  1. Hi I'm currently on a DMP and paying off my Egg card through Cabot financial. Can I still put in a PPI claim and if so then who do I contact??
  2. Hi, I have received a final response letter from Lloyds in regards to claiming back packaged bank account fees. Lloyds are saying that because I applied online and there was no physical person to give advise then the onus was on me for checking the box to the t&c's. Admittedly, I did not read these however the reason I upgraded my account was because I thought travel insurance was included which apparently never has been on the Select Account. My question is, do I accept this response ? Many Thanks
  3. About to start this having sorted out other family debts with help of CAG. Have printed off fos consumer questionnaire. Have some details of three loans taken about around March to Nov 2004 (more six years ago). Some loans used to pay off other Sainsbury's Bank loans, all with "Creditcare Silver" insurance , which looks like a single premium insurance. One account have Credit agreement ( March 2004) for two different amounts - think might have increased loan amount as dates one day after the other. A second taken out 3 months later - June 04 , OH thinks part to pay off previous loan. Have this CA Finally 5 months later a final loan dated Nov 2004, no CA, to pay off part of previous loan and balance as cash advance. Paid this off early in 2010 from proceeds of downsizing. Not sure if this had PPI on. Is it worth sending off the questionnaire to start the process off or is it best to send a SAR to get complete picture and do own claculations and then claim?? Intend
  4. Can someone please advise the NEW address of hsbc card services?? (gold credit card) They apparently have moved from Chartwell Sq in Southend. To clarify - I wrote a letter, normal postage stamp, regarding an hsbc credit card - and it has been returned as "Gone Away". Yet every google search I do, says hsbc card services are at Chartwell Square. I need to re-send the letter. I rang India !! They advised sending the letter to Coventry. Wasn't sure if that was a joke...
  5. Hey guys. I've unfortunately been on the receiving end of being duped by an absolute cowboy builder that really and truly needs to be stopped before anyone gets hurt. Over the Christmas period, i was looking to have some work done to the house, namely a new bathroom, toilet and to refurbish the kitchen. I posted an advert on rated people, received a call from a builder who came over to view the job and priced it up. I took a little time to mull it over, even went to view work he was doing at the same and agreed to hire him a few days later. Deposit was initially paid with the remainder to be spread over the course of the job. Work was scheduled to start on the 28th December and was to take 8 days to complete. He did indeed turn up on the 28th, albeit late. At the end of the day, he asked for more moneyfor materials and some to tie him over and stupidly i handed over another £300. I should have realized he's received a large portion of money with next to no work done but i guess i was at the mercy of him as it started to go downhill from here. He became unreliable, showing up late, working for minimal hours and a lot of the time now showing up at all despite claiming I'll be there in 10 mins'. All at a time when we had family in and out of hospital and he knew full well this was the case and took advantage. There were times he showed up and i gave him the benefit of the doubt and transferred smaller amounts of money into his account in hope of him turning up the following day. I obviously want to claim back the money I've paid him as well as for the materials I've purchased that he installed at a very bad and albeit dangerous manner as I've not heard from him in over a week despite many calls and messages. (He must have over 100 missed calls and many messages over the weeks of me trying to get in touch with him) These are the issues with the work he HAS completed. There's a whole heap of other stuff he hasn't even begun Bathroom Tiling not completed Tiling is not straight or grouted correctly where it has been completed Removed shaver socket to tile and left wiring exposed Removed towel radiator electrics and wiring is exposed Did not cap of old central heating radiator and left dripping for 3 days causing damage to bathroom floor and kitchen ceiling Left light wiring exposed after installing fan New bath has not installed straight and holds water in the center Cut (not straight) my new basin vanity unit after he measured incorrectly to fit Left shower wiring exposed in channeled wall and not sealed Toilet Has not tiled the walls Wiring exposed for the light and new light not fitted Channeled holes in the walls Toilet not secured Door not hung The only damage he caused in the kitchen was the ceiling due to the bathroom leak. He never attempted any of the work that was due in the kitchen. I would say he's completed 20% of the work to a satisfactory standard but has 85% of the money. After the struggles of trying to get in touch with him, i searched for an alternative number and came across horror stories where he has duped many others. I have since reported him to Trading Standard and will be reporting him to Health and Safety tomorrow as well as he needs to be stopped. But at the same time i would like my money back to get in a reputable trader to rectify and complete. I have looked for advice online on how to pursue but it all seems to be geared towards giving him time to rectify, follow the initial letter with another and seems like a long fix. I wanted advise on the fastest route to put in a claim without jeopardising my position as the work has been left in a dangerous state and i obviously don't want anyone getting hurt. I've mentioned most of the above to him in messages, asked for my money back but not surprisingly he isn't willing to work anything out. Luckily every payment bar £250 was transferred from my account to his. Apologies for the long rant, i appreciate a lot may not get to the end of this post but for the ones that do, all advise would be greatly appreciated. Now breathe..!
  6. Packaged accounts are current accounts that have ‘benefits’ attached. Such as Travel Insurance. It is a good way to obtain Travel, Mobile or breakdown insurances. However, you might be able to get these cheaper elsewhere and those included in the packages were not always beneficial to the customer. However, for this type of account, a monthly fee is charged, usually about £10 - £25.00 per month. – Doesn’t sound too much when you say it like that, but say £120.00 - £300.00 per year and that could be quite substantial. If you made a decision to take a packaged account for these benefits then all well and good. If you didn’t, and were advised that this was the only way you could have a mortgage or other type of loan, credit card or overdraft with your bank or it simply appeared – then you were mis-sold. If you were mis-sold, then you can reclaim:- Reasons for mis-selling You didn’t know you were paying for this type of account and don’t remember ever agreeing to having this account. You were upgraded without your knowledge. You were told you would be eligible for travel insurance but later found out this wasn't correct. You weren't told you wouldn’t be eligible for one or more of the insurance policies. You were told you had to get the account in order to take out a loan / overdraft / mortgage. You were told you wouldn’t be eligible for the Banks' fee-free accounts and had to get one. You weren't told there was an alternative, free account. You tried to cancel the account but the bank wouldn't let you . There is a draft reclaim letter in the CAG library. I am trying to do a JSA rapid reclaim online but after answering the first few questions im told i live in a Universal Credit postcode area and to click on the start now link to apply if you live in an eligable area. Do i simply go through and fill out the Universal Credit questions to do a Jsa rapid reclaim?
  8. Hi, Not sure where to post this so went to the most correct sounding place. I have for the last few years been working with a company during the summer months. As it is seasonal work there is no holiday in the usual sense, it is simply moving from site to site and working when needed. At the end of this current season (2015) I received a payment in lieu of holiday out of the blue for the time I worked as they have moved to an automated payroll system. However in previous years (2011,2012,2013 and 2014) I never received this payment. I was wondering whether there was any chance of reclaiming this or whether I would simply be under the employers discretion for whether or not to do so?   9. Hi I am in arrears with Paratus AMC (Previously GMAC) whom I gather to be difficult to deal with. As part of their pre-action they have kindly forwarded me the complete statement of the account. In it I have noticed that there are a large number of fee items and wanted to know if anyone can advice which ones can realistically be claimed against as unlawful charges: Unpaid DD Fee (£30) Arrears Fee (£50) Non Payment by DD Fee (£30) Thanks for any assistance

Was just wondering if you've been on ESA for a few years and close your claim to move to a job you've been offered as it would pay more than the Permitted Work rules allow but then find you can't cope as the pressure of the job quickly starts to exacerbate your medical condition are you able to do a rapid reclaim and go back to where you were or would you be looking at going through the ESA system from day 1 again?
  11. The background Story is this.. I took out several payday loans round a similar time 2 years ago. At this point i was already in around about 5k worth of debt which had all defaulted. I do not belive that the PDLC's i went with did enough checks on me to see if this was right for me. THE PDLC's are Payday UK Wageday Advance Quick Quid Uncle Buck 24/7 Moneybox PDUK have offered to remove the interest and charges and leave me with the amount i took out as a gesture of goodwill. Is there much chance of me getting this off my credit file and the debt written off? should i take this to the FOS? Uncle Buck and money box offered the same and i have sent my complaint to the FOS about a week ago. Quick Quid refuse to do annything. Any advice on this matter would be great Also by the offering a gesture of goodwill surely this means something they have done is wrong and they are just trying to shut me up? Cheers Guys
  12. A friends son has been banking with Abbey all of his life. Nothing fancy, simple child saver account which eventually they changed to a basic bank account - without an overdraft facility. They make purchases overseas frequently in USD (dollars) and because of a delay in the transaction time / rate of exchange, are often hit by being a penny or so overdrawn. To date, I think the most was less than £2. The bank in it's infinite wisdom, basically just deduct £25 as they can extort from his account and leave it overdrawn, despite this not actually being allowed under their rules. From my looking at his (disorganised) statements, he may well have paid over £400 this year alone and says it goes back much further. What is the best way to proceed on reclaiming these charges, before he moves to another bank?
  13. Whilst clearing out and shredding some old files a few days ago I came across an old loan agreement with First National Bank which had PPI added. There is also a letter in the file in answer to a letter I sent to them asking them to cancel the PPI in which they say they cannot cancel it. My question is, am I too late to claim this back? the agreement is date either 1999 or 2000 it is difficult to tell. I have all the papers, account number etc.
  14. I recently attempted to reclaim fees on our redeemed mortgage which was redeemed in October 2014. The fees charged to our account over 7 years amounted to £9550. After taking over two months to respond, as I expected, Acenden have refused to refund any fees, they consider the fees they have charged to be fair. Where do I go from here? Some forums say the ombudsman and some forums say the small claims court? Any advice will be greatly appreciated.

I'm hoping for some advice please..... here is my scenario exactly as it is: I work as a Lunchtime supervisor, in April I received a letter saying I had been receiving too much salary for a few years and given the option to accept the new salary/hours and that no claims would be made on these overpayments... I agreed to the new terms and was told that a new contract would be drawn up for me to sign with the new hours/rates. Since then I have received nothing........ until............... Last Friday, I was told that SINCE MAY 1ST an overpayment on my salary had been made and they were deducting the full amount from this months wages! Now I know they are not going to reclaim ages before the letter I received BUT............ I have still not received my new contract with adjustments so am still on the old contract on the higher wage. How do I stand legally about this...? Do I have to repay this amount as I'd verbally agreed to the change? Or do they need to have informed me in writing and provided me with the new contract BEFORE they made the adjustment to my wage? I would appreciate any help asap as I have been called into a meeting with the "business manager" on Monday to discuss the matter - and I don't want to be bamboozled by them Thank you so much.

I have submitted reclaim for missold PPI to Yorkshire Building Society they have responded to advise that they refuse claim on the grounds that throughout their investigation they found no evidence to suggest they acted inappropriately or improperly in any way either when arranging MPI cover at the outset or since. They have although found evidence to suggest that we were aware of the policy existing. We were told at the outset of applying for our mortgage that we would have to take endowment and payment protection insurance for our mortgage application to be looked on favourably. It was our first ever house purchase and mortgage and both my ex husband and I remember being pushed in the direction the mortgage adviser wanted and because we so wanted this house we agreed to all they told us we had to. They have provided copies of all the signed forms and say they find no evidence of misselling...... But they won't do because it was verbally implied we wouldn't get if didn't go down route of endowment policy and protect our payments. Do we go straight to FOS now or go back to the Building Society? What evidence could we provide to say missold as it was verbal? Of course they not going to have it written on any documents it's just my ex husbands and my verbal evidence? What now? Anyone have any advice on how we can prove? Thanks P.s. I also notice they have changed it from PPI to MPI and the insurance we took out was to cover payments which we didn't need as I got full sick pay and redundancy and so was the case for my ex husband. It was a monthly premium we paid which didn't affect any further interest charges added onto the mortgage but it was definable to cover our mortgage payment to the endowment policy if we were out of work for a period of time.
  17. I have had an account with Vanquis for a few years (opened originally as I had a poor credit rating) and i am looking to close thsi and balance transfer to a 0% account. I never check my statements (bad, i know) as i get a text each month with my balance and the min amount payable. When looking at my statements toady (i can only see back about 6 months) i noticed a Repayment Option Plan payments of about £14 each month. My questions are: I know i did not agree to any sort of protection on my payments, what can i do to claaim this back? Should i do this before balance transferring and closing the account with Vanquis?Thanks
  18. I took out a loan in 2001 from IGROUP loans. I spoke to them last week about reclaiming my PPI. I was (and still am) a Local Authority Officer at the time and would have received 6mths full pay and 6 months half pay if I became ill and could not work. I have just come across the papers for the loan. I made copious notes and there is no evidence of a discussion about what benefit my employer offered if I could not work. They have informed me that they cannot offer a refund because the PPI was sold by a broker - Headland Finance. What is the procedure if the PPI was sold by a broker? All my monthly instalments were paid to IG loans not to the broker? Is there anyone out there who can offer some advice? I do not believe that the PPI was necessary.
  19. Hello, I am brand new to this forum so please excuse my lack of knowledge. My mother is a pensioner who was missold PPI from Littlewoods on a credit card years ago. (Barclaycard?) She has no documentation for this currently. What I'd love to find out is 1) How do I make a claim/Who do I need to contact or address a letter to? 2) What proof/documentation would I need to do so? 3) Is the process very complicated, would I be better going through a company to do it for me or is the percentage they usually take too much? Sorry if I sound completely clueless, as indeed I am I'm afraid! Thank you so much in advance for any help.
  20. I am trying to reclaim a large amount of PPI from HSBC after I noticed just how much they have taken off me over the years in insurance on my credit card. I was originally told that I had to have it in the first year because I was a student and that it was mandatory. I did not realise that it was still going today. I have already printed and sent the letter asking for all the information they have on me but where do I go from here? I have never done this, my husband was lucky after just asking his bank about it his and they simply repaid him an amount. Any help or advice would be much appreciated thanks I must note I am dyslexic so if there is any forms or website that are of use could you please post them on your feeds as trawling through websites to find things causes quite a headache. thank you

I decided after many years being with my Bank to re-claim all my bank charges over a period of years!! today i received a call from my bank in regards with what i was asking for, the lady on the phone sounded quite vague and then by saying that they could only refund me partially my charges for 6 months??? So then i refused it and i told her to put it in writing what she had offered me,i told her i disagreed with her offer and i will be taking this further. Can anyone advise what i need to do now? thanks
  22. Hello, I owe two banks just over £4k from long ago - it was the result of bank charges and excessive borrowing to cover those charges. At times it was actually the charges that caused more charges. Those two bank accounts are still on my credit file as defaults and as far as I know were closed some time ago. Both date just over 6 years ago. Because of those two banks and their charges my credit history was badly damaged, I tried borrowing from other companies to 'make it right' and pay it off but the snowballing effect has started and soon I found myself borrowing more than I could afford to pay, debts were piling up and I suffered two major breakdowns and am still battling with depression, anxieties and poor health. And still battling with poor credit history and debts piling up. My question is - is it still possible and doable to reclaim charges or some of the charges or to nullify or reduce the debt that I owe to those two banks. Many thanks in advance for any input on this matter.
  23. Hi, I hope someone might be able to provide some general advice. I am trying to reclaim £450 in Platinum Card membership fees, I have already unsuccessfully been through their complaints process and they've sent me the FoS leaflet. 1 - I've had both a British Airways Amex card and a Platinum Amex Charge card (with flexselect credit) for almost ten years. The latter has a membership fee of £450, paid in December 2 - I hadn't actually used the Platinum Card for two years until April 2015 when I tried to use it to pay for a hotel abroad - declined, despite my statement telling me I had over £1000 of my £3500 Flexselect credit available 3 - I rang Amex, and they essentially told me that because I was a risky customer, they were declining to put through my charges. Yes, late last year I ran into financial difficulties and had problems making loan and credit card payments and this will have affected my credit file 4 - However, at no time did Amex tell me I can't use the card. There is no notification on my online account, and I have received no letters or phone calls, so this is the first I had heard of it 5 - In fact the card does work sometimes. It usually works for smaller (less than £20) amounts in supermarkets etc. Not always. Yesterday an £8 charge went through, today a £17 one didn't 6 - I wrote to Amex making a complaint asking that my card be downgraded to one of the free ones, and that as I had been sold a card I can't actually make full use of, that my year's membership should be refunded 7 - Amex has rejected the complaint saying I could only have a pro rata refund (which I guess would be £300 odd) and making me aware that they can basically stop me using it when they want as it says so in the Tcs and Cs I would now like to complain to the FoC. The basis of my complaint will be that Amex knowingly sold me a card membership I can't make full use of, and never told me that I can't fully use the card. Had I known this, I would not have paid them the £450 at the end of last year. I have two questions: 1 - There is £550 due to be paid next week, some of this is from the small purchases I have been able to make - public transport, small supermarket shops etc. The rest is from my flex select balance. I am in a position to pay this, but would there be any grounds for me not to, if I am disputing the account? Or would this make things worse and I should just pay up as normal. 2 - Because the Amex card seems to work for most smaller charges, does this in any way negate my complaint? The £450 membership is sold with various travel benefits, but as I discovered I can't actually use the card when travelling Any other advice of how I should approach this with the FoS is appreciated. Thank you for hearing me out, all being well I'll look to submit my FoS complaint in the next few days
  24. Six weeks ago I agreed to purchase (from a UK company) a classic vehicle for restoration which is being imported from the USA. The company has a good reputation and I based my decision to buy upon various photographs showing the areas requiring attention. My intention was to buy the vehicle 'as is' and to have it fully restored mechanically and cosmetically. I paid a 10% deposit to secure the vehicle and agreed in writing to pay a further 15% as soon as it had been shipped. The 15% is due this week, as the seller has the bill of loading from the shipping company. The receipt provided to me acknowledges the payment of the 10% deposit, states that 15% is due on departure, with the final balance payable immediately upon arrival and customs clearance in the UK. The only mention made of a refund is that, if Customs do not accept the vehicle (which is 40 years old) as being of 'historical interest' and the import duty and VAT is higher as a result, I may either accept the additional charges or be entitled to a refund of all monies paid to date. I did not sign a sales contract but have agreed in writing (via email) to pay both the 15% at the time of shipping and the balance on arrival. I work abroad and all of my dealings with the company have been via email. I was not in the UK when the deal was made. My circumstances have changed and I will not be able to afford the restoration. I have written to the seller, requesting a full refund of my 10% deposit. However, I am not sure where I stand legally if the seller refuses. Because I was not in the UK during the negotiations, can I legally pursue the matter under English Law? Would the fact that all contact with the seller was via email fall under the distance selling regulations? Or am I technically in breach of contract, and can the seller in fact sue me for the remaining balance. The seller has not done anything to justify me pulling out of the deal, and in fact has done everything exactly as promised so far. I would find it difficult, though, to complete the purchase and have the restoration work carried out. I'm really not sure where I stand if the dealer refuses to cooperate..

Having reclaimed the PPI on my RBS overdraft earlier this year see here It recently became aware that perhaps I had a claim regarding a miss sold packaged account as I was told that I had to have this account to have the overdraft facility that I wanted..... dropped a letter in the post a week last Friday, today I received a letter agreeing that was the case and approx £1600 in fees and interest will be in my account within 3 days of the date of the letter.... Quickest, easiest reclaim ever, one letter, 2 weeks, done and dusted.......
