  1. Hi I'm helping a family member with regard to a PPI claim. They don't know if they've ever had PPI and most of the accounts are closed. She has no statements and cannot afford to pay £10 for a SAR for all of them. I've noticed that banks have an online PPI checker. My question is - will the banks tell the truth? As you can see I'm very sceptical about banks. Thanks in advance.

Santander have rejected my PPI claim (store card) from 17 years ago on the grounds they believe it was sold in a proper manner (over the phone - which it wasnt - as I signed-up in-store with an agreement the assistant ticked for PPI) and was offered as optional and appropriate for me etc etc - which I absolutely disagree with. I have issued a SAR - but already do have copies of Agreement and statements etc. Unsure of whats best as next move - do I escalate issue with FOS (that I'm not hearing good reports about!) or small claims action? The amount of money involved is probably fairly small (circa £200 in PPI premiums?) Any thoughts appreciated!
  3. Hello all, Mods please move if in the wrong section? About 8 years ago I had a Debt Relief order against me. I've recently decided to contact all the financial companies I had dealings with and see if I was miss sold PPI any form? I have had Barclays admit they mis sold PPI and compensate me £1075 Hsbc I've not had a reply from yet? However capitol one have stated that they are making a redress payment to me of £ 60:45. Today I got a letter from capitol one saying that they have refunded the full amount and that it was Added to my account to reduce the debt owed to capitol one .....? Can they do that? I thought the debt was written off when I got a DRO ? Any advice appreciated

Britain’s banks face the threat of a huge new PPI bill that could add billions of pounds to the £30bn already paid out in compensation, following a court ruling lauded by claims management companies as “hugely significant”. The case opens the door to a renewed claims bonanza as it suggests that even if the PPI policy was not mis-sold, the buyer may still be able to reclaim because the scale of the commissions paid were excessively high. While the ruling does not mean any more cash for people who have already received compensation, it may allow cases that have been rejected to be reconsidered. The ruling is likely to be appealed against but if it stands it presents a fresh PPI nightmare for Britain’s banks, after one claims expert said new payments could run into the tens of billions.   5. Hi everyone, I have a friend who is on a debt plan with a Halifax credit card, she heard about the PPI deadline and wondered if the fact that she is on a debt plan ( with Step Change ) would exclude her from making an inquiry with Halifax and possibly claiming back PPI.
  6. Hello, I used Resolver to find out if I had any PPI with Studio catalogue, I attach the response and although the sum would be very small if I were successful, I feel that it is a matter of principle as this response is, I think a fob off. Studio response1.pdf
  7. gI have also recently received a letter from MBNA regarding the same thing.g In this letter they say,.. " You could now receive some money back if we took a high level of commission on your PPI policy but did not tell you this when you bought it. A high level of commission typically means it was over half what you paid for the policy. Generally we do not tell PPI customers about our commission at the point of sale, as we were not required to ". Interestingly the reply address they give begins with........MBNA Plevin Proactive. Unlike Welcome they include a form to be completed.
  8. Hi There, I am new to this site and need some advice please. I have recently submitted a PPI claim to Natwest in respect of PPI. I sent them a copy bank statement (dated 1998) depicting 'Credit Card Repayment Protector' being deducted at GBP30.67 per month on a balance of GBP4151 per month. I rang them and they have stated that this is CPP and not PPI. I know that this is not the case and have told them that. Any advice at all please and thanks? I have been informed that a rough calculation is that the PPI would have cost 77p for ever GBP100 outstanding on my credit card balance each month. Therefore the monthly payment of £30.67 on a balance of circa £4151 seems to suggest I was indeed paying the above insurance premium. Whereas NatWest CCP Credit Card Plus cost £36.99 a year
  9. I'm looking for some advice please. I have been looking to claim back PPI which was provided under a consolidation I did some years ago. It seems very complicated to me and I have put it off for a long while. Recently however a close friend of mine who had the exact same set of circumstances has made a successful claim. My big problem is that he has paid £5000 in fees by his claim company. So out of a total £11000 claim he has only received £6000. This seems ridiculous! The story is that I was approached by Carrington Carr, who persuaded me that consolidating my debts was a great idea, so I did. This included my car, double glazing and all sorts! This isn't really the issue though. The new mortgage was through Northern Rock (Problem 1). The PPI policy I bought was lumped on top of my mortgage amount, which now I know to be a ridiculous idea. On top of that I had my legal fees lumped on top and a fee from Carrington Carr that would provide their ongoing services for free (Haha!). Carrington Carr are no longer, Northern Rock are no longer! So how on earth do I approach this without paying a claims company an extortionate fee? Assistance would be greatly appreciated.
  10. Hi all I made a mistake and tried a ppi agent to deal with Cap1. they paid them and the agent deducted their commission and sent me the balance together with Cap1 letter calculations. Cap1 determined that since i was aware of PPI in 2005 when i cancelled the ppi then i was not entitled to receive interest since it was over 5 years ago. I wrote back asking them to pay the interest since i cancelled the ppi because i could not afford it... NOT THAT PPI HAD BEEN MISSOLD... DIDNT AWARE OF THAT UNTIL MY CLAIM WAS SUBMITTED. They will not budge their offer was final. Questions: do I have a reasonable case for interest? should I lodge complaint with FOS or go to court?? thanks

Firstly i will say hello and thank you for any help i obtain here the basics of what i had are a ppi policy for a car loan with welcome finance from march 1999 i have a copy of the loan agreement i have tried to claim against welcome but have been told to pursue the underwriter i have contacted the underwriter ( a bit confusing Lloyds say they weren't the underwriter but admitted the would pay out the policy if it had been claimed against and said jubilee group were the underwriter which have replied on behalf of lloyds i have had much correspondence from Lloyds mostly contradictory and i getting nowhere they told me to claim against welcome i asked the question why are Aviva paying out on policies as underwriters in the exact same circumstance yet Lloyds are not the response was they cannot comment on what another companies position is. im at the point of not really knowing how to go on any help would be appreciated thanks Kenny
  12. A friend has received payment from MBNA for a miss-sold PPI policy. The advice slip attached to the cheque invites a telephone call to their offices, should there be any queries. This in spite of a notification letter, received some weeks earlier, stating that “This is our final response to the complaint” and referring the recipient to the Ombudsman Service, should the refund not be deemed satisfactory. If MBNA are granting telephone queries, would they not similarly accept written queries? Secondly, I have attached MBNA’s calculations by which they arrived at their refund and would be grateful if someone, with more experience than I, would be kind enough to examine those and give us the benefit of their advice. The credit card was provided circa ten years ago and has been steadily operating with a constant debt just shy of £3000, since then, with only minimum payments being made, each month (if that helps). Hi, I applied for PPI from WFSL through the FSCS in November just received their decision letter saying that yes they owe me PPI but because I owe WFSL an amount on another loan they will offset it. WFSL have sold this account to PRA group for collection and it is also statute barred. I have read on various threads that apparently the FOS has said that if a debt has been sold that the compensation cannot be used to offset the debt, I have looked at the links in the threads but none of them take me to the relevant info and I cant find anything about it on the FOS website, can anyone point me in the direction of where it states this on the FOS website as I want to get all the information I can before I raise a complaint to the FSCS.   14. Recently I came across some old account numbers and decided to check if any might have had PPI on them and if I might be able to claim anything on them prior to the deadline next year. As I have no details other than the banks referance numbers I filled in the PPI Checker on the Halifax site where one of the account numbers was from. I few days passed and I got a text this morning from Halifax saying "Felix, Thank you for your PPI Complaint, We'll communicate with you via SMS during the course of your complaint" Now all I have done is check to see if I had PPI, I haven't made an actual complaint yet. Is this text just what they send out when they are checking if you even had PPI or does it look like they have found PPI on my old account and have auto opened a complaint? Also I have heard that Banks may phone you up to ask you questions about your claim. I have Dyspraxia and would feel more comfortable being able to read questions carefully and think about my answers and put them in writing. Would I be within my rights to request any questions be put in writing?

Over the weekend my hubby went up into our loft to try and find some paperwork in relation to another PPI claim I have but found an agreement for a car we bought back in 1994 from a Ford Dealership and its with Associate Capital. I remember at the time we had a really bad credit record and the sales man said that if we added the PPI it would help our application for credit. I remember being so desperate to buy the car as we needed one for work that we even took out the mechanical breakdown cover. We would of done anything in order to get the finance. At the time we were managers of a public house and so the cover was not needed as we would of been paid a salary even if one of us was ill as you ran the business as your own and had full control over takings and budgets etc and so if you was ill you would of just given staff more hours to cover for you. Also redundancy was not a worry as if for some reason the pub actually closed down, which was very unlikely, you would just be transferred to another one as we worked for the company as salaried managers. I have a copy of all the original paperwork etc and want to try and claim back the credit insurance which was £544 plus interest of £244.80 paid monthly over the term of the loan. I have googled Assocaites and can see that CITI bought them in 2000 so do I need to send my claim to them?
  16. I`ll be brief because I suspect this subject has been discussed elsewhere, however I have trawled through pages of threads without success. I have received my SAR from Welcome Finance for the five loans and HP I had with them from 1999 through to 2002. Aviva have paid up £1700 PPI redress for one of the post 2000 loans but are refusing to pay for the other post 2000 HP Loan as they say the PPI was clearly evident on the form. What they have done in error is state that I was in full time employment. I was working full time, but I was self-employed as a trade plate driver for United Fleet Distribution. That was why I went to Welcome in the first place because they were the only loan company who would lend to me because of my employment status. they gerrymandered the forms saying that I was working full time, without saying I was self-employed. I am going to challenge Aviva on this second PPI refusal. However, my question refers to the other 3 loans which were taken out prior to 2000. Aviva say they were not the underwriters at that time. Other threads on here suggest that the FSCS are only taking responsibility for post 2005 Welcome loans. So who do I claim against for the 3 pre-2000 loans? I know from the SAR documents that PPI was charged and the amounts involved. However, I do not know who was the underwriter. Furthermore, I actually signed the documents at the Welcome Finance offices in Stockport and not at any brokers or loan brokers offices. I am hoping someone on here might save me the time and trouble and point me in the right direction. If it cannot be done, well I will have to lump it, but I now have the proof that PPI was charged on all 3 of the pre-2000 loans.
  17. Hi all, Starting a thread for my new claim for my very old mortgage insurance claim with Countrywide Assured. Having looked around the site I see they are resistant to paying out, especially old claims. They tend to claim it's too old, not covered by regulation and the FOS can't touch them. Nice. Luckily I have old bank statements and tracked down all the monthly payments to the policies. Going to send a SAR tomorrow to see if they have any information on my accounts.
  18. I have got ppi with welcome finance but the debt was sold on to dlc hillesden Here is my case I took out a loan with welcome finance in February 2004 . I was missold ppi and they owe money . My debt was written off by welcome finance in 2006 and sold to DLC hillesden a debt collection company . Now will I receive the ppi money or will it go to the company it was sold to . Can welcome finance buy the debt back and offset it etc . Bearing in mind I took out the loan in February 2004 . I would be very a grateful if you could reply . I read somewhere that losns taken out with welcome finance only loans after 2005 could be offset
  19. Hello again, Is anyone else having real problems with Nat West credit card PPI? I filled out the online form to enquire if i had been missold PPI on two credit cards. A few weeks later i got a letter saying they had nothing on file and couldn't find an account number for me. Got back in touch and said i had specifically asked about credit cards as i don't have a bank account. Absolutely nothing from them. Filled out the online form again and highlighted it was credit cards only. Again nothing. sent letter and money requesting SAR, a few weeks later got a letter saying they had assigned my request to someone and the request only gives me access to my personal data etc etc. 12 may got a phone call from nat west saying they couldn't send the SAR because their carriers don't deliver to Cyprus but they had sent me a secure SAR via the banks internet. I received 38 documents of old statements, 2 letters from me about change of address and 1 bank info saying i had paid extra off my credit card. i did not receive the initial credit card agreement, nor a copy of the letter they sent to me saying they had no information from me. I emailed the chap back via the secure service and it was received the following day and asked him for a full printout of my history, plus the Notes on the Nat west archive and asked what was their data retention policy regarding credit card details. Also asked why they couldn't deliver SAR to me and who were their couriers? this was on 16 May and to date nothing! Any one with any ideas how i should proceed. apologies if this is long winded but I'm stumped and wondering if i should put in a Plevins case if possible. thanks for reading
  20. Hi all, I filled Barclaycards online PPI claim form in regarding an Egg card paid off a couple of years ago. One week later (yesterday) I receive a letter from them acknowledging my claim form and outlining what will now happen. They say they will contact me by 10th March with an update and have also sent a form for me to send back submitting my bank details for any repayment of PPI. So not bad from them! However, I only asked them to research the Egg card but in the letter they say they have found two further card numbers "linked" to the Egg card and will investigate them too. Im not sure what this means. I had other credit cards around that time but they were separate cards from other card providers. They were not "linked" to the Egg card in any way. Could it simply be that they are now responsible for other cards I may have had by way of buying other companies as they did with Egg? Thanks all.
  21. Over the last month or so I have started looking into old loans and credit cards to see if I had mis-sold ppi on any of them. These are all accounts or financial products that I had from about 1999 to about 2006 so pretty old and I had no information about them. I initially took the advice to use the resolver tool before I really knew what I was doing so might have scuppered myself there but after reading through more information and lurking on here I used the PPI checkers on various bank websites such as Halifax and Canada Square who were able to find my old accounts with them send me the account numbers and some have told me that yes I did have PPI. The thing is that even though I only checked to see if I had PPI with Canada Sq. on my Egg Loans and Halifax about an old credit card they both now seem to have opened investigations. At this point I haven't been sent any forms to fill in. Egg initially wrote to me a couple of week ago telling me one loan account number and saying if I wanted to make a complaint I should write to them. I have not yet written to them. However today I received a letter from them with three Loan account numbers (I guess from when I increased the loan amounts) and acknowledging my complaint and telling me they are investigating my complaint and that they will resolve my complaint in eight weeks. I thought I would have to fill out forms to initiate this complaint? It had been my plan to find out if I had PPI, then send a SAR and then make my complaint but if they have started the complaint already then what can I do, is it still a good idea to send in a SAR to these banks then follow it up with the FOS form making my official complaint? I appreciate that banks I first contacted via Resolver are within their rights to start an investigation but can Egg and Halifax start an investigation without my formally requesting one? I still have an old store card with Santander I want to chase and another old credit card I have no details for should I start with a SAR for them? Sorry for the long post I’m just feeling very confused as what to do next!
  22. Hi, I had an account with Natwest, which was shut down about 6 years ago. At the time, I had my Overdraft of £1800 (all owed), a loan for £1000 (£897 remaining), and one for £5000 (£3976 remaining). Due to my financial issues due to illness, I'd had to live off what little credit I had, and after a few months of being unable to keep above the maximum 1800 Overdraft (frequently going to £2000 when bills hit) my account was closed Following this, I was taken to court and something (I forget the technical term now, sorry) was put on my house so that when sold, my outstanding debt to Natwest would be paid out of any monies I received. We have since sold the house to a housing agency (again, lost it due to ill health and financial issues) and NAtwest received nothing because the mortgage was not fully paid off. Following this, Natwest sent debt collectors. MY wife was had by Shoosmiths (for similar level of debt) I think mine were Cabot financial (They currently take £2 a month from me, but I'm sure they said it was passed on however I've received no new paperwork) the debt is now with a debt collector. This morning I got a letter from RBS, regarding my Natwest loan, to tell me that I'm due over £800 in refunds Which will be paid into my account if it is still active, otherwise I will receive a cheque. MY account was closed, I do still get statements every 6 months about what is still outstanding. Will my refund get paid to these account, despite being closed, or will I get it? As if I receive it, I'm quite happy with my current £2/month arrangement and don't wish to just send them nearly a grand, when I've got other bills that are slightly behind now (council tax, water, TV, gas) that I would like to clear off, and I could do that with the payout, and still have a little bit over to help at christmas. As I paid these bills at a time when I owed them nothing, and I was not given a real option of not paying (I was flat out told I had to have it or I'd be refused). To me, they took money they should not have had. it should definitely all be paid back to me, for me to do with as I please. I realise they won't see it that way though, but just wondered if anyone else in a similar situation has had this happen, and received the cheque? As they only send me updates every 6 months, I wont find out now until March, as I got my update 3 weeks ago. :\ So I'm hoping someone here can help me a little sooner.
  23. I complained to Creation and just confirmed that I've had a payout of just over 3k from them in relation to PPI. Had to escalate to the ombudsman, but just received the cheque today, happy days!
  24. Hi All, We recently submitted a claim to the Halifax for PPI on a loan which was sold to us on the basis that the PPI was a necessary stipulation of the application. After 8 weeks of complete silence from the Halifax we today received a letter. The upshot is that they are refuting our PPI claim on the basis that they sent a letter to us 4 years ago stating that they had reviewed their PPI sales process and found that our PPI policy 'may' have been mis-sold. They apparently outlined common failings and invited us to respond if any of these concerned us. Now, apart from not even recalling such a letter or being able to find it in our records; is this sufficient reason to abdicate their responsibility to refund a mis-sold policy? If so, it seems to be a nice way of sidestepping the claim. Now 4 years ago I don't think we were in any way as educated to the whole world of PPI as we are now and so at the time we might not even have thought of ourselves as in the bracket of the 'mis-sold'. However, with greater and greater information and publicity around the whole scandal - we re-educated ourselves and took a longer look at our finances and historical loan applications. It now seems that was all for nought and that even if we were mis-sold, The Halifax can simply state they sent a letter 'way back when' and that's it - no redress. Am i missing something or doesn't that seem particularly unfair and insidious. Is there now anything we can do? or do we simply close this particular chapter and move on.   25. hi all, I used halifax website to submit my ppi complaint. they correctly discovered my old loan and credit card 2004/6 and sent me a 7 page questionaire to complete and gave me six weeks to do so... I just had a text msg to say three weeks later they are still waiting questions: can they really give me timescales to complete their form? do i really need to complete their form... can i send them a completed fos form which requires much less information? shouldnt i send them one sar for full statement for each acciunt? any help would be gratefully received zubo
