  1. Hi! I would be grateful for some help where I have received a £60 parking fine from New Generation Parking Management and could do with some advice before I lodge an appeal. I am the owner of a flat in a complex of flats. I have an undercroft parking space which is accessed via a shutter roller door. Unfortunately the shutter door has been broken for a couple of weeks and when I got home the other week someone had parked in my space, which I pay for. I tried to put my car in a visitor space but they were all taken at the time. I therefore parked my car in an area where other cars were parked and often are always parked which does not restrict anyone's access. I displayed a large handwritten sign in my windscreen explaining why I had had to park there, provided my flat number and my mobile number in case there were any issues. A visitor space became available within approximately 90 minutes of parking there and so I moved the car. A week or so later I have a £60 parking fine in the post. Do you think I have good grounds for mitigating circumstances to appeal this 'fine'. How would people recommend I proceed? It leaves a very bitter taste in my mouth that I am being penalised for someone parking in my space which I pay a yearly fee to have. Whilst I do not consider I should have to pay any fine, £60 seems very excessive. Thanks in advance for your help - it is greatly appreciated.

  3. My wife entered a private pay and display car park in Blackpool, and drove around looking for a free space. After about 20 mins of waiting for a space to come free, she gave up and drove out. Some time later we received a parking fine for £100 (£60 if paid in 14 days). Their evidence was a photo of the car entering the carpark and leaving 21mins later. We obviously felt this entirely unjust as she never actually parked! We apealed in the first instance directly to Parking Eye, who rejected it and said we should appeal to POPLA if we wanted to take it further, which we did. We have just now received a rejection from POPLA saying that as there is proof that she spent 21mins on the car park, and that "it is more likely than not that the appellant deliberately stopped the vehicle for a significant length of time. This means that the appellant parked, whether or not they left the vehicle." They say that we must now pay £100 within 14 days to avoid any charges. We are furious about this and are determined not to pay for Not being able to park. Any ideas what we should do next?

If the Bounty Hunters are obliged to start refunding all of their victims, then they won't have enough money to do it. The result could be that they start closing themselves down pre-emptively. People should consider issuing small claims for refunds without hanging around too long
  5. Just a quick question here If a car park is PRIVATELY owned and has barriers so that it may be closed to the public at any time. Does the RTA cover this car park? The story late august 2014 The partner of my daughter allegedly had a "bump" in the car park and did not know about it. The driver received the NOK asking for details of the driver under Section 172 Road traffic Act 1988 as amended by Section 21 RTA 1991 from the Police. This was duly filled in and returned by normal post. I think someone took the index of his car and passed it on to someone else. The police have said an offence Contrary to s172(3) RTA 1988 and schedule 2 of the Road Traffic Offenders Act 1988 has occurred. (no reply to NTO) My understanding of parking on private land the RTA does not come into force, as the signs clearly state the landowners will not be held responsible to any damage caused whilst visiting the site. This week the charge sheet was received by him and has been given a Court date. The Police are claiming that the A150/Section 172 form was not returned and duly sent a Court date (Mags). I have advance disclosure already (MG4E) and have drafted the response for him. In the Police witness statement they clearly state "I can offer no further evidence in to this collision and can only confirm that we did not receive back a completed A150/Section 172 form from Mr ************" So I have some questions 1. If no RTA is in effect then should this be civil? 2. If the S172 was "lost" is there a defence? 3. Police in their statement say no contact by phone from D, but D has proof of contact via itemised mobile phone bill to the Police that shows date time length of call 4. Why did the Police issue a NTO if on private land? 5. I have recommended that he speak to a Solicitor or (Duty Solicitor) This is time limited to 4 days as due to return the plea form to Court Thanks in advance

  7. Hi My neighbor's son and his friend have for the last year been renting with a private landlord who is now selling house. They were going to rent together again, but his friend changed his mind last week. Come Wednesday next week the neighbor's son will be homeless, and is friend he was renting with who owns a one bedroom flat which he was renting out is going back to it. The major problem is in late 2014 my neighbor's son (I don't want to go into the ins and outs) ended up with a electronic monitoring tag for homegrown for himself. He cannot afford to find a lump some to take out private on his own. He was made redundant and cannot get another job due to monitoring tag and community service. He cannot go back home to mums has she is sold up and moving away. He did try and tell the courts and electronic monitoring tag company Friday gone about soon being homeless etc but no one wanted to know. Anyone got any advise, what to do. who to go and see?   8. I have noticed that there are hundreds of parking threads, and a few stickies, but I have not seen a definitive one with instructions for us if we receive a parking charge notice. I (apparently) received a PCN in Iceland car park in Andover from Horizon, on 29th October. I received 2 days ago dated 2nd december a letter from Horizon to me as the registered keeper, suggesting that I pay £80. I went into the store today and spoke to the manager who was wetter than a wet weekend in skeggie, so now what do I have to do, to not pay this charge? Many thanks added sorry but forgot. the charge is for failing to pay for parking. at 0910 and the car park was almost empty.

  10. quick question. bailiffs clamp my friends car over unpaid council ticket. he sat in the car and bailiff called the police. informed him he was committing the offence of obstructing an enforcement officer and will be arrested. officers radioed control who said to go ahead and arrest them can they do this

I am at loggerheads with my employers with regards to the 'within a 5-mile radius of a permanent or temporary place of employment' ruling by the HMRC. Hi , i am IT student , i did enroll with one of private institute for IT certifications . i did enroll for year course on agreement but they said it may take longer if they dont have sufficient student batch. NOW they took two year but still half of lectures not scheduled . i keep on contacting them they always reply to wait for admin to contact back . few days back called them they says ur course due date passed so they reviewing case why course not scheduled . But i am tired to contacting them . i paid them £6000 but not got only half course lectures scheduled . i have all contract paper and fees proof of payment . Please can someone guild me how can i get this sort out ? thank you for your valuable time.
  13. My partner received a "fine" from one of these companies for overstaying in a free Pets at Home car park. Initially requested to pay £60 which would increase if not paid. He has appealed this charge quoting information from CAB and requesting a breakdown of how this sum is reached. He also requested to know who is the landowner. As expected, his appeal was rejected, but they also refused to provide a breakdown of charges and the name of the landowner. numerous emails have passed back and forth requesting higher appeal rights and more information--- all refused. They are now telling him that the amount has increased to £120. I have told him to ignore but he is getting twitchy about it. any suggestions please? Please note that we are in Scotland so no POPLA
  14. Hi, I was wondering if anyone could offer any advice on the below situation:- I live in a privately owned street. It's owned and maintained by the residents. We have signs at both ends of the street clearly stating that the street is private property and parking is for residents only. Most days there is just about enough space on the street for the residents to park. Recently someone from the nearby flats has started parking on our street, meaning that on occasions, there is not enough parking space. I, and a number of other residents have asked him to move and he has flat out refused. We've also attached a couple of notes to his windscreen which he's ignored. I spoke to him again on Friday and he finally agreed to stop. And he did.. .for two days. His car has been there again since yesterday evening. I've done a bit of online research, and as far as I can see, the police/traffic wardens won't be do anything about it, as this is a civil matter, rather than a legal one. It seems as though I may be able to pursue civil action against him through a solicitor (I have photographic evidence of his car parked in our street), but this seems like a lot of trouble and/or expense and is a last resort. Can anyone suggest anything that I can try? Thanks! Simon
  15. Hi all My bank is based on land with private shops but in a way has two parking areas one for the bank one for the shop. I parked in the shops, always have and used bank. Came out and a man approached saying have you used the bank, yes was my reply he then said unfortunately . ..... as I realised what he was I then stopped him and asked if land was private or council he replied private land so I just got in my car and drove off to shouts of see you in court!!! I took no other details than that but as I drove out I did see the sign contract thing on the wall, must admit never realised that although on the same land so to speak that they are separate My question is what to do next as and when the invoice comes through. No ticket was issued on the car or anything didn't give him the chance but I presume he has photographed the number plate. The car is also registered to my wife not me so don't want to cause her any grief. Any advice on correct procedures would be most helpful so I can do this properly whilst causing these leeches time and money. Thanks in advance
  16. Hi all, Could some one shed some light to this issue I am having. Vehicle broke down, and I end up leaving it at the private car park (offices etc). Was hoping to pick it up next day, and did not report to the car park/offices security etc... (OK my fault here). But 16 days later I came to pick it up and was told that it was "disposed of". No further details or information given. Police and insurance would not deal since it was on private land. Can they even do that? is that lawful action? If so, could anyone point me to some sort of regulation that they need to comply with when they impounded/dispose the vehicles etc? Thank you,
  17. Hello All, I really need someones help regarding these well known ANPR guys. So, here is the deal, back in January 11/01/14, I have parked at my friends house. it was saturday, had to do some work for Uni. I also have placed a note saying "Visitor of Flat X" When I left, I found the famous checker paper ticket on my windshield. Ticket was issued 14:23 He took the ticket and he contacted estate agents to deal with it as I was visiting him and he gave me a permission to park there as he is legal tenant of that house. There are no gates, nothing, its behind the building and the car park has roughly 6-7 spaces. That day, there was like 1-2 cars. Cant remember exactly, that car park is pretty much always empty. Him contacted the agents and them telling him it will be dealt with we left it expecting it will be dismissed. It was quite and then last week I received this letter of Final Demand. This was out of blue. No correspondence, no outstanding invoice as some have received, absolutely nothing until final demand. So i replied to them explained my situation that this is unfair and unjust and I was granted permission to park there. I also attached my friends witness statement. Unfortunately, I have not googled ANPR and and just acted and sent off letter as I got scared. I am attaching the correspondence with them. Please help me out as I am a student and I cannot afford to pay £140 or even more if they start taking me to courts. Big thanks to anyone who can help! Tomas
  18. Good afternoon, I recently received contact from a person I sold a car to (privately) at the beginning of the year, asking for my address. After about 5-6 messages claiming he wanted to pass a letter on to me, he finally tells me he has obtained a judgement against me and needed to provide the Bailiff's he has instructed with an address. This started shortly after I sold the car to him, when he claimed he was not happy with the car. Out of goodwill, I attempted to negotiate with him, but he would accept nothing less than a full refund. Eventually, I told him I was not willing to offer a full refund and eventually the emails stopped. It seems he found a very old address of mine and entered a small claim against me at that address, for the full purchase price of the car, which he was obviously granted by default (In June) because I was not given the opportunity to defend it. I have been in contact with the court, who have not given me much information on the claim but have advised me I need to make two applications; one to have the claim set aside and the other to stay the writ - carrying a fee of £155 each. I am waiting for an appointment with my local CAB, but I fear that may not be soon enough if the Bailiff were to find my new address. So I was hoping to get the advice of people more knowledgable than me, here; The N244 form is very ambiguous, can anyone advise how I should fill out the form for each application, if they are indeed both needed? The claimant has expressed an interest in obtaining my address from any application I make, no doubt to instruct his bailiff - can he do this? £310 is quite a lot of money. From reading the EX160A, I may be entitled to a part remission on the basis that I do not have disposable capital over £3k and my gross household income is under £5,490 - However, I'm concerned applying for such remission may add unnecessary delays. Are the fees incurred reclaimable if I'm successful in defending the claim? If so, perhaps the previous point is not such a concern. Any help would be most appreciated.
  19. Hi everyone, We are keen to find out if there have been situations similar to ours... We are currently in dispute with a well known car finance company.. 4 payments were missed (not Consecutively) and following expiration of the default notice the creditor had issued to us, they instructed a repo company to take back the vehicle. At the time of repossession we had not paid more than 1/3 of the total price. The night before, the repo company clamped the vehicle on our private driveway, and after a few un-productive telephone calls the next day (whilst we were at work), we arrived home to find the vehicle had been taken from our private drive, without our consent. It's worth noting by term private driveway I mean land owned by us, as confirmed by our land registry deeds. Not enclosed or gated drive etc. We are in the process of going to court over this as S92 of the CCA 1974 states they cannot repo from private land without a court order. I'm also aware they're not allowed to clamp on private property either. The creditors defence is centred around the fact they did not believe it was private land and they have submitted their evidence in preparation for the hearing. Does anyone have any case law to support a debtor in this particular dispute ? particularly relating to the interpretation of 'private drive' ?. The web forums are full of success stories when the debtor has paid 1/3 or more, but nothing appears for situations where the paid monies are under this. CCA 1974 states that the breach is actionable as a breach of statutory duty. Thanks in advance.
  20. Hi My dad works for a distribution company but is self employed (he is also carries out other work which they are aware of). He has recently received a letter advising him that he is now required to have a tracker fitted to his van (which is privately owned and insured) and that he is to purchase this himself. This just doesn't seem right, especially as he carries out work for more than one employer. I certainly don't think it is right that he would have to pay for this himself if it is a company requirement. Does anyone know what the legal position is on this?   21. Hi, can someone please help me. Today, I received a PCN in the post for £100 (£60 if paid within 14 days). The PCN states that I over stayed in my local supermarket car park. The fine states the the car park is "private land" and the enforcement company is not a council but a LTD company (not sure if I am allowed to name on here) but where do I stand? Should I pay it? Any advice is greatly appreciated.
