  1. Hi, I have been left rather confused by an ebay transaction recently. I have been ebay-ing for 10 years or more. Basically I won a samsung galaxy s6 edge+ spares and repairs. It had screen burn. I knew samsung would fix it under warranty and they have done. That is not issue as such. The ebay seller I got it from is a on-line cash generator type pawn shop. My hubby didn't realise that at time of bidding. I asked the seller if he'd done a Checkmend report before I paid for the phone but after I'd won it. He said 'No'. I paid for the phone and did my own Checkmend report the day I received it. The Checkmend report revealed a red Asset Watch marker. For those who don't know what a Asset Watch marker is, it means that the phone may be owned by a company and may be under a Hire Purchase agreement. The company who own the phone is Brighthouse (Checkmend contacted them on my behalf). Brighthouse's Fraud department has been in contact with me and have told me that I don't need to return the phone to them, at this time. I know that potentially that the phone could be become blocked in the future and if that happens, the Ebay seller will accept it back and I will get a refund. I am certain that the phone was not stolen and given to the Ebay pawn-broker. I guess that person who had it under Brighthouse HP agreement pawned it for cash. I am thinking should I keep phone or not ? I have done nothing wrong. I don't mind giving up the phone but Brighthouse are giving me no information. I have clearly asked Brighthouse fraud team under what circumstances would need to occur, for them to ask the phone to be returned ? I am still within the 30 days for Ebay protection and 180 days for Paypal protection. The tricky thing is that would require me to return the phone to the seller, which Brighthouse may not like as they own the phone. I don't know what to do ? Advice please. Thanks x
  2. Hi All Just looking for advice re a purchase I made via Ebay. I bought a Nutribullet in Sept 2015, it was advertised as an authentic model. It arrived, I used it about three times and put it away. I used it last Sunday and it blew up in my kitchen, plastic and smoke everywhere. On looking further I discovered that some unscrupulous traders were in fact selling counterfeit models on Ebay and alas I had fallen victim to this. I sent photo's of my Nutribullet to Highstreet TV who confirmed that it was indeed a fake. I contacted Ebay who basically said that as it is around 18 months old there is nothing they can do and I should go through the small claims court for the £100 that it cost me. The seller is still active on Ebay I paid for it through Paypal, and Ebay told me there is nothing they can do either. The seller is in China, another point I did not take on board when purchasing it, so I think the court route is a no goer. So do I have to just accept that I bought a dud and have lost my money.

I am a UK national, domicile in UK although I occupy much of my time in the Philippines where I have a business, and with my ebay (UK) account I made a purchase from a listing on ebay (UK) priced in British pounds, for delivery to an address in UK (England & Wales) and paid for from my PayPal account which just happens to be a Philippines PayPal account. My purchase transpired to be a fraudulent one so within their 180 days timeframe I opened a complaint with PayPal only for the (Indian) seller to pull a fast one and they, rather than I, escalated my complaint for PayPal to adjudicate and with no investigation whatsoever PayPal adjudicated against me wrongly believing the lies of the seller … and of course PayPal notify one of this by an email that cannot be replied to, that there can be no appeal etc. etc. etc. so I filed against PayPal (Europe) via Money Claim Online. Now if one attempts to go shopping with any UK retailer that accepts PayPal, Wilkinson to name but one, and one attempts to have delivered to a UK address using a foreign (Philippines) PayPal account then one receives this message: “We're sorry, PayPal Philippines accounts cannot ship purchases to United Kingdom.” But ... If one shops from an ebay (UK) account, on ebay (UK) and with delivery to a UK address using a foreign (Philippines) PayPal account then no problem at all, the transaction approves immediately. Taking PayPal to court their solicitors appear to have dropped their rebuttal that my purchase, the seller, was fraudulent, that they didn't investigate etc. and it seems their only defence is that as an ebay (UK) account holder, making a purchase listed and paid for in British pounds from ebay (UK), with a delivery address in UK, but with a Philippines PayPal account, their solicitors are arguing that I need to be taking this to a court in Singapore (Where PayPal Philippines are registered) and that I agreed to this when clicking to agree to their terms and conditions and all that nonsense. PayPal's solicitors deny that they are in any way the same business as ebay, as ebayer's know when we click to 'resolve a problem' we get offloaded to PayPal for here, in this scenario, PayPal to ultimately reply, to the effect, "Yeah right, but you need to sue us in Singapore and not in your own country and where any fraud took place". So my points, my questions are: 1. Whether they are the same company or not ebay (UK) have sub-contracted PayPal to deal with their customer complaints and PayPal have clearly accepted such a contract with ebay (UK). 2. And for this UK to UK transaction PayPal clearly broke their own rule of using n a Philippines account for delivery to a UK address, whether this is a money laundering law dictated by state or whatever, that a Philippines (Singapore) company has clearly accepted to deal with any customer complaint of a UK to UK contract and purchase. 3. We haven't yet made it to court, we're still in the stages of 'foreplay' but their solicitors are hiding behind "We're PayPal Europe, PayPal Singapore is nothing to do with us buddy". 4. So do I have a case to continue proceeding against PayPal Europe and what should my (legal) angle of attack be? And/or: 5. If I do need to proceed against PayPal Singapore, when indeed that PayPal is a global organisation, if PayPal Singapore are trading in UK, as they did with my transaction, should they not be held accountable to, as necessary, appear in court in UK to answer to any misdemeanour and not hide away in Singapore?   4. Hey, just wanting to know where I stand. Let me start with saying i'm no newbie to computers and this wasn't a case of me giving away my login details via some [problem]/phishing email. I have more than 20 years computer/internet experience under my belt and even have no use for anti-virus software (put it this way, I know to avoid anything which might gain me a virus and know the system registry and background tasks like the back of my hand). My ebay account has been up and running for just over 15 years without a problem. eBay has always been fine for me. To cut it short, the past few days the money in my bank didn't quite add up. Something was pending for £30. I guessed it might just be their systems catching up. I had a look at my eBay account and shocking to me was a purchase done a few days ago for a computer game priced at £30. I knew it wasn't me or anyone else I knew who made that purchase. Some cheeky sod has well and truly defrauded me out of money. They bought the game (which includes a download code and a disc). They read the eBay inbox message with the download code, redeemed it and got the disc (which is useless as the code has been redeemed) dispatched to my old address that was still saved on my account. They even tried to hide the fact by paying for it, not out of my linked PayPal account direct (which shows on my PayPal account transactions), but via my debit card saved on my eBay account (that processes through PayPal but doesn't show up in my PayPal transactions history). The only way I can imagine this happened was because of ebay's 2014 data breach and now how frequently they require someone to change their password. About a week ago I logged into my eBay account (via a typed address) and was forced to change my password. My current password was secure (7 digits long, 2 capital and 1 non capital letter), but as I would struggle to remember another similar password, I used a basic password I used to use 10 years ago. It's possible that login/password combo was saved by a bot all those years ago and was detected as being my new password and the account was accessed. Where do I stand now? It shows on my bank account as card payment to paypal. The bank have cancelled my card and i'm guessing they could do a chargeback that will likely cause me fees with PayPal and a suspended account. Will PayPal/eBay refund this? Considering the voucher would have been redeemed by now. Thanks
  5. I need some help. I was very foolish back in November buying an item off Ebay. The item was a supposedly haunted piece of jewellery from a magickal seller. The item cost me £160. Needless to say I am not happy with the purchase and want to return the item, but because its gone over 90 days I cannot open a dispute with Ebay. The seller is refusing to respond to my messages I have sent. Can anyone please advise what I can do to reclaim my money back over an item which is clearly not as described.
  6. Hello all A couple of months back, I saw an advert on Ebay for an Epson Stylus 4880 printer. The advert had a 'Buy it Now' price of £120 and was 'collection in person only'. As the seller was located nearly 200 miles away I contacted the seller through Ebay and asked if he'd be prepared to send the printer via courier at my cost and arrangement, he agreed. I paid the 'Buy it Now' price of £120 via PayPal and made arrangements with a courier company to collect and deliver the Epson Stylus 4880 printer at an additional cost of £90. The printer arrived but when I unpacked it I discovered it wasn't an Epson Stylus 4880 but an earlier 4800 model. These sell on Ebay for around £80 and is a completely different printer - it doesn't accept the cartridges I have for the 4880 (I already have 3 of the 4880 printers) I contacted the seller who accepted his mistake and offered to refund my £120 purchase price and leave the printer with me. He started the refund process. This was acceptable to me although I'd spent an additional £90 for delivery of a printer I didn't really want. Several days later I received a PayPal message stating the seller had cancelled the refund of £120 unless I returned the printer at my cost. This was totally unacceptable to me as I'd receive just £120 refund and be out of pocket for 2 x £90 courier fees, all this due to the advertiser's mistake. I started an Ebay claim but was informed I wasn't covered as the advert was 'collection in person only'. I have considered taking legal action and did send a 'Letter Before Action' by recorded mail. I've heard nothing since! What would be my legal position/options? Would I be able to claim: 1. The purchase (Buy it Now) price of £120 2. The cost of courier delivery to me £90 3. Basically I have put in a complaint against ebay for an item that I sold to clear which was marked for parts or not working and no refunds accepted as ebay are siding with the buyer and told me to start a return (buyer is non uk resident) however I have responded with an appeal against the decision and a formal complaint. Also this has incensed me so much I have decided to put a petition down if anyone wants to sign it to make ebay treat sellers fairly and stop siding with the buyer to prevent [problem]mers (which is what this buyer is). https://petition.parliament.uk/petitions/179807/sponsors/4dLn9AywqqgsvIT0cBcs If anyone could sign it hopefully there will be enough to make parliament take notice and start taking ebay to task...
  8. Hi, Just wanted some advice/reassurance so I can be prepared when eBay's dca try and contact me please. Sold a car in November, buyer didn't pay or collect. He bid and won the auction at £350 then messaged me to say he'd just checked and only had £230 in his bank account I opened a dispute and he never responded. Once a certain amount of time passed eBay automatically resolved the dispute in my favour and said they would refund seller fees. To be honest I thought that meant all seller fees. through December I've been getting reminder/suspension emails to pay £10 fees (listing fee I think) I started a new job which pays 2 months in arrears so I've had nearly 2 months without being paid and obviously had to prioritise my spending I removed my automatic PayPal payment. In fact I think I may have removed automatic payment when the dispute was open but the guy wasn't responding to stop them taking £45 when he wasn't going to pay. To be fair I was quite annoyed about paying anything in the first place after getting messed about. I had a voicemail and email yesterday from transcom. The email said I owed £18 (£8 fee on £10 "debt"... I don't think so...) I logged on to my eBay account today and had a message from them yesterday, same day of transcom email saying pay today to avoid further action. my dad lent me some money yesterday to tide me over till payday I've just been on and paid eBay direct and my account has now been reinstated and showing a balance of zero. What do I say to the dca now for them to leave me alone? They've tried to ring me again this evening. I don't want to be continuously contacted or them to mark my credit file for the sake of £10.   9. Hi I have used this website in the past with another problem I had and found some great advice so thought id try again. I sold a phone on Ebay 6 months ago for circa £500. The phone was paid for, sent, tracked and signed for by the buyer. I withdrew the cash and assumed all was fine. Now 6 months later with no correspondence from ebay, paypal or the buyer, I am getting debt collectors letters (AFS) requesting me to pay the negative balance in my palpal account circa £500. I am not sure what to do. The item was tracked and signed for (as can be seen on my paypal account). Now Paypal seem to have re-funded the buyer who now has the cash and phone with me having a negative paypal balance. I have no idea what has happened or what my next steps should be. Any help would be appreciated. Regards Pat
  10. Hi, I've had a listing removed from eBay - apparently it was reported by Sky Media. There is no real reason as to why the item has been removed just that 'please not (sic) that this item is not allowed on our site.' and 'for more information read the help pages or contact Sky directly.' The item in question was a Now TV Sky Cinema pass - I bought another couple of Now TV boxes before Christmas and didn't need the passes. As far as I'm aware the listing was compliant with eBay rules - item to be posted via Royal Mail, so not a 'digitally delivered item' or 'non-physical goods'. I believe Now TV is a subsidiary company of Sky - but they don't own it directly? The link to contact Sky and for more information is: https://business.sky.com/fighting-fraud/ when you look at this it only mentions Sky Sports, about illegal use of Sky Sports programming and Unauthorised foreign broadcasts - nothing to do with what I was selling. I believe when listings are removed like this it is because the company concerned are a member of eBay VeRO - 'Verified Rights Owner' programme or something. I've read in the past that companies basically abuse this, eBay remove all listings that they report which could be for a multitude of reasons. On the list of VeRO members (UK is toward the bottom of the page) I can't see Sky listed http://vero.ebay.com/ I hate such bullying by large companies - I've spent a while on live chat to eBay but they are adamant that I need to contact Sky and that 'if Sky allow me to sell the item, I can pass the communication onto them'. They won't give me a copy of the report, a specific number to call for eBay listing removals - nothing. It feels very much like a big bully boy company (Sky) dictating an item can't be sold to another large multinational (eBay) who simply bow to them - no mistakes, no appeals etc. What can I do? Has anyone had this issue before? Please help.. Thanks in advance..
  11. I joined this group about a year ago when a musical instrument I sent via Parcel Force arrived damaged. I knew that I could not get enhanced insurance on the item as it is on their list of prohibitive items for extra insurance coverage. But it is covered by the basic £100. (So I took the chance as I have posted this item to myself over a dozen times in the past with no issues as it was always well wrapped.) However, the response I got this time when things went wrong was terrible to say the least. I do admit I made my claim outside of the 60 days time limit (as I travel abroad alot), but I had hoped there would be some 'good will' for being a regular customer. No such luck! I took it to the top and still got a no. I did ask them for figures relating to claims in the past year under FOI, but as they point out since 2013 they were no longer a government owned business and it no longer relates to them! If anyone has any idea of the success rate (or not!) or claims, better post them here!
  12. Hello all, I am new here and in need of some opinions please. In March of this year, I sold (as a private individual) a full set of alloy wheels and winter tyres on ebay. The buyer paid £250 cash and went away leaving brilliant feedback. The price was for both as the tyres were already on the alloys. Late October (so over 6 months), I get bombarded with messages saying 2 of the wheels are buckled and are dangerous and cannot be repaired. To cut a long story short, the buyer says that they can prove the tyres have not been used since they bought them (their car was brand new in the spring and the tyre wear on the standard tyres matches the 5k mileage). The buyer also states that an alloy wheel repair guy says the damage is so bad that the car would have been shaking and undriveable. Therefore they say they can prove the damage was there when I sold the wheels. They seek either a full refund or £100 compensation to settle out of small claims court. If they were indeed damaged, I had absolutely no knowledge. The car I had then drove fine on the wheels and certainly didn't shake. Interestingly, the buyer told me they are purchasing brand new alloys to put the tyres on because they acknowledge there is nothing wrong with the tyres. Not sure how they can expect a full refund in that case! Technical question first: If the wheels are as bad as they claim, wouldn't this affect the tyres so that they too would be of poor quality? Legal questions: Fitness for purpose/satisfactory quality does not apply to private sales as I understand it but S.13 of SOGA re sale by description does apply. SOGA has been replaced now though and I can't see anything in the sale by description part of CRA that applies to private sales, do you agree? So, if an argument cannot be brought about the quality (caveat emptor) but lets say they can bring a description argument, my description would have needed to make claims that they were perfect and free from defects. In fact, my description said they were used alloys and tyres over 2 winters and had minor marks and scratches on them. No other claims were made in the advert and I could not advertise them as having a defect because as far as I was concerned, they were fine. All this law blows the mind somewhat! What are my rights here? Has she in fact got this in the bag and I've misread everything? Help! Thanks
  13. Hi All, I need some help regarding a problem buyer from eBay. I sold them a phone on 21 Sep 2016 for £95 (Pink iPhone 5C) It was on the Vodafone network and then unlocked when the contract had ended (tested from my end with a few sim cards one being the 3 network) A month later the buyer opens a case saying the item has never worked with a 3 sim card, so I thought "here we go," I begrudgingly accepted the return knowing that the item was working and I would most likely get a smashed phone back or something completly different. So I get the phone back it is sort of in the same condition a couple small marks had been added but nothing that was major, the phone was dead so I neeed to charge it and when turning it on he had added an icloud account to it and I could no longer reset it, after several messages he finally admitted the following; Adding the icloud account and even confirmed the email address used (but wouldn't give me the password.) The sim card did infact work (I knew this anyway becuase you need it to activate the phone to get as far to put a icloud account on it.) Had been used for the time that he had the phone (even though he initialy stated he had been working away.) Ebay decided the case in his favour giving the reason there was no evidence of him doing it, so I have since appealed the decision telling them that there is proof of him admitting to it in the messages we had been sending each other, I am still awaiting a decision on this one. If it doesn't get overturned I will then be out of £100 and have a nice Apple paperweight, so my question is who would I need to take to a small claims court eBay or the buyer and if so how likely do you think I will win ? This isn't the first time I have been messed around by a buyer and ebay and I now want to follow through with this to prove my point. Thanks in advance

  15. Paypal-Does anyone have any problems with them.On Ebay or any other site. I say this because in the last 4 weeks on Ebay my Paypal account has slowly closed on me. Only able to access it at strange times of the day,say 12 midnight or perhaps as i get up early 4 or 5 am. Then a few weeks ago i could not access at all. Usually it says DNS server cannot be found,but everything else in the world can be found. So i am selling on ebay and receiving payments paying postage but cannot access my Paypal account. So really for myself Paypal has turned into a great big savings account with no interest. I personally now have lost all faith in Paypal and looking for an alternative. This might cost me sales but all my eggs are never put in one basket.Just in case. Now this morning at 4-30 by some miracle i managed to access Paypal,i am honoured to have received this privilege.I will send them a letter thanking them. Due to the way things have been going i withdrew my hard earned money and transferred it into my bank whom i have much more faith in. This is what i have been checking each day as my frustration grew.Check it out if you feel so inclined. See what some are saying here and there.And of course is it accurate. I am invited to go to the resolution centre and say what has happened. If i manage ever to sign in again. Why i withdraw my money instead of leaving it in their hands. Anyway i just wondered what anyone else thinks of Paypal lately. And what are the real alternatives to Paypal when on ebay etc. Thanks Tawnyowl.
  16. I purchased an item using Ebay and the seller did not send the item. In my haste to get my money back I opened a Paypal dispute. However upon doing so the seller phoned me to say that they needed the Paypal claim closed to refund me through Ebay and rather stupidly I did so. Since then neither Ebay nor Paypal will do anything. I am unable to reopen the dispute with Paypal and Ebay say they cannot do anything because Paypal have closed the dispute (even though they are supposed to be two entirely separate entities). Now I could go the route of doing a chargeback through my bank. But it was done on a Visa debit rather than credit card. From speaking to my bank (Santander) that could entail some risk from Paypal challenging the chargeback which worries me. The amount is only the relatively small amount of £36.49. If Paypal were to be funny about it they could challenge it and possibly I incur some kind of legal fee? I don't know. Given that there is that risk I would rather swallow the amount and admit I have been ripped off and to be very wary in the future of closing any disputes before a full refund is given. Is there any other recourse for me?
  17. Hi guys. Here is an interesting one for you that I would appreciate any help in clarifying. In short, I purchased a buy-it-now item on Ebay. The seller is a business. Before I paid the seller contacted me to increase the cost of the postage (I do not live in Highlands or anywhere like that). I did not agree with this and when he followed up with a rude message, I chose to not proceed. So, I messaged the seller and politely told them I would not proceed and requested they simply cancel the sale. They refused. They then re-listed the item immediately AND subsequently opened a non-paying bidder case. Now this is where I would like clarification. Unless I am mistaken, the Consumer Contracts Regulations 2013 allows me to cancel within 14 days following the day of delivery. There is no beginning point, just an end point - 14 days following the day of delivery. So I could cancel now, tomorrow or any point up to that end point. I chose to cancel immediately as said. There was no payment made and thus the item was never sent. Again, unless I am mistaken it is an offence for a business to attempt to discourage a consumer from cancelling. Indeed I successfully sued Plusnet last year when they tried just that. And this is where it gets interesting - Ebay happily open the unpaid case, which by definition puts me under pressure to pay even though I do not want to proceed. Do not worry, I will not pay but some would. So, can anyone please confirm if Ebay business sellers are exempt from the CCRs (I don't expect for a moment that they are) or if Ebay are technically aiding and abetting breaking the law by allowing business sellers to try to talk consumers out of cancelling by threatening detrimental action on their buying accounts if they do not pay. Whilst Ebay do think they are a law unto themselves, business sellers in the UK must comply with CCRs and do not have exemption when using Ebay. Unless you know otherwise? Many thanks Rob

I sold a phone 2weeks ago last night he says its now been blocked or stolen how would he know that without going police or checkmend I did a checkmend and its clear and its only worth £65 phone why would I report it I sold high end £200 phones without issue well I told him go police and get proof if its true and he asnt he keeps saying you sold me a dodgy phone I cancelling my cards at bank so paypal cant take the cash told ebay I not taking the item back or refunding when I got evidence and if hes refusing to go police then it means hes broke it and that why hes making a excuse and it was a Saturday night he sent message I know its not good to cancel the cards but when I getting took the mick out of when I told him 3 times to go police he keep saying I will go police and not hear anything back where do I stand if paypal chase me do they get court because I not paying the guy back or do paypal already pay them back makes me wonder he tried to sell it on and broke the sim reader as some people do break the sim readers with trying adapters because not worth taking guy to court for £65 phone just found out they still give refund and chase me so its not worth taking court if its broken when I get it so that's me out of pocket but I not allowing to return going to make it drag out for is money
  19. Hi, I'm hoping someone might be able to help me... In August 2015 I purchased a Samsung Galaxy S6 on eBay from what seemed to be a trustworthy "phone company" with very good reviews. I received the phone exactly as described, brand new and sealed and factory unlocked. I have been on a Sim-only contract with Vodafone for a long time and I immediately began using the Sim in the new phone with no problems at all for the next 6 months or so. However, in February 2016 the phone suddenly lost all network coverage and after a few confusing phone calls with Vodafone (which also involved me sending the phone to Samsung to be tested) I finally discovered it had been blacklisted due to having been reported as stolen. Vodafone recommended that I try to get a refund from the seller on eBay or approach PayPal to open a dispute. I soon discovered that the seller had disappeared from eBay (hardly surprising if he knew what he was doing...!) and after explaining the problem to eBay they told me that PayPal should be able to help. However, I have been back and forth with PayPal over the issue and they are point blank refusing to help me due to the fact that the transaction was back in August and it was outside of their specified time cap on opening a case. I understand that this is their policy but I feel that in a situation like this there should be some sort of loophole as how was I to know that I was buying a stolen phone, especially as it was working fine until it was blacklisted!! I have spoken to CACs and trading standards regarding the matter but they simply insisted I keep on at PayPal and that without the seller's home address there's not much that can be done?! I am out of pocket of £380 and the phone is completely useless to me, and at the same time the seller of this phone (and I would guess countless other phones) is getting away with making money from stolen goods.   20. Hello all, I'm new to the forum. eBay have gone with the buyer. Buyer said camera was not working this was not true I have all the evidence. I have contacted CAB and they have stated Sales of goods act and a Breach of Contract. Who do I start taking the legal route with eBay or the Buyer the reason for asking is that eBay intervened and I'm now £48.00 out of pocket, Spoken to customer services at eBay about 10 times may as well talk to a brick wall. I bought a mobile phone from an ebay licenced trader in March. 6 weeks later it stopped working - whereas it was advertised as NEW it turned out to have had a previous owner, who's probably reported it stolen/lost after selling to the shop I bought it from. The shop have offered 50% of £430 purchase price, but I believe I should be able to claim all under Consumer Rights Act 2015? Nobody can tell me if it has been stolen or whether it's just lost, incidentally. Original network appear to have barred phone. The ad title was UNLOCKED - NEW & BOXED. The trader said that the item condition was NEW not that it hadn't been owned or used before. I thought I was buying direct from a store (and didn't realise they were a pawnbroking chain at the time) with a small saving v RRP as it was a phone (galaxy S6) that was becoming obsolete. The store said that ebay was for resellers and secondhand goods and that I shouldn't have expected a NEW phone (they have since sold another S6, advertising it as BRAND NEW......).   22. Hello, I wonder if anyone can help me. I bought 2 items from an ebay seller listed as a business seller. Firstly there was a problem with postage, 2nd item was supposed to be £1.00 postage and was charged full. Wrote a friendly email, no reply, left a friendly phone message and asked if I should go through paypal or if they could sort it. It was sorted the next day. OK, the items are not suitable, I collected from the post office last saturday, seller has a 14 day return policy and insists on a form being filled out via access to an ebay account. No ebay account. Have written 3 polite emails requesting the return, left 2 polite phone messages indicitating said emails are awaiting response. Meanwhile checked the new rules for distance selling, Consumer Contract Regulations. This says that the form requested is to make cancelling easier but does not affect the return of goods. As I used ebay as a guest I can't access the form the seller insists on and have made a request by email 3 times now and twice by phone. So as I understand it I have fulfilled my obligation to alert the seller within the 14 days (day 1 actually) that I want to return the items for a refund. No word from the seller. Any idea how I might proceed with this now to ensure the seller gives me a refund. I am trying to keep things cordial but I am anxious to get the items back and have the money returned to my account. Help much appreciated.
  23. Hello I bought 20 toys from someone on ebay. We arranged a sale outside of the auction site as I only wanted 20, rather than the 50 the seller was selling (as a bulk lot). They cost about £100. When they arrived, one toy was completely different to that of the agreed list. I notified the seller straight away and they said they would look at their stock and get back to me. They never did, I started a PayPal claim for £5. The seller then emailed me asking why £5, I said this was the price paid, divided by the amount of goods bought. The seller did no respond. Upon waiting for PayPal's time scale, I escalated it to a dispute for the full amount (£100). The seller did not respond, despite regular emails from PayPal to do so. After the time limit, PayPal awarded me the full amount refund. The seller has since contacted me and asked for me to "please pay for toys" I have not responded. Within days, they had begun finding me on Facebook, contacting me through ebay, and now finally they have written to me (recorded delivery). The seller has no interest in sorting it out in the beginning, which is why I applied for a full refund. i am still in possession of the toys sent. I originally said I was happy with the other toys (as I still am) and happy to receive a partial refund (of £5), why am I not re-paying? The seller had every opportunity to respond and help resolve the situation but didn't It is only since PayPal refunded that they are now fully into action. The details of the letter are: Stating they will be taking me to a small claims court (already threatened this by email/ebay messaging). Interesting that the CAB website states the usual (and reasonable) amount of time for this is a calendar month. The seller has given me 7 days from the date of the letter, so 6 days after I received it - not exactly "reasonable". Charging me postage for the letter they've written. £1 per day of interest, starting the day I received the full amount back. Charging me for any legal advice they may need to seek. Charging me for the cost of sending this to a small claims court. The seller states I proceeded "without notification" to make a claim for the full refund, when this is not true. The initial PayPal claim was for £5, but as this was ignored, I escalated it to the full amount. From what I can see, PayPal emailled the seller on numerous occasions. The timeline from PayPal is below: 26 Feb 2016 - Buyer: Dispute opened 26 Feb 2016 - PayPal: Email sent to buyer 26 Feb 2016 - PayPal: Email sent to seller 1 Mar 2016 - Buyer: Dispute opened 1 Mar 2016 - Buyer: Dispute escalated to claim 1 Mar 2016 - PayPal: Email sent to buyer 1 Mar 2016 - PayPal: Email sent to seller 8 Mar 2016 - PayPal: Email sent to seller 12 Mar 2016 - PayPal: Email sent to buyer 12 Mar 2016 - PayPal: Email sent to seller I have italiced the dates in which PayPal contacted the seller. What are my options now? I plan to respond, by letter (although I may email the letter instead) asking a number of questions as to why the seller did not bother to mediate when they had the chance - and even now, they have not asked me to repay the £95 - just going all out and telling me this and that. Bought a Lacie Rugged Hard Drive on Ebay via Paypal for £139.99, postage included (beware...still selling at this price, I'm guessing I can't give details of seller here) Payment taken promptly. Estimated delivery dates provided via e-bay. I left NO additional information re delivery. One day prior to the estimated delivery date period, I returned home from work (no text or E-mail from Hermes) to find HERMES courier had posted a 'sorry you were out' card with hand-written FRONT DOOR as some feeble indication of what he/she has decided to do with my item once they'd discovered I was not in. My home has a front door that leads onto a major public pavement and main road. Obviously the parcel wasn't there. I contacted the seller, they have been consistently distant. I also tried to contact Hermes, they leave no customer services number and again, I have found myself confronted with a host of strategies that make it hard for you to be heard. I had to wait to even open a case with eBay until the estimated delivery time was up which is in itself, a frustration. I gave the seller every chance to give me a refund or a replacement, stipulating that he has a contract with me to ensure that the item gets into my hands safely and that disputes with couriers are not my concern. He eventually asked eBay to step in and they have closed the case because he sent the parcel using 'tracking' and that the status of the parcel reads as 'delivered'. So according to everyone (except me) the item has been delivered, case is closed, even if it the item was effectively left in the middle of a pavement. I feel gutted that people can get away with this. Seems to me that these loopholes disempower the buyer utterly and create a breeding ground for dishonesty and [problem]ming. I left the seller bad feedback (nothing personal just the bare truth) and eBay erased it because of the findings of their 'so-called' investigation. The seller remains one of their top rated sellers yet couldn't care less that I have been fleeced. Thanks to Ebay, I have no voice and no way of warning others. I also have no money to make a second purchase of an item I really need to study. I know this a story you have probably heard thousands of times on this site, but it's my first time (being fleeced and posting on a forum!) Does anyone know if I stand a chance if I pursue this matter further and how do I go about this? Thank you for your help.
  25. I sold an item of my sons on Ebay before christmas. I was led to believe by my son that the item was fully working (I know I should have checked) On the day it was delivered the buyer messaged me to ask for a refund as it did not work. I agreed to this straight away and asked the buyer to return the item The buyer escalated the item to Ebay at the same time. The buyer sent the item back to me 8 days after they received it when I got it I tried to process the refund. For some reason Ebay/Paypal would not let me do this so I had to ask Ebay to do it (I suspect because the buyer escalated the case). Th buyer received his full monies. Ebay will now not refund me the final value fee as they say the buyer was unhappy. I am getting no where with their customer service, anyone got the CEO's email address. What a joke of an organisation they are.
