  1. Hi all, Don't go there but I have, again, got myself into a situation. Long and short I owe Uncle Buck £742.23. I emailed them over a week before it was due that due to devastating personal change in circumstances I cannot pay and I offered £40 a month. Very slow to respond to emails and was told, on the Wednesday that an I & E form would be sent via email. It turned up Friday, the day the loan was due to be paid (25th April). But they are asking for too much and seems very intrusive. The I & E form is very long with Excel tabs outlining every area of life! Here is the email: "Please complete the attached income and expenditure in full to enable us to determine what is a fair and reasonable repayment plan for you to repay your current outstanding debt. When you return your income and expenditure form you also need to provide 2 further proof documents: If your are in receipt of any benefits, a recent letter that confirms the type of benefit, the amount and how often you receive the payments and a complete bank statement dated within the last 3 months, showing receipt of your income and general expenses. If you are employed, wage slips to cover one month dated with the last 2 months and a complete bank statement dated within the last 3 months, showing receipt of your income and general expenses. Please ensure you return your completed income and expenditure and proof documents by the 29/04/2014. If you have any questions or need any other help, please call us on 01959 583979. We are available from 8am to 6pm Monday to Friday." I have major issues with sending any of this really. Can anyone tell me where I stand and the best way to progress? Thank you, Swanleyboy
  2. Hello, I posted on here a few years ago with regards to my husband's catalogue debt - which is now under control, we pay Lowell £5 a month for 2 accounts and they've not given us any hassle. We're saving to buy a house, and I know he's had a few defaults in the past so we did an in depth credit check and the only defaults showing as active were his Lowell ones which we're managing - which is fine. Fast forward a few months and we get some post from our old address regarding a Provident Loan thing that's been sold onto BCW group and they're demanding over £1000 - has anyone had any dealings with these guys? this debt is now showing on his credit file but a month or so ago it was showing as settled. I emailed them asking them to put the account on hold and tell me why it's suddenly become defaulted when it was 'settled' (even though he hasn't paid but all they said was that they bought the debt and if we've paid it we have to send proof. We're happy to come up with a payment plan but something tells me these guys are gonna be difficult. Can I sent them a CCA? If so, can someone direct me to the template cos we did one for Lowell but that was such a long time ago. Thanks.
  3. Hello I am at a complete loss and could really do with some advice please. Six weeks ago I ordered a bed from Littlewoods under the guarantee that it was delivered by a certain date, as we were moving home and due to medical reasons my husband needs a bed to sleep on (he can't sleep on the floor for example). The date came and the bed never arrived, after spending 3 hours on hold I was told that they had 'forgot to put it on the lorry' and would deliver the next day. The same thing happened again, they said they now couldn't deliver for a week - I said this is not acceptable and I cancelled the order because I needed to make alternative arrangements, so I did and purchased another bed. Fast forward six weeks, they only put the cancellation through 2.5 weeks ago, meaning I had to wait a further two weeks for the refund although I clearly stated I wanted the cancellation immediately, however nobody responded to any of my 15 emails and when I rung all I got was lies! Last week I sent a letter of complaint to their head office and customer excellence centre, saying that not only have I not had my refund, I have lost two days pay, had a phone bill with over £100 worth of Littlewoods calls and gone overdrawn - all I want is my refund and threatened to complain to Trading Standards. They got back to my letter the next day as it was sent special delivery promising refund on 02/06/2014. That date has come and gone, I have still had no refund, after calls to Littlewoods they refuse to help immediately saying they will ring me back (and I do kick up a fuss when they say this!!) and they don't, nobody is answering my emails and after I sent another special delivery complaint letter on Monday I still haven't heard from anyone! I have complained to the Citizens Advice consumer services and forwarded a copy of my letters to Trading Standards but these can take a while to get looked at. I really do not know what to do! Any help will be much appreciated, Thank you Laura
  4. Hi I have a debt dating back quite some time now for HBOS WHICH HAS BEEN PASSED TO LOWELL 03/09/2008 (Account opened date, according to Noddle Credit). It was a premium halifax account with only a £100 Interest FREE OVERDRAFT ON IT. I asked for a extension before i went away on holidays, they REPLIED FIRMLY NO. I had a good time on hols but spent a bit to much ££££ and when i got back i desperately needed some petrol to put in the car to get us back home! I Had only £10 Cash left on me so i thought i would try my Halifax card Just incase they might honor it as i was at asda and i have heard about some banks having agreements with larger shops that they will honour it if its a small transaction. RESULT! THEY HONOURED IT i purchased about £20s worth of fuel! Obviously a few days later i got a letter saying about the transaction and that it was outside my arranged overdraft and now unarranged as such and applied some fees (which back in 2008 was about £25 if u failed a payment, i know now the banks have changed there policies, i'm now with barclays and they charge £6 i think if a payment bounces, which is much more reasonable than £25!!! I hadnt heard anything about this debt for years, at the time i was living with my grandad and he has since passed away and i moved out obv, so maybe some delays in finding new address? but all these years, its abit long isnt it? lowell called me first about it around a year and a half ago, i said i was aware of my old account with halifax and that i owed £100 interest free overdraft and a little bit more for a transaction for £20 outside the overdraft and a reasonable amount of interest/charges. They then replied stating i owed £795!!!!!! i had to call them the other day to help a relative and it took them 55mins to answer the phone!!?? How they even exist as a modern day bank is beyond me!!!! SO THEY WANT £795!!! Ive done some googling and found that i can state to them i want to see proof of the debt, which i have done, infact ive done it 3-4 times over the last year and a half (they seem to cal every 6 months to chase it up!! In the case of this, its a current account, so we settled on account statements, which they said would take some to arrive from hbos! (over a year and a half ago) Although every few months they call me to ask whats happening and i have to tel them don't call me, call hbos, because i want to know whats happening too! So now ive filled you in and had a lil rant, the problem i need solving i suppose is this.... WHAT CAN I DO???!!? I'VE ASKED FOR PROOF OF DEBT, THEY REPLY STATING THEY ARE WAITING TO HEAR FROM HBOS! EVERY MONTH They mark my credit report with a default! IT JUST DRAGS ON! I want to resolve my poor credit history as quickly as possible and don't see why this shadow should be looming over me when i have even offered to pay them around about £180-200 for the £120 i borrowed!!! ALL HELP AND ADVICE IS GREATLY APPRECIATED!!!! THANK YOU!!!!
  5. Hello all, Wondered if anyone can help My dad took voluntary redundancy from the AA for which he received a severance package Just under 2 years later he was informed by the Tax Office that he had an outstanding tax bill for the time of £8500, he was obviously shocked by this Ultimately its his responsibility etc - although it was AA for issued it so not like my dad was trying it on - he is now self employed and earns much less than when he was in the AA - now a driving instructor - and so its difficult for him to pay it off He has made an offer to repay at £125 a month but that was rejected and he was informed that he would have to pay £1000 a month which there is no way he can accept as he would be penniless. At the moment they are threatening court and all the time it is gathering interest and I was just wondering if there was anything he can do with it? He owns his house but is obviously reluctant to sell it as although he would be able to pay it back from the proceeds there would not be a lot left other than for a house deposit on a rented accommodation. He also owns his car for work purposes ( HMRC told him on the phone to sell it ) but if he did that he would have no income Any ideas greatly appreciated as he is obviously worried about it and the prospect of it all going to court

  7. Hi all I wonder if someone can give me some advice please. My hustand is a sub contractor who works trough a company a bit like an agncy. All they did was pay him his wages. A few months ago they decided to put him on some training and they paid for it. My husband left this company 2 weeks ago because they wanted to cut his daily pay. My husband got paid today and turns out they have deducted £200 out of his wages to pay for the course they put him on. My husband wasnt told that if he left he would have to pay back the money for the course or did they inform him they would be deducting anymore out of his wages this month to pay for it they just took it. My question is, Can they do this without informing him and with out written notice they my husband would have to pay it back if ever he left? Thanks

  13. SEWAGE RUNNING ONTO JOISTS FOR NEARLY 12 MONTHS l had a shower room fitted under a council grant through an care organisation, from the onset wqe had problems, the tiles fell off the wall due to no prep work, this was redone, the shower ran water from the shower through the door on to the landing, so boards was fitted underneath now showing a rduige which as gone very springy. we just acceprted all the above but since our kitchen started to get condensation more and more but we didn't give a thought to any connection to the shower room, at the same time t5wo of the three of us suffered with severe coughs also the dog did, all with unknow causes. but suddenlty we noticed water marks on our wall by the stack pipe unit, having got the representaive who organised the grant from the council insisted it was just condensation, cutting a long story short after makin an hole in the ceiling it was clearly wet and cold, the person left and said he would see what could be done, after returning with an attitude owner of the company he agreed to have a look but if we was wrong we would have to pay, in between my son borrowed a Probe Camera and looked up the stack and saw no cap had been placed on the sewage pipe when the bath was took out, each time the toilet flushed it went on to the joists etc, the workamn looked at it and made out that he had dropped the cap but it had failed which sometime he said happend but he couldnt show us because he dropped it down the stack, when he went ouytside to his van he took his bag of rubbish which my wife went and looked and found the part he had sawn off which also showed that hge had no capping on, when asked he knew he had been rumbled, the joists in the exact area of the leak was badly discoloured black with some white on which l have been told is dry rot and could be in a larger area than the small area which he had covered. l have had so much stress over this and feel that the comnpany have devalued my property, l would like to sue the builder but not sure who my contract is with, would it be the council, the company or the orgamizer of the grant ? would be grateful for any advise thanks
  14. Hello, We purchased our house 1 year ago. It has a cesspit, which we never saw as a problem before purchasing. The previous owner has not had the cesspit emptied for 5 years - so our first job was to get it emptied, (we did ask him to empty it before as part of the purchase, but he declined). So we have the cesspit emptied - and had one of the wettest winters for a long time. The cesspit constantly had water in it. We then had a problem with the washing machine not draining 3 months after we moved it and looked in the drains and they were full, so had the cesspit emptied again, spoke to man who emptied it and he said it meant to have water in all the time for it to work. we accpeted this and stopped looking. The a month after that, i was clearing the garden and found another drain in the garden. This drain was never mentioned to us or to the surveyor. I opened it to find it was filled to brim. again we have the cesspit emptied. Few days later we look in the drain again and it had water in it. Had several different people out to look at it and have been told that the cesspit is a decongestant tank and should have mains power to it to clean/filter the water as we do not have a soak away, the water gets distributed around the garden. Problem is we have to empty the water out of the cesspit weekly or it overflows into the garden. We now how two choices - a new cesspit or to go on the main drainage. Is there anyway we can get some of the cost of this back from previous owner, solicitor or surveyor? We are so dissapointed. Thanks in advance
  15. Not all benefit payments, but some (JCP says 32,000 claimants affected) have failed to receive payments due today. These people are urged to contact the DWP urgently to arrange payments. Sorry I didn't see this story earlier.
  16. happened yesterday ive not been well for a couple of days so been avoiding going out but yesterday had to get the kids out of school as no one else could picked the kids up queing to get to the lights just as ive started moving again theres a car shoots out the junction on the right and tried to slam infront of me, had to nearly go up the pavement to avoid him, then to try to "get his own back" he started driving as close to my bumper as possible trying to watch him in the mirror wasnt paying that much attention to the road ahead, then brakelights caught my eye, not realising the other car was actually nearly a car length ahead i hit the brakes at which point the car behind hit me, he got out threated the wife with a fist, said he was going to "report me to the police for braking sharply" (doubt it), refused to give any details and basicly drove off now im not too annoyed about the details as despite there being little bits of his bumper in the road all he actually did was scrape some dirt off mine, not even scraped the paint so all in all theres some twits on the road, oh and if he tries to make up a story to get me in trouble im fine, ive got him pulling out and the fact the car in front braked on video (thank you dashboard cam) rant over
  17. Hi all I wonder if you can all help me, I was unsure where best to place this as it is related to several different lenders... In October 2007 I split up with a partner during the mess that followed I did not have the funds to pay any thing into my main lloyds account... So as of October 2007 nothing was payed into my main account in turn every thing defaulted. I in turn lost my job and moved away in 2010 I came back to the UK and recived some letters but have since not responded to any thing I was aware that there was a 6 year period to the debts coming of the credit files and made the decision to check noodle as of December 2013 to see where I stood and to see if I was at last going to be free again. Now these debts are not gone and some have quite long default dates I am aware that by accessing the report I will now get more letters but I wish to deal with them now as I have had enough of the letters.... As I said I am 100% that no money was paid to any of the debts since October 2007. The debts are now showing default dates as follows A credit card showing 13/5/2008 A credit card showing 28/3/2008 A personal loan showing 1/3/2008 A personal loan showing 13/02/2008 A personal loan showing 31/10/2008 ( this is a lloyds tsb overdraft if I remember right) Other accounts 14/01/2008 Other accounts 31/10/2008 ( lloyds tsb main account) Other accounts 29/10/2008 ( for some reason seems to be two accounts for lloyds tsb seems a double up to to me) I had some questions after reading the site and I wanted to confirm a few things. 1. It is from the date of last payment not the date of default that the account becomes statute barred.? 2. I should request from lloyds tsb ( the main debt being chased) the information they have on me as this would show the last date money was payed in to the account? 3. The lloyds tsb debts that show default all around the 31/10/2008 are a year after any thing was payed in to the account would this be unfair to place on th CRF after nothing was payed into the account since october 2008 and could I do any thing to reduce this default notice? 4. Should I send STB letters to the debt companys now or wait in till I have all the information back from lloyds e.t.c? Thanks for the help John
  18. I received a letter from Arrow global this morning Asking for £369.78. Further down the page it says: Original creditor Shop Direct Finance company Ltd Affinity Partner Kays Lifestyle. I have never heard of these companies and I have never had a catalogue or bought anything from one. I have no idea what this is about. It does say that if I think I have been sent the letter in error then to get in touch with Rossendales Collect Ltd. I am also worried that someone might have got goods in my name. What should I do?
  19. Brand new to this site, so please excuse me if I have posted in the wrong place. From the beginning, in March 2006 my partner was diagnosed with a terminal illness. I had outstanding with Lloyds bank a Personnel Loan of £18,000, a Credit Card with a balance of £13,000, and an overdraft of £470.00. I wrote to Lloyds to explain my circumstances and they agreed to accept reduced payments of £200.00 per month for a period of 6 months. In December of 2006 my partner sadly passed away, and with her my world. I was unable to work for a considerable time and I was living on SSP. Sometime in 2007, Lloyds contacted me and stated I had not kept to the arrangement so the arrangement was terminated. Various letters arrived from Lloyds over a period of time but I had more important things to worry about i.e.: my two boys, so the letters were ignored. I heard nothing about these debts until November of this year when out of the blue, a Statutory Demand arrived from a company called Lowells, demanding the £18,000 and an accompanying letter demanding the £470.00. The following day, another letter arrived from a company called Capquest demanding the £13,000. I have applied to my local Court to have the Statutory demand set aside, using the information I have obtained from this site and various legal publications. I have also sent CCA requests to the above companies, and also a SAR to Lloyds. The last payment I made to Lloyds was on the 29th January 2007, I can prove this via Bank statements. Are the above debts barred under the Limitations Act ? or should I start negotiating with the above companies? Any help/advice would be very much appreciated. Many Thanks.
  20. Hi all. I am in desperate need of some help & advice, so after spending some time trying to find info off the net have ended up at the CAG forum. my car insurance was due for renewal on the 23rd of this month & I received an email from the insurance company saying that they would automatically renew my insurance & that I didn't need to do anything & it would all be done for me. Well the renewal quote was completely ridiculous (even though I was apparently getting some sort of huge loyal customer discount) so I shopped around & got a quote that was £200.00 cheaper & paid in full with the insurance to continue on the 23rd of this month when my old one ran out. I tried to contact the insurance company on a few occasions when I got in from work but the office was always closed by the time I got in, as I didn't want them continuing my insurance on the renewal date I requested "call back" from them, this call back never materialised, so I tried again, this time using their "contact us" page I was able to leave a message explaining everything to them & also had to include my Name, policy number, phone number & email address. At the end I received a generic message saying thankyou & someone would be in touch IIRC within 24 hours. I didn't hear anything back, so after a couple of more days I once again requested a "call back" from them & this time At last they called me back, I explained everything to the guy on the phone about trying to contact them & giving them the info etc & he passed me on to another department, I explained it all again & the guy said its too late now because the money was taken from my account on the 17th of this month I told him that it wasn't to late as I had not requested this & in fact had requested the opposite, & that I was already insured with someone else from the 23rd of October, he said would I like to cancel it then & I said Yeah Of Course! he then said he had cancelled it & he would refund the £549.19p back to my bank account. I asked if it would be straight back into my account & he said it could take up to 3 working days to show in my account but I would get it back (I had to explain the situation to a friend & borrow some money as I didn't have enough left in my account to cover my mortgage & other direct debits) Well that was all said on Monday 21st October, today is Friday 25th October & still no money refunded to my account. I contacted the bank & was Shocked at the (none existent) help I received from a sarcastic girl on the phone, I was told that because it was a card payment & Not a direct debit they couldn't do anything about it & nearly all insurance companies do it now & I would have been made aware of it when I renewed my policy last year (I certainly was not as I would have refused to allow them to automatically renew it without my permission) & was told that I should have cancelled it before any payment was taken & she also said if I did cancel any future payments from insurance companies, to realise that I would never be able to get insured with them ever again because the cancelation is permanent & cant be reversed. she said that she would contact the insurance company, & if they say that I did cancel it & they were supposed to pay me it back they would take it back on my behalf, HOWEVER... if the insurance company says it hasn't been cancelled & they weren't supposed to be refunding me, then there is nothing she can do about it & I would have to just sort it out myself with them???????? She couldn't give me any sort of timescale of when I would have the money back in my account or anything. And after the experience I have had & reading the horror stories on here about insurance companies ripping other people off, I now have serious doubts about them handing my money back to me anytime soon & it appears that if they ever do hand it back it isn't anytime soon & certainly without putting up a battle first. I seriously think that insurance companies should be set stricter rules on how they operate because it seems that a Lot of them are only a stones throw away from crooks/thieves. I'm ranting on when what I really need is some good help & advice on where I go from here in getting my money back, I just simply cant afford to lose £549.00 & the only reason I pay my insurance in one go is because I save it up over the year to save on the extra costs making monthly payments. any help or advice you can give is greatly appreaciated. Darren
  21. I have had a letter out of the blue for a debt from 4 years ago. I have asked for it to be confirmed to be mine, and it has been by way of the signed credit agreement. It is less than 6 years since I last made payment so the debt is not statute barred. It is not a huge amount, just a few hundred pounds, however it has come at a very bad time. I have never had to propose anything before, but I was wondering if anyone had any pointers as to what I could propose to pay back per month? I expect my situation to improve in the next 12 months, but at the moment money is tight I have had help here before with the prove it letter, so thank you to that person
  22. Hi, I am new to this site, not really found any conversations that answer my questions regarding the debt collector company called Collectica and their bailiff approach. I current have a debt that’s been pass to them via the courts for a fine, I had left it a day late to make contact with the court to make a payment plan but was still able to make my first monthly payment, before being told it had been passed to Collectica and I would be contacted. Almost two months later, a bailiff turned up at my door giving me a Notice of Intention to Entre & Search my property - removal notice. At the time, I informed him that I had not received no letters from Collectica giving me the chance to set up a payment plan and advised to contact the office, as he was not willing to accept my £40 a month. Spoke to the office, who informed me two letters was sent out, to date I still have not received. Also informed of the added Admin & Bailiff cost, total of £300, I informed them that I was able to pay £40 a month where my first payment would be on the 30 Sept, I was unable to do this using online or automated services. Following online investigation, I emailed Collectica for a full break down of their charges and copies of letters and informed them that I was unable to make my first payment and if they could advise. After various emails between myself and Collectica, where they just repeated the admin and bailiff cost, s tating I would have pay £10 for copies of letters, advise to speak to bailiff regarding payment which I did via text message. He took almost a month to get back to me demanding full payment and threatening to attend my property on Friday. Bailiff also informed me today, that a letter was sent on 30th Sept and still have not received it. Due to not having any joy making payment, I have made two months payment to the court with the next one due the end of the month. Would it possible for someone to tell me, the correct procedures for debt collectors/bailiff, am I entitled to see the court warrant, breakdown of charges, copies of so call letters, can bailiff entre property in my absent and remove items, can bailiff enter property if I have children under the age of 6. Would be grateful for any advice, as I am not trying to avoid paying the debt.

  24. Hi everyone, I'm new in this forum and I want to thank you all for good work that you are doing to help others. I discovered this site about 1 week ago and I'm simply amazed by the wealth of information this site has made available to everyone in need, so thank you very much. I need some advice on this: I'm currently working as a cleaner (30 hours/week). I got this job after having been on JSA for a year and on WP for about a month. I only took the job because I was really desperate to get the JCP off my back because of the the way they made my life miserable with numerous sanction which almost made me and family homeless. Reasons for sanctions were I wasn't doing enough job searching, they were especially not happy that I wasn't keen to a apply for care home jobs. (I'm personally not wired to do personal care, but I have huge respect for carers) I have worked as cleaner for 1 year and four months and I get 171/week. I'm a father of 4 and my wife isn't working because we got a toddler. We get 300/month in housing benefit and we top up £425 for our £725 rent. Our expenses are way above my wages and therefore I have a huge gas/electric bill, water bill and council tax bill (£86/month) The council have already sent Chandlers bailiffs after me previous unpaid bills and currently owe the 2 months payments. So I'm at loss what to do simply because my wages aren't enough and I'm just overwhelmed by debt. I want to start my own business as a carpet cleaner, my question is; if i stopped working as cleaner, will I lose my HB & CTB and will I qualify to get JSA until I start making enough money? Please help and sorry for the long post. Thank you very much.
