we had made £121 of calls last month which was unusually high. The bill had been received and wasn't due for payment until 26th April. They asked me if I'd like to be put through to another department as there were packages which could make my bills cheaper. The bill was high as my mother in law had been ill and we'd made quite a few calls to Australia and Spain. It was by no means the highest bill we've had from Virgin media and, as I've said, we have an exemplary payment record. I said I didn't want to speak to another department and wanted the block removed. The following morning the bar was still in place so I phoned again to complain. I was told it would take 24 hours to remove and so I asked to speak to a manager. My son has learning difficulties and needs to be able to phone me from home if there is a problem. I was told he would call back within the hour. Just over an hour later the manager called and asked whether the bar had been removed. I didn't know as hadn't tried so he said he would hang up and call back in 15 mins. 15 mins later the bar still hadn't been removed - I had to go to work so left the house. No message was left, but the bar had been removed when I got home. I'm pretty sure there is nothing in their terms and conditions to say they can unilaterally bar my account without telling me about it. If there had been an emergency I would've been stuck without being able to call mobiles or overseas. I'm going to switch to BT without a doubt. Meanwhile I've made a formal complaint which has yet to be acknowledged.
  13. Hi, Fos have been handling my claims as my health is none to good at the moment. Have had a small success with Santander with a BHS store card £700 Recently had a response from Barclaycard with an offer which looks pretty much spot on £11345 So they've said that I should receive payment in the next 8 weeks But, just how accurate is that 8 weeks? Whoops....almost forgot to say that both were for PPI claims Lola xx Obviously a donation to CAB will be following
  14. Hi everyone, Hope someone can help me? I had a letter put through my door for a bailiff removal of goods for unpaid council tax I have not let the bailiff in so he has no list of my goods, I telephoned the council to ask if the would take the debt back but they said they would not and I'll have to talk to the bailiff so I telephoned him and asked if I could set up a payment plan he told me no and wants the money £549.26, i have told him I am single, on income support and have a six week old baby and all he said is that I'll give you two weeks to get the money. Really don't know what to do! I am really upset about all this
  15. Hello, I had car finance back in 2002 (apprx). I was with Welcome finance and was paying monthly. We fell on hard times and i could no longer afford the amount I was paying. So Welcome got me to sign a new agreement that was over a longer term and a less monthly amount. I've stopped paying it now but it went on for years before it was settled. I no longer have the contract, so I cant see the details of the accounts. I have no idea how to go about claiming ppi? I've had a good look round but I'm just getting more confused. Do I just call up Welcome and ask for my account details? Is there a link for a step by step guide to claiming back? I've had a look round but cant find it. Any help would be appreiated.
  16. Hi, I am a new user and could do with some advice please. My daughters phone bill has just come in and it is full of premium number charges which I know that she has not been requesting, I contacted our service provider who gave me the number to call to try and sort it out.... The number related to a company called Zamano, which when I looked up on the internet, there were a lot of complaints saying that many people had found excessive charges added to their bill without having given permission. My daughter is only 16 and is really upset about these charges which I have to say are extremely large. I did phone the company and they just fobbed me off and told me to contact my service provider which I already had done before contacting Zamano which is why I had their number. Has anyone had any experience of this company before and if so any suggestions as to how to get at least some of the money back? Thankyou J
  17. Hi there, My rent is due the 21st of every month, following my previous forum posts I have been issued an S21(4)(a) now on the 18/9/2012 and it ends next month on the 18/11/2012. I have just read that the dates can only be for one day before the rent or is this not true? And is the time frame correct by the landlord? I owed three months rent and a fourth month on the 21st which will all be paid and correct on the 21st of this month (the previous months are all paid off) and I wish to continue staying on the property. I will keep paying my rent as per usual and once the notice runs out he can then get a court warrant but if I am all paid up-to-date what will happen, will I still be requested to leave the property as I doubt he will have a sensible conversation with me to continue rental agreement. I understand he has 12 months to get the warrant also or have I read wrong? (the contract is periodic that the one?). Thanks.
  18. Hello all, I have 2 items from Brighthouse i have paid more than a 3rd on one item but have paid less than that on the 2nd item.I recently lost my job and have been unable to pay for the past 4 weeks.I am now in £200 in areas,Brighthouse has said that they are going to come to collect the 2nd item and put it on hold or something and that i can keep the item i have payed more than a 3rd on and continue with my weekly payments.I called them back and told them that i can afford to pay £15 a week until i get a new job and am able to pay in full. The woman on the phone said that they cannot accept that offer and will still be coming to collect,i told her i will not be allowing entry to my property. I do plan to pay for my items and do not plan to stop paying altogether. Have i done the right thing and can someone please advise me what i should do next as i am not very clued up on all this stuff?
  19. Hi All, Wasn't quite sure where to post so though a general area would suit. I am after some advice as to the best way to approach a lot of debts I have. I have for the last 2 1/2 years been completing a DMP via CCCS but was wondering if there was a better way. The payment I make them is jsut about manageable but leaves nothing left over and is still over 7 years off completion What I was wondering was if I stopped this entirely and had a go at getting them written off. I done this successfully around 8 years ago with some old statute barred debts from when I was a teenager but not really sure if it is feasible for debts I have been paying regularly for the last 5 years, albeit at reduced payment for the last 2 1/2. I dont mind putting the effort in if I stand a realistic chance of getting some of them removed but I would rather avoid spending time on them if there is little or no chance. Any advice gratefully received. Tim
  20. My eldest grand daughter, Ruth, has got a place at dancing college in London. Dancing is all she has wanted to do, ever since she was a very little girl. So now she can live her dream, well done Ruth, I am so happy for her and the proudest grandma in the world!!:lol:
  21. hi i won my appeal but i have some questions what is regulation 35? how long does it takle for the esa appeal to update
  22. Hi folks, lurked and read on here before, helped me somewhat so thanks. I have a situation going on whereby 2 small payday loans and a retail loan ended up with me having difficulties paying due to risking a lot on self employment on the promise of work which turned out to be a lie as to how much, loans occured towards the end of quitting self employed when all money had evaporated and was desperately trying to make ends meet. I tried everything to discuss and debate with the companies in question once Id successfully halted the sums growing much bigger or having ongoing costs. None of them were reasonable and all 3 have eventually binned me into DCA's. Ive battled with the DCA's a bit putting up with the usual sewer tactics. Currently all of them have been issued cca and non harassment letters asking for proof and the whole 9 yards of owning the debts etc. All 3 requests stand at 18 days and counting totally unreplied (from recorded date of delivery), although the post and phones have gone quiet. All were delivered recorded and have date of delivery proof. The problem is 2 of the debts have defaults and continue to rack up late payment scores at experian. One debt is for virtually the original loan amount, 2 are double the original loan amount! Mackenzie Hall, Moorcroft and Mercantile Recovery are the companies. I can be more specific on each debt if required. Heres the questions : Am I right in thinking these companies supposedly bought the debts for peanuts compared to the stated value of the debts? Due to an error the cca requests were sent without the £1 payment, where do I stand? After 12 + 2 and 30 days can I then issue disputes on the defaults and sums and try to get the defaults removed? I realise trying to agree a settlement amount then paying off now would just get me shafted and likely defaults remaining, if I could get these buggers to communicate by post with a promise in writing and payed by a method they couldnt steal from and then settle, would I stand a chance of those defaults removing?
  23. Hi, I was at the wafarin clinic this morning while out the DWP left a message on my ansafone, saying it was them and it was a courtesy call, when I got back I was very tired, having been up all night Tuesday, so I went for a lay down, they must have called again and left another message, at the end of which she said "I'll write a letter", and she sounded really peed off, any ideas what this could be about please, she didn't sound very nice at all. thanks
  24. I am having some problems with benefits.. as follows: I was accused of been in a relationship and living with my friend last year by my brothers girlfriend, last month I was pulled into the local benefits office about this as I live with another friend and her boyfriend at the time, I explained to the Compliance Officer about my brothers girlfriend and how she is causing problems for the whole family and the Compliance Officer said don't worry this will go no further as it is usually someone with a grudge usually a family member that make these accusations... I spoke to my friend that I was accused of having a relation ship with and we came to the conclusion that it would be to both of our advantage if I moved in, I would have my own bedroom instead of sleeping on the settee as I have for the past 3 years of my other friends house, and theres a shower so I dont have to struggle getting into the bath as I have spondylosis and am currently on morphine to try to manage the pain. she the bedroom needs taking up before the bedroom tax hits and shes further out of pocket etc etc. Anyhow, the next week I was putting away some of my clothes in my new bedroom and there was a knock at the door, it was a old friend of mine that works for the fraud department of the benefits office posing as a meter man to read they utility meters, I let him in and we caught up as you do talking about when he had his heart attack whilst on holiday etc... he asked about my friend who was at work and made a suggestion that she was my partner, and I replied no shes a friend as she is my friend. and that I was just moving in. So four days after that the proper meter man came.. hmm entrapment and conflict of intrest springs to mind here. Any how I let everyone know that I have changed address council tax, benefits etc etc.. Then I get a letter and a form about severe disability change of address form.so I sent it back, and i was not paid the following week so I rang them they need this form back to process it.. a week further a snotty little **** at the benefits office was not so nice saying this needs looking into before we can give you your benefits agin.. why I have not done anything wrong my surcumstances have not changed just a change of address. well if you need money you can get a loan from he local benefits office.. and how am i supposed to get there? bus? can not walk to the top of the street as I am in to much pain. Anyhow as things stand now I have 3 weeks then I am homeless thanks to the idiots at the benefits office. I do not know what to do, they know I have mental issues and that I have suicidal tendencies. I think its about time I followed through with these thoughts as I dont see things getting better with these idiots. The way I see it is that I have paid enough into the system to get my money back as I was self employed, employing people, paying a lot of money into the system what gives them the right to treat people like this? I would like to see them prove that I am in a relationship with my friend as I am transsexual and basically shes not my type. so much for Innocent until proven guilty...
  25. Hi All I was wondering if anyone could help me out with a calculation please. I have had 2 ppi claims upheld with Barclays on two different loans, and was wondering what i might expect to receive from them. Loan 1 was taken out on the 06/01/1999 and the ppi was an upfront payment of £291 I must have then re-financed that loan as loan 2 starts on the 10/06/1999 and runs until the 5/09/2000 this was also an upfront ppi and the payment was for £800 So it appears i had ppi on top of existing ppi when i re-financed. Thanks for any help. Regards
