  1. The title sums it up in a nutshell. I pay monthly by standing order and have done so since moving into this house a year ago. I have received, over the last few months, two text messages and two letters asserting that my account is in arrears and that if I don't respond I will become liable for the whole years bill etc etc. My account is not in arrears. I have bank statements which show the sums being transferred to the council in question every month. I have emailed the head of revenue and benefits to tell him to check whatever error is causing this on his system and to point out how unacceptable it is to send people threatening letters in error. I attached copies of my bank statement showing the payments by way of proof. I can well imagine there are some people who would be intimidated or caused undue stress by the type of things they've sent. I copied in my councillor, who acknowledged the message. No response yet from the recipient. Today I have received a court summons for 23rd of May on account of my non-payment. Obviously I am not overly concerned, as I know I have paid and can prove I have paid. What I would like to know is how best to act now? I have let the councillor know what has happened and sought further advice from him . I am not against attending the court date if there is anything to be gained by that for me. The outcome I am seeking is an acknowledgment of the errors on the part of the council and a stop being put to the harassment via text message and letter which has now been going on for some months. Does anyone have some advice for how best to proceed?

  3. Hello This is my first time using this forum and this may be a little bit long winded which I apologise for I purchased an item online over 11 days ago from Appliance Direct. The item was advertised at £19.97p and the original delivery date was to be Monday 26th March 18. The item did not turn up I contacted the company via their chat facility online, I was then informed the delivery date was changed to Wednesday 28th March 18. Again the item did not turn up I contacted them again. The item in question was put on hold for delivery as the price of £19.97p was wrong and there was a discrepancy. I have now been informed by the company this order has been cancelled for this reason and I will be reimbursed the money owed. The actual item is shown on their website as £59.99 now, this is the exact same item. I have contacted their customer services and they informed me that because the item was not dispatched then there was no contract in place. The money has left my account over a week ago to pay for this item and I have received an email informing me the item was despatched. Where exactly do I stand with this? Any advice greatly received.   4. Hi all I've just been pulled up by the police who told me, to my surprise I had no insurance on my car. Our insurance was up for renewal in January so we let it automatically renew. £200 fine and 6pts on my license I came home to see what had happened. I have been driving this car for 3 years now. The Insurance company (first Central) told us on chat (can't get hold of them by phone) the details were correct that only my husband was insured. We looked for emails regarding policy documents etc. They said that they got details from confused.com and that's how they based their/our policy. Our previous insurance company always insured the name driver and spouse. I am not sure if my husband has ticked the box which states spouse or not and there is no way to check. Could I have been driving around with my kids in the back of the car without any insurance for over 2 years??? In December last year I had to go on a speed awareness course for doing 34MPH in a 30 zone. My question is wouldn't this issue have flagged up then? I did the speed aware course in December. Our insurance for the car was automatically renewed in January. Please help.

Sent my appeal off with some brief details of why i was appealing , Had a Letter from DWP confirming that they received my appeal, and about how much ESA i will get until it's heard, But so far over 1mth since requesting the full written statement of the Atos wca Form IB /ESA85, But so far i have not been sent it, The person that i recently spoke with from DWP ,Confirmed that they could see that i had previously requested it, but could not understand why i had not yet received it, What can be done to force them to supply this info,(assuming it actually exists) ?
  6. Hi everyone, I received a phonecall out of the blue at work last week regarding an ‘important business matter’. He said they had been sending emails with no response, and sending by post to Victoria with no response. I told him I hadn’t received any emails or the mail, which is true. He asked for my uk email address , I told him to send an email to the one he has on record. I told him not to contact me at work twice and gave him my mobile number instead. 31.01.18 - They rang my mobile, asked to confirm full name DOB and address, I said no due to data protection/privacy. I denied owing anything, and asked how they were going to recover the money. He flustered & couldn’t answer. I said not to ring my employer as it will jeopardise my job as I’m currently on probation. I got the attached email back threatening Stevensdrake. I apparently owe $43k, they’ve reduced it to $37k if I settle in two weeks. I left Australia nearly two years ago. Please see attached email from CreditCorp... There are 3 credit card debts. I’ve received assignment letters for the two smaller debts via email after the phone call, but not the main CBA debt for $27k. I suppose I’m in for the long haul reading about this company & some of the posts on here, just wondering what my next move should be? I told them they could lose me my job if they persist contacting me at work, don’t they realise it’s counterproductive?!! I’m assuming they can’t enter a judgment in Oz while I’m not in Oz anymore, and if not, surely there’s nothing to enforce in the U.K.? Thank you so much for any advice you can provide xxx
  7. I had my home repossessed in 2009 due to a change in circumstances. The mortgage was with HSBC who marked the debt as 'settled' on my credit file in 2011 although I owed them money. This was removed from my credit file at the start of last year since it had been 6 years since the settlement date. I am certain that I had PPI on this mortgage. If I try to reclaim this PPI will it awaken the debt? I have seen the rule of 6 years for standard credit card and loans but wondered what would apply to the mortgage?
  8. My partner has a CCJ against her which we found out about when applying for a mortgage recently. The CCJ was created by Vehicle Control Services Ltd. PCN at St Andrews Retail Park because she alledgedly parked incorrectly or for too long. We still don't know which. She changed address a month after the parking occurred in November 2014. She didn't receive a ticket at the time (in fact we think she was in her shop at the time of the 'incident' and not even in the St Andrews retail Car Park), she hasn't had any communication about being taken to court and she hasn't had any notification of losing the case either. We think all correspondence must have gone to her old address. The 'offence' occurred on a Monday at 4.19pm. Her shop is a mile away and doesn't close until at least 6pm. BW legal must have sent the forms to her old address and not bothered to check if the address was still valid even when they took her to court in September 2016. I'd be grateful to hear how to remove this CCJ without paying the £255 to contest it. Surely a person can't be issued with a CCJ without any written information whatsoever? That can't be legal can it? There was no parking ticket issued either.

I did have a Barclaycard which was paid off. recently checked my CR file and note that they have put a marker on the file for Barclaycard with an outstanding balance. called them today and they could not find my old card details. said to them that I am in possession of the card and was reading out the card number and they told me that it does not exist, gave me another card no which they claim that belong to me. only had one Barclaycard. told him why do I need two Barclaycards and that does not belong to me. am going to send them a CCA letter. Does anyone has a contact name or address to whom I can send a letter to please? Many thanks
  10. Hello, My sister has had a incident with my travel card. When she was exiting the station a travel officer caught her using my card. She admitted to the travel officer that she had used her husbands travel card as she did not know it was mine. She had also informed him that he did not know her taking it. She admitted to using it, and gave all her personal information. He informed her that she would recieve a letter and now we have recieved that letter. The letter states that she was reported 26th of October 2017 failing to produce a valid ticket, pass or photocard for the journey. The facts of the incident are being considered and they are advising that legal proceedings may be taken against her . In order for them to deal with our case correctly they want us to fill out the form on the reverse side. We do not wish for her to be prosecuted and she has never been convicted before regarding anything. I have not sent her appeal yet but I would like some advice before i send it This is what I wrote in her appeal: Dear Sir / Madam I would like to inform you that all these years I have been living in the UK, I have never been part of such an incident as well as I have never been a part of any criminal activity and most certainly never fare dodged. I feel so ashamed and depressed because of my ignorant decision. It was not something I neither planned nor did intentionally; rather it was more in the heat of the moment. It has been a very stressful period for me and my husband since he is working full time and I am on maternity leave alone with toddler and baby during the days. I literally have one free day a week when my husband has a rest day from his job, which lately I have been spending on gathering necessities for my children and relatives regarding our travel in November. Therefore when I was to enter the station I notice that I am not carrying my own pocket book and I had already reached the entrance. There was a long queue behind me stressing me so I panicked and used the card that was in the pocket book which I thought initially was my husbands. After this whole incident I feel even more stressed, distraught sad but mostly ashamed. I have had so much trouble sleeping and I barely have enough energy to take care of my kids. I am so afraid of what will happen to me. I will co-operate with you to the fullest and you have my guarantee that this will never be repeated. I would like to make you aware that there is no excuse for what I did and I am ready to pay the maximum fine for my mistake. I wish one day in the near future to return to work and continue my job search after starting a family, and a conviction would destroy my chances of finding a decent job to support and help provide for my family. I beg and wish for you to have some understanding of my current situation and we can find our way towards a settlement. If anyone can please read this through and advise me what I need to add and if there is someway we can settle this without her getting convicted? If there is someone out there with similar experience and can inform us what our next step should be and what we should be prepared for I would appericate it so much I would appericate it My sister is so stressed out right now.   11. Any advice would be greatly appreciated please. I have listed the main details below: Purchased a DJI Osmo camera in March 2017 Camera cost £519 Paid using Currys YourPlan buy now pay later credit agreement Paid off the credit agreement in August Sent camera in for warranty repair on 28th August Waited three weeks and heard nothing Called Currys. Unable to advise at to the whereabouts of the camera. Called again. No information. Received a call on 27th September informing me the camera was lost. Went into store on the 28th September. Was issued a refund for £519. Refund was issued back to my YourPlan account. Was advised refund would show up immediately. Refund did not show on my YourPlan account. Called numerous times between 28th August and 18th October. Have been given contradictory information. Currys have confirmed that there is some sort of error. The refund is showing as having left their system, but has not reached my YourPlan account. I have sent emails. The emails have not been replied to. I have been promised call backs. No one calls back. I have launched a complaint, but have had no updates. I have been without my refund for nearly four weeks now. What do I do now? Do I initiate a claim in the small claims court? This will cost me £60 and if they now refund, I will lose the money. Any help gretly appreciated. Thank you in advance.
  12. Post for a friend Letter from Mortimer Clarke concerning a CCJ issued in July 2017. Please fill out this I&E form within 14 days otherwise instructed to life the stay and request payment of £50 per month. No CCJ on credit report. Requested copy of CCJ. Defaulted back in March 2011. 1st letter knowing about CCJ. My question is does sending stat dec as never received the CCJ paperwork and couldent defend claim, where does it reset it to? Does it take all the way back to 2011 so debt would be SBd now or to the original court date in 2013 and debt not Sbd?

  14. Hi, Wondering if anyone can offer advise before we go into what will I am sure, become a battle for compensation. My business partner & I went to Indonesia in February to design and buy goods for our shop and online business. As it was our first trip doing this we took a couple of weeks to set up our contacts etc. We shipped the goods back in 6 crates. The goods arrived and were cleared through customer by a broker called Global Fallow. We organised pick up of the goods, it was very stringent and had to give the registration number and drivers details of the vehicle collecting as the goods were being held in a bonded warehouse owned by Hemisphere. When the driver arrived he was told they hadn't been released through customer. After a few phone calls this was sorted and he went again only to be told that they couldn't fond the pallets. This was 2 weeks ago. Apparently our goods were stored under a mezzanine floor and weren't fully visible to the CCTV. They have apparently contacted all haulage companies who came through. {over what time span I don't know, not sure if t was just the day or from when the goods arrived] and they have all said that they didn't have any extra pallets. They have done a warehouse sweep and can't find them either. This is not a small shipment, so I am finding it hard to understand how 6 pallets can disappear. Noe comes the fun bit. We called FSB who advised us to claim for loss of profit. We would have marked up x 5 and this would have covered the cost of our trip, the shipping etc. I know that they won't want to pay this so I am asking if anyone on here has any experience of this type of case. I am reading all sorts of things on google about consequential damages etc but it would be great if we could know how to word our letter to them so that we can speed things up. We timed it so that the goods would be on our shop floor for our very busy season, we are in Cornwall and this is our best selling time and now we have missed that and even if we get the money quickly the goods will not arrive in time to maximise the selling opportunities. Naturally we are very upset and cannot understand how this could have happened in what is meant to be a secure warehouse. Any help or advise will be much appreciated, Best Rebecca

  16. Or avoiding £8 handling charge from rm? My mum and dad gave me some money for my birthday and I went about buying a new phone through mums card. Decided on a Redmi from banggood and all was well. My friends mum told me that I should ask for the parcel to be sent via swiss post which I did. So I come home from school today and my mum has a right face on her like dragging on the floor kind of thing and whats happened is shes had a notice through the door asking for and extra 11.42 for charges £8 for rm and 3.42 for tax? dad said i cant do nowt about the tax but maybe with rm charge and sent me here to ask. Shes threatening to refuse to pay and send it back which is bonkers. The declared value was $21.94. can anybody advise please.
  17. Hi, I have a small shop on ebay selling printed Hen t-shirts, babygrows, mugs etc but nothing big but slowly growing with great feedback. Since may this year I have been selling a 2 t-shirt set for newly weds with a design I made of my own after looking at reference material online. But my design was a fresh font and shape and wording. Also at the top of ebay searches which was something I had worked hard for. Now in September I suddenly get these listings removed. Another t-shirt company has claimed copyright violation. I checked the design and it is similar but I have different wording and shapes it just looks too different to accept. The company pointed out their design was registered. I managed to search online and find it but it said registered 10 September 2017, about a week before I was reported. I have been selling my design from may 2017. It also look like the their t-shirt is a new listing. I am suspicious I am being pushed out by a slightly bigger company. I emailed the company as recommended and they replied with the registered number and to not relist my it-shirts. I have since checked them out and emailed the above and asked when they started selling their deisgn but no reply as yet. Can anyone see that this may be corrupt. Thank You

Hi all After doing a lot of research, the general opinion, from enforcers from the police to bailiffs, Seems to be if we have done wrong you can get remedy through the court process, so pay up and correct afterwards. examples arrest for possible breach of the peace, mainly when EA's are involved. social services we will take your children for possible future harm. When was this changed from the accuser has to prove, to the accused has to prove. 3rd party has to prove property is theirs,They should not have to prove anything, just to make it easy for the enforcer whether an EA or police. In this country of ours you are meant to be innocent until proven guilty. Just want caggers views Leakie

Health professionals for years have said that Butter is bad for us - Dairy farmers cut back on their herds and/or went out of business whilst consumers turned their attention to low fat spreads or margarine. Now... Meanwhile, thanks to the scaremongering - small dairy farmers have gone out of business and the Consumer is now forced to pay higher prices for not only the raw product - but anything that contains it !
  20. Had to email the court to see where a claim against me was as hadnt received anything. Received an email from them today stating that due to me not filling out the questionnaire my defence was struck out, further down the email stated that the claim has also been struck out as the claimant did not file a directions questionnaire. I can pay money to have my defence considered, but its seems to be a standard email sent out as as the case has been struck out it is pretty irrelevant. My real questions are Can the claimant pay £XXX amount to reopen the case? If YES do I need to pay to have my questionnaire submitted or does it reset the clock? If they can do this will I be informed of this and my defence accepted? Full email below. Unfortunately we cannot process your Directions Questionnaire as it has been received outside of the time allowed. The defence has now been struck out. If you would still like to contest the claim you will need to apply to re-instate the defence. This application should be made using an N244 Application Notice and should be accompanied by a completed Directions Questionnaire. You will need to explain why you did not file your Directions Questionnaire within the deadline provided and why you feel you should still be allowed to contest the claim. All forms can be downloaded from www.justice.gov.uk/forms. If the claim against you was for over £10,000 please attach an N181 Directions Questionnaire; for claims of £10,000 or under please attach an N180 Directions Questionnaire.   21. Hi guys will start this " high level" but appreciate we may need to delve into the lower level detail too.. In April 2017 a case I was a defendant for was "struck" as an order placed by the judge upon the defendant was not complied with. Through the post last night I get a new county court for the same account, same claimant but different "solicitor" to send " payments/ documentation though to. Is this REALLY allowed? and if so in what cases? Just strikes me as odd Thanks
  22. Hi everyone! we bought an Audi A6 auto in September 2016 with a known gearbox problem. We found a gearbox on eBay (rare gbox code), and had it sent to us and fitted by our mechanic. It wasn't right and was leaking, the supplier took it back, repaired it, and sent it back out to us. It still wasn't right. Eventually the supplier said to send him the car (To Essex, we're in Birmingham) and he'd fix it free of charge. By this point we had paid him £1000 for the gearbox. He then said the ECU was a problem and to send him £350 to have the ECU repaired. He has now had the car since April 2017. I've called countless times, and when I eventually do get hold of him, he either says they're busy, or the latest one was that they've changed 3 gearboxes with no luck. I managed to get someone from a nearby garage to go and check that our car is still there. He said that it is, but that we should go get our car as it will just rot there. He said we're not the first to threaten the guy with legal or police action, and that no one has ever had any luck getting money out of this guy. Apart from our mechanics' labour, we're out £1350 to this guy. We obviously didn't know who we were dealing with initially. We have bought many gearboxes and engines from eBay and from breakers, and never had any issues. Paypal won't cover the money, as the transaction is over 180 days old. And it wasn't paid for by credit card, so I'm not sure what happens with indemnity. Do any of you have any experience with something like this? Is there any way of getting our money back? Thank you.
  23. trying to sort this out for a neighbour.... a person whom is specifically mentioned in an English will in the regard of: a gift of £30k in respect to a loan they gave the decreased has it appears cleared out all personal items of the deceased as well as many very valuable items that were destined for distribution along with the sale of said property as part of the estate distributed amongst surviving children. my neighbour being one of these. this was discovered when he was escorted to the property by the solicitors/agent to collect 'something' to remember his dad by for the meant time and collect photos etc etc. this person is an executor of the will, but retained a set of keys when they should not have done? and have never been escorted like his son was and his other son that was escorted around at another time too.. the person has returned on numerous occasions since the death until my neighbours visit [we have CCTV evidence!!] and can be seen for want of a different word, rifling the place of anything of worth. to the extent that other than photos, there are NO personal effects of their father left!! even the bedding has gone!! [yes this person and my neighbours deceased dad have lived together many a year] the property was a second home. the solicitors seem non plushed by this....... but surely this cant be legal? your thoughts CAG please
  24. Hi Guys, The story goes, purchased a car from Lincolnshire from a couple. Paid in cash. Did a HPi check (Basic one) and everything clear. The couple signed receipt to say no finance etc. HPi check done with cazana. Car purchased March 2017. No logbook received i contacted the couple and it looked like they was playing games. i applied for a logbook myself and came with 2 weeks. Did a further HPi check with cazana.com in April 2017 as was getting worried why the logbook hasn't come and the HPi came back clear with no finance etc. I sold the car on the 06/06/2017 on eBay and the buyer advised me he has done a HPi check and there is outstanding finance. I then went back to the HPi I did with cazana.com and now it shows a 36-month agreement taken out on the 10/11/2016! I have removed it from eBay and apologised to the buyer. Contacted couple and the wife has advised me that she is no longer in contact with her husband and she can’t pay it off and is sorry they didn't tell me about the loan! Today I get a letter from Loans2go saying the car belongs to them and there is a BOS. Contacted HPi company who are looking into it. Where do I stand here? The couple duped me. Such a disgusting thing to do to someone. I have called Loans2go and asked for the BOS. I’m so upset with all of this. When I contacted the couple their mobile phones were dead I managed to track them down on Facebook to which at the start she was like don’t worry I will sort it out when I’m back from my holiday. Such horrible people out there. I’m a student and cannot afford such a loss, it would mean I have to drop out of university for 1 year and work as I pay my own fee’s. The lady is giving me a story that she cannot pay this loan as she is a single mother now with a disabled child.
  25. I'm the executor of a will and the estate includes a property. The relative has died just before the insurance is due to be renewed and I'm having problems finding cover. I'm being told that I can insure it as a second home once probate has been granted but until then I can't. I'm guessing that because I'm not the owner yet I have no insurable interest in their eyes. I can't be alone in this situation. Is it really impossible to insure a property throughout the process of probate?
