  1. Hi, thanks for reading my post, and help and advise is welcomed. I have a PG in August 2008 which I didn't even know till my partner passed away last December for a business which now has been dissolved by company house. Basically my late partner paid all the repayment and dealt with the HSBC alone, I was a silent partner who lost all the saving to the failed business. I have requested and received a copy of PG documents which I have found some irregularities. First, there is no date on the 8 page documents, where is the date needed to be filled all written Do Not Date, it's the same on the second page and last page where the signatures are, all without date. The only paper with date on is on a form called Winessing of Security Forms Aide-Memoire but it's not part of the PG documents (8 pages), and without any original guarantors' signature on it, so it could be filled anytime and anywhere. To be honest, I didn't even know that I have PG, so no advice for seeking independent legal advice nor warning about the risk of PG by the bank representative. I have done some researches about some banks asking guarantor to sign a waiver of independent legal advice to prove the bank representative has done diligence. But in my case there is no waiver in my PG documents nor initial/date on the front page of explanatory note, even no initial where the checker's initial is needed. The total value of the business loan was 40K, now is 26K after my late partner passed away. Any help and advice I will be really grateful. Thank you.
  2. Hello everyone. My first post on here but have been reading various posts for months. I have a complicated one so bear with me but in summary, I am being pursued by a supplier (not a builders merchant) after my company ceased trading as they claim I have given them a personal guarantee. Five years ago, I opened a trading account on Pro-Forma and filled in a 'Trading Account Application Form'. At the time, I was a sole trader and signed a personal guarantee. That's the nature of sole trader - no protection. Six months later, I formed a LTD company and transferred stock etc over to this company. I informed the supplier of this change but they never asked me to fill in new forms for the company. So the forms they have are from when I was a sole trader and there is no mention of the LTD company anywhere on the forms. In their letters, the debt is in the name of the LTD company. Last year, this supplier and myself had a joint venture and I signed a new 'Terms of Trading' for this separate venture as Director of the company. This venture was being treated differently and separately to the core business and so a new form was signed where I gave a personal guarantee as a co Director. It gets more complicated. They have amended the original form from five years ago and added a tick in the box next to 'LTD Company' as the legal entity. The original was 'Sole Trader' - I didn't tick this second box. So in summary, they have added the agreement page meant for the separate entity to the initial account application form in the name of the sole trader, and ticked the LTD company box - without me knowing. Any idea as to where I stand?I would never have knowingly signed a PG in the name of the company for the entire company and its debt. As I said, they have taken a form and added it on to an old business account application form. The one document has dates that are 3 years apart. The wording of the paragraph is as follows: "In consideration of *Supplier*agreeing to open a trade account with the company named overleaf, the undersigned directors of the company hereby agree that should the company fail to meet its obligations of payments for goods, they shall take responsibility for the same" This paragraph is written above the area where you sign but does not have a title, heading, bold writing etc. I think this is incredibly misleading, given the docuement is titled 'Account Application Form'
  3. looking to make a medium sized personal injury claim after an injury last year - which is still affecting me on a daily basis. no idea what to look for in a lawyer/PI claims firm. Specalist ? It was a fallen object on a construction site FWIW. should i check my home insurance for personal injury claim cover, or will that result in higher premiums with no real benefit ? Look forward to pointers ;-)
  4. Hi I'm hoping that someone can give me some advice please. Here's goes, a bit long winded! On Friday 21st June 2013, my friend and I attended a concert at a well known stadium. We had an altercation with another member of the public over a seat and this resulted in a lot of shouting and a drink being thrown (by me). Following the altercation in the stadium, my friend and I were asked to 'come out the back for a quick chat' by two male members of an outsourced security firm. A heated discussion between the 4 of us occurred and one of the security staff went to speak to some members of the public to investigate the incident further. My friend and I were asked to stay where we were whilst this was happening. About 5 minutes later, the investigating member of security staff returned to advise 'we have witnesses, you're in the wrong, you cannot go back to the concert'. I would like to add at this point, no witnesses or third parties were asked to come along to discuss this, we were simply told that we were not to be believed and we could no longer attend the concert. A heated argument occured and a female member of the security staff joined us. At this point there were 3 or 4 male members of the security firm and a female member (I am female by the way, this becomes relevant further along....). I then told one of the security staff to call the police and I was told 'don't worry love, they're on their way'. I then advised a male security guard that I was going outside for a cigarette and I attempted to move towards a rear door to go outside and I was violently pulled back and manhandled by 2 or 3 members of the security firm and pinned to the floor. There was an arm around my neck and one around my head. Both of my arms were yanked behind my back and I was in so much pain, I thought that they had broken my arm. I was understandably distressed and extremely upset, the pain in my arms was excrutiating and I could not breathe due to the hands and arms also around my face and neck. My skirt had also risen up and my underwear was on show. At this point, a male member of the security firm was shouting ' there's no need for this, you're hurting her, let her go'. My friend who was with me at the time was also shouting to let go and was told by the security staff to be quiet and sit on a chair, which she did. At this point, due to the amount of pain I was in and the fact that my breathing was restricted, I temporarily blacked out for a very short period of time. I came to and my left arm was still yanked behind my back by one or two members of the security firm, there was also a hand near my face and neck and I was shouting that I could not breathe and I attempted to bite the hand in front of my face. May I add at this time, that although I attempted to do this, I was unsuccessful due to the amount of pain I was in. The security staff, eventually pulled down my skirt (I'm presuming to preseve my dignity, however at this point it was too little, too late) and I was manhandled off the floor and made to sit on a chair. I am sure you can imagine how understandably distressed I was at this point. A black male member of the security firm, whom I do not wish to implicate came over to me, knelt down and took my hands in his and gave me a tissue and a cup of water. He apologised for the way his colleagues had treated me and told me that 'this should never have happened and I am so sorry it has'. As far as I am aware, this black male member of the security firm had abolutely nothing to do with the way I was treated and he apologised profusely many times, he had nothing to do with the way I was treated. I was then taken away with the police. The police issued me with a fixed penalty notice (section 5) which I paid the very next day. I was also in so much pain the next day, I went to my local A&E who gave me painkillers and xrayed my elbow and left arm and I was advised that I had extensive muscle damage. Anyway.... I then decided to go back to the police to press charges against the security firm for the shocking and brutal was I was treated. The police have done their investigations and unfortunately, there is no CCTV available for them to view as all of this happened in a 'staff area'. The police advised that the CPS may not take on the case due to the lack of CCTV. I've therefore decided to continue with a civil claim for personal injury. However, after making an official complaint via email to the security firm, I received an email today stating that they acted correctly and their 'contractors' were also going to take civil action against me! I've spoken to my solicitor and she thinks that they are scare mongering, however I am concerned even though i haven't done anything wrong! Will the fact that I have a fixed penalty notice go against me, can the police give out my personal information (they don't have it at the moment, other than my name). Hopefully someone can give me advice please.
  5. Hi all, I wonder if you can help? I have a personal loan with NRAM, was £20K but on a DMP and it now has £13K left. Paying £180 per month. Received a letter this morning saying that on the 28th, the debt will move across to some company called Marlin s thought I would call NRAM and see if they will accept a F&F of around £3K. They stated that even if accepted, it will show as partially cleared on my credit rating.... this worries me as I assume it will stay like tat for ever and also, I guess they can sell the remaining debt to someone like Marlin. Can I push for a F&F and request this is "closed"?

  7. Hi, I'm trying to help my gf with a debt. She lent a neighbour money and is having trouble getting it back. The neighbour has admitted to owing the money and I have that in a text message. The neighbour is being difficult both giving it back in whole or in instalments. What are the chances of a small claims court claim, I have done this in the past so know the deal. Any advice would be appreciated.
  8. Hi, I have just renewed my car insurance with the same company for the 2nd year. They are now asking me to provide copies front/back of my paper licence and photo id to validate my insurance. I find this request disturbing, espcially allowing them to have my 'photo' on file. I cannot see how they can justify having my picture id. Surely the paper licence is sufficient, and that the only additional information on the photo id is the photo. I have asked them to explain why it is necessary to have my photo id, but so far no answer. Are they able to ask for this kind of personal data? can I redact the photo image but give them the rest? Thanks
  9. in 2004 I left UK with unpaid personal loan around 8000GBP, Credit card 2000GBP i paid only one installment I was resident in the UK. How do I find out out if an arrest warrant has been issued against me due to this unpaid loan? can ccj become as an arrest warrant against me ? i am traveling to Europe can UK issue an arrest warrant and record it in the EU system because of this loan? Also, what are the chances of being detained at the airport coming into the UK? any expert in such cases
  10. Hi Everyone, I've recently began my claim after reading a lot of stuff on here, on an old HFC Personal Loan Plus account that ran from 2001. to 2007. So far I have done a Subject Access Request and got a list of transactions and a copy of the credit agreement from HFC. At the moment I'm stuck with the spreadsheets to work out the interest I can claim. Do I use the Compound Interest calculator to work out the 28.9% APR for each monthly PPI fee for the time the loan ran which is MAR 2001 to FEB 2007. Then Statutory Interest of 8% added to each payment from the date added to present day? This is all a bit confusing.
  11. My business has gone bust due to bad debt and has led me to have to close my business. I've instructed an Insolvency Practitioner to handle it. Everything seems fairly straight forward, if rather sad and expensive, but the real problem that has become apparent is a personal guarantee I had with my bank and this relates to a business loan to help finance the company when I bought it. The bank made me sign a personal guarantee and put a charge on my house. At the time it was either sign this or don't get the money. Now because I've put the company into administration, I've received a letter form my bank demanding the money personally from me. Can anyone suggest a way I can avoid paying this, because my financial situation is bleak?
  12. Hi all In Sept 2010 my then best friend offered me a job knowing how much I hated my old one that I had been doing for 14 years. He offered me a job and told me to leave the old one and not to worry at all. I said yes, left the old job and started working with him as a manager for his online site and we agreed a salary and to review this yearly with a wage rise to be agreed between us both at the time. I was happy, left my old role and started working for him. in Sept 2011, I mentioned the wage rise he promised and he said that the company wasn't performing as well as he thought and didn't give me a raise at all, saying it could not be justified, I accepted that and never brought it up again. In April 2012, we as a family got into financial trouble and needed help, my boss/friend offered to get a loan for me in his name and we agreed to take it off the salary each month for 5 years to pay it back. The loan was for £7000 and my immediate debt worries were sorted. In May 2012 my father died and I took a few days off, came back to my work and continued as normal, finding it a distraction from what had happened, 7 days later, he sacks me, VIA MSN Messenger! Giving me 3 months notice. I was devastated, I had left a 14 year career and now was left with nothing to fall back on, I struggled to find work for 11 months and on April 30th 2013, had our family home repossessed as we had not got any help to pay the mortgage, we have been left in a major shortfall with the mortgage and other debts and we (wife and I) now face going bankrupt as neither of us have a job yet, despite nearly 400 applications being sent (3 jobs were screwed by references, co-incidence? or nastiness? I don't know, but when I ask to see the reference, the company reply with "the person who wrote it would not give permission to show you" I have a feeling its him, but cant prove it or think of a reason why he would do it. I have now found a part time job, just about breaking even each month and cannot afford to pay anything back whatsoever to any creditors as we just don't have a penny to spare. My question is what to do next. He has started to message me (haven't heard from him since August last year) saying he wants his money etc, where do I stand? What should I do? I know morally I should pay him his money when I get in a position to do so, but legally, theres no signed agreements, no loans in my name and the way he screwed me over a month after giving me the money in the 1st place has left me very peed off to say the least. What would you do?

  14. Hi I am having problems with the above company, I sent me claim in Feb and received a letter telling me the signature was different to that on my original agreement. I then replied with a copy of my marriage certificate and have heard nothing??? I am about to follow up again can you please send me the email address to send this too, that way I have a record of exact dates etc! Thanks
  15. I am off work at the moment with depression. My spouse took the sick note in and my boss started launching into a conversation about how useless I am at work, and how I will be having disciplinary procedures started against me soon amongst other more personal criticisms. Also my boss told my spouse that I could give less than the required level of notice if I wanted to leave and if I left now I would leave with a good reference, but if I went onto the disciplinary procedure my reference would be compromised. I have been bullied by my boss for months and now other colleagues are seeing me as incompetent due to the way I am portrayed by my boss and I just couldn't face it anymore, i was having panic attacks and was really depressed and my husband refused to let me go into work one day and took me to the doctor. I have a sick note covering the absence but after only a few days off a note has come home telling me that I have to fill in a form to allow the insurance company at work, access to my medical records. I didn't want my spouse being told all of the ins and out of work, now he feels very involved and upset. Is it legally ok for my boss to discuss me and my work in this way without my permission? thanks for any advice.
  16. Around Xmas time I applied for a Vanquis credit card, that despite the high interest rate i've had no problems maintaining. When you apply for Vanquis, they have a neat 'trick' that ensures you give them your phone number as they need to call you back post-application to try and sell you services you don't need, such as an expensive cash advance or a PPI plan that isn't really PPI but is a bit ropey nonetheless. I went for neither, but that's not my issue. since this application, i've been receiving daily calls - you know the ones - "I'm calling to talk about your Payment Protection Insurance" in an automated voice. This is annoying, but I just hang up. During the past few weeks, i've started to receive texts from 1st Credit, along the lines of "If this is Mr Danson79 call this number to talk to us urgently". Today I had a phone call, that when I answered was an automted voice asking me to 'press 1 if you're Mr Danson'. I hung up and Googled the number straight away, and it belongs to 1st Credit. The same google search brought up that 1st Credit are a DCA Vanquis use when people fall into default with them (which I am not). I never give my phone number unless I really have to and i'm utterly convinced that Vanquis are selling my info, which would be in clear contrivention of the DPA... However I cannot prove this... is there any form of disclosure I can use to try? And have any other Vanquis users experienced an increase in dodgy calls since applying? (For the record, I have had dealings with 1st credit in the past, whom I sent packing thanks to a total lack of cca - ICO were involved etc. I know they're phishing, which seems like a good way to handle data that they've received in this method - harass the phone number and hope I trip up and confirm my name and details to them). Apologies if posted in the wrong forum!
  17. Hi All, looking to a bit of advise. My Limited company is now insolvent. I am being per sued personally from a couple of trade creditors. THEY SAY I SIGNED A PERSONAL GUARANTEE WHEN I OPENED A TRADING ACOUNT. I was the managing director and signed the account forms in that capacity. They are pursuing me personally. What do i do and are they right to pursue me ?
  18. Hi Guys, Need some help urgently..... I got a personal loan from the above bank over 2 years ago, it was to do major home improvements at the house i share with my hubby. Paying every month without fail, but started to struggle when my husband got made redundant and i had to take take over all the bill paying. I approached my bank manager to ask if they would consider taking a reduced payment till we got back on our feet, but they wouldn't accept that, and told me to get advice regarding debt, so i did. I approached Payplan (one of the banks suggestions), and they negotiated with the bank to take a payment of £127.00 per month instead of the £241.00. I was really relieved by this, and its made things easier with my hubby still not working. But the bank have sent me a statement of account and and i'm now in a worse position than ever. I gave Payplan the oustanding balance of the loan, they did say that interest would not be frozen, but the bank is adding almost £200 per month to the loan and i owe more now than this time last year when i was paying the loan as agreed. I'm really scared about this, i spoke to payplan and they said they couldn't help. What can i do. Grumpy

Hi Guys, i was looking through my old financial files and found an old paid off loan i had with HSBC, now i know that there's been a lot of noise in regards to PPI's and getting the extra paid back. the loan was taken out in 2001 and then re-packaged with the same terms in 2002 - the loan is fully paid nothing is outstanding, but now looking through the old paper work i can see that i was paying for "Credit protection insurance" would i be wrong in assuming that this is not PPI? and if it is PPI payment how do i go about claim back the money which in the initial loan was 8k and £2,311.67 was added as Credit Protection Insurance Loan on the 7-08-2001 & when it was repackaged it was£8,670 £2,495.56 added as Credit Protection Insurance Loan on the 19th of Nov 2002. I'm curious to know if i have a case and if yes can you please advise on how i can engage with HSBC to get this money back? i really don't want to use one of the firms that advertise on the telly since i don't think they can't be trusted. Any advise is welcome please, i have signed paper work but per say its classed as Credit protection insurance and not Payment protection insurance. Cheers Red11
  21. Afternoon, Some years ago it is claimed I had a PG (joint and severally liable - partner is away for good) with a brewer and 5 years ago we went under. I have heard nothing from brewer until 4 weeks ago when a recorded delivery letter arrived at an address that I do not live at and today at an old workplace the same letter. Only because of contacts there I have heard about this. Both letters have been sent back via royal mail but contacts got a look at them before doing so. The amounts stated in their letter are overstated in my view but as yet I have not had any direct contact from the solicitor acting on behalf of the brewer. If indeed it can be proven that a PG exists and that I am liable I am concerned that if I engage I will ultimately be made bankrupt and given i have recently left my job with a severance package lose all of that as it doesn't cover the full claim and that and in the end I will be unemployed without any savings. The other option is to engage but would they be prepared to take so many pence in the pound deal? I feel I'm damned if I do and damned if I don't - I do not have any assets except a car and live in rented accommodation. To be honest I need some signposting as to who the appropriate people are to discuss this issue with without compromising either option and what possible outcomes are best pursued.   22. firstly i didnt have a clue were to post this one ...appologies to admins if it needs moving Hi there i recently missed a court appearance regarding theDVLA Anyway the case was delt with in my absence and i was fined(alot may i add considering the offence ) Someone rang me 2 weeks ago and said “hello Mr yelow yourin the local paper it says you were fined £$$ and it says your age and home addressis Is this right ? I would have thought there would be somthing in dataprotection / human rights article 8 I realise the public interests thing regarding court casesbut i think printing my home address in the local paper is wrong Is there anything i can do ?
  23. Hi, Due to my own poor and inexperienced business decisions, being too generous with customers particularly in this economic climate I have been forced to close my business. I am/was a sole trader. I now work in Asia and have no plans to return to the UK at all. The job I have, for the moment, is enough to survive here and contribute with payments to my ex wife for my sons upbringing but not pay the debts I have in the UK, either business or personal. I think I will earn more as time goes by but right now this is all I am able to cover realistically without going into serious hardship. Much as I tried to keep up payments on all personal and business debts, eventually at the end of last year it became obvious that it could not be done. I would barely be able to spare £50 a month to all my combines creditors and think it is very unlikely that they would accept any offers. Further down the line I would be able to increase payments but am wondering if I would be better off going down the route of bankruptcy from abroad. I have spoken to national debtline and they say try and negotiate with the creditors or go for bankruptcy but be very careful which company I choose to do this for me. On the personal debt side of things, I think it would be possible for me to negotiate considering I am in a non reciprical country and I think they would either accept or if not then I doubt very much for the amounts involved it would be worth them pursuing me, if indeed they can. I will summarise these below and would welcome any advise. After this I will go to the business debt and the one Debt collector I am concerned about and would be expecially interested to know what people think. Many of the personal debts are now with debt collectors. PERSONAL DEBT CREDIT CARDS BARCLAYCARD £4000 MBNA £5000 LOAN SANTANDER £1500 OTHER VODAPHONE £1200 OVERDRAFT BARCLAYS £500 In regards my business debt, I owe one of my suppliers about £12,000. I was paying them off as much as possible but not enough as far as they are concerned and my debt has been passed to a specialist business debt collector and is now increasing with interest being added. This collector has offices all around the world and collect debts both in the UK and obviously internationally. Now that this company is involved it has made me consider bankruptcy as opposed to trying to negotiate whatever small payments I am able to offer as I do not feel they would accept them. I am concerned about what they can do to me in the country where I am now. I have no assets in the UK and no money for them at this point but this may change in the future. Would bankruptcy be the best option or making a token offer. Should I reveal to all the creditors where I am? In doing so it would hopefully stop any visits or calls and letters to the address in the UK they have for me, where family members reside. Any advise much appreciated on all aspects.
  24. I took out a secured loan in 2003 for £25k that had ppi attached. I had other policies etc. to cover my mortgage and 2nd charge in the event of redundance, death & critical illness etc. so do believe I will claim it back. I called Endeavour Personal Finance who told me that yes it did have ppi attached but I had gone via a broker called CT Finance. I called them and they said that since the loan was taken out prior to 2006 1. The insurance was brokered prior to the regulation of general insurance by the Financial Services Authority. 2. Central Capital Limited (the broker) was not a member of the General Insurance Standards Council (GISC). 3. Central Capital Limited (the broker) was not a member of the Association of British Insurers (ABI). 4. The sale took place moer than six years ago. They are saying this is their final response with the usual garb and leaflet for the FOS. Can I still claim?
  25. Hi guys. Trying to sell my car. The dealer is asking for a notice of clearance from Santander as I took a loan to buy the car. This loan isn't paid yet, but as its a personal loan it shouldn't have any bearing on selling that car. What is this notice? And why, if the car is mine do they need it? Thanks.
