  1. Hi, hope somebody can help. My husband gave his notice, which was a month, but as he had 8 days holiday left the Employer agreed to take this off his notice. So instead of his final working day being on 10th April his last day was actually 31st March. He got paid his full month's wages on 1st April and has received his P45 (only partially filled in but that is another story!) but has not been paid for the 8 days holiday/notice. Can someone please confirm that we are correct in assuming they have to pay him for the outstanding 8 days? Any help would be brilliant. Thanks in advance.
  2. I am currently employed on a contingent contract (temporary) which requires no notice on the part of either myself or employer. From 1 April we are moving to a fixed term contract which requires a months notice. We were told about this over 2 weeks ago when we were also informed that our salaries would be brought into line with permanent employees. One can only assume this means we will be on a lot less money as the manager has been heard saying on the phone that we will all walk out if we were offered 'that much'! To date we still do not know the rate of pay but have had no choice but to apply for our own jobs if we wish to continue to work there. Today I have been offered a job elsewhere which I have said I will take. Due to the criminal security checks involved the start date won't be until end of April. I'm loathe to hand in any notice to my present employer in case anything weird comes back from the vetting check (inaccurate records etc) and I also have a slight concern about a blip with my finances where I am paying an agreed amount each month to a creditor. Question 1 What can my present employer do if I don't hand in a months notice and just give a week's after the 1 April Question 2 Are financial records searched for criminal vetting!   3. Hi I have two questions that I hope someone can help me with 1. I was awarded ESA SG in Sept 2013 without any interview/assessment (I did have previous advice from this forum). I have not been told how the decision was made and the time/length of the award. My Benefit Advisor told me to ring and ask for a particular form or something but the DWP Person on the phone was a bit abrupt and just said I would only need that form for appeal and said I can be reviewed at anytime. Im in Glasgow and my turnaround time was within 6 weeks and a total surprise. Just don't know how I was awarded it points wise etc. I didn't want to push it just in case it triggered an unwanted review so let it drop. Since then my sister and brother have both been told in their award letters the award period. So I feel a bit in limbo. Stupid I know but I hate the unknown. Should I be asking for anything in writing? 2. I thought migration from IB/SD to ESA was to be completed by April 2014. A friend of mine is worried senseless just waiting for the letter to drop through the letter box because they have not heard anything. I know there are delays etc but I cannot find anything that states the April deadline is to be extended. Any advice will be appreciared

Today I was called into the "office" at work by my regional manager, he had a go at me about not filling the "quick quote" forms out properly ( no one in the whole business fills these in properly .. including my store manager) He told me If I did not start to fill them out properly and if I didn't sort out my sales ( I am on £3,500 for the month ... my store manager is on £6,500) (Last month I was on £15,000 the month before £10,000 so its not as if I don't sell)the he will end my probationary period and I will have no job. I have had a look over my contract and no where in it does it state I am on a probationary period, when I started I was told I only had a 3 month contract (which should of ended 18/02/14) Yesterday I was told I was actually taken on as a 12 month contract (again it does not state this in my contract) So before I start questioning my Manager, Regional Manager and the company in general I thought I would get my facts right first Should my contract state how long it is for ? Should it state if I am on a probationary period, and how long this is for?
  5. Hi. Just looking for some advice on claiming PIP (Personal Independence Payment). I'm confused regarding the so-called 'qualifying period'. I've read that it's 3 months minimum that a person has been affected by a disability. But it seems as if you don't need to wait when making a fresh claim. I've been diagnosed with a condition for only a few weeks, but the Dr has agreed to provide ongoing Fit Notes (as she's aware of an ongoing claim for ESA). Do I have to wait until 3 months have lapsed to make a claim? Or can I start the ball rolling now? Many thanks.
  6. Hi there I finished my last job on Thurs 19th December 2013 with one week's notice paid out. This notice fell between two bank holidays (Weds 25th and Thurs 26th) My employer decided that I left on gardening leave for that 1 week as I left to work for a competitor. I would have had those 2 days off paid if I had worked that week Would that mean I am only eligible to be paid 3 days (20th, 23rd and 24th) and miss out on the other 2 days (25th and 26th) or should I have gotten paid for those two bank holidays?....... I ask as I have not been paid anything from my last employer even though I had a weeks notice and had 3 days holiday pay left. Their excuse for not paying me was because I was overpaid for the month which was paid out on 23rd Dec but if I add the 5 day notice from when I left and the extra 3 days holiday to that then I should be paid for 2 days holiday. I.e (20th, 23rd,24th,27th and 30th would have been my weeks notice and then 1 of my 3 holidays that I had left would have been used for the 31st), Am I correct or are they not obliged to pay for bank holidays?
  7. 2 of my family members are soon to lose their jobs due to the outsourcing at NPower, The redundancies were announced in November and a 60 day consultation period was announced. The consultation ends next week and then both of these people expected to work their respective notice periods and then be paid any monies due. It now seems that no actual date for finishing their jobs will be forthcoming and so they are unable to commit to a new employer without losing substantial amounts of money via redundancy. What should really happen in these situations? Should NPower have given finishing dates so that they could sort out their futures without having to lose out on many thousands of pounds? Or is what NPower are doing proper practice?
  8. Hi All, I would appreciate any advice here please. I had a 3 month probationary period on my new role of 3 months. I started on the 9th Sep and it should have completed on the 9th Dec. My new boss started in Nov and I had no formal review or update meetings. Out of the blue I had a meeting called, and without realising it would be on the agenda he said he wanted to extend my probation. He also said he wanted to change my contract terms slightly, but the main issue I am asking for advice on is the probation as it’s the difference between having 1 week and 1 month notice if they do get rid of me. My question is can they extend probation this long past my probation period or do I default to standard contract terms? Thank you! D
  9. Hi I started work for my current employer on 25th November and have a four week notice period. However, I have today been offered another job (it's an IT contract role) to start next Monday, paying twice as much money and closer to home. I have spoken to my manager and he is unwilling to negotiate on the notice period. Is there anything I can do? If I just leave on Friday, what's the worst that can happen? The current job is 230 miles from home so I'm required to stay away during the week. My partner is currently pregnant, and we've also recently found out that it's twins, so working closer to home, and especially for twice the money, would be an advantage. I interviewed for the new job back in October, so before I started the current job. It's just that the wheels have turned very slowly, so I ended up taking the current job to tide me over.   10. Hi, need bit advice if possible please, as most of you know I started a new job on 12/8/2013 after being unemployed for nearly 2 years. I am a delivery driver with a well known cash and carry company, well of course most jobs give you a probation period,mine is 3 months. Well everything seems to have been going well and have had good customer feedback until recently when we had a lot of managers form other branches suddenly appearing on the scene, I just carried on with my job as normal but one of the managers seems to have it in for me for some reason and keeps questioning me over things like, why are you not picking orders or on the shop floor or the tills, I said I was employed as a driver ( no contract yet ) and went to see the boss who employed me, he said I was employed as a driver and nothing else, I thought the matter was resolved but again he starts on me so again I spoke to my boss and he now changes his story to you are employed as doing most jobs and you are on probation, this now keeps getting bought up by the other manager so looks like come November 12th I will be out of a job. I was taken on as I have a CPC licence which they were looking for, sorry for long post but just when thought getting back on my feet I have this hanging over me, also my overtime is not being to me ,most weeks it is not on my wage slip yet I clock in and out, we keep a record of my hours also.   11. I started work on the 17th October for a small travel agent, but after a number of incidents it looks like I need to get out asap as they appear in dire financial straits. After six weeks they are still uable to provide a PAYE reference, despite daily chasing. Whilst contacting HMRC on 29th Nov I found they have still not received a P46 to inform them I have started work and still have me listed as unemployed. Their landlord has visited the shop, shouting the odds and demanding arrears paid in full or will start eviction proceedings - he also mentioned their references hadn't checked out but didn't care as long as he got his money. They frequently argue with utilities over size of bills. The biggest stumbling block has been getting paid. After informing them in writing that I had concerns about the HMRC status and the lack of PAYE info, I requested confirmation that the wages would be paid on time, as well as a copy of my payslip as I need it to finalise a housing benefit claim. As I was short term unemployed I didn't get rent run-ons or back to work grants so we'd struggled a lot - a timely payment was absolutely essential to pay the rent etc. I was given a payslip on 28th November and told the money would be in on the 29th. It wasn't paid in, so I called into the office (as I had friday as a holiday) to find out why, only to be told the accountant had sent a cheque (which they couldn't produce) but it should be sorted in 3 or 4 days. I pointed out this was not what we had agreed upon, and that my landlord was the type to look for new tennants if a payment was late. They then made a range of contradictory excuses but eventually promised to pay in £500 on 29th and the rest on the 30th. When nothing had gone in on 29th (payday mentioned in T&C and employment offer) , I contacted them again to chase payment and the excuses came thick and fast, one of their on-line banks was down, then they were juggling funds about, then they insisted the 'in-hand' element was one-month and I was only due a smaller amount (rather than the two-weeks in hand mentioned in their offer of employment, and contradicting the payslip they had issued) After mentioning I'd tell the landlord he was unlikely to get paid they suddenly had funds available to pay the wages in full and transferred them within two hours. When started the job I did get a copy of the statement of particulars of employment that I refused to sign as the holidays were below the statutory minimum and I had issues with a couple of other elements - a new one was supposedly being drafted but never handed to me. In the initial terms it mentions a notice period of 1 week after a month of employment. I'd need to give one week notice in writing. At this point I feel the working relationship has broken down irreparably and would prefer to resign with immediate effect as I don't think they'll be solvent for long. If I resign without notice could I risk losing the wages held in-hand for the first two weeks?
  12. Hi I started a new job at the beginning of october. The day before starting I broke my wrist. However, I've been able to do my job and as far as I know there were no issues with my performance. Last week, the day after I had my splint removed I was asked to lift heavy boxes (not usually part of my job) and shortly after my wrist and hand became sore and started to swell. Few days later it was so swollen I couldn't dress and now have to keep it raised. Was off work for three days last week after being advised complete rest for it and having it raised to reduce swelling and had hoped to return today but still have to see the doctor. It's still swollen though not as bad and I have some limited movement in it. I'm really worried how this will affect my probation period. I'm reluctant to take any more time off incase I'm let go but I'm worried going back too early could leave permanent damage. Any advice would be gratefully received.
  13. Hello, I moved property 3 months ago. When I chose this location, there were several factors which were very important to me. 1) A NTL connection had to be available, which the estate agent told me was available, and they even showed me the NTL connection. 2) That there was CCTV around the entire property, which there appears to be by various cameras placed around the property. Since I have moved there, I have found out that: 1) The NTL connection is infact a dummy and does not work. I approached the letting agent about this and got the following response: ********** Response: With regards to the NTL. This is the first ive heard about it. And as far as i am aware if you are in a non serviceable area then NTL would'nt install a connection point. If there is a connection point Joseph would assume like anybody else would, that NTL would supply a connection there. ********** 2) The CCTV camera's are ALSO dummies... I also approached them about this and they came back with the following: ********** Response: With regard to the CCTV this would be down to the Managment Company (SLM) TEL: 01482 328068. ********** Now why do I feel like I'm being fobbed off here and that the buck is being passed on. What options do I have to sort this out? Also in light of this, can I dispute the £120.00 administration cost which they said was for 'administration and credit checking'? Thanks and Regards Adrian
  14. In 1994 I obtained a mortgage. A condition of the mortgage was that I had adequate insurance to cover buildings and contents. The mortgage company said the most convenient way to arrange this insurance cover would be for them to arrange it. They would also decide if another insurance company was supplying adequate cover. To do this I would have to pay their expenses of £25. Rather than go through all this I agreed to the mortgage company arranging insurance for buildings and contents. After 5 years I found out this combined insurance was about twice as expensive as other insurance policies offering the same cover. When I stopped paying I was forced to pay the mortgage company a fee of £25. I was also told to take out separate Life insurance to ensure the mortgage company would be adequately protected in the event of my premature death. The mortgage company told me which insurance company to take out the Life cover, I had to pay the insurance company separately but the mortgage company was the sole beneficiary of the insurance. Faced with no other alternative I took out this Life insurance. I paid if for about 5 years until 2000. I found out about mis-selling of various insurances just a year ago when Lloyds announced it could not defend PPI claims and CMCs' sprung up everywhere. Questions: * was the Life insurance mis-sold, * is it now too late to claim as it was more than 6 years ago, * if not too late is my claim with the mortgage company or the insurance company * can I claim to recover the contents part of the combined insurance * can I claim to recover the difference in cost between the mortgage company buildings insurance and the subsequent insurance company I chose * can I claim to recover the entire insurance
  15. Hi all, firstly, thanks in advance, I get a lot of good advice here I have been offered a new job, which I have accepted. They would like me to start in just under 3 weeks, however. My contract states that I must give 8 weeks notice, and that they (my current employer) could give me one week if they wanted to let me go. I want to just give the notice to leave in 3 weeks, is there some way they could penalise me? I can scan a copy of the contract tomorrow if that helps, thanks! andy
  16. In 1993 I took out a mortgage. I was told that a condition of the mortgage was that I paid £14 per month PPI for accidents and unemployment. After about 15 months I changed building societies and I'm not sure if I paid for PPI to the new lender. (I just cannot find out) I have been reading the Limitation Act. am I right in thinking (a) that for mortgages and other secured debts the limitation period is 12 years and (b) the limitation period for reclaiming PPI is also 12 years. If I am right then this still leaves me outside the 12 years BUT is it true that the limitation period runs from the time when a person could reasonably have known they could have a claim. In my case this was the case where Lloyds realised in 2011 that they would lose any court actions over PPI. Am I right in thinking this. If I am could 2011 therefore be the start of the 12 year limitation period. Generally the Limitation Act 1980 seems fairly straightforward but there are parts that I find difficult to understand. Can anyone please help me out; it seems to me that the limitation period of 6 years for say unsecured debt applies IF your lender doesn't contact you about the debt, and you don't acknowledge the debt in writing, and -you don't make any payments towards it... My questions; 1, Must ALL three conditions exist or just one 2, What is meant by the term "Acknowledge" 3, Does the six year period start from the time a creditor is informed that no more payments will be made and none are made 4, Does the six year period restart anytime within the six years if the creditor just tells the debtor that they owe money 5, Does #4 apply if the debtor refuses to answer correspondence

Started work for a company on 10th June 2010 pay rises are on 1st July every year didn't get the pay rise as they said I wasn't entitled to it as I was a new starter and still have never received that pay rise but have had my yearly pay rises the same as everybody else but people on the same grade as me are being paid more as they got this pay rise. Should I not havebeen entitled to it after I passed my 6 months probation Also could this pay rise be back dated
  18. Hi all.I have just received a letter from a Council about a parking ticket from over 2 years ago.21/04/2011. It states that i did not clearly displaya valid ticket. At the time I recall sending an appeal. I never heard anything and assumed it was upheld. I have not received any further communication since the original date.

  20. I am currently on a Fixed term contract which expires on 25/4/2013. I have had no indication as to if it is going to be extended or if I am to finish on this date. I have been working for the company since September 2012. As I understand it I am entitled to a weeks notice if they do not intend to renew. This is impossible as it is now 6 days away. What is my position with regards to this?
  21. I am currently claiming IB JSA jointly with my partner. My partner is the principal claimant. We have recently applied for mortgage interest relief in relation to my flat having been on benefits for more than 12 weeks. It looks like I may be separating from my partner. As such I'm trying to find out if we separate and I go on to income support (we have a daughter aged 1) whether I would need to wait another 12 weeks as I'm a new claimant or whether the MIR payments could continue albeit in my sole name? Any advice would be gratefully appreciated.
  22. Hello All, I finally managed to secure myself my next job, however I am not too clear about somethings before i hand in my resignation letter. Our holiday period runs from Beginning Feb 2013 to end Jan 2014, and I am entitled to 20 day per annum which means every month i work i should get 1.67days. When I work my notice do i still build up holiday entitlements? i.e more days as i want to take those days at the end of my notice period so I can start my new job earlier.

I am renting a flat since 2009 as assured shorthold tenancy (AST), every year it was extended for another year with the break clause saying: 'any time after six months or after a similar period following a fixed term extension to the original tenancy, either L or T can invoke a breaking clause providing 60 days notice. Now, the last extension was signed from 15 Aug 2011 until 14 Aug of 2012. I have served 1 month notice to stay until 14 Aug 2012. However, the landlord says that as per contract it should be 2 months. Do I understand correctly that given that my fixed term of 6mo has ended, my AST contract became statutory periodic tenancy which is payable monthly. Given this, only 1 month notice is required. Please advise
  24. Hi, Im new I need some advice. Basically my son goes to a childminder and has done for 1.5 years. On 8th January she handed me a letter and told me it was her notice letter and that her and her husband were moving away in March. I read the letter which was undated which said this wa sher notice of terminating contract no mention of a final date. She said she could work up until 28th March but she was telling me now so I had more than enough time to find another childminder. Four weeks passed as per our minimum notice period and I told her on 4th feb that as of 11th feb louie would be with his new childminder. (four weeks had passed since she gave me her notice) she has said I told u I could work up until March 28th you have to pay me until then which amounts to £1200 or give me four weeks notice as of 4th feb because ur ending the contract. I said you given notice already and the four weeks notice period is up as of 8th feb. she said this isnt the case as she told me should could work until march 28th but gave me notice early. I said either way I would not send him back as she has a puppy and a large dog and the puppy keeps jumping up on my son and scratching his face and I do not think it is safe. so either way he wouldnt be returning anyway. Now she is threatning me with legal action and she said she has a copy of the notice letter that states her end date was 28th march the copy I have does not have this date on it. I have paid her up until the last day she looked after my son however I do not see how I owe her any more money. Ay advice? PLEASE!!
  25. Hello Could someone confirm please when the 3 month period to submit a claim under the ETA commences (unfair redundancy dismissal). Is it when a notice of redundancy is first issued, or the date when you actually become redundant. My notice period has been extended, does this make any difference? Many thanks. C
