  1. Hi there I have a couple of defaulted debts (unsecured loans) showing on my credit file. Both accounts are shown as defaulting in mid 2009 and since then I have made regular, agreed payments against both of them up until late 2013. At this point I requested cca's from both DCA's but received no response from either. However, rather than cancelling either of the direct debits I simply reduced them to 1p per month, which is where we are at now. I haven't heard from either of the DCA's since doing this by the way.. I understand that the Statute Barred trigger is 6 years from the most recent payment I make against the account (providing I don't communicate with the DCA/acknowledge liability etc), but what I want to know is will these accounts disappear from my credit file 6 years after the default date, even though the SB date will not have been reached?   2. Hi All, I am creating separate threads per debt (continuing from this thread: Will defaults be reissued if I am only making £1 token payments?) (to figure out how I can get defaults removed. OC (DCA) Amount Owing: Barclays OD (Credit Solutions Limited) £11,669 Last Payment: £2 on 6 May 2014 to Credit Solutions Limited as they are the ones chasing me for this debt, I last sent them acknowledgement in Feb 2014 to setup token payments. Per Noddle: Lender – Barclays Bank Plc Account Type – Current Account (Overdraft) Status – Default Account Start Date – (not sure and it’s not on report either but probably around 2010) Account Default Date – 16 Sep 2012 As this is a Current Account, can I start with CCA/SAR? not what other route do I follow please? How can I calculate Penalty Charges and PPI? Thx!
  3. Hi All, I have recently sent a complaint to the FOS about late entry defaults on my credit file. I sent a SAR request which shows Default Notices were sent out for both account as follows Lloyds Loan 08/12/2008 Default on CRA 16/06/2010 Lloyds CC 17/09/2010 Default on CRA 29/11/2010 I was on a DMP with Lloyds since late 2008 and since that date never broken the agreement. Something doesn't seem right to me that they have waited so long to file the defaults. Any opinions? Spoke to the adjudicator at FOS and she seemed to be sitting on the fence although it is still under investigation. Also the SAR has shown quite a lot of excessive charges for returned DD etc. It also shows charges for been over my OD limit,when on some occasions it was the charges that sent me over the OD limit. Can I claim all this back?
  4. I am currently in the process of trying to clear up my credit rating/file after a disastrous 10 year relationship and bad money management during that time. Its coming up to 9 years that I have been credit/debt free or so I thought, the ex of said 10 year relationship fe lt the need to open up various credit accounts in my name, from a credit card with Capital One, to 2 phone contracts (orange and T-Mobile), a few catalogues (SimplyBe (no idea why he did that) &Next) even the odd book club etc at both the family home (before & after I moved out) and my last address (he no longer knows where I live) all without my knowledge. He since spiralled out of control with his debt and went bankrupt, but left me it seems with 6 defaults on my credit rating that I am not the owner of! One will end in December, another March 2015 and the 4 remaining in 2017 I have already managed to get Capital One to remove one default noted against my account and I now have a CIFAS logged also. to the current issue at hand, on the 24th May 2014 I received a letter from Cabot Financial, which consisted of 3 pages the first was dated 12th May 2014 the first page holds lots of information from Cabot's reference, original lender, that account number, the amount I currently owe, any arrears, minimum payment, credit limited and the date the account was opened, the second page is a statement of account, which is dated the 7th May and the 3rd is a blank page and a payment slip. I am a little confused as the account in question was opened in 1997 belonging to Next (quiet probably my original account I opened when I was 18 so nothing to do with above potential fraud) its states that I currently owe £0 the account is in £0 arrears, £0 minimum payment and a £0 credit limit. Then it goes on to state that the letter is my agreement with Cabot for the period covering 1st November 2013 until 30th April 2014 and I need to make minimum payments to avoid my account going into arrears? Ive checked my credit file this morning and I do have a default on my credit file with Cabot which dated back to 2005 and has a default date of 2008 with a balance of £153. When I originally checked my file it was on my list as potential fraud by my ex as I don't remember opening anything in 2005. I am at a loss of what to do next so any help would be gratefully received!
  5. Hi guys, I have been silent reader of the forum and I must say that the shared information/experiences is very helpful indeed. I wonder if anyone could help me with my situation please. I requested my Credit File from Equifax and found 3 default accounts in it which has latterly messed up my rating sadly. I was into financial mess during 2012 and on the top my father’s ill health forced me to abruptly travel to my home country in July 2012 due to which I could not keep track of my finances. 1. Lowell Portfolio Ltd Current Balance: £72, Default/Delinquent Balance: £120 Start Date:01/11/2010, Default Date: 13/04/2012, Date Updated 23/01/2014 Remarks: I have got no clue that what is this default about. This default is totally unrecognized to me and I have never received any sort of letter from this company. What shouldI do in removing this default or to acknowledge them about it? 2. Virgin Media Group Current Balance: £61, Default/Delinquent Balance: £61 Start Date:26/02/2011, Default Date: 24/08/2012, Date Updated 27/09/2012 Remarks: I have used Virgin Media in the past and before leaving the country I rang them amid April 2012 to request the final bill due to 2 month early termination of the contract. But to date I didn’t receive nothing in papers/post from them.Further, I do not have any signed agreement with them as I renewed the contracton phone which expired on my previous address. Regardless, I am happy to pay the amount as it’s not a lot provided that if I could somehow remove default from my file. 3. Lloyds Bank Current Balance: £274, Default/Delinquent Balance: £274 Start Date:06/01/2006, Default Date: 10/05/2012, Date Updated 25/06/2012 Remarks: This is genuine default sadly, and the balance is Overdraft amount which I failed torepay. I am in position of repaying the amount in full in one go but only if I manage to remove the default. Again, as I left the country and my previous address in July, I did not receive any notice from them otherwise I would havehad split the amount to avoid the default. Could anyone kindly assist me a way out in removing these defaults from my file? Cheers.

Hi, i have paid off my debts with natwest. tried to apply for a job. got through the interview then got turned down because of defaults. looked at experian. i have 2 registered. i was ill during the repayment and relied upon a family member to go to the bank and deposit the money. she says she must have forgotten to go on time (this was over a year ago now). the employer has agreed to hire me so long as i remove these defaults by the end of the month. how do i go about doing this as quickly as possible. i really want this job
  7. Hi, I've just been looking at my Experian account. I had two defaulted accounts from back in July 2008. However, one is showing as settled (in July 2013) and the other isn't. If the 6 year rule applies then surely the one showing as settled back in 2013 was settled too early and should be settled in 2014? They defaulted within days of each other - why would one be settled and the other not?
  8. ]PLEASE HELP ive tried to be a thorough as i can so theres no confusion. My husband had been with orange for about 7 years and had always paid his bills on time and in full by direct debit. A few years ago he got fixed on the idea of an i-phone, so he signed up for a 2 year contract for it in store. Again all bills were paid in full. His contract ended and it continued to roll on while he decided what he would have and do next. The bill continued to be paid as always. In around January/ February time my husband finally decided to go under a new contract, having paid 36-40 every month for a contract where my husband was only ever using about 60 minutes out of 500 each month and very little sms messages, We decided that he needed to have a lower contract as we were paying for something he simply didn't need or use. This time we did so online. We chose an 18 month contract at £26 a month with HTC desire s. The phone arrived and the sim was placed in it but with in two days the phone was collected again and replaced with a new one as it was not connecting properly and so failed to work. The problem continued with the next one for a while also. we were continuously on the phone trying to rectify the issue, when finally we received our contract details. They were wrong. Despite sending out the correct phone they then sent us contract details for another iphone contract at £35 for 2 years again and this was the contract the sim card was under. We contacted orange and we were repeatedly passed from person to person, we rarely got phone calls back when we were told they would. The phone bill was still going out at the £35. We were offered the contract reduced to 18 months then we were offered it at £30 or so for the two years instead. they were trying to pretend that they were giving us great deals, extra minutes ect but it was things we did not need let alone require or what we signed up for. the direct debit was cancelled, untill the problem was rectified. Eventually this happened and the moment I had some spare 5 mins or so I telephoned them and asked for details to set up my online banking so they could be paid again, by the time they sorted the problem we were two months in arrears. However i was still happy to set up the payments and informed them that i could not budget that same week for an extra £52 on top of the current bill due. She understood (or so I thought) and that I was able to pay extra each month to clear off the outstanding. Everything with the bank was in the process of being set up, when I received a call from my husbands work phone saying his mobile wouldn't work. They had cut him off that day despite my having made contact. Once again I was on the phone to orange but this time I was being put through to the arrears department. They refused point blank to turn the phone back on untill the full £84 pound was paid (contract plus late payment fee) I explained I could not afford that and the recent phone call id made. but they were determined and refused to turn his line on, as well as this they continued to bill him for the months where his phone was not on so he could not use it. they expected us to pay off the full balance just like that despite the problems wed had and the severe lack of customer service, even if i managed to save the 80 or so pound to pay them by the time I could it would have been 106 and so on. eventually having gotten no where with them the hubby got a pay as you go sim as he could not be without a phone should something happen to the children. We never received contact again.then about 6 months ago when we signed up for equilfax (as we are trying to sort out our credit files having suffered greatly with finances the last two years). Unfortunately we discovered orange had defaulted us for the 106.62 pence. we were never made aware of this and had not received any correspondence. We were disgusted, my husband was always a loyal customer and we tried to rectify the problems from the start, but they would have none of it. I did some research and we wrote to orange explaining the situation and that we were never made aware of it, and also the financial difficulties we had faced. We stated that we were getting on track and things were being corrected and want to pay that balance plus a little extra for a notice to delete. The reply we got was a simple this is your file for a reason and the answer was no and we still owed the money. Since then we've received various letters from companies stating they are collecting almost £500 on behalf of orange which is obsurd, its now settled to none other then lowell who want 540.02. not only this but weve been hit twice. not only did lowell apparently buy the debt but rather then take it over on our credirt file so it still stays as oine default, they have added another. so we now have a default for 106 from orange and a default for 540 from lowell for the exact same thing. the hubbys file is sqeeky clean except for these however we are now unable to obtain a mortgage or any other credit. Ive tried to contact orange by telephone however they have actually blocked the phone it would appear as it just states thank you for calling and were sorry we cant not take your call. However by simply dialling 141 first I can go through to the automated line but then no further as there customer service lines are far from managed properly. Im at my wits end juggling three children under 5 while try to correct this error and getting nowhere, any help or info would be greatly appreciated. we have since gone through equilfax as well to try and solve it and lowell investigated agreed that orange made a mistake at the beginning but they sorted it before cutting the line off lowell have then come back and offered a discounted rate however they have made no effort or even mention the fact that there are twoi defaults for the same thing double jeapardy, im sure this is illegal as well as not recieving an idication from orange in the first place saying they were placing a default and selling it on ive attached copy of equilfax report showing the two defaults thank you for your time

I have just been reading through 'the credit reference agency explained' section on the experian website and noticed that under the section 'what is credit reference information?' and the sub section 'credit account information' it explains that lenders can only share your information with your permission and that you would normally give this permission when you sign the initial agreement when excepting the terms and conditions etc. This has lead me to wonder, if I have an account which is now marked as defaulted 8 (agreement ended) would this not mean that the permission I gave ended when the agreement was ended? I have nothing from the bank that says the agreement has ended, I am just going on what is stated on my experian credit report. Hopefully this all makes sense, any thoughts from somebody more qualified than myself would be much appreciated. Many thanks, from a first time poster.
  10. Hi guys and girls my names Sunny. Sorry to bore you with my life story. I desperately need a CCJ removed and 2 defaults removed. CCJ was received last year I didn't go to the hearing or respond personal reasons. I also had a default last year where I didn't respond personal reasons again. I also had a default in 2011. Although I have about four credit cards and two mobile phone accounts which have been ran excellently I know I can't get a mortgage because of these above debts showing on my credit file. I desperately want to buy a house. I understand I can have the CCJ set aside and I understand the procedure where if the CCJ is set aside then it will be removed pending a hearing and if the hearing is successful it will be removed permanently. I need some tips for this I haven't applied yet but I have the form n244 so I need to know the best way to get it set aside than at the hearing get it removed forever. Second of all I have two defaults I understand these are more complicate but I guess its worth a try to get them removed and again if you good folks have any good advice on how to go about it. Please don't judge me on how I got myself onto this situation because I just don't know but if I could turn back hands of time for the petty amounts I would not have let my credit report haunt me. I am in a better financial situation now but at one time it felt like I was on the poverty line.   11. I have just signed into Equifax having decided to apply for a mortgage having last been a member a year ago. I have found that a default has been added to my account January 1st 2012, Mail Order from MacKenzie Hall. I'm not sure who they are but guessing that they are debt collectors but have no idea why this has been added now. When I was out of work, I did have a number of accounts that defaulted but I have had no failed payments since returning to work 7 years ago. I have an idea that it may be Studio Catalogue, however, I know that this was also more than six years ago. Are they able to add the default in this way? I've struggled to get my credit back on track and now I'm ready to move forward, this has happened and it's really bringing me down. Any help would be muchly appreciated!!
  12. Hi All A new default has just appeared on my credit file for a loan from about 9 years ago, as far as we were aware this was a statute barred debt and it had already defaulted years ago. Is there anything we can do?
  13. Hi Need to seek some advice about cheque a/c with Cahoot. Over a year ago I wrote to them disputing charges on my cheque a/c with them, i.e over limit charges and unauthorised monthly charges and interest etc They did not reply and are still charging these charges each month - I do not use the account - but I checked the account recently now the balance has reached £1900 and about £950 of this is for these charges. The overdraft limit was £1000. They have not chased me at all - do I wait till the OFT case is resolved? I am not able to pay back at moment - so do I just keep quiet? Your advices would be appreciated. Many thanks:) I am not able to pay this back
  14. Hi. I have 2 small debts (from telecoms companies), caused by my own silly oversight at the end of contracts. The Lowell one originally came from o2 (for £42), and I recently settled this in full. The T Mobile £20) one I about to settle, but I am going to use repayment as a leverage for having the default removed. These are rather low amounts, so I was wondering what my chances are of having them removed, by either cajoling or threatening them with legal action if they can't prove the defaults were served correctly. A copy of my letter (I've changed it slightly to suit each instance) is below: As I said in the letter, these are for such small amounts and have an adverse effect on my credit file, when reality I manage to pay debts totalling Circa 15k with very little problem (and I am in fact reducing my debt levels each month). I also read that Lowells routinely removed the entry completely from credit files on full payment. Their letter to may certainly didn't say that, so is this true, or am I going to have to fight to get it removed.
  15. Lowell has issued me with a county court claim for an amount left on an old debt. They state they purchased this debt from Halifax earlier in 2013. I have another thread open in relation to the court case, access to info etc. I have just accessed my credit report (experian). It shows two entries for the same loan. 1. It is recorded as Lender: halifax. Balance: '£xxx and Status: Default. Default date is 11/02/2011. This has not been updated since 2012, which makes sense if they sold it on. It is also in my married name. 2. Lowell Portfolio. Balance: £xxx (slightly different amount) Status: Default date is 16/02/2011. It is in my maiden name. Can there be two defaults for the same debt? It reads like I have two loans, both of which I have defaulted on, when it's the same loan and there is nothing to link the two. I get that Lowell are now the owners and therefore are going to be adding their input onto my credit file, but how should this be recorded, to show that there are not TWO defaults (different amounts, different default dates would suggest to a third party that I had two loans at the same time, defaulted on them both rather than one loan balance being sold to another company). Is this wrong, and if so, how do I go about getting it amended? Thank you
  16. I am posting this on behalf of a friends son. He is looking to get a mortgage in the summer and had obtained his credit report file from equifax. However, this shows some very small debt from 2011 which was satisfied in 2013. However Lowell were involved and they have reported the same default on his credit file and its settlement but some 6 months later. Therefore, it looks like a duplicate entry but one from the original creditor and the other from Lowell. (1) Is that permitted? (2) Will either of them get dropped off his credit file or will it be the usual 6 year rule? (3) How can he improve his credit file in respect to both these defaults? Can he write to equifax to have a note put on his file or will financial institutes realise it's the same original debt? (4) How will creditors view occasional missed payments to other accounts (over 12 months ago though) Any guidance to improve credit scoring would be appreciated to pass on. Thanks in advance Shelley

Hi Guys, I have 2 problems Firstly, the CO-OP sent me a default in 2009 but on my credit file the date is dec 2011, so I will have an extra 3 years nearly of this on my file when it was well before, what can I do about that? Secondly, a company called Fairmile have re-issued a default in 2008 from a original 2002 one which had already been removed in 2008 just previous to them issuing the new one. Same debt, same acc no I know they won't remove it as I have had bad experiences with them already, so what can I do?
  18. Hi I am hoping someone can shed some light on my issue. I have been on a DMP with CCCS (Step Change) since December 2009. Of the original eight creditors five applied defaults. They were applied on the following dates 05/01/2010, 09/02/2010, 07/12/2011, 09/03/2012 and 26/11/2012. I am due to complete my DMP in the middle of 2014 and my concern is that if defaults stay for 6 years then those added in 2012 will not fall off till 2018:jaw:. Does anyone know if there are any rules on when defaults should be applied, all creditors received DMP payments from Dec 2009 and have done so every month since. I just feel a bit cheesed off that this will effect me for almost 9 years rather than 6, this is not because I want to access more credit but I will need to remortgage as my fixed deal ends in Dec 2014.   19. Can some one please explain this? As I understand – in 2011 Jan-March has late payments between 3-4 and April put on a Default. Is this normal? Thought you need to have 8 late payments. 2010 has late payments as being in April, July, Aug, Oct, Nov and December. 2011 – Jan (4), Feb (3), March (4) April (D) 2010 – Jan-March (Green), April (1) May-June Green, July (1) Aug (2) Sep (Green) Oct (1) Nov (2) Dec (3) However, according to my records, this is not the case. In 2010 missed in April, July, Oct and Nov. Paid in Dec. I have paid twice in May to catch up the missing one on April. 2011 – missed – Jan, March, and although paid in April it went to May. Had a ‘D’ in April. I don’t understand this?
  20. Hi I have just looked at my credit file (Experian) to find four defaults One default is with Mbna credit card which I settled and now shows satisfied and dated 30/11/2010. The second default is with Arrow which is for the same amount and date as the Mbna account, surely you can not have two defaults from two companies for the same account. The Mbna account is full of information about payments and dates. The Arrow information consists of 5 lines with no information only that the default balance is exactly that of Mbna! If I pay off the other defaults will that improve my credit score or just not bother and stick it out for upto six years. And lastly after six years your defaults are removed from the Experian list (and the other dcas) do you still have to pay the outstanding amounts of the Defaults

  22. When I became ill a few years ago I ended up defaulting on a number of debts and stupidly stuck my head in the sand. Lowell ended up buying a few of my debts and the first I knew of it was when I was handed a stat demand in respect of one of the debts on my doorstep. I have entered into a payment plan on that and the SD was cancelled. MY PROBLEM One of the debts which was Barclaycard (not the above one) can not be enforced as there is no CCA and the account was opened in 1999. Lowell have admitted in writing that they do not hold the CCA, Although Lowell purchased the debt there are two defaults in respect of it on my credit report - one being Barclaycard and one being Lowell. Surely having the same debt defaulted twice on my credit file is wrong? There is however a note on my credit report next to the Barclaycard debt saying "Satisfied" in the balance column. Furthermore, the amount reported is incorrect and Barclaycard admitted that the statements don't tally to the balance they were collecting. Having looked at this document from the ICO posted in another thread regarding defaults.   23. Hi all, hope I'm posting in the correct place? I need some help about an old debt with Barclays. I had just bee made redundant and explained this to Barclays at the time and asked the m not to put any more charges on my account as it was crippling me financially. They continued to add charges on to the tune of £530. Anyway I changed bank accounts and got myself sorted out again. I got a few letters demanding money from Barclays, but wrote back saying that I wasnt going to pay their unlawful charges and if they wanted their money they were going to have to take me to court. I heard nothing more untill.................................................... Several years later I had a letter from lowells demanding this money. I was getting several calls a day from them and despite blocking their calls they would use another number. Finally managed to get hold of them and gave them an ear bashing as I work nights and calls every 20 minutes in the day was continously waking me up. They have finally stopped calling thank god. However on checking my credit record today, which is 960, I have noticed that Lowells have added a default on this debt. Barclays had defaulted it on 25/06/2008 but now Lowells have put on a default on the same debt for 03/12/13. I dothey dont really understand about defaults but had thought that they drop of your file after 6 years. But surely if Lowells keep adding defaults this will stay on my file forever. Sorry for being long winded but can Lowells keep adding defaults?
  24. Hi, I have 2 defaulted accounts that are owned by Lowells, one is statute barred but the other one has some months to run. They have sent me a letter for the one that is now statute barred saying if I don't pay soon it will be passed on to someone else and if I don't pay them they could try to get me a CCJ. I could send them the statute barred letter but I am worried if I do it will make them pursue the other one which isn't statute barred. The one that is barred is for £1,000 and the other one is for £2,900. I recently got a couple of bad credit credit cards and on the letter Lowell's had said after looking at my recent financial activity on my credit file they believe I am in a position to pay. Any ideas on how I should handle this situation? Thanks Andy
  25. Hi, Just after a bit of advice to see if anything can be done. Here is the history. Moved out of a property on the 11/06/11 - Rang to confirm moving out (no record of call by Scottish Power) As it turns out they have me down as transferring supply electric in June and gas in July. (This must of been the new tenants and means I actually got billed on my final bills for part of their usage?) They have told me they sent reminders and defaults to the original address and finally defaulted it in Oct and Nov. (Didn't get the letters I had moved out) Chased at my new address for the electric debt in March/April 2012, realised I had an amount outstanding and paid the DCA. Didn't realise at the time that the gas was outstanding (thought it was all one account) So my main question really is do I have a leg to stand on getting them removed? I have been emailing SP but they have said no error has been made by SP so it can't be removed. I have tried to argue that I told them I moved hence me not getting the reminders, I have also argued the defaulted amounts are incorrect because of the dates. They told me it wouldn't make much difference to the amount and I would still have a debt. Any help please
