  1. Morning all, I have had ongoing problems with Lloyds since last year since they decided to split things, I was told I would no longer be under one manager who I had direct contact with through the North Midlands Agriculture ofice as this would be closing and I would have to deal with the call centre managers, for the last year I have had no sense out of them when contacting them and not even a letter of acknowledgement when writing to them never mind a reply, anyway to the crux of the matter, things have been tight on the business last couple of months and I have gone over the overdraft a few times, however despite me trying to talk to them about it nothing has been resolved and now they have started bouncing direct debits and cheques if they would take it over, however when applying thier own charges they have allowed these to take it over which I will then be charged on again no doubt, any advice appreciated, getting sense out of a call centre manager is like getting blood out of a stone!
  2. Good Morning All, My dad took out a couple of loans and credit cards in the early 1990s with TSB (Later part of Lloyds). He was advised at the time that he could not take out the products unless he also took out PPI. He did not need the PPI as at the time he had a very good job which had an excellent sick pay/redundancy policy. He recently tried to claim this PPI back through a claim company. The claim company were eventually sent a Data Subject Access Request showing basic details of the accounts my Dad held with the TSB. Lloyds (TSB) claim that my Dad did not have PPI on any of the loans or credit cards. He knows that he did but has no way of proving otherwise. The Loans and CCs were taken out so long ago he has no proof. The claim company have since sent him a letter along with a copy of the DSAR stating that they have rescinded their contract with him. My first question is this, where does my dad go from here. He knows he was mis-sold PPI but has no way of proving this. Secondly, If there is a way of proceeding and he was successful in his claim, can the Claim company demand any of this money from him?   4. I would be so grateful if I could get some advice please as to how to proceed. I have been through the forums and managed to totally confuse myself now and am panicking over what we should do. A CCJ claim form arrived for my Husband in regard to a Lloyds CC debt dating back to 2010. The original debt was for £1250.19 and has now increased to £1619.82. He knows he owes them money. They might owe him money to in regard to the charges piled onto this cc account including a monthly cc insurance protection fee. The question is how to proceed and after reading through some of the threads I am not at all sure now. If he completes N9A does that mean that he would have no recourse to claim back any monies owed to him? Sorry if I am rambling but I have managed to get myself into a right state over this. I have a long term illness and he looks after me I want to help him as much as I can.

This is a long shot but wonder if anyone could advise I had a £7,000 loan from lloyds with PPI .. if i remember rightly it was around 2000 . i fell in money problems - basically living off credit cards , fell behind with loan repayments and ended up around £1000 overdrawn which got bigger and bigger with the constant charges , and fees for letters to tell you , your were overdrawn after burying my head in the sand for ages i finally set up a debt management plan with CCCS to pay off the lloyds loan, overdraft , MBNA, egg and barclays. Lloyds refused to accept if for about 9 months (the CCCS advisor told me this would happen, even told me which depts would write to me and what colour the letters would be !! ) so for 9 months masses of charges were added to my account , every month they would debit for the loan repayment, PPI and missed payment charges etc , then finally they accepted the DMP - by now with around an extra £1000 + added to my overdraft !! i slowly paid off everything with my DMP and slowly just had LLoyds left to pay ( i upped payments and as one creditor was paid off , assigned the rest to lloyds. ) This took about 5 years to pay off and i came into a bit of money and asked lloyds for a settlement figure which was around £3600 - as i had kept up my DMP, upped payments etc they rounded it off to a final payment of £3000 , which i paid. would it be worth doing a SAR to try and claim back the charges, and PPI - i would understand if they no longer had any record of me - but if they did have details of my current account and loan account would they refuse to pay anything as both accounts were defaulted and came under a DMP ? PS : for the record if anyone is interested Barclays accepted the DMP straight away and so did EGG - MBNA argued for about 3 months but then accepted it , LLOYDS took about 9 months+ before they finally accepted it and stopped all interest and charges
  6. I am new to this Forum. Thanks for the great works you all do here. This is my first post. I am helping my wife who made a claim against Lloyds Bank plc, for refund of mis-sold insurance protection products (IPP) premiums. She obtained judgement in March this year. But Lloyds applied to set it aside and filed a Defence. The amount claimed is £1,274. We have drafted the Reply to Defence, which we have to submit on 17/08/15. But the Reply, (together with the Defence) need looking at or reviewed before we submit. Please, I should be very grateful if someone or the administrators or moderators can send me your email so I can forward a copy of the documents for your review and return by Friday 14/082015.   7. Hi all, I'm getting a bit lost with the huge wall of information available on the site, and I was hoping someone could point me in the right direction to help me straighten things out. I've had several thousands taken from me in bank charges in the last 7 years (I know you can only claim for the last 6, found that much already!) mostly because the charges themselves have dropped me into an unauthorised overdraft so I've been charged on them too. For the last 3 years I've been on benefits and the charges have kept coming in. I'm not at the point where Lloyds TSBs new charges system is REALLY going to sting me. I was making payments on the overdraft of 10 pound a month and was a few days late paying one month. They put a 15 pound unauthorised overdraft fee on for that, then a further daily charge (I forget how much without checking the paperwork) to go with it. Because those charges were taken there's no way I can bring my account back into the "authorised" overdraft without starving my family! Given the current situations with claims being put on hold while the test case goes through, what options do I have open to me? I'm getting calls from Lloyds TSB now threatening to pass the account off to debt collectors when it wouldn't have been a debt if it wasn't for the stupid new charging system! It's at the point where they'll charge 215 pound a month (15 pound unauthorised overdraft and 10 daily charges of 20 pound)! Thanks for any advice or "direction pointing" anyone can offer, Steve
  8. I sent paperwork to them a couple of years ago, which they rejected. Two weeks ago, out of the blue, a reversal of their earlier decision and an offer of £5K to settle, which they credited to my account last week. Seems like the regulator is finally making some progress.
  9. Hi there (I apologise for the essay in advance) I'm requiring some assistance which seems to be somewhat of an emergency at the moment. While I was at university I had a student account with Lloyds TSB. Everything was fine and there was regular money going into the account , however towards the end of university I had accrued quite a significant amount of debt (as most students do) and as my student account became a graduate account I had gone over my overdraft limit by a few pounds and I had started incurring overdraft charges that were equating up to a substantial amount. I made a small deposit into my account in 04/2009 and that was the last time I used my account, from then on the charges carried on going, however I didn't use the account whatsoever. The closing balance for the account was around £2300 and the account defaulted on 12/11/2009 according to my credit report. This account has been passed around to various DCAs, but was bought by Lowell around 3 years ago and they have passed it around to their other companies (Bryan Carter etc.) I have never made a payment to this balance and I've never claimed that the debt is mine. I sent Lowell a prove it letter a few months ago and they responded in May 2015 by sending me a copy of the last few months of bank statements for the account with Lloyds TSB. The statements also stop at 11/2009. Lowell since then have been sending me letters every week or every two weeks, and last week they now claim they are trying to "escalate" the situation. I'm unsure if this debt is already statute barred or if it will be on 12/11/2015, my concern is that should I send a SAR to Lloyds in order to obtain any information as to when the overdraft was officially withdrawn? and if so should I contact Lowell in order to tell them I have requested additional information from Lloyds.   10. Hi. Long time since I last posted on CAG. I am hoping someone can help me guide my Brother. He had a loan for £1000 way back in 1991. PPI single premium was added making his total loan £1,112. He still had his original loan agreement which made it very easy to fill in his claim form for missold ppi. He originally had gone to his bank to take out a pension plan with scottish widows (still running) whilst there he was encouraged to take out a loan also. That was his first and last loan! On to the misselling of ppi, when he called back into the bank to sign the paperwork for the loan, the form had been prefilled. He hadnt been given a choice on taking out the ppi. he states that when he questioned the figures prior to signing it was only then he was told it was required for the loan. lloyds letter just consisted of a breakdown of his ppi figures and conclude that he is entitled to a refund of £6.33 including interest. Im a little bemused and wondered if I should be doing a spreadsheet to include 8% interest? Any help would be greatly appreciated Thanks in advance P.S The offer letter arrived Thursday and the cheque arrived this morning. Quick service.....
  11. **Please accept my sincere apologies if I posting this message in the wrong forum (newbie)** Please can I have some help/recommendations on the following?: In FEB 1994 I took out a mortgage with Lloyd’s Bank (the underwriter was Blackhorse) and the term was for 12 years (FEB 2006). I moved in DEC 2000 and still kept my mortgage with Lloyds Bank but the underwriter was now Cheltenham & Glouster, in 2001 I paid off the mortgage following redundancy payment from my employer. I have found a PPI policy for the Blackhorse mortgage (I assume I paid PPI on this from FEB 1994-DEC 2000) but cannot find my Cheltenham and Glouster mortgage PPI policy. I do recall in 1994 that I was told I needed to take out the PPI policy in order for the mortgage to be accepted but I didn’t need the insurance as I worked for ‘Lloyds of London’ and would have been covered if I couldn’t work due to illness ect. My questions are: 1) Do I write to Lloyds Back directly as they provided the mortgage regarding the PPI or do I write to the underwriters Blackhorse and possibly Cheltenham and Glouster regarding the PPI? 2) As this is relatively old now am I still able to make a claim for misold PPI?   12. Hi I was wondering if anyone can help me at all; I have received a letter from Lowells Portfolio demanding that I owe them £1268.53. But I DO NOT agree with them at all!! To explain what happened, there was unsufficient funds for a Direct Debit to go out (literally making me go £2.00 overdrawn). I then received a letter demanding that I now owe them £60...which is just unreasonable. A couple of months later, I received a letter demanding £400...so I decided to call Lloyds bank and got through to an call centre in India who confirmed that I am being charged bank charges everyday for the failed Direct Debit. I tried to offer them a settlement of £50, but they would not reason. I even went to see my local branch who confirmed I am being charged bank charges daily and I need to speak to their debt team (which was the team based in India, that I had previously spoke to). I'm just wondering what the best route to take with this is because I understand I need to submit a sars request to Lloyds? But I'm really concerned by Lowells as I have dealt with them in the past and I know they will just issue proceedings. Any help would be much appreciate....I physically feel sick thinking about the battle I have got ahead of me
  13. I defaulted on a credit card account back in July 2009 with Lloyds TSB. I agreed with them to pay £40 per month which I have been doing ever since. In Feb 2013 Lloyds sold the debt to Prime Credit effective Aug 2012. They said all future payments would be forwarded to Apex Credit Management. In Aug 2014 Apex assigned the debt to Cabot Credit Management. I have at no time responded to Apex or Cabot. The defaulted debt has now been cleared from my credit record. I still owe around £5k. My question is, what would happen if I stopped paying the £40 per month? Many thanks
  14. Hi there, First post! I'm looking for advice about how to make a compensation claim against lloyds bank for what they did to me re: snowballing charges and a packaged account. In short, I was a student for four years. In this time I was paying for a silver account, not a student account. I had a large overdraft from ft working before uni (£1200) and was told I was ineligible for a student account as this silver account was taken out when I was working. To get a student account I would need to close this and pay off all the overdraft. I told them I was a student so couldn't afford to just pay off all the overdraft so they put my account into debt collections and I had to pay it off at around 50 a month. I remember vividly being told I had to speak to debt collectors on phone and being told I had no choice to do this otherwise my limit would be removed and student loan would be swallowed. I was hit with snowballing bank charges - one Xmas they totalled 220 then 100 in January. I struggled to pay these charges as a student. As well as this I was paying overdraft interest. I was in trouble financially - I paid the overdraft off by borrowing from another bank,, I had two credit cards and most of my spare money from part time job earnings was on paying off debt. On graduating I went into DMP in 2009. I look back and like most young people, I knew no better and worried and just accepted what they said - the best they offered me is downgrading my account to non fee paying- I should t have been on it anyway as I have no recollection of signing up for travel or motor insurance benefits- I dont drive. now , obviously I've been around the block with credit and I've clawed my way back to good credit at last. I look back and I feel very angry that they took thousands from me as a student. I tried to reclaim bank charges from them before the test case and they put it on hold and then smugly wrote to me saying the case said they didn't have to pay out. But aren't there two issues here? One that I shouldn't have had that account, and secondly that their charges came at a time when I simply could not afford them and they were causing me distress and worry. Does anyone know on what grounds I could complain to them and how to go about it? Was this technically unlawful or unfair. I don't want them to get away with this as it made things very difficult for me in the past. Thank you in advance!

  16. Hi all, been a while! Just a quick one - i;ve been out the loop for a bit, I had a credit card with lloyds that i unfortunately defaulted on in 2013 due to being a single parent and this was only thing I could reduce on my monthly expenditure. - at the time it was arranged that I would pay £25 per month and have been doing so ever since due to financial hardship, the balance was just over £4000 and now stands at £3760 approx. I have recently decided to sort it all out , possible start paying more now that I can afford it. and it dawned on me that its probably full of unfair charges and ppi too from memory. How would you go about this? - if it works i would hope that it offsets some of the amount i owe? I am looking to get a mortage in a year or two just trying to make my credit score better too. Any advice much appreciated!
  17. Looking for some advice about where to start with my claim I have been through the forum looking for a definitive answer about which way to proceed. Basically I am on a dmp and have been for just over a year my estimated debit free date is june 2025 so as you can guess i owe a fair bit across 8 accounts ;- 3 with lloyds , 1 halifax, 1 egg,1 tesco and 2 with mbna. I know I should be able to reclaim on at least 2 of the above if not more , i also know any money will go off my overall debit which again I am fine with . What i would like help with is the following Most of the accounts for the above have been closed by the lenders so should i just go for a SAR for each of them ?? On my CCS statement it states the two MBNA debits are being paid to moorgate loan servicing and the egg on to barclay card so who should i write to. In the case of the halifax one would a SAR to lloyds given me the halifax info. I also had a egg loan a couple of years ago and I am sure i paid ppi during the loan period (think this might be longer than five years ago though) Also because I have the dmp and these organisations are still getting money off me will it make it easier. Also my mortage is with cheltenham and Gloucester so would the sar to Lloyds give me my mortage info as well as i think I may be paying ppi on that as well. Finally am i best sending a sor request straight from the begining As you can tell things are a bit of a mess and i woulld like to take some positive steps to sort them out Any advice will be most welcome and i will keep you informed of progress once i get started Thanks Mark:???:
  18. GM firstly a note to say this is a temp. thread as all of my previously started threads are currently lost in cyberspace. Bit of history:- Credit card first taken out in August 1999. Hubby always been self employed. DMP started in 2008 Stopped payments in 2009 and account charged off and has since been passed to several DCA's but I have dealt with them all by CCA requests which none have been able to comply with. SAR requested in March this year in an attempt to get the CCA and all statements to do PPI claim. Information received in June. Looking through the mountain of paperwork received it would appear that the account was opened in 1999, but then in 2001, closed and the balance transfered to a new card, which is the account being pursued. So, I have received some, but not al,l statements from original account, and application form/agreement (presume it's the CCA) that has been filled in by bank, PPI selected by bank and clearly stating self employment status so shouldn't be a problem claiming this back. However, Lloyds still have not supplied a CCA for when the transfer took place, they have so far sent me 3 reconstituted agreements following my CCA request for this account, but what they sent relates to the previous account. I'm flummoxed ! - and pretty annoyed at their suggestion that I am trying to "write off a legitimately owed debt " I have written to them several times pointing out that I am not trying to do this, but I am just trying to confirm the amount owed either by me to them or indeed them to me. They just keep sending me duplicate letters. I might be being pedantic, and perhaps I should just go ahead and send claims for both accounts, but without the CCA for the later account I'm not sure if both accounts are 1 in the same. There is nothing in the SAR paperwork that indicates the closing of 1 account and transfer to new account other than the statements and 2 account numbers. I don't trust Lloyds (or any other bank ) as I have several disputes going on with them at the moment and have learnt that will do anything to avoid admitting responsibility. I've spent hours and hours going through others' threads trying to find a similar situation but no joy. Any advice or suggestions as to where I go from here?

Just a quick one is it possible to reclaim ppi on a business loan, I know once in the past when the loans have been settled I have been refunded the premiums, but on my present one I had to take out a life insurance at £x per month rather than the total premium being added to the loan as has been the case in the past which I assume is due to the ppi scandal, just curious at the moment as someone told me their bank had handed them a form in branch and suggested they try.
  21. Hi Guys, I'm glad i came across this site. I've been doing some in depth reading regarding the process to have an SAR carried out on various lenders etc. In the past I've had the following: Black Horse Loan (2002ish) Applied for my PPI back and told they couldn't find account (now they've been fined 110+ million i'm sure they'l be more helpful Halifax Bank Account BOS Bank Account Birmingham Midhsires Mortgage. I guess my question is can i just send a single SAR to Lloyds banking group HQ (now that they own all these subsiduaries) or will I have to make one to the individual companies within the group.
  22. First of all apologies if the answer to this exists in another thread. I’ve recently started up as a limited company business and (foolishly) opened up a business banking current account with Lloyds around a month ago. I tried to transfer my salary on Friday only to be advised there was a block on my account and I didn’t have access to my funds. I’ve since spoken to a grand total of 6 different individuals, none of whom have been able to explain why my account is blocked or specifically when it will be unblocked. I’ve also been mostly ignored by the bank manager at the branch I opened the account, fobbed off on Monday with an e-mail claiming he would look into. Despite providing my phone number on 4 occasions to 4 different people, I’ve not had a call back to explain. I want to close the account and open one with another bank, however this will negatively impact my credit score. I’m at a loss as to where to take this now, I’m beyond furious. Any help/guidance/direction to a relevant thread would be massively appreciated.
  23. Hi all, I have a Default on my Credit Record from Lloyds TSB. The story behind it is that i went around £15 overdrawn on my Current Account. I did not have an overdraft so quite why they allowed me to go £15 overdrawn is something that particularly annoys me... Anyway, they then proceeded to hit me with charge after charge until the account was some £177 overdrawn. They then hit me with a Default.! At the time I was dealing with a lot of other problems and overlooked the matter. Silly of me I know. Is there a way or has anyone had experience of dealing with Lloyds and asking them to remove it based on the fact it is rather heavy handed and causing me a huge problem moving on with my life?
  24. At least I assume it's Lloyds Credit Card. Another vague Lowells/Carter claim issued 4 Nov. Assuming it is, this would probably have been issued pre 2007. The claimants claim is for the sum of £xxxx.xx being monies due from the defendant to the claimant under an agreement regulated by the Consumer Credit Act 1974 between the defendant and Lloyds under account reference xxxxxxxxxxxxxxxx And assigned to the claimant on dd/mm/yy, notice of which has been given to the defendant. The defendant failed to maintain contractual repayment under the terms of the agreement and a default notice has been served which has not been complied with. And the claimant claims xxxx.xx The claimant also claims statutory interest pursuant to s.69 of the county act 1984 at a rate of 8% per annum from the date of assignment of the agreement to date but limited to a maximum of one year and a maximum of 1000 amounting to 494.58 6 Nov CCA1974 S.78 formal request + £1 po sent to claimant (Lowells) 6 Nov CPR 31.14 request sent to claimants solicitor (Carter) 7 Nov Claim acknowledged on MCOL 11 Nov reply to CPR request from Carter, the usual refusing to supply any documentation under Practice Direction 7C point 1.4 (3A) eliminates the requirement to attach the documents to the PoC when they are issued by the Court. draft defence follows...
  25. Hi, I am hoping someone can advise me can I defend or challenge County Court Claim N1CPC issued by Restons Solicitors on behalf of Cabot Finance on 10th November 2014. The claim is for £10k overdraft on a gold current account that was originally held with Lloyds TSB. I am in this mess because I was made redundant from my Job, diagnosed with depression and unable to work for two years. At the time I opened my account in 1995 I had an overdraft facility of a few hundred pounds (£200). The facility was supposed to be reviewed every two/three months but never was. I was also obliged to take out CPP card protection. The Particulars of the claim are as follows: 1. The Claimant claims payment of the overdue balance due from the Defendant(s) under a contract between the Defendant(s) and Lloyds Bank – Current Account dated on or about Oct 12 1995 and 2. assigned to the claimant on Jun 17 2014 in the sum of £9918.09 Also what are my other options? Do I offer a payment plan and how can I do this without having a CCJ entered against me? Please help.
