  1. I took out a Unsecured Personal Loan with Halifax online in December 2011. I was NEVER asked questions like, can you afford the payments, are you employed/unemployed, and I certainly was not asked about my income. This have got so bad I am currently on an IVA - Halifax increased the IVA from 5 years to 6 years forcing me to pay for longer. I am now wondering if bankruptcy is the best option. Do I have a claim that Halifax lent to me irresponsibly without going through my finances first?
  2. I am making this query on behalf of my daughter in law. She is currently employed however she received a letter from the tax office stating that she had paid incorrect tax for the year 2012-2013. She informed the tax office that she was employed and therefore had no input into the amount of tax she was paying as this was done by her employers. They requested that she send in her P60 and 2 payslips which she did and they informed her that it should be sorted out. Later she was sent a letter stating that she needed to complete a Self-Assessment form which she has never completed before and due to this she returned it late and they have sent her a penalty notice. I am a bit confused as she is as it would be her employers fault that they were not paying enough tax on her behalf not her so how is she being penalised for this and is there anything she can do. Currently she has been sent a letter which states 'Appeal against the penalties for sending in your 2012 to 2013 Self Assessment tax return late'. This is dated 30th September 2016. She has until 30th October 2016 to respond to this. Any help would be appreciated.
  3. Just after some advice please on my situation. I’ve been in a DMP with Stepchange since June 2011. I currently pay £100 per month on an outstanding debt of £24k, split between 8 creditors. Most of the original debts have been resold. I had fallen behind on payments at the end of 2010. Fast forward to now I’ve noticed that in my credit file that 2 of my DMP accounts are showing as having only defaulted in June 2014. I can’t understand why they waited 3 years to default them, given that I’d been making very much reduced payments for 3 years. Do I have any options for getting the default date moved back in line with the others in 2011? The two accounts were an overdraft from HSBC (they correctly defaulted a credit card I’d also had with them) and a credit card from Barclaycard, (they correctly defaulted two others that were bought from Egg) now resold to PRA. Both accounts were opened in 1997. I am intending on doing F&F settlements with them all in the next few months , but I would like to get these default dates sorted out first, so they drop off my credit file in 2017, rather than 2020. Has anyone had any similar issues and any successes? Thanks!
  4. Hi I have just noticed the EE have has placed a default on my credit report for £450 and it has been on there for two years before I noticed. I called the and they admitted that it should not have happened and will remove it within 48 hours. This is all well and good but I have not been able to get loans or credit cards in this time is there any way off getting compensation for there mistake? any help would be gratefully appreciated. Hi everyone, my car was caught by a mobile speed camera doing 35 in a 30, here is account audit trail showing time line 21.01.16 alleged offence took place 26.01.16 nip sent ( i didnt reply ) 17.02.16 reminder sent 23.02.16 letter received requesting photos 23.02.16 letter sent with photo images ( doesnt even show an outline of driver as lighting was poor ) 24.02.16 reminder sent ????? 02.03.16 driver info form returned completed ( with my name ) but stating unsure who was driving 07/03.16 letter sent to ME advising driver info form not acceptable and matter referred for court process as unsure of driver My main issue here apart from photo not showing driver ( i informed them that car was for sale at the time so could have been test driven , car did sell some weeks later ) The police officers statement ( which is clearly a template filled in on computer ) has a GLARING OMISSION , and i quote " The images reveal that on 21/01/2016 at 16:34 at INSERT LOCATION, motor vehicle blah blah " So the witness statement is unreliable surely, there's no way they can pull this guy in and he'll remember it, so i have a good case, right ? common sense suggests i do but i know they are a law unto themselves. Any feedback ? cheers
  6. I recently came to apply for a re-mortgage and was gobsmacked to be declined when I have never been late with or missed a payment for anything to my knowledge. On checking my credit report - which is otherwise perfect - there is a default showing from Vodafone ex. Singlepoint in November 2012. I'm pretty certain this arose when Vodafone sent me an internet dongle a couple of years ago- which I didn't want, hadn't asked for and on receipt didn't work in my area due to poor signal! I phoned Vodafone and arranged to return the dongle. On my next bill there showed a rental for the dongle, so I phoned Vodafone again to confirm that they had received it back. They confirmed they had and that they would credit the month's charge and there would be no further charges made. Case closed. In November 2012 I closed the Vodafone account as I was given a work mobile phone which I was allowed to use for personal calls. As I had been with them so long there was no cancellation fee and they confirmed the account would be closed. I destroyed the SIM card and disposed of the phone. A couple of months later a Debt Recovery Agency contacted me via my Mum's address (where I haven't lived for over 14 years!) to say they had been passed a debt of £110 by Vodafone to recover! I immediately phoned Vodafone who said they were unable to find the account, so it must be closed and settled and that I shouldn't worry about it. I never heard any more from the debt recovery agency and, perhaps somewhat naively, assumed it was all fine... until the failed mortgage application. I am posting on here after more phone calls and visits to various Vodafone stores where I have had no help or assistance, I am at my wits end with this as it has destroyed what should be a perfect credit rating over £110! I don't believe I owe the money but to be honest I would just pay it to get rid of it off my credit report if that was the easiest way. Thanks to Martin3030 for the info on previous threads and the sticky - I will now email all my details and the link to this thread as instructed and will re-post if I manage to get any response!   7. I have started having a sort through old paperwork from the last 20 years, imagine my surprise about the gems one finds. My first loan was with Barclays in 1996 for £1795.44 and PPI was added, I was self employed at the time. The next loan was with Barclays in 1997 for £7273.40 and used to pay the previous balance off.... PPI added....I was still self employed Then had an egg loan in 2000 for £5831 which was used to pay off the previous balance( PPI added). The next egg loan was in 2002 for £15241.66 which was used to pay off the previous balance( PPI added). PPI settlement from egg on this back in 2012 for 6.5k. The next loan was a Barclay loan in 2005 for £23331.36 and paid previous balance off and trip to AUS. no PPI on this one. Renewed Mortgage and paid of previous Loan 2006 Chelt & G. So at this moment is it worth firing off a claim for the first 2 Barclays loans ? Egg is obviously done and dusted in settlement. The next area that I have now noticed on the 23k Barclays loan, Is that the bank copy and my copy of agreements are different. Also on both, Apr is shown as 7.9% that doesn't add up right to the payments 48 x £486.07= 7.767 % not 7.9 or am I looking at this wrong?   8. I am having problems with British Gas. To explain they sent me a bill one month after I moved in that was grossly wrong based on three weeks of use. I sent them a letter correcting this and complaining. I pointed out in this letter too that I was deaf. The response of me being deaf was for them to ask me for a mobile phone number so they could discuss it with me. I paid the bill even though it was out by a huge amount because well,.... it wasn't that much as it related to not much use - about £200 for three weeks use! They failed to adjust the meter readings for the property though despite being supplied them with them in writing, failed to credit my account with the overpayment. Now they have sent me another gas and electricity bill which is even more wrong. They want me to pay £718 on the basis of my meter readings they have guessed as being 24339 for electricity and 14545 for gas. In reality my meter readings are 24073 for electricity and 14038 for gas. How can I actually deal with overcharging where basically they consistently over estimate my use by 100% and fail to adjust even when informed? They won't adjust the previous bill not because I am wrong or because they provide any reason. They don't... it's like it goes in one ear and out of the other. They won't correct the meter readings even though I have supplied them with the correct ones and seem eager to simply overcharge as much as possible.

Lending Stream Hi there, in March 2011 I took out a loan with lending stream (amongst others), which I didn’t pay back, Due to a gambling addiction (addiction fixed now:-)) All of my accounts at the time fell into arrears and therefore default, which I deserved But upon checking my credit file, all of my other accounts show a default date of around may-sept 2011, yet lending stream show there’s as Nov 2012 With the 6 year rule I was happy to wait till sept 2017, but lending streams is a more than a year later, I thought It was a reporting mistake so I called them, and they confirmed the same date Surely it should have defaulted within 3 months to 180 days like the rest, I’ve heard of lending stream being weird how they report things to the CCA’s Can I challenge this? I.e. you should have defaulted me sooner
  10. Hi, I'm new on here so first of all hello everyone. I wonder if someone could lend some assistance. I recently received a parking ticket from my local council (Leeds) however, the location on the PCN is incorrect. Having reviewed a few posts on here I made an online appeal stating that I had reason to believe the alleged contravention had not occurred & requested sight of photographic evidence along with a copy of the CEO's notes. I received the photos back which clearly show my vehicle on double yellow lines along with a rejection email stating that the PCN would still stand as a result of this. They have not however mentioned/ noticed the fact that the alleged location of the contravention is incorrect & in fact, if they were to check the location where they allege this contravention took place, they would find that there are no yellow lines whatsoever on that street! The rejection email I have received simply states that if I still wish to appeal then I will need to wait for an NTO through the post & take it from there. What do you guys think I should do? What do you think may chances are were I to continue to appeal? Or, should I simply pay the reduced fine & be done with it? Any help would be much appreciated. Thanks, Zen

  13. Hi, I just had a Fixed Penalty Notice (fine) for dropping g a cigarette end on the floor and quite rightly so. So I'm not disputing the fine at all. When I came home looked on the Councils Website, it clearly states: I then logged in, attempted to pay and voila.. It asked for £80... I contacted the Council and asked to speak to the team which deals with this to get the correct amount put on (as I received the fine today) and was told that I wasn't able to speak to them. I explained about the website, they confirmed this; Her manager confirmed too that the site indeed IS incorrect and that as per 1st April there isn't a reduced fee any more. Luckily for me, I: 1) Took screenshots of the entirety of the page (including the date etc... in my computers status bar) 2) Printed off a copy of the page 3) Saved a copy of the page With the above quote in it. I was then assured that a manager from the team will contact me back this afternoon as they were unable to override the amount on the phone with me. Can I hold them against this £60 (rather than £80) that they quoted on their website? I've just confirmed now (58 minutes later) that the websites been amended...   14. I have had a parking ticket issued by a private parking operator for a road I was parked on under their regulations and I admit I should not have been parked there. However ,the parking tickets says I was parked in a different road (Road A) with a different name (which is around the corner) to (Road B where i was parked) In my view the ticket is incorrect as it says I was parked on a different road. (Road A, Not Road B where I was parked) I have appealed with Poplar who have rejected my appeal as they say the operator proved I was parked where they said I was. I have not at this stage said where I was parked but just claimed I was not parked on RoadA where the private parking company said I was parked. Do I have any more rights to carry on if the parking company decide to go further and take it to court? Given the correct information is not on the parking ticket they issued. Also the original ticket they said they left on the car was not on the car when I returned to my car, The first I knew about this was many weeks later via a letter through the post. Many thanks
  15. Hi all, This is my first post on the consumer forum. The error that Vodafone is continuously failing to correct causes me great distress and badly affects my health. I have tried to sort this issue personally through Vodafone Customer Service making endless phone calls but it got nowhere. I was going to take the mortgage in March but Vodafone INCORRECTLY has placed a Default Account on my Credit Rating which prevents me from getting a mortgage. I have written formal complaint to Vodafone Customer Service that was posted to them on 14/10/2015 but the letter was never acknowledged and I have never received a response from Vodafone. To cut the long story short: I had Vodafone account opened in September 2013. I have systematically paid monthly payments of £39.50 up until December 2014 (shown on my bank statements). I then accidentally stopped the Direct Debit to Vodafone and I had accumulated some unpaid months to them. I have paid all those unpaid months on 29.05.2015 plus all the future monthly payments up until September 2015 (I had minimum 2 years contract) in one payment of £380.40. The reason I paid all the future payments on that day is because I asked the Vodafone Customer Service to close my account during the same phone call on the 29.05.2015. 1. Vodafone has failed to acknowledge internally in their automated system my payment to them on 29.05.2015 of £380.40 2. Due to Vodafone failing to acknowledge my payment they employed the Debt Collection Agency to retrieve the payment from me and more importantly they incorrectly put a default account on my Credit File in August 2015. I'm in the process of applying for the mortgage and imagine what impact this incorrect Vodafone default account has on my chances of being approved. 3. After the Debt Agency started to chase me for the payment I have brought a proof of the missing payment to the Vodafone store first in August 2015 and then I was asked to do that again in September 2015 and the store manager made a note on my Vodafone account about witnessing the payment. I then had spoken straight away to Vodafone customer service on the phone and they said that they will be processing a Missing Payment Form and once done the information of payment clearance will be passed on to the Debt Agency and my Credit File will be cleared. I note that this was done in September 2015. 4. After giving 7 working days (in September 2015) for the Missing Payment Form being processed I have spoken to Debt Collection agency and they said that they still haven't received any instructions from Vodafone to close the issue. I have spoken to Vodafone Customer Service again and they again confirmed that they have submitted Missing Payment Form. I have spoken to the Debt Collection agency a week later and they said the issue has been put on hold for further clarification. I think they realised that I don't owe the money to Vodafone because I've sent to them the copy of my bank statement but they were not receiving instructions from Vodafone to close the issue of this debt. 5. I now checked my Credit File for the first time on 23.02.2016 as I'm just about to apply for the mortgage and it still shows Default Vodafone Account! Bearing in mind that Vodafone confirmed processing Missing Payment Form back in September 2015 they had 4 months to clear my Credit File from the default account, however, this still hasn't been done. 6. I have called to Vodafone again yesterday (23.02.2016) about the issue. Vodafone Customer Service yet again acknowledged over the phone the note from Vodafone store manager on my file made in September 2015 about witnessing the evidence of payment. They said that they had submitted the Missing Payment Form AGAIN and he said it will take 3 (three) months! to clear my Credit File from default. But I was reassured previously by Vodafone Customer Service that the Missing Payment Form on that payment was processed back in September 2015 and they had 4 months since then to clear the Credit File but this hasn't been done! (I mentioned this to Customer Service). How can I allow another 3 months of empty promises to find out in May 2016 that nothing has been done. I have read on the Internet an Experian expert saying that changes to the Credit File can be done overnight. The house prices are rising every month and I have been waiting since September 2015 for Vodafone to clear my Credit File from the default account that they had put in their error. I have no idea what to do anymore and who to speak to about resolving the issue and clearing my Credit File from the wrong default. Vodafone is promising to clear the error since September 2015. Since September 2015 they endlessly saying to me that the Missing Payment Form has been submitted and that I should wait for the Credit File to be cleared of the default. I'm worried that Vodafone will incorrectly make changes to the Credit File simply by showing that I have paid the default money. But I need the fact of default removed from my Credit File because all of the due payments were made by me in May 2015. The default was put incorrectly in August 2015 when I in fact didn't owe any money to Vodafone by then. I'm also worried that Vodafone will reactivate my account once they acknowledge the missing payment when in fact I have asked to close my account in May 2015 and paid all the due payments then. I've asked the Vodafone Customer Service many times to send me the letter confirming that my account has been closed in May 2015 but they have never sent it to me. Any advice on how to resolve the issue with removing the Default Account History from my Credit File and getting the Vodafone to confirm that my account has been closed in May 2015 would be greatly appreciated.   16. On the 10.02.16 I received this : (thanks for not letting me insert a photo, guys, that's a great help, please see attach.) I fired back a defense: ---------------- Of course I simply copypasted the above defence from this forum and assumed that a CPR and a Sec.78 request were one in the same thing. Further reading of this forum informed me that they are, infact, two quite separate and distinct beasts. As I say in my defence , I submitted a CCA on the 21.01 to which they still haven't replied, choosing instead to go to court whilst i waited for them to get back to me. So I seem to have submitted an incorrect defense. What would be the best course of action for me to take? Send in a belated CPR? Not kick sleeping dogs? Write to the court and apologise profusely for my misleading statement? Any advice gratefully accepted, I am well and truly out of my depth with the 'waters' of the cloaca lapping my nostrils.
  17. Hi guys, i've been trying to register to other forums (more than 14 days!!) but cant even register, thank this website i was able to register and post for help!! I have a PCN here with correct picture and vehicle registration number, but the contravention address is not printed clearly, cannot even read it. The stated junction does not exist; Colney Hatch Lane with Alexandra Road. The juniction with Colney Hatch Lane is Alexandra PARK road, not Alexandra Road. Although Alexadra Road exists near Colny Hatch Lane, it is not a junction with it. google maps coords: 51.603039, -0.142909 (this is Alexandra Road, Colney Hatch Lane is near it but not a junction). I don't have permission to post links or images as i'm new here, but basically on the letter the only part of the location is readable is Colney Hatch Lane j/w Alexandra £$£$@£%^$%. That last part is jumbled up like that, also no postcode. The online details held also states Alexandra Road N10, which is wrong. Do i have grounds for this? i believe i do with the incorrect location but i don't know how to word it. I have like 2 days left (thanks to the other forums). Many thanks.
  18. Hi All I had a DRO which I was discharged from in 2011. I had a barclaycard debt as part of this. So for the last six years, barclaycard have been reporting a default every month on my credit report incorrectly, negatively impacting me. I asked them numerous times 2011-2012 to sort it. They never did and I just could not be bothered to chase. I am now sending a final formal complaint before I go to the FOS. Would you say I could request some compensation too for the fact they have left it this long, it has negatively impacted me for years and they ignored me? Not sure if thats a basis for it..
  19. Hoping for some advice. Trying to get a default cleared off my account with QQ, now sitting with PRA Group. It was rolled over twice before they passed it to PRA. paid it off in full 2 years ago. Default was set as 12/2012. I have explained my situation at the time but so far they keep coming back with it was an affordable loan and they refuse to remove the default notice. My question is related to the default notice. I received a copy of the default notice from them last week and the address does not include my house number, only the street. When i queried this with them they stated they had sent the default notice to my house number as they hold it on file however I do not believe this was the case. I never received the default notice and every system I have ever used always places the address automatically from the system to both envelope and letter so why should this be any different. I have argued that this is why I never received the default notice which i believe means they have not met the requirements to place the debt in default. Im not after any compensation or interest back, i took the loan, couldn't afford it and failed to pay it back, but I do want the default removed. Do I have a case or not if the default notice has the incorrect address by not showing my house number? I am desperate to move on with my life and buy a home for my wife and daughter but this is still sitting over me and will for a further 3 years. Thanks Graeme

Hi all, thanks for taking the time to read this, hopefully someone will able to advise… To cut a long story short, in 2009 I took out a car finance agreement with Santander, the monthly payments were £179. Unfortunately the vehicle was stolen during a burglary in 2011 and was not recovered. The cars insurers paid their amount to Santander but for reasons beyond me the gap insurers didn’t make their payment. Last year this came to light and the gap insurers made their payment (3 years late) this caused there to be an outstanding amount left on the agreement. I negotiated with Santander to pay £25 a month until the remaining balance was cleared, this was confirmed in email and letter. Last month my beloved jaguar failed it’s mot quite badly to the point where it wasn’t cost effective to repair it I looked into getting a new car on a lease agreement, however to my complete surprise I failed the credit check?!?. That had me stumped as I’ve never missed a payment on anything. I purchased a copy of my credit file from Experian and found that every account listed was perfect, all payments were made on date ect, apart from Santander! They had the car finance agreement listed as £270 x 60 months, which is incorrect for a start as the original agreement was £179 x 60 months, whilst the monthly balances showed that the agreed amount of £25 a month was being paid each month, it showed each months payment as being late! After speaking to Santander they have wiped the outstanding balance and have said they have updated my credit file to clear the incorrect entries, I still need to check this. My question is… as this was clearly the reason my application for the lease car was refused, and it led to a lot of costly inconvenience having to purchase a car through different means, have I a case to seek compensation from Santander for the incorrect entries?   22. I appreciate any help and advice I can get on my case as I feel I have hit a brick wall with Vodafone. I will try and keep the summary below brief. In short I sought to upgrade my old 12m contract to a new 12m contract and upgrade my old iPhone 6 to a new iPhone 6s Plus. I placed a pre-order, only to receive a 6s and not a 6s Plus which was delivered around 5 weeks ago now. Phone was returned promptly as possible. Vodafone charged me for the upgrade via direct debit and have yet to refund me for the returned handset. Furthermore they have not rolled back my tariff as I was advised to ask them to do, and there has been a problem with my contract dates, meaning they do not see me as being owed a new handset, believing I have already upgraded. My old iPhone 6 has been associated with this new contract and I have had problems unlocking it as a result, to this day I have not been able to successfully unlock the phone. So to summarise, I am owed £385 plus the difference of my new tariff versus my old tariff (approx. £10 for the 2 months that have elapsed), an apology for the sheer incompetent and inaccurate customer service wouldn't go amiss either. Given the time elapsed I will soon be considering legal action if not resolved to my satisfaction. Long version: On Sep 12th, 2 weeks before the release of the new iPhone I received an email inviting me to upgrade. I called customer services and explicitly placed an order for a 6s Plus and agreed to a new monthly tariff. On Sep 24th I received an email from Vodafone thanking me for my 6s order. I queried with customer services to be told not to worry and a 6s Plus was on the way. On Sep 25th I took delivery of a 6s and not a 6s Plus. I called customer services who told me I could try and return the phone to store, but would most likely need to wait for a returns bag which I was told should be with me within a couple of days. 1 week on and I had not received a returns bag. Another call to customer services revealed a returns bag had never been ordered for me, but one would be dispatched. Extremely frustrating, but this time a returns bag did turn up. It was also confirmed to me I was due to pay for a 6s Plus and not a 6s, so appeared to be a "picking error". I received the returns pack and posted the unopened box back on Oct 7th, and can see via tracking the package was signed for on the 8th. No confirmation of receipt of return was given to me, despite customer services claiming I would be sent an email or text updating me with the status. On Oct 14th I called customer services to confirm they recognised I had returned the phone, which they did. I was informed I would be charged for the phone in my next direct debit payment. I asked if, given receipt of my handset, they could reverse this charge, but they said no. I was told the refund payment would be processed within 72 hours, but to this day there is no sight of the refund. I was given the option of cancelling the direct debit payment (including the contract payment), which I declined as I didn't want to end up in a situation where I was showing a missed payment opening a whole other issue. At this point I asked for my tariff to be rolled back to my previous contract terms, and was told this would be done. On 15th Oct I was unable to make or receive calls, despite having full signal. I thought this might have to do with a tariff adjustment. On visiting my local store to home this seemed to be a network issue that was resolved 3 days later, but over this time I could not make or receive calls via 4G. No notice from Vodafone on any network issues. On 19th Oct I visited a store local to my work to check on the process of my refund, my tariff change and my showing of eligibility to upgrade. Nothing had changed despite being more than 72 hours since I was told these changes would take effect. On 20th Oct I attempted to unlock my iPhone 6 which was now past its 12m contract date, only to receive an email saying I hadn't yet paid 3 months worth of bills on this device. It then became apparent my old phone had been linked to my new contract. A further visit to my work branch saw me have to repeat the sorry story again, and this time the sales rep sent an email to "HQ" telling them what needed to be done. I saw him type the email and it covered all the necessary points. Despite promising to keep me updated, this individual has not contacted me once with an update. The manager local of the branch local to my home has called sporadically but hasn't manage to resolve any of the key issues. On Oct 27th I sent a recorded letter to Vodafone head office, detailing the above points, requesting I wanted the above to be rectified; a refund for the handset and the excess tariff charge, to be able to upgrade my phone and to be able to unlock my old phone. It has been a week now and the letter has still not been signed for. I cant recall sending a recorded delivery letter and it not being delivered within a couple of days. I called customer services last night on 3rd Nov, explained my story again and was told it takes 72 hours for a refund and they had been promising this for nearly a month. I told her I had written a formal letter of complaint and would be seeking further action to recover monies that I am owed if not resolved, to which she hung up on me. Throughout this process customer service has been atrocious, plain and simple. Lies is a strong word, but it would appear I have been told false information on numerous occasions. No one seems to be able to help, and no one I have been able to reach in the company has any authorisation to override what is a relatively simple mistake, and a mountain has been created out of a molehill. I have spent hours on the phone to 191 and would estimate the average wait time is about 45 mins, and on more than one occasion I have been cut off. I will not hesitate to proceed with a small claims charge if need be. Vodafone have been quick to take money from me, and slow to refund, and have not refunded when they have said they would have. This has caused me some financial inconvenience as I have had to move money around to cover this handset charge that would usually be offset by me trading in my old handset. I would be extremely grateful if anyone with sufficient authority at Vodafone could contact me to resolve this (if this person even exists), and to also receive some advice on how I would prepare a case for a small claims court and what I should be looking to claim for. I would need to take a day off work, so would seek cost associated with this too. Beyond the financial aspects, I would like to receive an apology from Vodafone, for what is their error, but yet I am the one having to chase all loose ends to try and get a resolution. Hi all, I've looked through and tried to find a similar case, and was wondering if someone could help shed some light on the issue I detail below: 1 - my wife received a letter stating a £65 private parking charge from NGP (New Generation Parking) for supposedly parking in an unauthorised area of Capital Retail Park (Cardiff) in October/November 2012.......subsequently ignored the letter as per instructions elsewhere on the web. This letter had been sent to an old address for my wife. 2 - received a letter from DCBL saying they had been instructed to claim the 'debt' by NGP, and had added charges so the new sum 'owed' was £180. This letter had been sent to an old address for my wife. 3 - as my wife had not received the letter in point 2, we were not aware of the charges/actions, and have recently been sent another letter stating (something along the lines of) ''as all attempts of contact have been ignored, more charges, now totalling £340 are payable immediately to DCBL, or they shall instruct their client to file for a CCJ. If possible, could someone please advise on the following points? 1 - What right do NGP have to chase the debt and what proof do they need to provide? 2 - My wife's name is spelt incorrectly (2 letters different) on all correspondence, is this a 'strike out' and therefore unenforceable? 3 - My wife has changed her name, as we got married in the 2 years during the time where there was no contact from NGP/DCBL. Should either/both parties have conducted any relevant identity/address checks? Again, can this be struck out and therefore unenforceable? 4 - My wife sold the car around 18 months ago, therefore she is no longer the registered keeper, is the 'debt' therefore enforceable? 5 - Are DCBL legally allowed to add on £275 in charges if they are now returning to NGP and advising them to try and obtain a CCJ? 6 - Would NGP/DCBL be successful in obtaining a CCJ if (as per above) my wife has changed name, address and sold the vehicle? Sorry for all the questions, am hoping that I've covered all the points and some of you experienced people will be able to help! Thanks

Hi I have just received a letter with cheque attached from Santander stating that 'while reviewing my closed business account they have noticed they applied the wrong interest to the unauthorised overdraft on a business account between 2009 to 2014.' Now this account was closed after being paid in full in 2014, but what they have refunded is the difference between the wrong interest and the correct interest and then have applied interest to that as accrued to current date. While this is OK, my question is would I be entitled to compensation on this error as well as any charges on the account that were applied. The additional interest that I had to pay off at the time certainly delayed the settlement due to the extra interest added by them and this was at a time of hardship . I did not have use of that money for use by my family as it was paid to Santander, and it prolonged the time that it was reflected on my credit report. My thoughts are to request copy statements from them for the time period noted and details of charges applied so that I can check what they are referring to, details of how they have calculated the refund, have they included the amount of interest applied to the incorrect interest, along with a request for compensation for the hardship stress and lack of use incurred by their error. Any thoughts and additional suggestions on this would be appreciated along with what level of compensation would be reasonable to expect/ request. Thanks in advance for your thoughts and comments
  25. Hi folks, I hired a car from Enterprise on 02/04/15 for a trip the following morning from Kent to Leicestershire. As this journey involved using the Dartford crossing I went online on the morning of 03/04/15 and paid the Dart Charge toll, and received an email receipt (03/04/15 at 9:19am). Today I received a letter from Enterprise informing me that they had received a PCN for using the crossing without payment on 03/04/15 at 10:21am, and including a copy. They, quite rightly, passed on my details to the DOT and are charging me £35 admin fee as stated in the rental agreement. I have to wait for Dart Charge to reissue the PCN to me, and will obviously be challenging it when they do. Will I be able to claim a refund from them for the Enterprise penalty that they have lumbered me with? ta, B ps: the PCN is all in order (correct car, date, time etc., barring the small matter of my having PAID)
